with the Ordinance with the possibility of changing the zoning from IL to CG -

ITEM #4: PRELIMINARY PLAT ON MERIDIAN PLACE #3: TABLED AT LAST MEETING:
Giesler: There was some concerns over the irrigation I was wondering if those have
been resolved.
Jim Howard: From JJ Howard Engineering. I visited this site generally in the NW corner
of the project is the only area that would impact adjoining land owners. We will provide
an easement so they won't allow individual lot owner to fence that gentleman out. We
will show directly on the plat that all fences have to be located well inside that headgate
area. We have a drain ditch on the west side which it serves to, it takes the wastewater
off of our property and drains it into a large drain ditch and that will eventually
some 100 to 200 feet will be covered. The drain ditch directly to the south will be
tiled.
Kingsford: There is no water that drains during that area into the drain ditch that
will be backing up and so forth --
Howard: The drain ditch we'll have to work with irrigation people, but we are proposing
to cover it, we've never had any problems before as long as we keep the joints open
to allow water to seep in.
Giesler: I might ask Mr. Hawe if these responses answer his questions.
Hawe: The 10x10 area that he is discussing is one of the areas of concern that I had,
the other is the, of course that spring that runs east & west on the south side of their
property that of course would have to be tiled. There is one stub that runs north &
south on the west side of their property and I'm not sure that I heard him address that.
The access easement to that irrigation box is my concern because at that point I receive
the water for my place as does about seven other people.
Howard: It will be easily accessible.

Hawe: What size of tile are you proposing to put into that east -west lateral.
Howard: It's 24" existing and that will be dictated by the irrigation district.

Kingsford: Engineer Smith can you give a brief explanation of where we are at concerning
the water situation.

Engineer Smith: Since the last meeting I have been in contact with a consulting engineer
who was assisting us previous to that point and there are a couple other wrinkles we
are looking at. Explained those to the Council. I have had the water department install
a pressure recording device out there at the subdivision.
Liz Bolts: I believe it was taken off on Monday but it was only on over the weekend.
Sometimes it's weeks it will go on fine. I would like to see it on there for a longer
period of time.
Smith: we have a new recorder coming and it's a seven day recorder.
Giesler: Do you have an estimated time of when this project will be completed.
Smith: I still think we can get something done by early June.
ITEM #5: CONDITIONAL USE PERMIT FOR SHIRLEY PERSON FOR YOGURT SHOP AT 310 EAST FIRST
STREET:
Kingsford: Is there a representative here?
Sam Briscoe, Briscoe Builders was present.
Giesler: Have they determined whether it will be a drive thru or a drive up?
Briscoe: It would be a drive by in the front.
Giesler: Has the concern about the fire hydrant been resolved.
Briscoe: She talked to them, the plans are in the process of being changed to see if
we can get around the fire hydrant rather than moving it.
Giesler: I am concerned about the curb & gutter. Where do you draw the line as to
when we start adding onto that new highway, we don't want to put a burden on new business,
but I'm wondering when we have that done. If we have the downtown done, then I would
like to see something be the start. Would there be a time that that could be done,
curb & gutter on King Street. You will be entering from East 1st and leaving on King.

Moore: If any one of us visited Arnold Machinery's existing facility in Garden City
we'd be apauled by it, it does look terrible. That is why they have decided to
relocate. There will be equipment on display but no rusty parks or junk sitting out.
Ken Northness, 1703 S.E. 3rd Way, was sworn by the attorney:
Northness: I am a concerned homeowner in Meridian Greens. Our water pressure is low
in Meridian Greens now. As I understand it, Arnold Machinery has two divisions, one is
a machinery division b a materials division, I assume they are going to move both
divisions onto this five acres. School buses unload Meridian Greens kids right there on
Overland Road, I don't think anything was said about widening the road. He said the
access road will be for both the five acres and the twenty acres, is that correct. We
appreciate his move to cooperate with landscaping.
Vern Labernik , 555 E. Antigua, was sworn by the attorney.
Labernik: There was a comment made about a three net, a three net is the tennant pays
the taxes, the maintenance and the insurance. Zonings were created for highest and
best uses, I think this is of upmost inportance. Has there been an impact statement.

that would be a much better access.
Moore: I would like to briefly respond to Mr. Northness's comments. He is concerned
about water usage, yes we will be using water there. We are"in fact widening Overland
Road on our side, we are creating what they call a decel lane, we are doing curbs S
gutters and a couple hundred feet of sidewalk.
Kingsford: I just became -aware of. -a water ..pressure .problem, Mr.:Puller has been doing
some investigation with regard to whether it's our rein or laterals or what -
Whatever the problem is it is our .intent to have adequate water pressure there.
Meeting for Thursday April 26th. At this time I'd like to recommend that the Council
continue this until the next scheduled Council meeting.

