0 February 22, 1990 Mr. John Navarro 1200 West Pine Meridian, Idaho 83642 0 Re: Property Line and Proposed Easement Dear John: In accordance with your letter of November 30, 1989, I have provided to you copies of a quitclaim deed and a sewer line easement which should adequately address your concerns expressed in your letter. The City of Meridian has dictated and passed upon the sewer line easement as written, and therefore the various requirements set forth in your letter have effectively been met by the terms of the easement. Please note that the City of Meridian requires the sewer line to be eight inches, which according to my engineer is sufficient for 500 homes. I agree that the ground within the easement will be restored to the same condition that it was prior tD the construction. We will remove the top soil first, and keep it separate from the other soil. Compaction will be 98 percent. Top soil will be replaced last, and will be wheel -rolled and water settled. I agree to pay and be responsible for all costs and liabilities relating to the construction of the sewer line across your property. I agree to indemnify and hold you harmless for any actions relating to the construction of that sewer line. Finally, I have been told that no reimbursements will be payable under 7-527A since future expansion would not result in oversizing the sewer system. Therefore, the City of Meridian will not write an arrangement where any reimbursement resulting from 7-527A would be payable to you or me. Howard, Wilma Blair, Gary Smith, Bill Gordon, Wayne Skiver, Moe Alidjani, Paul Stutzman, John Navarro, Peter Covino, Colleen LeMay, Howard Jenkins, Clint Shuler, Wayne Crookston: The Motion was made by Tolsma and seconded by Giesler to approve the minutes of the previous meeting held November 21, 1989 as written: Motion Carried: All Yea: ITEM#1: PUBLIC HEARING: FMLIMIMRY PLAT OW -- Mayor Kingsford opened the Public Hearing and asked for public testimony, please come forward and be sworn. John Navarro, 1200 W. Pine, was sworn by the Attorney. Navarro: I have a couple of questions I would like to ask. There comes a possibility of encrochment, the engineer had surveys taken 6 feet over onto my property. Also wanted to know whether the developer is going to put in pressurized irrigation and whether the ditch along Pine Street will be tiled. Jim Howard from J.J. Howard Engineering, was sworn by the Attorney. Howard: I am here representing Mr. Jenkins. Mr. Navarro owns the ground to the west and there is a fence line in there approximately 6z foot, we set the fence based on a section break down, the fence fell 6, feet west of his fence line, and to the north it would be in the northwest corner of our subdivision about 3. This subdivision plat reflects the adjustment. To answer the second question about tiling the ditch that runs parallel with Pine, do you have a Ordinance stating that all ditches be covered? Kingsford: No, not as this time. Howard: In the past he has tiled them, but I am not going to respond to that question. Kingsford:I have a question for you about the pin placement, when you addressed the pin placements you said that the pin placement was 6 feet west. Howard: Six feet west of the existing pins which falls on the ground of Mr. Navarro. We will pull those pins back to line up with that fence so we don't have a dispute. Tolsma: You said that the irrigation ditch was on the south side of the property. Howard: It is on the south line, our property fronts Pine and there is an open irrigation ditch that will have to be continued, and I image that Howard will elect to tile that. Kingsford: The other question that Mr. Navarro had was with regard to pressure irrigation system and of course the Council has adopted a measure now that irrigation systems will 0 0 MERIDIAN CITY COUNCIL DECEMBER 5, 1989 PAGE #2 be low head irrigation systems in the subdivisions. Have you made any provision for that. Howard: Mr. Jenkins will respond to that. We are in fact going to take the storm water thats generated in this subdivision, we are going to have a dropin on both sides of the street, the subdivision will drain, all storm water will drain directly south out to Pine. Tolsma: There is also a irrigation ditch on the north side of the property, will that be tiled also. Howard: Yes. Kingsford: Is it your opinion that tiling that would remedy that situation. I heard some concern that it didn't have the capacity on down the ditch to handle that. Howard: The pipe on Pine is 12" and on the north boundary of our property the ditch that he was speaking to is also 12", but I'll recommend to Howard that we go with 15" and that we use plastic pipe. Howard Jenkins, Pearl Route, Eagle, Idaho, was sworn by the attorney. Jenkins: Will be willing to resolve the conflict of boundaries. Will tile ditch along Pine as well as ditch on north boundary. We're not bound to pressurized irrigation? Kingsford: Yes, I don't know how it's timing was in relationship to your filing, but not being a preliminary plat approved I would assume without legal advice that it would be in effect. Jenkins: We have provided this for other areas and it has not been adequate. We will try to drill a well and pressurize it. Howard: There will be a change in the plat, we would like to take this lot 4 and take that with the east line as before and project that straight forward. We create another lot and the purpose behind that is we have the option as possibly using that as a well lot and also to sell it to the gentleman to the south by doing this in the platting procedure we don't have to go through a re -platting. Morrow: One question on Blk 3 Lot 5 what did you perceive to be buildable on Lot 5. Howard: It would be the existing Lot 4, just extend the line. Kingsford: How are you going to meet any kind of a set back on Lot 5. Howard: I'll take a look at that. Kingsford: Is there any one else that would like to offer testimony. Being no response the Public Hearing was closed. Morrow: It's nice to be doing business with someone that has his neighbors best interests at heart. Motion Carried: All Yea: ITEM #2: RESTRICTIVE COVENANTS ON GEM PARK SUBDIVISION: Kingsford: Councilmen you've had those covenants for review are there any questions or comments. There was some discussion on this. (Tape on file) The Motion