Pat Tealy: I'm representing the owner of the project Mr. Ted Sigmont. Essentially what we are trying to do, is the owner has bought two lots in Terr~ubdivision, this pis a recorded subdivision. #2 indicates that all lots in this subdivision are four plex lots, typically that note is put on there just to protect some type of future down zoning or whatever. What Mr. Sigmont is proposing is one eight plex on two lots. We are not exceeding the density of the lots. All we are tpying to do is combine two four plexes to make better use of the land. Gave the Council a site plan. Crookston: The proposal sounds very fine, but the plat you have doesn't allow it. It's up to the Council, the way I view it is by going ahead and allowing it your allowing a violation of the plat. Kingsford: Voiced concerns about what people are going to say. I'd feel slot more comfortable if you could get an approval from those owners in that subdivision. Discussion about materials stated or placed on the face of plats. (TAPE ON FILE) Clerk Niemann: Can they file an addendum to the plat? Crookston: To ammend the plat only requires the owner of that property. I think that you can replat the lots that you are talking shoat. How many lots are we talking about. Kingsford: Two out of six. Clerk Niemann: If they could get the owners to all sign an affidavit to the plat couldn't :.they do that? Crookston: It seems to me that I've seen that done. Kingsford: I would suggest that that be the route we go, then have the attorney look into it. The Motion was made by Myers and seconded by Tolsma to approve of an eight Alex conditioned upon the City Attorney's finding a vehicle by which to remove note #2 from the plat. Section 3. Dwelling Cost, Quality and Size. (a) No single family dwelling at a cost of less than $40,000 plus lot cost based upon cost levels prevailing on the date this declaration is recorded, shall be erected or placed on any building site and the floor area of the main structure, exclusive of one-story open porches, terraces and garages, shall not be less than 1350 square feet for a one-story dwelling, nor less than 1700 square feet for a split entry or two-story dwelling. Where a garage or other accessory structure is not part of the dwelling house, no portion of the garage or other structure shall be nearer the front or street line than the rear line of the house. Section 5. Building Materials. All buildings erected upon any lot shall be of stone, brick, frame construction ands if other than brick or stone is used, such building shall be finished painted and maintained in good repair so as to be inoffensive to any other property owners in said subdivision. Section 6. work Prosecution. The construction of all dwellings and outbuildings shall be prosecuted diligently and continuously from the time of commencement thereof, and same shall be completed, including exterior painting within eight months after the date of commencement of construction unless such completion is prevented by causes beyond the control of the Grantee. Section 7. Temporary Structures. No structure of a temporary character, trailer, basement, tent, shack, garage, barn or other outbuildings shall be -.used on any lot at any time as a residence either temporarily or permanently. Section 8. Moved Buildings. No building shall be moved onto any `building site unless specific permission and approval of plans, specifications and location is obtained in writing from.:the Architectural Control Committee. Section 9. Nuisances. No nosious or offensive activity shall be carried _ on upon any lot, nor shall anything be done theron which may be or may ,'become an annoyance or nuisance to the neighborhood. Section 10. Animals. No lot or portion thereof, shall be used for -the keeping or pasturing of goats, sheep.,. swine, horses, cows or other non- household animals. Dogs, cats or other household pets may be kept, provided "that no animals are kept, bred or maintained for any commercial purposes. Section 11. Signs. No sign of any kind shall be displayed to the public view on any lot except that the name of a resident of a dwelling upon a lot may be displayed on a sign of not more than one square foot in area. The Grantor reserves the right to display signs upon lots advertising the property for sale or rent, and signs used by builders to advertise the property during the construction and sales period. Section 12. .Fences. No fence, hedge or boundary wall situated upon a lot shall have a height greater than six feet above the graded. surface of the ground around which such fence, hedge or wall is situated. The construction or maintenance of spite fences or spite trees or shrubs shall be prohibited upon all lots in this subdivision. All wooden fences shall be constructed in a substantial manner, and shall be painted an attractive color and be maintained in good repair so as to be inoffensive to any other property owners in said subdivision. No barbed wire fences shall be constructed within this subdivi- sion. Fences"greater in height than three feet shall not be placed nearer to a front street line than a dwelling unless the plans for said fence have been approved by the Architectural Control Committee as provided in Section 2,b. Continued TERRA SUBDIVISION - Page ~ • Section 13. Oil and Mining Operations. No oil drilling, oil development operations, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavation or shafts be permitted upon or in any lot. No derrick or other structure designed for use in boring for oil or natrual gas shall be erected, maintained or permitted upon any lot. Section 14. Water. The Grantors will deliver domestic water to the point where the water meter is located at the pr~perty line. Each lot owner shall connect to this water system at this point and use this water for their domestic use. Grantors are under no obligation to deliver irrigation water to any lot in this subdivision. However, each lot owner may avail himself of the irrigation water for those lots that are within the existing irrigation districts, subject to the payment of any and all dues and assessments for the use of said irrigation water. Additional irrigation laterals may only be constructed int3~e easement area that is provided along each lot line.