Eng. Smith: The other item concerns the staking of the project. I have been in
contact with Hubble Engineering and they have given me a range of fee from
$17,000 to $25,000. somewhere in that area. These two items are in addition
to the construction costs. The Highway District is roughly paying 708 of those
costs.
The Motion was made by Giesler and seconded by Yerrington to authorize the Mayor and
Clerk to hire the stakers and the materials testing people subject to a dollar figure.

ITEM #8: DEPARTMENT REPORTS:
Yerrington: Wanted to report that we have a new trash truck.
Giesler: We still have a flooding problem in the park at the Chamber Building.
The Engineer got a bid for around a thousand dollars to have this repaired. After
visiting with the President of the Chamber they said they would pay half if the
City would pay half.
Clerk Niemann: He is scheduled to come before Council at the next meeting.
I also need approval of a beer license for the new Meridian Chevron Station.

April 25, 1991 )
A hearing was held before the Board of County Commissioners on April 4,
1991, for the purpose of considering the above-captioned planned residential
development and preliminary plat approval request.
The following persons were in attendance: Coaanissioner Gary Glenn,
Commissioner Vernon L. Bisterfeldt; Mr. Dave Bieter, representing the
Prosecuting Attorney's office; Mr. Don Hubble, representing the applicant;
_ and, Mr. Ted Hutchinson, representing Development Services.
SUMMARY OF THE RECORD
This file is a request for approval of a planned residential development which
consists of a preliminary plat of Jasmine Acres; a four lot subdivision which
will include a private street for access. On February 28, 1991, following a
public hearing, the Ada County Planning and Zoning Commission voted to
recommend approval of this application to the Board of County Commissioners.
The record before the Board is comprised of:
1. Staff reports prepared for the Board and the Commission.
2. Application forms submitted by the applicant.
3. Preliminary plat of Jasmine Acres.
4. All other information contained in file 91-06-PDR/91-OS-PR.
PROCEDURAL ITEMS
1. On January 24, 1991, Development Services accepted file 91-06-PDR/91-OS-
PR and scheduled it for public heazing before the Ada County Planning
and Zoning Commission on February 28, 1991.
2. Legal notice of the Commission's public hearing was published in the
Idaho Statesman on February 11, 1991. Also on February 11, persons
owning property within 300 feet of the site were notified of the
Commission's public heazing by mail. Prior to the heazing, notices were
posted near the site.
3. Staff notified other agencies of this application on January 24, 1991,
and solicited their comments.

4. ~n February 28, 1991, a public hearing was held before the Commission.
Upon conclusion of the public hearing, the Commission voted to recommend
approval of file 91-06-PDR/91-OS-PR to the Board.
5. Legal notice of the public hearing before the Board was published in the
Idaho Statesman on March 18, 1991. Also on March 18, persons owning
property within 300 feet of the site were notified of the public hearing
before the Board by mail. Prior to the hearing, notices were posted
near the site.
6. On April 4, 1991, the Board of County Commissioners heard public
testimony concerning 91-06-PDR/91-OS-PR.
TESTIMONY
1. Mr. Ted Hutchinson, representing Development Services staff, presented
_ the staff report and sutmnarized the history of the parcel, the Planning
and Zoning Commission action and the pertinent sections of the zoning
ordinance.
2. Mr. Don Hubble of Hubble Engineering, representing the applicant,
testified in favor of the application.
3. No other testimony in favor of or in opposition to the application was
presented.
BOARD ACTION
Upon conclusion of the public testimony, the Board voted to table 91-06-
PDR/91-O5-PR until April 18, 1991, to consider the evidence and testimony
presented, to render its decision and to prepare Findings of Fact and
Conclusions of Law.
FINDINGS OF FACT
1. The site is 25.92 acres and is owned by Jon P. Wagnild.
2. The site is located on the west side of Eagle Road approximately } mile
north of Ustick Road.
3. The site lies within the Meridian Area of City Impact and is zoned RT
(Rural Transition). Section 5.40 of the Ada County Comprehensive Plan
and Section 9-4-3 of the Ada County Code adopt the Meridian
Comprehensive Plan as the applicable plan for the area.
4. The area surrounding the site is zoned RT and is in agricultural use
with associated single family dwellings.
5. Eagle Road is classified as a principal arterial street and is scheduled
for major expansion.