was made by Morrow and seo:rr19d ty Myers to approve the covenants on Gem Park Subdivision with the exception of striking Page 5 Paragraph 8 Section C. Motion Carried: All Yea: ITEM #3: CONDITIONAL USE PERMIT FOR PETER COVING, TABLED AT LAST MEETING: Morrow: I have reviewed the letter signed by this real estate agent and it doesn't appear to me that that letter indicates or takes a position that guarantees the City anything. In terms of our historical problems with Mr. Amyx and the fact that he has taken alot of our time and alot of our money and the court systems time and money to force compliance to things he has agreed to in the past, I don't see that this letter gives us a guarantee to accomplish what we'd hope to accomplish. I am sympathetic with Mr. Covino who is trying to start a business but I don't see where the City should make any exceptions. Giesler: I feel basically the same way. We don't have anything in front of us as far as diagrams or anything to assure us as to what is going to happen. Kingsford: I had some concern in the first paragraph the comment by Mr. Amyx. I'm not sure that that's going to improve the statute of that building. I drove by there after work this evening and it appeared to be about 15 to 20 vehicles outside again. In terms of his meeting a compliance, the deal we've got from Mr. Amyx is in violation of that. The Motion was made by Tolsma and seconded by Morrow to approve of the turn off list with the exception of Wilma Blair. • Howard Jenkins 10332 Fairview Ave. Suite 201 Boise, Idaho 83704 JOHN NAVARRO 1200 West Pine Meridian, Idaho 83642 November 30, 1989 Re: Property Line & Proposed Easement Dear Howard: We have talked on previous occasions about my granting an easement for sewer purposes across my property so as to allow you to move ahead with your proposed development directly east of my ground. However, there is one matter that must be dealt with before any easement can or will be considered. Your surveyor has placed survey pins on the west end of (apparently) your legal description. These pins encroach upon my property line which is determined by a fence line which has been in continuous existence for well over 30 years. As you well know that in an instance such as this, the fence line governs and as such you must agree that your west line is along the existing fence and is not as your surveyor has marked it. To clarify this, it will be necessary for you to deed to me that portion of property which is west of the fence line which your surveyor apparently believes.to be covered by your legal description. If this is not done or some other satisfactory arrangement reached there will be no discussion of an easement. Assuming that you acknowledge and agree that the property line is governed by the fence line and that you have no claim to any property west of my fence and are willing to execute the necessary documents to this end, I will outline my thoughts regarding the proposed easement. Since our last correspondence i have done some additional checking on the proposed easement and how it relates to the City of Meridian. As I am sure you are aware, the actual easement would run to the City of Meridian. Anytime that a sewer line is placed in the City it then becomes the property of the City and as such, the easement, if given, will run to the City. 0 0 The whole purpose in my being willing to grant this easement is that it will eventually be of benefit to my property should I at some later time want to sell it for development or develop it myself. Therefore, as a specific condition of the easement, the trunk line that is placed along the easement must be such that it will not only handle sewer from your property but also be large enough that when it is used in conjunction with development of my property that it will handle the sewer from my property. My engineer informs me that in order to accomplish this it must be at least 10 inch. Further, the City must also pass on the size of the line, taking into consideration the ultimate use of the line by both my property and your property or possibly other properties that the City may want to take into consideration. I believe that it goes without saying that the line must meet all City, Ada County, ACHD and state requirements. Other conditions relating to the easement are as follows: 1. The easement must be located with its center line approximately 145 feet from the northern boundary of my property. 2. The easement would be 20 feet in width. 3. The City will probably want a temporary construction easement wider than the 20 feet and I would be willing to grant this condition on its' lapse once construction is completed. 4. The ground within the easement must be restored to the same condition that it was in prior to construction. This would call for the top soil to be removed first and kept separate from the other soil. Compaction must be 988. The top soil would be replaced last and it must be wheel rolled and water settled. 5. The'line must be constructed with manholes located at the extension of 11th and 12th streets. These manholes must include short stubs to the north and south. My recollection is that I have previously informed you orally of these conditions. The City may want to add additional conditions, which is certainly their right but the conditions set forth in this letter are my conditions for granting this easement and must be met whether the City requires them or not. As I understand the City's CO-OPERATIVE AGREEMENT (7-527B) it is possible for the agreement to be written so that any reimbursements (resulting from 7-527A) relating to my property would be mine. If we did it that way then I would be in a position to either accept or waive any of these charges. Therefore I specifically request that this be part of any arrangement between us and yourself and the City. 0 0 It must also be agreed that you pay and be responsible for all costs and liabilities related to the construction of the sewer line across my property. This would also include insurance and a hold harmless and indemnification agreement executed by you in my favor. In addition, it would be your responsibility to have your engineer write the center line easement description for the sewer line beginning at the center line of West State Street at the Leisman Addition and