- Where it is necessary for a lot owner to obtain water over and across another lot and maintain the necessary irrigation lateral through the easement area only, as herein provided and as well as shown on the recorded plat across the lot owner's property. _ Section 15. Sewage disposal. All "bathroom,.sink and toilet facilities .shall be located inside the dwelling house or other suitable appurtenant- =building and shall be connected by underground pipe with a privatesewage -. disposal system placed and constructed in accordance with the regulations `of the governing. health authority. Private sewage disposal systems shall be placed in the frnnr vara~ 1 Drainage from said private sewage disposal system shall be kept within the building limits of each lot. Approval of all sewage disposal systems installed shall be obtained from-the governing health authority, and the Grantor shall have. no obligation. to construct any sewer or provide any connec- tion thereto. ~U OS ~ y ~~ ~~~-Y ~~~ b~~ `0.~ ,O _I G 1 yt!'/ The sanitary facilities of any dwelling shall, within ninety days of er activation of the dry line sewer, be connected thereto, and the grantee agrees to pay all applicable connection fees and monthly charges. Section 16. Garbage and Refuse Disposal. No lot included within this subdivision shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste material shall be deposited only in sanitary ccSntainers meeting the requirements of the sanitation ordinances of the County of Ada, State of Idaho, and the regulations of the ordinances of the State of Idaho Health Authorities. No machinery, appliances or unsightly material shall - be stored upon a lot until a Grantee is ready and able to commence the construc- tion with respect to which such building material shall be used, and then such building material shall be placed within the property lines of the lot upon which the structure is to be erected. ~ j /_O / „ ~c..~j Section 17. Driveways. Any driveway constructed o„n/(~an~y of-said lots shall be of 4,000 psi; 4" thick air-entrained concrete and shall be connected to the curb at the edge of the street in a manner that it will not disturb the drainage pattern created by the street and curb section. Sidewalks, To preserve the aesthetic quality and living style intended by the Grantor, standard five foot concrete sidewalks shall be constructed by the Grantor adjacent to the back of the curb for the full width of each lot prior to the time the dwelling is occupied. In order to avoid unnecessary breakage, sidewalks need not be constructed by the Grantor until the dwelling is constructed. Sidewalks shall be of 4,000 psi; 4" thick air-entrained concrete. ARTICLE II EASEMENTS Easements are reserved for installation and maintenance of utilities, irrigation and drainage facilites five feet in width on side lot lines and five feet in width on front and rear lot lines. Within the easements no structure, planting or other materials shall be placed or permitted to remain which damage or interfere with the installation and maintenance of utilities or which may change the direction of flow of water through drain- age channels in the easements. The easements area of each lot and all im- provements in it shall be maintained continuously by the owner of the lot, ', except for those improvements for which a public authority or utility company is responsible. I _ _'' ARTICLE I II . ~r GENERAL PROVISIONS '~ 'i Section 1. Term. These Protective Covenants and Restrictions shall run with the land described herein and shall be binding upon the parties hereto and all successors in title or interest to said real property or any part thereof, until January 10, 2020, at which time said Protective Covenants and Restrictions shall be automatically extended for successive periods of ten ;years unless the owner or owners of the legal title to not less than one-half of the platted-lots, by any instrument or instruments in writing.,- duly signed Viand acknowleged by them, shall then; terminate or amend said Protective Cove= ~nants and Restrictions, and such termination or amendment shall become ef- ~fective upon the filing of such instrument-or instruments for record in the office of the Recorder of Ada County, Idaho. Such instrument of instruments ;shall contain property reference by volume and page number to records of 'the Deed in which these Protective Covenants and Restrictions are set 'forth and all amendments hereof. Section 2. Amendments. These Protective Covenants and Restrictions may be amended from time to time with respect~.to any part or portion providing the owners of at lease one-half of the platted lots, as of the date of said amendments execute such amendment duly made and reduced to writing as pro- vided in Section 11, herein. Section 3. Violations and Enforcement. Should the Grantees, their heirs, personal representatives, successors or assigns, violate or attempt to violate any of the covenants or restrictions set forth before the. termination thereof, it shall be lawful for any person or persons