6. Applicable poz•tions of the Meridian Comprehensive Plan are as follows:
HOUSING DEVELOPMENT
Rural Residential - Agricultural (outside the Urban Service
Planning Area, but inside the Area of Impact.)
Single Family Housing, Farming: Not more than one dwelling unit
per five acres.
RURAL AREA
Policies:
1. The Meridian Comprehensive Plan shall apply in the rural
areas which are outside Meridian's City Limits and within the
Meridian Area of City Impact, and the Ada County Zoning and
Subdivision Ordinances shall apply in the rural areas outside the
_ city limits.
3. Although it is recognized that urbanized development does
exist within the rural areas of the Area of City Impact, the rural
lands should be kept in agricultural production as long as
possible until urban services (municipal sewer and water
facilities and other essential services) can be provided. In that
regard the following policies shall apply with regard to single
family dwellings on 5 acre tracts, to wit:
a. Within the Area of City Impact but outside of
the Urban Service Planning Area, one single family
residential building may be constructed on a 5 acre
lot without municipal sewer and water services being
provided if Central District Health Department
approves private sewer and water services.
4. Residential development is allowed in the rural areas
provided that said development does not exceed to the Rural
Residential Agricultural density, unless it is inside an Urban
Service Planning Area and City sewer and water is provided... All
residential development must also comply with the other
appropriate sections of this plan.
7. In accordance with the Meridian Area of City Impact Agreement, Meridian
was notified of this application request on January 24, 1991.
8. Section 8-4C-6 of the Ada County Code lists the design and dimensional
standards for the RT zone. For single family dwellings, the minimum lot
size is listed as five acres with a minimum public street frontage of
250 feet.
9. Section 8-9-2E of the Ada County Code allows for concurrent processing
of associated applications. This file contains a request for a
preliminary plat and for a private 'street.

lU. Section 8-9-3C(5) a through g of the Ada County Code specifies the
finding of fact which shall be made by the Board prior to action on a
planned development application.
11. Section 8-13-3A of the Ada County Code requires that the private streets
be reviewed under the general provisions for conditional uses contained
in §B-15-1C(1 through 6).
12. The Board finds that this proposal complies with the design and
dimensional standards for the RT zone for lot size and, if conducted in
compliance with the conditions of approval concerning the private street
construction, with the street frontage requirements.
CONCLUSIONS OF LAW
1. The Board concludes that the site design conforms to the existing
_ topography and landscape features of the site.
2. The Board concludes that this proposed development is compatible with
the existing and planned used in the vicinity and no damage, hazard or
nuisance will be created with this proposal.
]. The Board concludes that the internal street system will provide
efficient and safe flow of vehicles and pedestrians within the
development without creating undue burden on the existing transportation
and service facilities in the area.
4. The Board concludes that this proposal complies with the design and
dimensional standards for the RT zone.
5. The Board concludes that this proposal is in compliance with the
Meridian Comprehensive Plan, with the Meridian Area of City Impact
Agreement and with the subdivision and zoning ordinances of Ada County.
6. The Boazd concludes that the appropriate action is to approve this
proposal.

ORDER
!lased on the Findings of Fact and Conclusions of Law reviewed shove, the Board
hereby approves the planned residential development which consists of a
preliminary plat and private street for Jasmine Acres as documented in file
91-06-PDR/91-OS-PR. This approval is subject to the Conditions of Approval
listed in the attached Exhibit A.