ITEM #5: PUBLIC HEARING: PRELIMINARY PLAT FOR MERIDIAN PLACE #3:
Kingsford: Is there anyone present who wishes to testify, if so please come forward,
state your name and be sworn.
Julie Parker, 10900 Goldenrod Ave, Boise was sworn by the attorney:
Parker: I am representing the developer. We are proposing a 42 lot subdivision, one
lot is to be set aside for the well lot for the pressurized irrigation system. We are
continuing with City sewer and water. There have been concerns about low water
pressure and we are going to be working with the City Engineer and participating in any
effort he sees that would help to alleviate that. These are all 8,000 sq. ft. minimum
lots. we will have restrictive covenants for -maintenance of the well lot and all streets
are to be constructed to ACHD's standards. We are reducing the size of Chateau

through ACHD's approval from a 60 to a 50 to make this a residential rather than a
collector. The drain that runs along the south of our property will be tiled.
Any irrigation that is around our property or near it that travels through our property
will be addressed so that all concerned land owners adjacent or downstream from the
project will continue to receive their water.
Giesler:Have you seen a copy of the letter from Mr. Hawes, he is concerned about the
provisions about Engineers for an easement to maintain the lateralls of water distribution
box that serves for irrigation for his property.
Parker: we would prefer that all irrigation be retained on his property, since we will not
be utilizing any of that irrigation water.
Tolsma: You didn't have any problem with the City Engineer's comments.
Parker: No.
Kingsford: Is there anyone else to testify.
Marcia Burton, 1011 E. Chateau, was sworn by the attorney.
Burton: I would like to know if at this time they know which lots those duplexes are going
to be on.
Parker: In the culdesac area towards the top.
Burton: Voiced concerns about property value and having small houses and the additional
traffic. There is a real water problem. When you can't water your lawn and run the
dishwasher at the same time it's pretty bad. At this point with that lot being undeveloped
it was a fire hazard. Currently what is being done about the water pressure situation.
If something is being done when can we see the results. We respectfully ask that you
delay any construction in that area until the current water situation is taken care
of.
Raleigh Hawes, 530 Blue Heron In., was sworn by the attorney.
Hawes: I attended the P & Z meeting and submitted information concerning the drain
and the irrigation system that serves farm property that I have to the west of this
proposed subdivision. There is a drain that runs east & west that they are talking
about covering and providing a drain system engineered to handle the surface or subsurface
water, however there is also a drain that goes -north & south for 150 ft. which tonight
Julie has not addressed. The other situation that I have is in the NW_corner there
is a laterall that runs east and west, -it's amain laterall, it serves I believe one
hundred and some acres to the north. At that junction on the NE corner it goes directly
north and serves some farm ground to the north and to the west. There is an irrigation
box there that serves the farm ground directly to the west, my farm ground, the corner
of this particular property line is right in the middle of this irrigation box. Now,
to move that box would entail a considerable amount of work on someones part to relocate
that. It's this particular area that I'd requested an easement. - ----
Tolsma: How have they responded to moving this box or putting in a new one.
Hawes: They have not responded.

Myers: If that is a Nampa -Meridian Irrigation District requirement then it just has
to be done, right?
Hawes: Nampa -Meridian doesn't impact anything except the water coming over the weir
at Locust Grove, and that's the only area that it doesn't. The responsibility of that
water and the box maintenance from their weir on down is the responsibility of the land
owners.
Kingsford: Anyone else that would like to offer testimony.
Liz Bolts, 984 Claybourne, was sworn by the attorney.
Bolts: I was at the P & Z Meeting held March 13, 1990 and we were told that the Ewings
had been given permission to tile and stub the drain. I have since spoken to John Anderson
at Nampa -Meridian about two weeks ago and he informed me that he knew nothing in writing
that had been approved to the Ewings to tile and stub the drain. Two to Three days after
we had been to the P & Z Meeting we called and the ditch rider came out and he had no
information of the drain being covered. Water is a problem. I have spoken to the Mayor
about the water problem. We are not opposed to development but if it's going to put
our lives in detriment we don't for see that it's going to do anybody any good. We need
to address the problem before we move forward. We don't want duplexes if they are going
to turn into rental trash. I would also like to know what you're going to do to help
us with the water situation, traffic, etc. I would also say that there should not be
any building in this area until these problems are solved.
Kingsford: Accepted eleven (11) letters voicing concerns about the development.
Cindy Paul, 2043 NE 10th, was sworn by the attorney.
Paul: Voiced concerns about traffic, property values & again the water situation.
Joe Lambuth, 904 E. Willowbrook Dr, was sworn by the attorney:
Lambuth: I also want to stress the fact about the water situation. The two subdivisions
that are going in on both sides of Locust Grove, is the water coming from Meridian or
do they have their own systems.
Kingsford: Those are from Meridian.
Lambuth: It makes you feel kind of silly to stand in your yard and water your lawn with
hardly any water coming out. When i paid my water bill I asked them why the fluctuation
of water, I was told they were putting in some kind of control in the pump house at Jericho
& Willowbrook. Whatever they've done it sure isn't doing the job. We also have a speed
problem. Voiced concerns about property value also.I amvery strong against this.
Engineer Smith: As the Mayor indicated we've tried several things but there are no working.
I've got some plans that were just returned from the a Consulting Engineer which will
require a significant discharge to Jackson Stub Drain. The problem isn't the water quantity
we have a well there that pumps 1300 gallons a minute. -The problem is that based on
the development of that area vs. the quantity of water that is pumped most of the water
heads back towards town to the tank.` When the pump shuts off it basically lowers the
water pressure. I hadn't been aware of any zero pressure. The reports we've had were
in terms of minutes but I know it may seem like minutes when your standing in the shower

and the water stops but I think it is more in terms of seconds, because the register
that we had on the meters showed that to be just an instantaneous drop in pressure then
resume pressure.