owning any other lots in said development or subdivision to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenant or restrictions, and either to prevent him or them from so doing or to recover damages or other relief for such violations. The invalidation of any one of these covenants by judgment or court order shall in no way effect any of the other provisions, which shall remain in full force and effect. There were several questions that were raised: .Density, Open space, Traffic They intend to provide open space and landscaping Lot sizes are approximately 9,517 square feet on which to place a 4-Plex. Adjacent land is around 6,ooc square feet Two (2) Off-street parking spaces per unit is required and are provided.' The buildings cover 2'7A~ - 28~ of the lot land The area is located East of Gem Estates on West Idaho extended East from 7th Street. Mr. Sharp explained that he liked the layout but the density is considered too great for the policy as set up by the Commission in the last few months. The area is 1.56 acres in size Mr. Sharp stated that he thought they could approve four (4) triplex unite sad two (2) duplex unite on these 6 lots. Commissioners Jeppesen, Fairbanks and Silva present. Ada County Highway District Staff present: fary Funkhouser, frank Capshaw, John Joines, Chuck Smith, Ra,y Putman, Les Niederklein, Marcia True, Jim James, Alice Sinsel. Several Ada County Highway District employees and ten citizens present. LEASE Af,REEMENT - Gary Funkhouser said the staff would like to enter into a lease agreement with the present tenant in the Boise Avenue property that the Highway District has just purchased, and asked for Commission approval. The lease is for $200.00 per month and requires a $100.00 deposit. Tenant to be given 90 days notice to vacate the property, and the last 90 days will be rent free in lieu of relocation costs. Commissioner Silva moved to sign the lease agreement. Commissioner Fairbanks seconded. Motion carried unanimously. CURB DESIGN - Fred Bagley, President of Highlands, Inc., explained that they would like to propose that the Highway District allow the use of the 6 Special Curbs to overcome the problem for developers of having to tear out curb and sidewalk when a house is built and the driveway is to be put in another location. He explained that there is no allowance for the 6" Special Curb in the new Highway District specifi- cations. Discussion followed concerning problems with each kind of curb. Richard Smith explained the reasons for using vertical curbs, especially in the Highlands. Orin Givens, President of Orin Givens Construction Company, explained the reasons for objecting to putting in the vertical curbs and the reasons for using the 6" Special. A sweeper operator from the Highway District explained that it takes twice as much sweeping to keep the 6 Special clean. tor. Smith presented a letter from Fred Sherman to the Highway District asking that the 6" Special be allowed. Commissioner Fairbanks said his objection to the 6" Special is that there is not enough berm behind the gutter plate. Gary Funkhouser explained the reasons for not allowing the 6" Special curbs, one being that if there is careless installation of the first gutter plate, there is a pool seal. It would also have to be allowed in all areas of the county and some of the soils would not handle it well. Pir. Funkhouser presented slides and explained the problems. Commissioner Silva asked t+lr. Funkhouser to correspond with other cities in the northwest with similar topography to see how they handle similar problems. Mr. Bagley further explained the costs of replacing curb when the home is built. Further discussion concerning length of time gutter plate could be left, and the berm which would have to be installed followed. Decision delayed until a later meeting. PERt1IT FEE DISCUSSION - Gary Funkhouser explained that the Highway District has filed suit against the utilities and that they are not in attendance. MR. FRED BIERMAN - Mr. Bierman was in attendance and explained that he is required to put in vertica curbs and said he is wondering why he can't use rolled curb in his development. Commissioner Silva asked that this gentleman be called when the curb subject is to be on the agenda again. After discussion and the property owners expressing willingness to pay, it was decided that the staff will try to work something out to improve the street. Mr. Caps haw will coordinate with the State to see if the no left turn sign off of Fairview onto Mountain View can be removed. It was presented to the property owners that they would have to pay the cost of paving the street and would not be able to get into an L.I.D. Mr. Funkhouser explained that it would cost approximately (no firm figure given) $23.00 per lineal foot, on each side. Property owners advised to check with all property owners concerned and have signed statements that 100% would be willing to oay for the street all at once. FOUR DAY WORK WEEK - Jim James said the EXCOMDEA has requested that the employees be a owe to wor our ten-hour work days per week. He requested that the Commission approve a trial period of six weeks, and explained the benefits for the District's efficiency. Mr. James explained that there is no data available to compare data received during the trial period with. After discussion, Commissioner Silva moved to approve the four ten-hour work days for a period of 90 days, and that it be evaluated at the end of that time. Discussion followed concerning the possibility of working the same schedule during the winter, it would have to be looked into with regard to safety, etc. Commissioner Fairbanks