Street construction plans for Cherry Lane Apartments, located on East 3rd
and Gruber, have been approved for construction.
I have received Ordinance #563 by the City of Meridian concerning the defer-
ral of the street improvements on 2-1/2 Street. The only method ACHD has
of deferring street improvements is a Road Trust Fund deposit. This is
calculated to be $12,000, plus utility relocations, as necessary.
Inspection permit is $300.00.

Kingsford: If 3t doesn't ,lust be for your subdivision then you
are going to have to have a zoning change. It is in fact
commercial if you are renting out space in there. If it serves
that unit then I don't think you have to have a zoning change.
Stucker: There would have to be a fee. This is what I wanted to
know is if this would be acceptable.
Crookston: I think it's the use that controls. If it is used
for storage then that's the zoning that has to fit. If it is
used for the people only in that area or whether you rent it out.
Stucker: It's the use that is the problem. In other words we
could not use it at all.
Crookston: Right. Without a zoning change.
Stucker: Would it be feasible to approach that angle and try to
get a conditional use?
Kingsford: I think my recommendation would be to visit with Mr.
Johnson here and some of the Council individually and see what
their thinking would be with regard to that.
Crookston: The other thing that is a possibility is to do it as
a planned development which does require Conditional Use but you
could define the whole area and do it that way.
Myers: What were you going to do with the barn and shop and
house anyway?
Stucker: The small one there we would keep it along with the
existing house there. The larger barn is the one we were
thinking of converting. We were thinking of being a contributing
factor to the use of the area.
Kingsford: I think it's an excellent idea.

AN ORDINANCE OF THE CITY OF MERIDIAN AMENDING AND CHANGING THE
ZONING OF CERTAIN REAL PROPERTY IN THE CITY OF MERIDIAN WHICH IS
GENERALLY DESCRIBED AS LOTS 3, 4, 5, 6, 7, 8, 9, 10 & 11 OF CHAPIN
SUBDIVISION NO. 2, BOISE MERIDIAN, ADA COUNTY, IDAHO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to amend and change the zoning from R-8 Residential
to R-40 High Density Residential, for the following described
parcel:
Lots Numbered Three, Four-, Five, Six, Seven, Eight, Nine, Ten
and Eleven of Chapin Subdivision No. 2 to Meridian, Ada
County, Idaho, according to the official plat thereof on file
and of record in Book 11 of Plats, at page 646 thereof, in

NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council
of the City of Meridian, Ada County, Idaho:
Section 1. That the aforementioned real property which

Meridian, Ada County, Idaho, according to the official

either by Ada County Highway District or through a Local
Improvement District, or otherwise, but the requirement shall
continue to be a requirement of the owner of the subject property
to participate in that construction cost.
Section 3. EFFECTIVE DATE: There being an emergency,
which emergency is hereby declared to exist, this Ordinance shall

approval as required by law.

Kingsford: I will now open the Public Hearing. Is there a
representative present, if so please come forward and be sworn

Jack Rose, 436 Los Creek Road, Boise, was sworn by the attorney
Rose: We are requesting a rezone of the property at 324 Gruber
Street for the purpose of constructing a forty four unit
apartment complex. At this time we are hoping to have this

resolved and have a positive approval by the Council meeting
tonight. I also have a request on a waiver of the property that
has come up concerning the property. Handouts passed out to
Council showing the type of building to be constructed and a
condensed site plan drawing. We have since been informed that we
have a problem on the E. 2 1/2 Street side of this property which
runs between the property and the rear of the Payless Shopping
Center. On that particular side of the property there are power
Poles that run down along side this piece of property that are
indeed out in the right of way. If we indeed are required to
build curb, gutter and sidewalk on that particular side it would
mean that we would have to move all those power lines. At this
point we went out and did a cost analysis of that and talked with
Idaho Power and it was estimated that it could run as high as
$55,000.00 to do that and that was just make this project totally
cost prohibited to do it. So I'm asking along with the rezone
that you would consider waiving just this particular side. I did
have a meeting with ACHD and the result of that meeting was that
they were willing to waive that if the Meridian City Council was.