extending to the West center line of West State Street at the Jenkins Subdivision. Needless to say, our correspondence amounts to preliminary discussions and assuming that we should reach an agreement, this must be reduced to a written agreement, before anything is binding between us and this agreement must be signed prior to the granting of any easement as well as any construction. Rountree: Did you address the comments from the City Engineer? Parker: Yes we have and we have a revised copy of the plat here that reflects those comments, Parker presented this to the Commission. Rountree: Have you officially withdrawn your request for a Conditional Use Permit? Parker: Yes, we have we are not wanting to develop a duplex lot: Hepper: You have reviewed all the comments from the other agencies? Parker: Yes we have and we have no problems with any of those: Chairman Johnson: For the record we want to acknowledge that you have withdrawn the Conditional Use Application for a duplex on lot 1: Parker That is correct: City Attorney: The City has recently passed an Ordinance requiring pressurized irrigation systems, have you addressed that or thought anything about that? Parker: We can look into that, we have irrigation out front but there may not be enough water that we would not have to drill a well in order to provide that, I would like to see what the requirements are prior to seeing how much it would cost and how effective it would be to install a pressurized system City Attorney: I just wanted you to be aware that this was passed. Vern Allman, 101 East Ustick load, Allenan was sworn by the City aTtorney: Alleman: My concern would be the irrigation systen,and the reason I am concerned is that I have ran into some problems as to whereby I have been the one that is beyond the new subdivision and I wonder haw they are addressing this problem as the people beyond the subdivision have the people in the subdivision just going in and taking the water whenever they wish. There needs to be a definate turnout for the subdivision with a measuring device so they cannot take the water that should be flawing on to the people beyond the subdivision. There was discussion on this item: Chairman Johnson: Is there anyone else from the Public who wishes to comment on this application, there was no response the Public Hearing was closed. any cannents or questions of the Commission? Alidjani: What would you think about Mr. Allenans concerns about having some control over who is using the water, what are your plans regarding irrigation water? Parker: The one we have completed before had boxes where they had to take the water out of the lateral. Motion Carried: All Yea: Item #2: Public Hearing: Request for Conditional Use Permit by Amyx Family LTD & Peter Covino, JR. for Recreation Facility at 27 East Broadway: Chairman Johnson: Is there a respresentative present, if so please came forward, state your name and be sworn by the City Attorney: Peter Covino,Jr. , 4260 Venture Circle, Meridian, Covino was sworn by the City Attorney: Covin: I am going to give the Commission Members a small hardout that describes this type of game, this describes the concept of the game, this game has been around since the late seventies, the guns themselves were invented by surveyors, the gun itself is a bb gun, it uses a co2 cartridge just like any bb gun you buy at any store, the difference is the barrell is large and the projectile is large also, a little bit larger than a regular marble, it is soft it is full of paint, a water solvable paint that washes out of your clothes, the object is when it hits you it breaks and you are marked, same statistics people might be aware of since in this area it is not to well known, it is played currently in your city and in the parks and around the foothills by a comber of people who use it just as it was designed and the way it is designed it is the old game that Boy Scouts and Cub Scouts play called capture the flag,.except here c....bead of tagging them or catching then they shoot then with the paint pistol instead. The association that is connected with this releases and helps put together various magazines that are quite popular, there is even an official rule book that was put out back in 1981 on how to play the game. My comments are as follows: 1. The drain line you are proposing to use at the northwest corner of the subdivision is not functioning as it should. Your developer will need to see that the line is clear prior to connection. Also, ACHD will need to accept responsibility for maintenance of this proposed system. 2. The sewer line extending west from this subdivisions west boundary(West State St. extended) needs to be in a permanent 20 foot wide recorded easement in favor of the City of Meri- dian. 3. The depth of the sanitary sewer on West 11th St. and West State St. shall be sufficient to serve the property east of this development and to pick up the flow from the man- hole on West 11th St. located between W. Washington and W. Carlton Ave. 4. The right of way width for all streets shall be 50 feet. 5. A six (6) inch diameter water line shall be installed from W. State St. north to Washington. The City is respon- sible for off-site costs. 6. Extend W. State St. to this subdivisions eastern bound- ary for future extension. My comments are as follows: 1. The drain line you are proposing to use at the northwest corner of the subdivision is not functioning as it should. Your developer will need to see that the line is clear prior to connection. Also, ACHD will need to accept responsibility for maintenance of this proposed system. 2. The sewer line extending west from this subdivisions west boundary(West State St. extended) needs to be in a permanent 20 foot wide recorded easement in favor of the City of Meri- dian. 3. The depth of the sanitary sewer on West 11th St. and West State St. shall be sufficient to serve the property east of this development and to pick up the flow from the man- hole on West 11th St. located between W. Washington and W. Carlton Ave. 4. The right of way width for all streets shall be 50 feet. 5. A six (6) inch diameter water line shall be installed from W. State St. north to Washington. The City is respon- sible for off-site costs. 6. Extend W. State St. to this subdivisions eastern bound- ary for future extension.