seconded. Motion carried unanimously. Mr. James said there are technical changes that will have to be made in the employee manual, and he will present it for approval at a later date. PAY SYSTEM - Gary Funkhouser explained the latest vote results as bi-weekly, 62; semi-monthly, 84; monthly, 30; there is no majority. Les explained that if the pay- roll has to be done by hand and there is different hours every pay period, there will not be enough time. After discussion, Commissioner Fairbanks moved to approve the semi-monthly pay system. Commissioner Silva seconded. Motion carried unanimously. BID ON PULL IN BUCKET - John Joines said this purchas was deferred in January. Bids have been opene an Northwest Sewer Equipment Company was low bidder, and Mr. Joines recommended that the bid be accepted. Commissioner Fairbanks moved to accept the bid of the Northwest Sewer Equipment Company. Commissioner Silva seconded. Motion carried unanimously. SUBDIVISIONS - FINAL PLATS ~. Terra Subdivision - John Joines presented the plat and recommended approval. The sub- ~- division is located on West Idaho Street in Meridian. After discussion, Commissioner Fairbanks moved to approve the plat for Terra Subdivision and to authorize the Chair- man of the Commission to sign the plat. Commissioner Silva seconded. Imperial Plaza - John Joines presented the plat and explained that the project is now existing and that it is being re-zoned to allow the apartment owners to sell the apartments as condominiums. Glaisyer stated that he did not realize the City was approving concept plans. Wright stated that they had previous approval. Glaisyer stated that he could appreciate as a developer what they were trying to do. However, he stated a concern about the lack of ordinances - he had no personal ill feelings about the concept. The properties annexed were clarified. Compliance with the Comprehensive Plan was outlined. It was confirmed that any plans for the area would have_to clear with the Council.. Kingsford stated that he liked the concept better than the old plan. Bodine stated that he had no problem with the plan. They are asking for twenty-four units. Williams stated that Planning and Zoning denied .the request Sept. 19,1978 and recommended a density of 10.256 per acre, or 16 total. Osier stated that the lots were larger than the average in the area. There is more room for landscaping as the lots are around 9,000 sq. feet. The difference between a Four-Plex unit and. Duplex unit is not that great... Williams stated that he could not go for 24 units per acre with the minimum square footage. Osier stated that one reason they would like to go with the higher density ` is to get quality units. If"Chey could get 20 units they could do what they would like to these and it would be more attractive. Osier presented a concept of the six Four-plexes but if they could go with four (4) 'four-plexes and two (2) -0uplexes, they could still squeeze through. Bob Jones stated that is is not 24 units per acre but 24 on 1.56 acres total, over an acre and one-half. It is laid out with more open space, bigger yards for play areas than those surrounding this development. ~.;~ Glaisyer inquired if the area would be landscaped with pathways as shown_on-.the ~~ ' concept plan. If it is aoproved and the building lots are sold off, whaf assurance does `,the City have that the concept will not change. Osier stated that the concept will not be changed, they will be landscaped as shown. Jones stated that"they hold back on the price of landscaping:' 'They pay for the landscaping when they buy the lot and we pay them back if it passes. As soon as it is - done they call us. If it passes, we pay them back - if it does not,we reserve. the right to do the landscaping." They use this system at Boise. Glaisyer inquired if the concept will be what is in there when it is said and done. Osier stated, yes. Glaisyer inquired about parking. Osier replied that both on and off street parking - two (2) spaces per unit. Kingsford stated that he could support 20 units. Bodine stated that he thought it was better than most that come in. Glaisyer stated that he was for it if it was landscaped as shown. Kingsford inquired if they were still talking about setic tanks. It is not economically feasible to put tanks in for three months. Thomas Annexation - LDS Church Conditional Use Permit Clyde Weber was present to represent the request. He stated that they had received a good rating from Planning and Zoning and would answer any questions the Council might have. Williams stated that he did not recommend a Conditional Use Permit. It should be under a Zoning classification. There is a concern with the Tax base with the land and non-taxable revenue the City would get out of that concerns him. There is also going to be a on-ramp that cuts across the back of the property. Weber stated that as fora rezoning vs. conditional use permit, it was discussed with the Mayor and staff and it was recommended that a Conditional Use Permit be requested Because when zoning was changed the City would be open. Pat Joy clarified the recommendation. This was to come in fora zone change and Conditional Use Permit. Weber stated that on the Tax base they understood the feelings of the_City. Their response is even though the property itself is not a profit making operation, the City will still see some revenue generated because people from Mountain Home to Weiser will be coming to this facility. They will be. buying gas, ect. with the sales tax being picked up. Glaisyer inquired what a trade store is. Weber stated that it is kind of a large furniture store. It is called Deseret