Rose: That really is my request. As they reviewed the plans and
analyzed the situation and knew clearly about the history of the
curbs and there is nothing in that area at all. Because of our
willingness to run such a long curb and gutter on 3rd Street side
and along Gruber side, it's an enormous cost for a property this
big.
Tolsma: Is there run to put that curb, gutter and sidewalk up
along that ridge?
Rose: No. ACHD went out and looked at it and they said that
we'd be better off just to waive the thing in this particular
area. If we ever did an access here we could and would be
willing to do curb, gutter and sidewalk past this power pole if
we can if it will line up. We would be ■ore than happy to do
that to match up with Fairview Avenue.

Kingsford: I understand your problem and an sympathetic towards
it but yet we are talking about a high density development in an
area there would be alot of foot traffic. It seems to me that
this would be an area that would really need them.
Rose: I appreciate your concern. I think one of the things I
might point out to you that I have failed to add and it will
really help this particular process is that along this side where
we are asking for waiver we would build a continuous six foot
fence so that we are controlling the traffic.
Crookston: The fence creates a problem also, it would be right
an the sidewalk.
Rose: No we are going to drop the sidewalk actually down onto
our property more. We will not be exactly right on our property
line.

Myers: There is going to be a sidewalk on the inside of the
fence then?
Rose: No. No sidewalk. There would not be a sidewalk on this
particular side of the property because of the cost to do the
power poles.
Tolsma: Well if in the future then Idaho Power or whatever
decides to move those poles would there still be room to move
them?
Rose: Yes we have indeed designed it so that there is room.
Giesler: Are there any plans for 2 1/2 Street?
Kingsford: Not that we know of.
Rose: We would like to do alot of things in the Meridian area.
We have always proven to be ones that are givers and not takers.
There will be an entrance to the project on 3rd Street and
Gruber.
Giesler: What did you figure on doing between the fence and the
road?
Rose. At this time it's pretty much grass and we will maintain
that in a very professional way.
Tolsma: Could this be put as a deferral until such time that the
power poles are moved by Idaho Power or a street lighting project
or something like that?
Crookston: You would have to have an agreement between the owner
and the City.

Kingsford: It's not necessarily true, the City can force an LID
at any time if adjacent property were developed to sidewalk. We
could force whoever the owner is to put in sidewalks there.
Crookston: That's true but if your talking about having solely
Mr. Rose do it -
Kingsford: That's not going to fly because those things change
hands to often.
Crookston: Then a deed restriction is appropriate.
Rose: We understand and we have had this happen to us before
where at sometime in the future an LID does come through there
and we are participants we don't have an option on that from a
legal standpoint. We are more than open at that time to
participate at that LID. At least at that point we don't have to
share the entire cost of it as the whole street is done and it
helps us cost wise as they do it all the way down. At this point
we are hoping for the waiver. Anytime in the future when the LID
does come up we will be a part of the assessment.
Myers: If you do a deed restriction what does that tell? Just
say that if for example they sell it to somebody else it says in
the deed that they agree to put the sidewalk in if an LID comes
along or something?
Crookston: Yes.
Myers: How much of a problem would that be for you guys?
Rose: To be honest with you, I'd rather not do it that way just
because if I buy a piece of property and it has something like
this and I fully understand that I'm buying it with the potential

that at any time an LID could come into my property for any
reason then that's fine I assume full responsibility for that. I
would hope that we wouldn't have to do that.
Crookston: If your inclined to do that we would still need some
kind of an agreement.
Kingsford: Any other questions or comments. Anyone else to
testify on this issue?

Strasser: Is it the curb and sidewalks or the power poles that
are the problem as far as expense?

Giesler: What is the chances of that curb being at the right
height if that road is redone?
Kingsford: Typically it's been that the Highway District won't
have any kind of elevations established for it.

Kingsford: Is there a representative present?
Dennis Butterfield, 2833 Autumn Way, Meridian. Basically I think
your all aware that we are trying to get a conditional use on
that property. We are going to put a shop in there and it will
be a real asset to Meridian.
Kingsford: Has the problem been resolved concerning the power
line?
Butterfield: Yes, rather to pay Idaho Power $100,000.00 we
decided to move the building.
Tolsma: Do you have any problems with ACHD & NMID specs?