1. All public rights-of-way shall be dedicated and constructed to standards
of the State of Idaho Department of .Transportation.
3 All street and subdivision names are to be approved by the Ada County
Street Name Committee and the County Engineer prior to submitting the
final plat for approval.
3. Provide a surface run-off drainage plan to the County Engineer prior to
submitting the final plat for approval.
4. Compliance with the Board of County Commissioners Resolution 82-1-79 and
Section 31-3805 of the Idaho Code pertaining to irrigation waters.
5. Installation of fire protection facilities as specifically required by
the Meridian Fire District.
6. Installation of service facilities to comply with the requirements of
the public utility providing service. All new utilities shall be
installed underground. All utility easements shall comply with the
utility recommendations and shall be shown on the final plat.
'. The preliminary and final plat shall be in conformance with Section 8-
10-4, 8-10-5 and Sections 8-10A-1 through 8-10A-6 of the Ada County
Code.
8. Building setbacks and dimensional standards in this subdivision shall be
in compliance with the applicable zoning regulations of Ada County.
This statement shall appear on the final plat.
3. All building or preliminary site work is prohibited prior to recording
the final plat.
10. Prior to approval by the Board of County Commissioners, the final plat
shall contain the following certifications and endorsements: signature
of the owner(s), certificate of the plat engineer, certificate of County
Engineer, certificate of Meridian City Clerk, certificate of Meridian
City Engineer, endorsement of Central District Health Department,
endorsement of Ada County Highway District.
11. The following statement shall appear on the face of the final plat: "Any
resubdivision of this plat shall comply with the applicable zoning
regulations in effect at the time of the resubdivision."
12. The final plat must be approved by the Board and .recorded within the
year of the Board's approval of the preliminary plat, unless a time
extension is granted as per Ada County Code Section 8-9-3C(7).

13. If individual lot irrigation is to be provided, an internal irrigation
and drainage plan must be approved by the Settlers Irrigation District
and the County Engineer prior to submitting the final plat for approval.
14. Irrigation/arainage waters shall not be impeded by any construction on
site.
15. Work within the rights-of-way of the State of Idaho must meet the
requirements of the State of Idaho Department of Transportation. For
information regarding those requirements, please contact the Idaho
Department of Transportation, District IZI Engineer.
~ _ 16. All easements and public rights-of-way shall be shown on the final plat.
17. No direct lot access onto Eagle Road is permitted. All lots shall
access the proposed private street or the existing Jasmine Lane.
18. The private street shall comply with the following. Compliance is
subject to field verification by the County Engineer.
a. The private street shall be named and provided with an approved
street sign.
b. The private street shall originate at a public right-of-way and
shall terminate at a forty five foot (45') radius cul-de-sac or another
turnaround area which shall be approved by the Meridian Fire District.
If a turnaround area other than the cul-de-sac is approved, written
approval shall be submitted to Development Services.
c. Documentation of a perpetual use easement guaranteeing access
across the servient estate shall be recorded. A copy of the recorded
easement shall be deposited with Development Services.
d. No more than four (4) lots with residence shall fronton this
private street.
e. The private street shall be constructed to the following
standards:
Minimum right-of-way width 30 feet (50 feet shown on plat)
Minimum improved surface width 20 feet
6" of 2" crushed gravel, compacted
2~ slope from centerline
Improved surface gravel
19. No permits shall be issued until the private street has been constructed
and verified by the County Engineer.

Ada County Development Services has received an application for a four lot
planned residential development Jasmine Acres) and a private road to access
the development. The property contains 24.26+ acres and is located on the
west side of Eagle Rd. approximately 1J2 north of Ustick Rd. in the SW
Quarter, Section 32, Township 4N, Range lE.
This application is scheduled for public heazing by the Planning and Zoning
Commission on F'ebruazy 28, 1991 in the Les Bois Room of the Boise City Hall,
150 [l. Capitol Blvd. and is scheduled to begin at 7:00 p.m.
Please return your comments by February 14, 1991. You may use the reverse

Dear Mr. Abo:
The attached land use application is submitted to your office to
request approval of a four (4) lot subdivision, which is located in
the southwest quarter of Section 32, Township 4 North, Range 1
East, Boise Meridian, Ada County, Idaho, on the West side of Eagle
Road approximately 2600 feet south of McMillan Road. This proposed
subdivision is within The Rural Transition Zone of Ada County and
within The City of Meridian area of impact.
The lots within this subdivision contain five acres or greater and
are in conformance with the area requirements of the zone. Lot 1
shall have access from Jasmine Lane, an existing private road.
Lots 2, 3 and 4 will take access from a proposed private road along
the subject subdivisions southerly boundary. We are presently
working with the State of Idaho Department of Transportation to
secure approval of this second access point. In conjunction with
the development of this subdivision, the ten acre parcel lying on
the West side of Lots 1, 2 and 3 will eliminate its access from
Jasmine Lane and will take access from the said proposed private
road.
The lots within this development will have individual wells and
septic systems and will have access to existing irrigation
facilities.