Industries and it is a store that employs handicapped persons. They sell new and used items - similar to an oversized thrift store. Glaisyer inquired where the location is and if they would be on City sewer and water. Weber replied that is correct - a site plan was reviewed. Hosac stated that they were for it. Storey commented that is is expensive land that will nearly all be Commercial and though they would build in a place that would make them more money by selling the land than building in that particular spot. That is good Commercial land.. Weber stated that as a professional, he would agree with that assessment._ He was - -- - hired to provide dra~aings for the Church. Other members of the Church are present and perhaps they would like to respond. Dr. VarSelle Weaver, Area Welfare Administrator for the Church, explained the Facility. ';+ It is a Welfare facility to take care of the poor and needy that are in the area. Deseret Industries would hire about 100 people. These people would be handicapped ;'yg people from the area who cannot get gainful employment in town or are too old to i~' work normally. Goods are donated by stores or people, refurbished and sold at a +~ . reduced price. Many people in Meridian would benefit from that - they say about ~ , ~- twice as many non-members buy from Deseret Industries as do members. It is usually ~*"* the low income people who cannot afford. Weaver stated that they bought in the Deseret Industries Store in Boise last week, ''' a baby seat for their daughter for $1.50 that would cost $24.00 in a store. It was donated by somebody and they put it out fora good price. DeseretIndustries in Boise, which is overgrown, is going to be moved out here if they have this facility. Last month it did $46,000 worth of business in small items - it is one of the nicest stores in town. ARTICLE I PROPERTY USE RESTRICTIONS All of the above described real estate, including lots, parcels and tracts thereof, and any conveyance covering or describing all or any part thereof, either by reference to the above described plat or by any number or designation thereon, or by any other description shall be subject to the following restrictions, covenants and conditions, and that by the acceptance of any such conveyance, the Grantee or Grantees and their heirs, executors, administrators, successors and assigns, covenants with the undersigned,-its successors and with each other as to the property above described the following: Section 1. Land Use. All of the lots in said subdivision shall be known and described as residential lots, and said lots or any part thereof, shall not be used for commercial purposes. The use of said lots shall be limited and restricted to single family, two-family, three-family, and four- family dwellings which shall not exceed two stories in height, and an attached, semi-detached private garage or carport. Section 2. Architectural Control. No building shall be erected, placed or altered on any lot until the construction plans and specifications and a plat showing the location of the structure have been approved by the Architectural Control Committee as to quality of workmanship and materials, harmony of external design with existing structure, and as to location with respect to topography, finish grade elevations and minimum building setback lines, No fence or wall greater in height than three feet shall be erected, placed or altered on any lot nearer to any street than the minimum building setback lines unless similarly approved. (a) Architectural Control Committee. The Architectural Control Com- mittee is composed of A majority of the committee may designate a representative to act for it. In the event of death or resignation of any member of the committee, the remaining members shall have full authority to designate a successor, Neither the members of the committee, nor its designated representative shall be entitled to any compensation for services performed pursuant to this declaration. At any time, the then record owners of a majority of the lots shall have the power through a duly recorded written instrument to change the membership of the committee or to withdraw from the committee or to restore to it any of its powers and duties. TERRA SUBDIVISION - Pag~ • (b) Procedure. The committee's approval or disapproval as required in these covenants shall be in writing. In the event the Committee, or its designated representative, fails to approve or disapprove within 30 days after plans and specifications have been submitted to it, or in any event, if no suit to enjoin the construction has been commenced prior to the completion thereof, approval will not be required and the related covenants shall be deemed to have been fully complied with. Section 3. Dwelling Cost, Quality and Size. (a) No single family dwelling at a cost of less than $40,000 plus lot cost based upon cost levels prevailing on the date this declaration is recorded, shall be erected or placed on any building site and the floor area of the main structure, exclusive of one-story open porches, terraces and garages, shall not be less than 1350 square feet for a one-story dwelling, nor less than 1700 square feet for a split entry or two-story dwelling. (b) No two-family dwelling at a cost of less than $48,000.00 plus lot cost based upon cost levels prevailing on the date this declaration is recorded shall be erected or placed on any building site and the floor area of the main structure, exclusive of open porches, terraces and garages, shall not be less than 1600 square feet. (c) No three-family dwelling at a cost of less than $66,OOO,plus lot cost based upon cost levels