ITEM #5: TERRY EDWARDS, PASTOR OF THE MERIDIAN SEVENTH DAY
ADVENTIST CHURCH:
Terry Edwards: I am pastor of the Seventh Day Adventist Church
here in Meridian. We are in the process of getting together
funds for a building project. We did sell our building that was
at Carlton and 2 1/2 Street. We are now renting the Methodist
Church and they have given us the use of that facility for one
year. In the meantime we are trying to get the funds together
and we are having an architect draw up some plans. We've got
Briggs Engineering doing our site work and one of the things we
discovered as we got into this project which we were not aware of
is the fact that we would be required to do curb, gutter and
sidewalk and extend the asphalt out to the existing road. That
was something that when we purchased the property we were not
aware of. This is going to put a financial burden on us that's

FACTS & FINDINGS:
1. Dorado Development Co. is requesting a rezone from R-8 to R-40 of
2.3 acres of property located at 324 Gruber Street.
2. Gruber Avenue has 60 -feet of right-of-way (which is adequate), and is
improved with 30 -feet of paving plus rolled curb on the opposite side.
3. E. 2 1/2 Street has 50 -feet of right-of-way (which is adequate), and is
improved with 24 -feet of paving.
4. E. 3rd Street has 60 -feet of right-of-way (which is adequate), and is
improved with 1/2 (approximately) plus 12400t street improvements.
If the rezone is approved and development proceeds, the District will pro-
vide the following requirements to Meridian Planning & Zoning as conditions
for approval.
SITE SPECIFIC REQUIREMENTS:
1. Curb, gutter, 4 -foot sidewalk and match paving shall be constructed on
Gruber abutting parcel. Improvements shall be constructed to a 36 -foot
back-to-back street section.
2. Curb, gutter, 4 -foot sidewalk and match paving shall be constructed on .
E. 2 1/2 abutting parcel. Improvements shall be constructed to a 36 -
foot back-to-back street section.

STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
3. Written approval shall be obtained from the appropriate irriga-
tion/drainage district authorizing storm runoff into their system.
4. Obstructions (utility facilities, irrigation and drainage appurtenances,
etc.) shall be relocated outside of the proposed street improvements.
Authorization for relocations shall be obtained from the appropriate
entity.
5. Existing irrigation and drainage systems shall be continued across par-
cel.
6. Three sets of street construction plans shall be submitted to the Dis-
trict for review and appropriate action.
7. Site drainage plans and calculations shall be submitted for review and
appropriate action by ACHD. The proposed drainage system shall con-
form to the requirements of Boise City Code Section 9-20-8.5 and shall
retain all storm water on-site.
8. Design data for proposed access to public streets shall be provided for
review and appropriate action by ACHD.
9. Driveways shall be located a minimum of 5 -feet from the side lot proper-
ty lines.
10. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public rigot-of-way. Contact Quality
Control at 345-7667 (with zoning file number) for details.
11. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.

This planned apartment complex will accelerate the need for
Joint School District No. 2 to construct additional classrooms
and/or to adjust school attendance boundaries. Meridian Schools
does not have excess capacity. Nearly every school in the
district is beyond capacity.
The Meridian School District supports economic growth for Idaho
and specifically the district's area, but such growth produces a
need for additional school construction. We ask that planning
and zoning officials assist the district in obtaining support
for a development fee statute on new home construction to help
offset the costs of building additional school facilities. We
also ask that the same support for school bond issues be
required from developers and other interests seeking planning
and zoning approval for residential projects. If this support
is lacking then we ask that additional residential development
be denied.
School bus service may be restricted if adequate turnarounds and
loading areas are not provided.
Residents cannot be assured of attending the neighborhood school
as it may be necessary to bus students to available classrooms
across the district.
Developers are strongly encouraged to provide walkways, bike
paths and safe pedestrian access to schools.

The above entitled matter having come on for public hearing
September 10, 1991 at the hour of 7:30 o'clock p.m., the
Petitioner appearing in person, the Planning and Zoning Commission
of the City of Meridian having duly considered the evidence and
the matter, makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Rezone
Application was published for two (2) consecutive weeks prior to
the said public hearing scheduled for September 10, 1991, the
first publication of which was fifteen (15) days prior to said
hearing; that the matter was duly considered at the September 10,
1991, hearing; that the public was given full opportunity to
express comments and submit evidence; and that copies of all
notices were available to newspaper, radio and television
stations;

