Orchard Ave., Suite 305 Boise, Idaho 83706 Dear David: Re: Meridian Meadows East Subdivision I have reviewed the preliminary plat and sewer-water utility plans you submitted for this project and I have the following comments: 1. The 8th line callout of the detailed property descrip- for the preliminary plat relates to the annexation boundary, not the preliminary plat boundary. as shown. 2. The street alignments shown do not provide adequate access to lots in the northeast area of the subdivision. There needs to be more than one way in to a lot that is nearly 2,000 feet from Locust Grove Road. I have shown some revisions to the alignments, for your consideration, on the enclosed blueline. 3. One-half width right of way on Locust Grove Road (Sec- tion line) must be 40 feet in accordance with our City Transpor- tation Committee Policy. 4. We continue to hear from corner lot owners that they don't have adequate backyards. To this end we receive variance requests for placement of 6 foot high fences at the back of side- walk. Most of the time this is a difficult situation because of required vehicle sight distance at-the adjacent intersection. Corner lots should be larger than interior lots because of the front and side street set-backs. 5. Lot 20-Block 5 will be difficult for buildings because of its shallow. depth. 6. A preliminary plat has been filed with the City of Meridian, and approved, for 10 acres bordering the south bound- ary of this project. Provide a stub street to connect to the stub previously provided by the preliminary to the south. 7. Presently a private drive, Dixie Lane, exists along a portion of this projects east boundary. This needs to be addressed. Page 2: Meridian Meadows East Subdivision 8. Water lines need to be looped to provide better service and less disruption when lines have to be shut down for service. Also, hydrant locations need to be shown. 9. The sewer and water lines need to be kept within the dedicated road right of ways for our service purposes. 10. Water, and sewer lines where practicable, shall be extended through the subdivision for continued extension by adjacent land owners. 11. Live water drainage and irrigation ditches need to be piped through the subdivision. This needs to be shown on the preliminary plat. The City is endeavoring to initiate requirements for subdivisions to provide low pressure irrigation supply to each lot. We need to discuss this situation with you in more detail. 12. Street light locations need to be established at approximately 350 foot centers. 13. Street names need approval- from the Ada County Street-Name Committee. Our Fire Marshall has expressed concern over the number of names containing the word "Meadow." This can cause problems during intense emergency calls. Please call if you have any questions. Chateau Meadows East is a 224-lot subdivision on 58-acres located east of Locust Grove and north of Fairview. 2. Locust Grove has 50-feet of right-of-way by prescriptive use and is improved with 24-feet of paving. It is designated a minor arterial requiring 66-feet of right-of-way and 52-foot street section. 3. Chateau Drive west of Locust Grove is considered a mid-section collec- tor. 4. The following items on the plat submitted are not indicated, so it is unknown if they meet District standards: (1) Property lines in cul-de-sacs: Cul-de-sac property lines require a minimum of 56-foot radius. (2) Right-of-way widths of all streets: a. Locust Grove - 33-feet is required from section line; b. Collector streets - 60-feet required; Chateau is designated section collector; c. Local streets - minimum right-of-way for public streets is 50-feet. 5. The following does not meet minimum acceptable standards: (1) Intersection of Chateau Drive with Locust Grove. Maximum devia- tion angle from the normal is 15°. (2) The intersections on Meadowglenn Way designated by C9, L8, C10 do not meet District standards for an "ell" intersection (Policy section IV-7, Section 2 - j). (3) The separation between the intersections of Laughridge and Meadowglenn does not meet policy, 125-feet (Policy IV-11, section 7 - f). (6) The intersection of Meadows Drive with Meadows Drive does not meet District policy (IU-11, section 2.j.). (7) The intersection of Meadows Drive and Meadow Rose does not meet District policy (IV-11, section 7.f.). (8) Green Meadow does not meet policy (IV-8, Section 2.k.). SITE SPECIFIC REQUIREMENTS: 1. Provide by dedication 33-feet of right-of-way from the centerline of Locust Grove abutting parcel. 2. Chateau Drive is to be designated a collector street through subdivi- sion. 3. All dedicated streets to be constructed and designed to ACRD standards and specifications. 4. Provide curb, gutter, 5-foot sidewalk, and match paving on Locust Grove abutting parcel. Provide 1/2 of a 52-foot back-to-back roadway section. STANDARD REQUIREMENTS: 1. All specifications, land surveys, reports, plats, drawings, plans, design information and calculations presented to Ada County Highway District are to be sealed, signed and dated by a Registered Profession- al Engineer or Professional Land Surveyor, in accordance with Idaho Code 54-1215. Z. Obtain written approval from irrigationldrainage jurisdiction for storm runoff into irrigation/drainage system(s). 