prevailing on the date this declaration is recorded shall be erected or placed on any building site and the floor area of the main structure, exclusive of open porches, terraces and garages, shall not be less than 2400 square-feet. (d) No four-family dwelling at a cost of less than $75,000 plus lot cost based upon cost levels prevailing on the date this declaration is recorded shall be erected or placed on any building site and the floor area of the main structure, exclusive of open porches, terraces and garages, shall not be less than 3200 square feet. (e) It being the intention and purpose of the covenant to assure that all dwellings shall be of a quality of workmanship and materials substantially the same or better than that which can be produced on the date these covenants are recorded at the minimum cost herein for the minimum permitted dwelling size. Section 4. Building Location. (a) No building shall be located on any lot nearer than 20 feet to the front lot line. (b) No building shall be located nearer than 5 feet to any interior side lot line or 20 feet to any side street line. No dwelling shall be located nearer than 15 feet to the rear lot line. Where a garage or other accessory structure is not part of the dwelling house, no portion of the garage or other structure shall be nearer the front or street line than the rear line of the house. Section 5. Building Materials. All buildings erected upon any lot shall be of stone, brick, frame construction and, if other than brick or stone is used, such building shall be finished painted and maintained in good repair so as to be inoffensive to any other property owners in said subdivision. Section 6. Work Prosecution. The construction of all dwellings and outbuildings shall be prosecuted diligently and continuously from the time of commencement thereof, and same shall be completed, including exterior painting within eight months after the date of commencement of construction unless such completion is prevented by causes beyond the control of the Grantee. Section 7. Temporary Structures. No structure of a temporary character, trailer, basement, tent, shack, garage, barn or other outbuildings shall be used on any lot at any time as a residence either temporariiy or .permanently. Section 8. Moved Buildings. No building shall be moved onto any building site unless specific permission and approval of plans, specifications and location is obtained in writing from',.the Architectural Control Committee. Section 9. Nuisances. No nosious or offensive activity shall be carried on upon any lot, nor shall anything be done theron which may be or may become an annoyance or nuisance to the neighborhood. Section 10. Animals. No lot or portion thereof, shall be used for the keeping or pasturing of goats, sheep, swine, horses, cows or other non- household animals. Dogs, cats or other household pets may be kept, provided that no animals are kept, bred or maintained for any commercial purposes. Section 11. Signs. No sign of any kind shall be displayed to the public view on any lot except that the name of a resident of a dwelling upon a lot may be displayed on a sign of not more than one square foot in area. The Grantor reserves the right to display signs upon lots advertising the property for sale or rent, and signs used by builders.to advertise the property during the construction and sales period. Section 12. Fences. No fence, hedge or boundary wall situated upon a lot shall have a height greater than six feet above the graded surface of the ground around which such fence, hedge or wall is situated. The construction or maintenance of spite fences or spite trees or shrubs shall be prohibited upon all lots in this subdivision. All wooden fences shall'be constructed in a substantial manner, and shall be painted an attractive color and be maintained in good repair so as to be inoffensive to any other property owners in said subdivision. Continued TERRA SUBDIVISION - Page • Section 13. Oil and Mining Operations. No oil drilling, oil development operations, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavation or shafts be permitted upon or in any lot. No derrick or other structure designed for use in boring for oil or natrual gas shall be erected, maintained or permitted upon any lot. Section 14. Water. The Grantors will deliver domestic water to the point where the water meter is located at the property line. Each lot owner shall connect to this water system at this point and use this water for their domestic use. Grantors are under no obligation to deliver irrigation water to any lot in this subdivision. However, each lot owner may avail himself of the irrigation water for those lots that are within the existing irrigation districts, subject to the payment of any and all dues and assessments for the use of said irrigation water. Additional irrigation laterals may only be constructed in the easement area that is provided along each lot line. Where it is necessary for a lot owner to obtain water over and across another lot and maintain the necessary irrigation lateral through the easement area only, as herein provided and as well as shown on the recorded plat across the lot owner's property. Section 15. Sewage disposal. All bathroom, sink and toilet facilities shall be located inside the dwelling house or other suitable appurtenant building and shall be connected by underground pipe with a private sewage disposal system placed and constructed in accordance with the regulations of the governing health authority. Private sewage disposal systems shall be placed in the front yards. Drainage from said private sewage disposal system shall be kept