incorporated herein; that the property is presently zoned R-8
Residential; the area in which Applicants' property is located is
developed in large part as a residential area; that some of the
nearby land is used commercially for a Payless Store and other
retail shops; that the majority of residential units in the area
are single-family dwellings; that there are commercial uses on the
property to the north of the subject property.
3. That the Applicants propose to have the property zoned
R-40 Residential and construct an apartment complex on the
property housing 44 housing units.
4. That the R-40 District is described in the Zoning
Ordinance, 11-2-408 B. 4 as follows:
(R -a0) High Density Residential District:

forty (40) dwelling units per acre.
Connection to the Municipal Water and Sewer
System of the City of Meridian is required.
5. That the property is contained in the NORTH CURVE
neighborhood as designated on the Policy Diagram at Page 7 of the
Meridian Comprehensive Plan; neighborhoods are defined in the Plan
at Page 6 and states as follows:
"Definition: The neighborhood is a residential area
wit uni orm characteristics of a size comparable to
that usually served by an elementary school or a small
business convenience center or a local park. Although
neighborhoods occur in various shapes and sizes, a
section of the City measuring one-half to one and one-
half miles across is usually used for planning purposes.
It has facilities within easy walking distances and
provides the basis for community identification."

has frontage on Gruber and East 3rd Street; that the portion of
the property to be used for the complex is presently vacant
property.
7. That sewer and water is available to the property, but
the use will require additional charges and fees.
8. That comments may be submitted by the Nampa Meridian
Irrigation District, Meridian Police Department, Ada County
Highway District, Meridian Fire Department, and the Meridian Sewer
Department and other agencies and those comments will be
incorporated herein as if set forth in herein.
9. That proper notice has been given as required by law and
all procedures before the Planning and Zoning Commission have been
followed.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the Applicants'
property.
2. That the City has the authority to take judicial notice
of its own ordinances, other governmental statues and ordinances,
and of actual conditions existing within the City and state.
3. That the City of Meridian has authority to place
conditions upon granting a zoning amendment.
4. That the City has judged this Application for a zoning

amendment upon the basis of guidelines contained in Section 11-2-
416 of the Revised and Compiled Ordinances of the City of Meridian
and upon the basis of the Local Planning Act of 1975, Title 67
Chapter 65, Idaho Code, the Comprehensive Plan of the City of
Meridian, and the record submitted to it and the things of which
it can take judicial notice.
5. That 11-2-416 (K) of the Revised and Compiled Ordinances
of the City of Meridian sets forth standards under which the City
shall review applications for zoning amendments; that upon a
review of those requirements and a review of the facts presented
and conditions of the area, the Planning and Zoning Commission
specifically concludes as follows:
( a ) The new zoning would be harmonious with and in
accordance with the Comprehensive Plan and no
Comprehensive Plan amendment is required.
(b) The area is in the NORTH CURVE neighborhood which
is designed for residential and other uses which support
residential needs and a mix of those uses and a rezone
of the subject property is in line with that
designation.
( c ) The area around the proposed zoning amendment is
developed in a residential and commercial fashion that
would be allowed in the North Curve Neighborhood and the
new zoning would not be contrary to the allowed uses in
the area and would be a buffer between the adjacent
commercial uses.
( d ) There has not been a change in the area or adjacent
area which may dictate that the property should be
rezoned but the use to be developed would act as a
buffer.
( e ) That the property is proposed to be designed and
constructed to be harmonious with the surrounding area.
( f ) The proposed uses should not be hazardous or
disturbing to the existing or future uses of the
neighborhood.

(g) The property will be able to be adequately served
with public facilities, and connection to municipal
sewer and water is required.
(h) The proposed use would not create excessive
additional requirements at public cost for public
facilities and services and would not be detrimental to
the economic welfare of the community.
( i ) The proposed use should not involve any detrimental
activity to any person's property or the general
welfare.
(j) Development should not cause a significant increase
in vehicular traffic and should not interfere with
surrounding traffic patterns in that the property has
substantial street frontage.
( k ) That this rezone will not result in the
destruction, loss or damage of any natural or scenic
feature of major importance.
( 1 ) The proposed zoning amendment is in the best
interest of City of Meridian.
8. It is further concluded that the comments,
recommendations and requirements of other governmental agencies
will have to met and complied with.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the

Rose: Our proposal is to bring to Meridian a fourty four unit apartment complex and
it's location is 324 Gruber. Presented photo's to Council. Each building covers
approximately 2,052 sq. feet which equals twenty three percent of the entire area.