3. Relocate all obstructions outside of the proposed street improvements.. He recommended approval as submitted. Commissioner Rhodes moved to approve the preliminary plat for Chateau Meadows East as recommended by staff. Commissioner Board seconded. Discussion held concerning the problems in- volved in approving bits and pieces of roadways; the need for a master plan; and the notice given to neighboring communities when development is planned. Gary Smith, City Engineer, City of Meridian, stated that the City of Meridian holds public hearings; those hearings are advertised to all adjacent property owners before a development is approved. He indicated that several property owners had expressed concerns about Dixie Lane, but not about Chateau. David Collins, Engineer for the Developer, 204 North Atlantic, stated that Chateau is the mid-section line road (extended} and will be built to a collector status. After further discussion regarding future development of adjacent properties, motion carried unanimously. Items 3, 4 and 6 - John Stolley presented subject items and recommended approval as submitted. REMOVAL OF PARKING - BROADWAY AVENUE - BOISE RIVER TO ROSSI STREET - Steve Spickelmier explained the history of the propos- al to widen Broadway Bridge as part of the Broadway Chinden Connector project which has been approved by the Federal High- way Administration. He explained the request to remove parking along Broadway Avenue based on the need for additional lanes as the bridge is constructed. Mr. Spickelmier explained the project in detail (copy of staff report attached) and stated that the improvement is needed at this point in time to handle the traffic that backs up on Broadway. Mr. Spickelmier noted that the project is scheduled to begin on August 24, 1989 and be completed by September 8, 1989• Discussion held concerning the scope of the project; the work hours; and the need for removal of parking in order to allow the construction. The parking removal would be effective the week the contract starts; property owners involved will be notified if and when the parking removal is approved. Commissioner Board moved to authorize staff to remove all on-street parking on Broadway Avenue between Rossi and the Boise River, effective upon com- mencement of the contract. The general area surrounding the property is used agriculturally with some residences. 5. That the property is adjacent and abutting to the present City limits. 6. The Applicants' Lee Stucker and Leonard Stucker are the owners of the property. 7. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 8. That the entire parcel of ground is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 9. This district delineates those areas where such development has or is likely to occur in accord with the Comprehensive Plan of the City of Meridian and is also designed to permit the conversion of large homes into two (2> family dwellings in well-established neighborhoods of comparable land use. Connection to the Municipal Water and Sewer systems of the City of Meridian is required. 17. That proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met; including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's property. 2. That the City of Meridian has authority to annex land pursuant to 50-222, Idaho Code of the Revised and Compiled Ordinances of the City of Meridian; that exercise of the City's annexation authority is a Legislative function. 3. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances of the City of Meridian have been compiled with. 5. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 6. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 7. That the annexation application has been initiated by the Applicant, with consent of the owners, and the annexation is not upon the initiation of the City of Meridian. 8. That since the annexation and zoning of land is a legislative function the City has authority to place conditions upon the annexation of land pursuant to 67-6512, Idaho Code, and Section 11-2-418(D) of the City Zoning Ordinances. 9. That the development of annexed land must meet and comply with the Ordinances of the City of Meridian and in particular Section 11-9-616 which pertains to development time schedules and requirements; that the applicant should be required to connect to Meridian water and sewer; that the property will be subject to Site Planning Review. 10. Don Bryan, 2070 North Locust Grove Road: Bryan was sworn by the City Attorney: Bryan: I am here to oppose the annexation, there are a lot of reasons-why, one thing I vould like to understand is , the fifty eight acre parcel that was started is this just a part of it this Final Plat? It was explained that the whole parcel was to be annexed and zoned but at the present time only a part of it would be developed. Bryan: On the irrigation in Item #9 of the Findings, it is possible that it is going to be greater density than is currently in existance in the surrounding area, to possible interference with surface irrigation and water rights, use of irrigation easements for possible access and to a possible change in life style for the current adjacent property aaners, when they start building in there how am I going to get my water, I would also like to know on Item #6 it states it would not be a shoestring annexation, what is a shoestring annexation? Mayor Kingsford: A shoestring annexation is one that is a very shall line,. in the State of Idaho you have to be corrtigous to the City Limits to annex, what is meant by a shoe- string annexation is not to just annex the center line to get there. Bryan: These are some bf my questions and also I think that Locust Grove itself cannot handle the influx of traffic so tam just hereto voice my opposition to thi§: Mayor Kingsford: While you are here, we might address your first concern in regards to irrigation, I will have the City Engineer comment on the regulations of interrupting irrigation water: City Engineer: The developer has to maintain the ditches through the property