within the building limits of each lot. Approval of all sewage disposal systems installed shall be obtained from the governing health authority, and the Grantor shall have no obligation to construct any sewer or provide any connec- tion thereto. The sanitary facilities of any dwelling shall, within nine months after activation of the dry line sewer, be connected thereto, and the grantee agrees to pay all applicable connection fees and monthly charges. Section 16. Garbage and Refuse Disposal. No lot included within this subdivision shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste material shall be deposited only in sanitary containers meeting the requirements of the sanitation ordinances of the County of Ada, State of Idaho, and the regulations of the ordinances of the State of Idaho Health Authorities. No machinery, appliances or unsightly material shalt be stored upon a lot until a Grantee is ready and able to commence the construc tion with respect to which such building material shall be used, and then such building material shall be placed within the property lines of the lot upon which the structure is to be erected. Section 17. Driveways. Any driveway constructed on any of said lots shah. be of 4,000 psi; 4" thick air-entrained concrete and shall be connected to the curb at the edge of the street in a manner that it will not disturb the drainage pattern created by the street and curb section. Sidewalks, To preserve the aesthetic quality and living style intended by the Grantor, standard four foot concrete sidewalks shall be constructed by the Grantor adjacent to the back of the curb for the full width of each lot prior to the time the dwelling is occupied. Zn order to avoid unnecessary breakage, sidewalks need not be constructed by the Grantor until the dwelling is constructed. Sidewalks shall be of 4,000 psi; 4" thick air-entrained concrete. ARTICLE II EASEMENTS Easements are reserved for installation and maintenance of utilities, irrigation and drainage facilites five feet in width on side lot lines and five feet in width on front and rear lot lines. Within the easements no structure, planting or other materials shall be placed or permitted to remain which damage or interfere with the installation and maintenance of utilities or which may change the direction of flow of water through drain- age channels in the easements. The easements area of each lot and all im- provements in it shall be maintained continuously by the owner of the lot, except for those improvements for which a public authority or utility company is responsible. ARTICLE III GENERAL PROVISIONS Section 1. Term. These Protective Covenants and Restrictions shall run with the land described herein and shall be binding upon the parties hereto and all successors in title or interest to said real property or any part thereof, until January 10, 2020, at which time said Protective Covenants and Restrictions shall be automatically extended for successive periods of ten years unless the owner or owners of the legal title to not less than one-half of the platted lots, by any instrument or instruments in writing, duly signed and acknowleged by them, shall then, terminate or amend said Protective Cove- nants and Restrictions, and such termination or amendment shall become ef- fective upon the filing of such instrument or instruments for record in the office of the Recorder of Ada County, Idaho. Such instrument of instruments shall contain property reference by volume and page number to records of the Deed in which these Protective Covenants and Restrictions are set forth and all amendments hereof. Section 2. Amendments. These Protective Covenants and Restrictions may be amended from time to time with respect'to any part or portion providing the owners of at lease one-half of the platted lots, as of the date of said amendments execute such amendment duly made and reduced to writing as, pro- vided in Section 11, herein. Section 3. Violations and Enforcement. Should the Grantees, their heirs, personal representatives, successors or assigns, violate or attempt to violate any of the covenants or restrictions set forth before the. termination thereof, it shall be lawful for any person or persons owning any other lots in said development or subdivision to prosecute any proceedings at law or in equity against the person or persons violating or attempting to violate any such covenant or restrictions, and either to prevent him or them from so doing or to recover damages or other relief for such violations. The invalidation of any one of these covenants by judgment or court order shall in no way effect any of the other provisions, which shall remain in full force and effect. ';, •, Williams stated those are maximums, the higher density would be available with amenities to the City. It is a double sided coin. Traffic flow is a concern.. Osier asked if there were alternatives that the Council could suggest. They will be nice units, 1040 feet per unit. The general area was discussed. Welker stated that he would have to review the plat. Glaisyer inquired who. would maintain the open areas. Osier stated the owners. Glaisyer stated that he liked the plan, it is one of the better Four-plex plans- that has come through here. Covenants should be submitted. Kingsford stated that they look better than what is out there. Williams stated that they have seen concepts before, once the plat is approved they are built different. Osier inquired if they could be approved contingent upon ultimate approval of the covenants. They could include a minimum square footage which would preclude putting anything less than whattheypromised to