This is a moderate income apartment complex. We do see the rents working at approximately
$475.00 a month. This is in no way a low income project.
Alidjani: You mentioned the square footage in the building to be 2200, is that
correct?
Rose: That is correct. The actual size of each apartment is 894 square feet. They are
two bedroom, one bath apartments.
Alidjani: If this is approved tonight, what is your time table?
Rose: we are finding that financing is extremely tough . We have been pre -approved
in our financing. Our time table is to start as soon as we have approval.
Alidjani: The picture you are showing, is this a type of quality of the work that you
are doing. It is almost identical?
Rose: That's correct.
Rountree: You are going to emphasize landscaping.
Rose: Again, over 36% of the project is landscaping.
Rountree: Will there be on-site management of the complex?
Rose; Yes there will.
Hepper: Is the parking covered?
Rose: No at this point there has not been a decision made. We have a total of 91 parking
spaces at this time.
Hepper: Will there be any fencing around the project?
Rose: We would anticipate fencing the 2z Street side because of a difference of
elevation.
Hepper: There is a residential house on the corner, will there be fencing there?
Rose: Yes.
Hepper: On the square footage you said 894 sq. feet, is that living area?
Rose: Yes.
Crookston: Just for clarification. You said the building size is 2,052 and each
apartment has 894 sq. feet.
Rose: That's correct your looking at a four plex building with two down and two
up.
Johnson: Have you read all the comments from the specific agencies?

Quang The Do, 48319 Fieldhurst Ave., California, was sworn by the attorney.
Williamson: Presented a map on project. Quang The Do would like to have a nursery here
about 150 feet on Cherry Lane and 871 ft. weep or south of Cherry Lane, to grow trees,
shrubs and flowers. Explained this would make a good buffer. Presented letters to be
entered into record in favor of this request. He would also like to have a home at the
back of the property.
Hepper: Have you seen the comments from the City Engineer?
Williamson: No.
Hepper: The main item listed was the parking. It shows there is nine parking spaces
shown on the site plan and he states that the nine spaces don't appear to be enough.
Quang The Do: The parking is not to scale, I think there is more parking than that.
Williamson: I really don't see where they wouid be any probiem. He probably won't
develop for about three years.
Rountree: We have one item that is not addressed in the Engineer's comments and that
is the setback requirements for right of way off Cherry Lane.

FACTS & FINDINGS:
1. Dorado Development Co. is requesting a rezone from R-8 to R-40 of
2.3 acres of property located at 324 Gruber Street.
2. Gruber Avenue has 60 -feet of right-of-way (which is adequate), and is
improved with 30 -feet of paving plus rolled curb on the opposite side.
• 3. E. 2 1/2 Street has 50 -feet of right-of-way (which is adequate), and is
improved with 24 -feet of paving.
•
4. E. 3rd Street has 60 -feet of right-of-way (which is adequate), and is
improved with 1/2 (approximately) plus 12 -foot street improvements.
If the rezone is approved and development proceeds, the District will pro-
vide the following requirements to Meridian Planning & Zoning as conditions
for approval.
SITE SPECIFIC REQUIREMENTS:
1. Curb, gutter, 4 -foot sidewalk and match paving shall be constructed on
Gruber abutting parcel. Improvements shall be constructed to a 36 -foot
back-to-back street section.
2. Curb, gutter, 4 -foot sidewalk and match paving shall be constructed on
E. 2 1/2 abutting parcel. Improvements shall be constructed to a 36 -
foot back-to-back street section.
3. Curb, gutter, 4 -foot sidewalk and match paving shall be constructed on
E 3rd abutting parcel. Improvements shall be constructed to a 36 -foot
back-to-back street section.