he is developing both on a temporary and a pernmnent basis, he has to conduct that water to you, if your ditches are interrupted by the development they have to be piped, they have to be rerouted whatever to conduct the water to you as you received it before developnent, the developer should be working with all water users to establish that it is a acceptable plan to everyone. Lee Stucker, 2530 N. Locust Grove Road: Stucker was sworn by the City Attorney: Stucker: I am one of the owners of the property so naturally we would expect that the property should be annexed argil the provisions of the developers granted. There are other reasons why I think it should be annexed, we are in the impact area, we are adjacent to the City Limits on two sides and if we anticipate for our children to be able to stay here, if they choose we must have growth, if we have industrial growth we must have residential growth to have these opportunities. Giesler: What time frame are you looking at before you wanted to get going on this project? Stucker: To my knowledge that has to be answered by the developers but they have shown interest in going ahead and doing considerable pre-work, surveying aril that type of thing, so it is their anticipation to move acrd move rapidly. Helen Sharp, 2425 Wingate Lane: Sharp was sworn by City Attorney: MERIDIAN CITY COUNCIL • • SEPTII~IBEI2 19, 1989 PAGE # 3 Sharp: Our property abutts up against the property in question, I want it on record that I am opposed to this subdivision and am opposed for several reasons, I am not sure that I agree with Mr. Stucker that we need industry here and we need housing to accamdate people if they are moving in industry. I agree with the traffic problem on Ir~cust Grove Road and I thuik it is to bad that there is not someone here fmn the Highway Department to address the situation on IociLSt Grove.I_also-see a problem on Faizview and Locust Grove, and if there are two-access off Locust Grove into a subdivision as opposed to having another exit, it is going to cause, I would think considerable problems. One of the issues that was brought up to me after the zoning meeting was the monies that would be available to the schools and the city because of the annexation and this I question also, granted there would be tax money and one of the issues is once the development-starts it' takes better than a year to get the tax money arm if anybody and i would like to know has many houses have been built and are now in the ~7eridian School systan that is between Meridian & Locust Grove-and Faiuview and Ustick, not-all of that is developed and there is to be more development there and there is to be-a school in ther~nd children in that area pass two schools to get to Joplin and were told they would have a new school within three years for their children. We are told we need schools for just the children we have naa. As far as industry we all know that the Industrial Park on Fa3xview has not done a thing. people have lost interest not only because we have a school probl t will discourage people fran crnung into the area, if we have a high density t they are proposing, 250 house in 58 acres, you know what that is going to do to the City and the SChoo1.I am also going to be-very blunt and straight forwarri after talking to a realtor this week he said it is a go, our imput would mean nothing. That was from a realtor in the City of Meridian and I would hate-to think these things are going to happen without the imput of the people of Meridian. We have been in Meridian several year and we like what we have here, we like the quiet country living, tfiat is why we moved out on Wingate Lane: I am for moving fonaarcl and progress but I am questioning this spot annexation to the City of Meridian.Because there are houses built on locust Grove that have not been annexed and I eras also informed that annexation canes about when people request it. I really feel spot annex is not going to help us. It says the water maintenance would be done and handled by the developer and my question would be for has long. After the project is completed who takes care of it? I really feel that though progress is not to be halted, this is not the time for two hundred and fifty muses in fifty eight acres right there in that area. Dale Shari, 292 Wingate Lane: Sharp sworn by City Attorney: Sharp: I attended the Planning & Zoning Meeting on this and was told by than that the only thing they could consider was whether or not what they were doing was legal, I said there was no sense of us being here because you are not interested in our input so they backed-off, I just want this on record, I am opposed to this subdivision especially with the speed in which it is being proposed, you have 238 houses and say four or five people per house and probably three of those will be children, that is really going to have an impact on our schools. The additional traffic is only. going to create more problans on Locust Grove, when-you get two accesses to Locust Grove fratt 258 Houses that is a considerable amount of traffic, they say this is the Highway District's problem,,I think it is the City of Meridian, if you are going to annex than, North Locust Grove beanies a City Street, does it not? Mayor Kingsford: It is still the Highway District, none of the Cities in Ada County' have their streets any more. Sharp: Doesn't Boise City? Mayor Kingsford: They do not have them, Kuna does not have than, we don't: MERIDIAN CITY COUNCIL SEP'PII~IDER 19, 1989 PAGE # 4 Sharp; Regardless it is going to create a real problem there, I have a sublateral that goes through my place on Wingate Lane which goes