Dear Anna:
We aze owners of approximately 75 acres included within the approved Lochsa Falls subdivision.
A request has been made that we approve relocation of W. Apgar Creek Street within our
property boundaries approximately 50 feet to the north. This request is being made by Kevin
Howell, developer of the adjacent property to the east, owned by the Fulfer family. This
proposed realignment has been revised and is depicted on the attached memo and plan from JUB,
dated July 15, 2003.
We are willing to allow this relocation to occur, based on the assurance of its acceptability we
have received from Ada County Highway District, as referenced in the attached memo from ^
CONTACT _Con-451604791BE 1c \s u Christy Richazdson0 dated July 17, 2003. The
implication of this is that the 30 foot access easement that aligns with West Apgar Street, to the
west, across Goddazd Creek Way can remain in its presently planned location.
If we can receive written assurance that this relocation will not result in a future requirement that
we relocate the access easement to the west, we are willing to go along with the proposed change.
If this is not possible, then the proposed preliminary plat for Kelly Creek should be revised to
recognize the alignment of West Apgaz Street as depicted in the approved Lochsa Falls
Preliminary Plat. Please let me know if you have any questions.

Bitl: Here is a sketch showing haw the streets align today between
Lochsa Falls and Kelly Creek at Apgar Creek Street. I have drawn, by
hand, a proposed street modification to allow the centerline of Apgar
Creek to align with the centerline of the 30' wide private driveway to the
west of your main entry street. The deflection angle is less than the 20
degrees allowed by ACHD and will meet their intersection requirements.

As you are both aware, ACRD policy requires streets and driveways to
align or offset. It appears that by skewing the road just a bit to the
north (Apgar Street) you can still achieve this. Policy also requires
the angle of the intersection to be 90-degrees, but does allow some
flexibility down to 75 degrees. This intersection is at 82-degrees, and
under the circumstances, I would recon¢nend approval.