STANDARD REQUIREMENTS:
1. Street and drainage improvements required in the public right-of-way
shall be designed and constructed in conformance with District stan-
dards and policies.
2. Specifications, land surveys, reports, plats, drawings, plans, design
information and calculations presented to ACHD shall be sealed, signed
and dated by a Registered Professional Engineer or Professional Land
Surveyor, in compliance with Idaho Code, Section 54-1215.
3. Written approval shall be obtained from the appropriate irriga-
tion/drainage district authorizing storm runoff into their system.
4. Obstructions (utility facilities, irrigation and drainage appurtenances,
etc.) shall be relocated outside of the proposed street improvements.
Authorization for relocations shall be obtained from the appropriate
entity.
5. Existing irrigation and drainage systems shall be continued across par-
cel.
6. Three sets of street construction plans shall be submitted to the Dis- •
trict for review and appropriate action.
7. Site drainage plans and calculations shall be submitted for review and
appropriate action by ACRD. The proposed drainage system shall con-
form to the requirements of Boise City Code Section 9-20-8.5 and shall
retain all storm water on-site.
8. Design data for proposed access to public streets shall be provided for
review and appropriate action by ACHD.
9. Driveways shall be located a minimum of 5 -feet from the side lot proper-
ty lines.
10. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Contact Quality
Control at 345-7667 (with zoning file number) for details.
11. A request for modification, variance or waiver of any requirement or
policy outlined herein shall be made, in writing, to the Manager of
Engineering Services within 15 calendar days of the original Commission
action. The request shall include a statement explaining why such a
requirement would result in substantial hardship or inequity.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the Planning
and Zoning Commission of the City of Meridian will hold a public
hearing at the Meridian City Hall, 33 East Idaho Street, Meridian,
Idaho, at the hour of 7:30 o'clock p.m., on September 10, 1991,
for the purpose of reviewing and considering the Application of
DORADO DEVELOPMENT COMPANY for a rezone of lots 3, 4, 5, 6, 7, 8,
9, 10, & 11 of Chapin Subdivision, Ada County, Meridian, Idaho,

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the Planning
and Zoning Commission of the City of Meridian will hold a public
hearing at the Meridian City Hall, 33 East Idaho Street, Meridian,
Idaho, at the hour of 7:30 o'clock p.m., on September 10, 1991,
for the purpose of reviewing and considering the Application of
DORADO DEVELOPMENT COMPANY for a rezone of lots 3, 4, 5, 6, 7, 8,
9, 10, & 11 of Chapin Subdivision, Ada County, Meridian, Idaho,
from (R-8) Residential to (R-40) High Density Residential, for
development of a 44 to 48 unit apartment complex with
approximately 20 units per acre. The address for the above
property is known as 324 Gruber Street, Meridian, Idaho.
A more particular legal description is on file in the office
of the City Clerk of the City of Meridian and is available upon
request.
Public comment is welcome nd will be taken and heard.

10. The general location and topography of the subject property
lends itself extremely well to the construction of the
proposed apartment complex. The site is located one block
south of Fairview Avenue and one block east of 1st Street,
adjacent to both the Cherry Plaza and other surrounding
shopping centers. The immediate neighborhood is comprised
of a mixture of existing multi -family and single family
residences to the south with a small mobile home park
located to the east. Consequently, residents of the
proposed Cherry Lane Apartments would be within walking
distance to most downtown amenities.
11. The City of Meridian is currently experiencing a severe
shortage of newer, high quality, market -rate, multi -family
apartments. Most of the existing apartments are operated
under either a Section 8 or HUD subsidized rental program.
An exhaustive marketing survey was conducted with various
property management companies, real estate offices and
existing apartment projects. This survery, among other
things, indicated that there is virtually no vacancy within
the existing apartment community of Meridian. In fact, some
families are forced to rent available housing in other
communities, necessitating a commute to their jobs in
Meridian.

The Cherry Lane apartments would clearly help to alleviate
this shortage and provide a project which would, from an
architectural standpoint, blend into the maturity of the
existing neighborhood. The Cherry Lane Apartments would:
A. Provide an outstanding value in housing at moderate
rental rates.
B. Offer housing for those who cannot afford to purchase
single family dwellings.
C. Provide housing for those who do not qualify for, nor
choose to live in a subsidized low income apartment
complex.
D. Provide well located housing to the work force employed
by the retailers of the largest shopping area in the
City of Meridian.

15. In every town and city in the United States, concentrated
shopping areas are always accompanied by various multi-
family apartment complex's. Apartment complex's fill many
needs in our society that economically cannot be met by any
other type structure. We feel our proposed apartment
project will fulfill a tremendous need in the City of
Meridian. In addition to building to the highest quality of
construction standards, we are sensitive to creating a open,
family oriented setting to our projects. Consequently, we
intend to fully develop the adjacent grounds into a park-
like atmosphere, incorporating an abundance of trees,
shrubs, flowers and burms. We will have family barbecue and
picnic areas combined with more than adequate on-site
parking. We fully realize that 80% of the successful
renting of apartments is due to "curb appeal". Thus, we
intend to create a atmosphere that will place the Cherry
Lane Apartments among the finest in the city. I know that
this commitment to quality and beauty will relate very
highly to the Meridian Comprehensive Plan.