right into that subdivision and I question whether or not any development would continue that on ,you say they are responsible to ca?Y it down to the farmers and so forth. There is a road along the canal and I am really concerned that if you put a subdivision in there ,those subdivision people will be using that road.You-say that is my problan, that's my problem, but if you approve this annexation then you are making it my problem. As far as progress yes, but I question the spot zoning that you are doing here, You say you are only doing at requestthen that means that there could be a hundred acres right around the heart of the city and nobody request it might not be annexed for - fifty years.You cane down Fairview and there are open spaces. Dave Collins, 204 North Alantic, Boise: Collins was sworn by the City Attorney: Collins: i am the engineer for the developer, I thought I would address a couple of issues or answer any questions you might have about things that have been brought up this evening, at the present time we have developed the roadway Plans for the project which includes improvanents along North Locust Grove Road, working with ACFID and also working with your City F3zgineer to implement the Transportation Planning Ca[mittee's reamnend- ations fran the City of Meridian to provide for future widening of North Locust Grove, . at the present time that is minor arterial status, which rern,ires a 66 ft right-away, we will be providing a additional seven feet in reservation for future right-away. - the section in front of the subdivision will be Built with a full 33 ft right-away, which is two lanes of traffice plus curb, gutter & sidewalk the additonal-seven feet . will be landscaped and maintained by the home owners association until such time as it would be needed as right-away. The 58 acres all lies within the Urban Service Planning Area, the irrigation issue, I have been in contact with Nampa Meridian, the sublateral will not be effected in this phase #I: It will be at least a year before we mwe north to where that lateral is, we have discussed providing easements for this as well as intentions to engineer a piping system for this. The ditch on the south wanders on and off the property we are developing now, that will be maintained on a continous basis, Giesler: Would you have any idea when that road would be reconstructed? Collins: That would be up to Ada County Highway District: Giesler: Do you knot; whether there has been any study made on the intersection with Fairview Ave has long before there would be the possibilty of a light being installed? Collins: I do not know whether they have done traffic studires but I do knaa there is a given level of service they will achieve and then realize they need a signalization; at that location. Collins: One other point I would like to clarify,-it is 225 residential lots not 250: _ It is just belay four dwelling units per acre and it was r on a R-8 with the stiputalion by the developer that he would not request any duplex units in this So we are restricting it fran duplex units. The restrictions we received from the City, ACI-ID and Nampa Meridian we have no problans with. Morrow: Did that include consolidating sore of the Street Names, clarifing those with the Fire Department. Collins: Those have all been approved by the Street Name Ca[mittee. City Clerk: They have been approved by the Committe of which the Fire Department is a manber; MERIDIAN CITY COUNCIL SEPTE[~ER 19, 1989 PAGE # 5 Collins: We would be willing to look at the name issue, at the present time two of the names we carry in there are in alignment with an existing street name. Giesler: I see our Fire Department has not signed off that doc~unent_and whether they have approved it or not I would wish that it be signed off by than. Dan Wood, 628 Lawndale, Wood was sworn by the City Attorney: hood: Basically I just have sane questions, in phase I the drainage ditch, so far everyones talked about irrigation water, the drainage ditch to the south of this phase. What are you going to do there? Is that going to be piped? Collins: It will be piped about the last 160 to North Locust Grove. Wood: The Monroe property and my folks property, the Woods drain into the ditch-that runs parallell with the Hosac and the property you are going to develop.. Collins: It is the same thing with drainage, you cannot-cut off anyones drainage. Wood. Right naa it is hard to drain as is, with what you are saying I think; you will do phase I and maybe when you get done with phase II I assume then you will address the problan, is that correct? Collins: As we do the project: _ - Wood: Basically what happens if everybody has put fences up along there, are we going to go through the back of everybody's property aril put pipe through there? Collins: Actually most of the line lies on the Hosac property? Wood: The drainage ditch? Collins: Yes, where you plot the legal line not the fence: Woood: Then it would be basically whoever develops the Hosac property are the ones who will have to worry about it? Collins: we are not cutting off any available drainage to any land. Wood: The only ones it is going to effect~eally is it is going to effect the home owners in the respect that basically the water is going to drain that way no matter what._ It is going to effect than, if it is plugged up it will back up all over their yards. It sears to me it would be an issue that would have to be resolved whether it is Hosac property problem or +-his develogrnnt. With the way they are going to develop this property are they planning on enough capacity I guess for the interior develognent,_ the interior propertyin