do. Storey stated that Stuart and Welker should review and comment and inquired what Planning and Zoning commented. Joy read the P&Z motion. Bob Jones stated that the units they propose will be better units if the density is higher. Storey stated that the overall plan should be looked at-the number bf units per acre should/influence every subdivision plat that comes before City Council.. not Welker stated that they are large blocks and Idaho should be dontinued. ' Osier stated that they have larger lots than is out there. Storey stated that they should'ntbe compared with what is out there. City requirements on submitting a plat were discussed. Osier stated that they did not have a copy of the plat last time and the Council did not want to act on a drawing. They were not on the Agenda and were asked to come back tonight. As far as the concept and what they planned they were in favor of - the whole question centers around the fact of whether it was eighteen (18) or twenty-four (24) units. They are trying to establish if what they are looking at is feasible or if not, they will have to change their plans. They are asking if the plan is acceptable. The Mayor stated that this was presupposing and would set a precedent. Rod Medley, I am the presiding overseer of the Jehovah Witnesses here in Meridian, for several years now we have had a traveling representative that comes through from time to time and most of the time he has a trailer and with permission of the City, he has parked there temporary, maybe five or six weeks out of the year, we have a new arrangement under the traveling MERIDIAN CITY COUNCI~ • OCTOBER 2, 1990 PAGE # 4 overseer that he would like to leave his trailer here at our Kingdom Hall here in Meridian on a permanent basis, most of the time it will just be stored there and then he will be in from time to time to stay in it for a week or a weekend, it is a 30 or 35 foot Holiday Rambler TRailer, it is a nice looking unit, from the front of the Kingdom Hall and the street you cannot see the trailer, it set behind the wing as you are traveling west on Broadway you cannot see the unit. We would like to have the City approve leaving the trailer there on a permanent basis. Myers: Is that hooked up to City water & sewer? Medley: Yes, it is, we have a regular hookup there, which we put in about 1973 when we built the Hall. Giesler: This is an RV type trailer? Medley: Yes. Giesler: Wouldn't that be a violation of our Ordinance? Somone staying in a RV unit. Attorney: In essence it is a mobile home, even though it is a RV, it is used as a residence, I think it falls within our mobile home, which requires them to be parked within a mobile home park, they would at least have to have a Variance. Giesler: It is hooked up to water & sewer, I think it would require a Variance request.The thing I am getting at here is if we allowed some- thing like this we would be setting a precedence, someone could pull one in and put their relatives in there for periods of time, behind their homes or etc. it could maybe really get us into a jackpot and I am not certain I am really in favor of permanent type basis. I am not sure how the Ordinance is worded but they can do this for like 72 hours or such. I hope you can see where we are coming fram, we could get a number of people asking for the same thing. Medley: What if we disconnected it while he is not staying in it, he will only be there from time to time? Giesler: If you kept it for the storage and within the Ordinance, I don't think there would be anything we could do about it, but 72 hours I think is the maximum on it. Myers: I don't think it would make any difference whether you disconnected it from the sewer & water, if you were just storing it there, whether it was hooked up or not wouldn't make any difference, as long as someone was not living in it. That is what you are talking about is if someone is living there more than 72 hours according to the Ordinance. Whether it is hooked up to water & sewer, I am not sure the Ordinance speaks to that does it Counselor? Counselor: I have not researched it but I think there is, if it is used as a residence whether it is used throughout the year, whether it is on a two week basis, you know every other two weeks or once a week out of the month it is still a residence same as if someone was in an apartment or a home, some people live in their homes during the summer and leave in the MERIDIAN CITY COUNCI~ • OCTOBER 2, 1990 PAGE # 5 winter. I don't think there is much difference between that and this, I think it would have to be looked at as a mobile home, if he is going to reside in it. I would have to look at it further because I did not research it but I do not think it would be appropriate now to grant it without further investigation. Tolsma: We have granted temporary for office space and classrooms for up to six months. Giesler: That was for storage or etc. not to live in. There was more discussion. Myers: Maybe we ought to have the Counselor do some research on this and on the Ordinance and see what it says before we do one thing or the other at this point & time. Maybe table it until the next Council Meeting. Would that be satisfactory to you folks at this time? Medley: Yes, that would be fine, I have a question though can we leave the trailer there until the next meeting? Myers: I would think so. He would be working under the same fee structure as Mr. Swartz. Broadway be granted the use of a trailer house for a fifteen day period from August 1st to August 15th. If the people of Meridian want flouirde in their water, then it should be put on a referendum and voted upon. Kingsford agreed.