Dear Wayne:
' This counter-offer is delivered to you as agent for The Church of
God Seventh Day ("SELLER"), regarding that certain property owned
by Seller and located at 302 Gruber, Meridian, Idaho, a legal
description which is attached hereto as Exhibit A.
' The Property contains 2.30 acres, more or less, together with all
improvements, rights of way, and any other tangible and
intangible assets. Dorado Development Company or Nominee
("BUYER") proposes to purchase the aforementioned property. This
t letter is intended to be a binding instrument and reflects the
transaction that the Buyer is willing to undertake, subject to
certain conditions and contingencies detailed herein.
tHere are the basic terms of this offer:
1. Purchase Price. The total purchase price shall be
' $95,000.00.
2. Terms of Payment. Cash at closing in the amount of
t$95,000.00.
3. Description of Property. The legal description of the
Property with the presently existing exceptions to title, if
any, are to be provided by the Seller.
4. Review Period. Upon acceptance of this offer, Seller shall
' deliver to Buyer a perimeter survey and preliminary title
report on the property. Upon receipt of the aforementioned
information, Buyer shall have a fourteen (14) day period
' within which to review the information, inspect the
Property, etc. Upon satisfactory completion of the review,
Buyer will immediately notify Seller who will proceed with
' the preparation of the necessary closing documents,
forwarding copies of the same to the Buyer and the originals
to the closing agent.

' 5. Conditions Precedent to Closina.
a. Seller shall provide Buyer clear title to that portion
' of Boise Avenue previously vacated and presently a
portion of the Property. (This condition should be
removed upon receipt of the preliminary title policy by
' Buyer).
b. Seller shall provide Buyer clear title to that portion
of the un -named alley previously vacated and presently
' a portion of the Property. (This condition should be
removed upon receipt of the preliminary title policy by
Buyer).
'C. Sellers shall remove all desired items of personal
property, and/or fixtures from the building prior to
' but not later than a thirty (30) day period following
closing.
d. Seller shall remove the metal tent support structure,
foundation, and concrete platform from the Property
prior to but not later than a thirty (30) day period
following closing.
e. This Offer is subject to a re -zone of the property by
the City of Meridian, Idaho, to a minimum density of
' R-20 or acceptance of a PUD with a conditional use
permit allowing a minimum of twenty (20) units per
acre.
f. Seller guarantees location of utilities to be adjacent
to property line. Utilities must be of adequate size
to conform to multi -family use.
6. Closing. Closing will take place at the offices of Stewart
Title Company, Boise, Idaho, or another Title Company
mutually acceptable to Buyer and Seller, provided that all
items as provided for in this counter-offer have been
completed. Both Buyer and Seller acknowledge that timing is
of the essence and that the date of closing is subject only
to Buyer obtaining proper zoning (as per 5 e.). Buyer
agrees to use his best efforts in a timely manner to obtain
proper zoning, and upon obtaining same shall close this
transaction within fourteen (14) days. However, in the
event proper zoning cannot be obtained prior to midnight,
December 31, 1991, this offer may be declared null and void

by either party. All normal closing costs, including the
preparation of documents, shall be shared equally between
the parties except the cost of Title Insurance which shall
' be the responsibility of Seller. Each party will be
responsible for their own expense of legal and/or tax
counsel.
Brokerage Fees. Seller acknowledges that Robert R. Angell,
a licensed Idaho Real Estate Broker, representing the Buyer,
may subsequently become involved as a principal by reason of
his involvement with Buyer's entity. It is further
understood and agreed between Buyer, Seller and Listing
Broker, that the sales commissions to be paid by Seller on
this transaction shall be divided equally between the
Listing Broker and the Broker for the Buyer and that the
Broker for the Buyer, in any case, shall be paid an amount
not less that three percent (3%) of the purchase price.
8. Acceptance by Seller. This offer shall be null and void if
not accepted by Buyer prior to midnight, July 31, 1991.
I would appreciate the Seller ratifying the terms and conditions
of this Offer by signing this letter and returning it to me along
with the information detailed on Exhibit B attached.