that arear meaning sewage and those type of things. City Engineer: Not the whole section of land, because it does not ail drain that way but it will have to be of such size that it will take to at least our urban service _ boundry, which is the middle section line. Mayor Kingsford: It is our policy to require a developer to oversize so that it will handle other properties. Wood: one of the things I read with the R-8 I understand the saner is going with this because the odd shape of some of the lots, there is basically with one of the people NIEftIDIAN CITY COUNCIL SII'i'II"18F~ 19, 1989 PAGE # 6 who previously testified is where You are ahaiigrng the zoning from farm ground to basically where You could have a duplex, I know the City cannot basical~lyr~ error the price of hones which you build on a lot so the only way the City _ canpensate for that is in size of the lot, so I~ es~st wa othe 1ots~would be 1ar+gere to see is that it did not have the R-8 Zoning, Y Meridian has got a fair share of lacer priced banes and I would think the City would encourage maybe higher Priced hares if at all possible; Mayor Kingsford: We do this, the issue and they are going to record-this on the Plat that they will not put duplexes, the issue is because of our' Ordinances mar ~R ,ill lot requires a certain amount of frontage, sane of those lots are irregul not meet thus requirements. So it was our Zoning p~ni.nstrator's advise that would be the easiest way to deal with it. Do not let than build more than four units per acre, you give than an R-8 Zone and then you handle that problem with regard to the frontage. Wood: So we will not-have to worry about any duplexes? _ Mayor Kingsford: No. _ City Clerk: It will be recorded right on the plat: Wood: I guess the other question and I am sure You have already discussed it like the_ City services, schools, fire-department, Police, everybody gave their input as to they can expand with the two hundred and so mt5re houses event-uatly? _ - . Morrow: I can address sane of your issue in regards to the Fire Department andlsare as the irrigation things, recently in regards to irrigation we ve ta..en the Po the City that each property aaners is responsible to make sure that the wr dceones~nocets ed flora down steam to the next Property if that property at an unemped still do make sure that service continues the City can send ~~ a le ce~lein on the not canplY then the City can have the the ditch cleaned and p property and collect with the property taxes. We have taken those steps because of problem in the older part of than. In terms of the Fire Department, I am the Fire Catmissioner what we have been involved with over the last six months with_the Rural Fire and the City is a long tens plan that should last 30 to 40 years denoting s four other-fire station locations, of one which we have already e4u~-recd plans and budgeting funds last year and this year towards our next fire trucks basically our Planning in terms of fire protection for the City of Meridhan~ and eater'. Meridian to and including the rural area pretty much have been acoa~ next several years. All the property which is currently annexed and zoned as well as property in our planning area are incorporated in those plans. So in answer to your'. questions yes they have been taken into consideration and have been covered. City Engineer: I guess the intent was to have it just 10 feet along the back of the sidewalk. I did not follaa the bearing of the street , I did not look at that, I did not position the driveway on the property to the south of you. Smock: If with pulling out with a Vehicle the line of sight is to the corner, wouldn't the line of sight follaa straight loan the fence, that would allay us to square it out. That the Application requests that the parcel be annexed and zoned R-8 Residential; that the present use of the property is for agriculture; that the applicant indicated that the intended development of the. property is for a subdivision for which a R-8 Residential zoning is required; however the Applicant testified that the objections pertained to the development of the property at a greater density than is currently in exis tence_ in _t he surrounding-area, to possible interference with surface irrigation and water rights, use o€ irrigation easements for possible access, and to a possible change in life style-for the current adjacent property owners: 10. That if the land were annexed at this time the City would be obligated -to provide, at a minimum, police and fire protection services. 11. That Meridian has, and is, experiencing a population- increase; that the number of residential building lots has significantly decreased in the last two to three years; that there are pressures on land previously used for agricultural uses to be developed into residential subdivision lots; that a residential subdivision has previously been annexed and zoned which abuts the Applicant's property on the south. 15. Where will these entrances and exits be? I am also concerned about the water table. Johnson: It's not a spot annex, there is no break between this property and the City property. Sharp: I am very opposed to the zone change but especially a zone change that would be so many houses per acre. Dan Wood, 628 Mondale Drive, Meridian, was sworn by the Attorney. Wood: Are they going to require this subidivision hold back part of this ground for road. How about house size? City Clerk Niemann: It would have to be at least according to what the City Ordinances say. Bryan: I an next door to the proposed subdivision and I am here to voice my opposition against it because we don't need the excess traffic and I also question the two entrances in a subdivision of that size, I think there should be another way in somewhere behind the back. Dale Sharp, 2445 Wingate Lane, was sworn by the Attorney. Sharp: Had a question as to where N. Locust Grove is on the Map. We are right on the Ditchrider Road. My questin is, what are they going to do with that ditchrider road, are they going to put a gate there so that those people do not come down. that ditch- rider road, because they are coming accross my property,-I don't like that at all. I am certainly opposed to something like this. - - Gordon Wood, 2200 Dixie Lane, was sworn by the Attorney. Wood: I didn't understand about Dixie Lane and I don't think other people do either. This Lane is maintained mainly by myself and Mr. Monroe, if this went through other people would be using this as their alley.. I also heard that Dixie Lane was also going to run East and I don't understand that. Until I understand these things, I would be against this, I want this explained to me. Johnson: We are working without benefit of the ACHD comments right now, this is a first step in what's going to be a long process. Collins: I had a preliminary meeting with the staff at ACRD, two of the points discussed there were the alignment of Chateau rather than taking it directly east we are taking it up through north over against the five acre parcels, we looked at just taking ii North of the two that are on Dixie Lane there so that in the future as land developed those residents could be left in place. The highway district indicated to me that the actual official, and I didn't get any indication from them whether it was public or a private street, they referred to it as lane.and My understanding is that term is used for private streets exclusively, in other words they would not own the right of way. There is three accesses on the map also. Shearer: I've got a real problem here. We are requesting zoning for an R-8 and as i understand it that's a multiple family. Clerk Niemann: No its not. It only allows duplexes. Hepper: Do you have any indication of the square footage of the houses? We also have the question about the ditchrider road. Collins: We are in contact with Nampa-Meridian, I've talked two a couple of gentleman - there today, I am meeting with the ditch rider on this lateral that goes through there. Hepper: Then on the R-8 zoning the reason for that was because of [he lot size. Collins: It wasn't the area it was the frontage requirement. Alidjani: Do I understand you correctly that there will be a few one way and a few the other way? Collins: On this collector, no sir they will all face off, there will be no fronting lots on the Collector Road at all. Steve Hosac, 1802 N. 31st, Boise was sworn by the Attorney. Hosac: I am here to represent my parents Chuck fi Lorraine Hosac who own the ten (10) acres on the south border of this project. The first thing I would like to point out is that we are in support of this project. Our only concern is how this project may affect the future development of my parents project which has already been approved by the City. The annexation has been finalized but was a zoning classification given, I guess it's R-8. We would make a request with this project that Ehey are required to extend their trunk line utilities all the way along their Locust Grove frontage so that we don't in the future have to start digging up a newly widdened street. We show on our preliminary map a road subbing to the north about the midway point, I understand that on the new map they have shown a road stubbing to the south. I do feel that there needs to be a north south connection somewhere and if Dixie Lane turns out to be the north south street I might point out that on their project that wil create double frontage situation along there easterly boundary.What I would like to suggest if Mr. Blazer & the Engineer is willing and if Planning 6 Zoning Commission Members are willing to set up an informal work session with the ACRD people fi a representative or [wo from the Planning fi Zoning Commission and my parents and myself and sit down with those folks and decide some of these road issues. Monroe: There was a question as to whether or not Dixie Lane vent all the way to the end of the property and I do have some papers here that prove that it does go all the way, there is an exclusion off of the front of our property which is just before the Wood property. I don't know that it is dedicated but it is excluded from our property. There is also a question about a ditch that runs along Dixie Lane, it would be on the south side of this project, would that be covered. Alidjani: We do not know if it would be covered. Billie Jo Premoe, 3045 Wingate Lane, was sworn by the Attorney. Premoe: I would like to go on record as opposed to this project. We feel that anything moving in is an encroachment and we feel that a subdivision this large will sometime in the future cause them to feel that they need to use our private lane as a public access. Johnson: Anyone else wishing to testify? Being there no response the Public Hearing is closed. what we do is make a recommendation to the City Council based on the legality of .the Ordinances. We have no authoriEy to approve or disapprove, we just make a recommendation to the City Council. Engineer Smith: All of the ditches that are under control of the irrigation district will have to be taken care of and of course if they are required. There was further discussion. The City Attorney advised the Commission that the Preliminary Findings of Fact be revised to reflect the testimony that was received at this hearing.