I have to pull the heads up because the pressure is not high enough to raise them.

Seely: As tax payers my husband & I are against this subdivison going in manlybbecause
of the smaller homes and the duplexes, we feel it will bring down our property a

Joplin Elementary being so crammed. We feel that it's not only in-excuseable it's irresponsib:
I agree with the water situation, I think anyone of us would invite any of the water
people to come to our home and take a shower and see how long they can stay in there
without the soap drying on there skin. The traffic is a problem, we need a light at
the corner of Jericho & Fairview. The children are in danger when they plan on Jericho.
Kingsford: Anyone else?

Conley: I also have concern with the water pressure. Voiced concerns about traffic
and property values.
Liz Bolts, 984 Claybourne Drive. I would like to request that maybe the homeowners
in Meridian Place #2 could get together with the Ewings or we could ask them to be present
at the next Council Meeting if this were to continue instead of sending a representative
in their place. I was home the day the City came out to monitor the pressure, I don't
feel that a 24 hour monitor is going to give an acurate-reading.
Kingsford: Anyone else, being no response I will close the Public Hearing.
Tolsma: I'd like to see this tabled at least until they get these water rights worked
out.
Myers: It sounds like these folks here have some real concerns.
Giesler: I am real concerned about the overcrowding of the schools. We are concerned
concerned about the school overcrowding also. ---
Kingsford: one thing that has been suggested to the school district and I wish they
would pursue it, is a development fee per lot, per house, per bedroom, a number of those
have been promoted I think they are very constructive.

ITEM #6: REQUEST BY AMYX & PETER COVINO TO RECONSIDER CONDITIONAL USE PERMIT FOR CREAMERY
BUILDING:
Giesler: I have a question as to where Mr. Covino intends on putting a entrance for
his project.
Covino: Right across the street, it would be E. Broadway. There is currently a door
there and it used to be an entrance.
Giesler: Do you still have the access to the parking at the rear?
Covino: Yes we have parking on all sides. I can use your parking lot it looks like.
Kingsford: The parking over hear is the banks and it is private property, and they
don't have to let anybody park there.
Covino: I notice the City people park there.
Kingsford: They have allowed us to park there and their people are parking in some
of our parkings spaces as well.
Covino: We do have enough parking area however without any other parking places.
Giesler: Is Mr. Amyx's business still being conducted in that facility?
Covin: Depending on the outcome of this meeting tonight is business will be out towards
Mountain Home. As soon as I have permission I will then give him a deposit he will
take that and give it that man and as fast as I can get about fifty guys together we'll
move him out.
Giesler: In the Findings there was a note that the sewer service -
Covino: We are going to follow whatever it takes to put in water & sewer.
Myers: You mentioned you were going to bring the whole building up to code.
Covin: Just the part we are using.
Myers: It looks to me that the problem we have is the junk vehicles and the parking.
Covino: We can't move it until all that is gone. We will meet the code. We won't
take possession until we have met the code with his stuff out. That is the current
plan. Everything in that building will be gone, he may leave a couple of antiques in
one area.
Yerrington: Are you leasing the entire building?
Covino: No, we are leasing approximately 20,000 sq. ft. about 1/3 of the building.

Re: Meridian Place Subdivision No. 3
Regarding the application of Richard Ewing, Sara Ewing
and John Ewing in reference to the above subdivision, there is no
provision by the engineers for an easement to maintain the
laterals and water distribution box that serves for irrigation
for my property. This will be required for both maintenance and
service.

The Motion was made by Rountree and seconded by Shearer' to recommend to the City Council
to consider approval of Cherry Lane #3 with the conditions that are outlined in my
previous comment relative to design review for landscaping along Ten MIle, some
design consideration for reducing speeds on Woodmont and irrigation variance with
successful result of those issues approve the subdivision.
Alidjani: Are you asking for redesign or reroute the whole Woodmont to go through off of
Sugar Creek?
Rountree: No, I'm looking at some design features that could be put in there from the
traffic stand point in terms of signing, speed bumps, etc.
Alidjani: So you motion is for the design to stay as it is, but you just need some
design changes.
Rountree: Just some design changes to incorporate some of those features.

Johnson: Is there anyone present who wishes to testify, please come forward. I will
open the Public Hearing.
Julie Parker, 10900 Goldenrod Ave., was sworn by attorney.
Parker: I am representing the developer. What we are basically proposing to do is
to take that large lot that was platted under Phase 2 and develop 41 buildable lots
with Lot 1 Block 1 being set-aside for a well lot •for -;the _presurrized_irrigation system -
you require. We are extending NE 10th Ave. intothesubdivision along with Chateau Dr.._ _
and ending it up in our NW corner. They do share a corner north and west from our
NW corner they have another 40 acres but they don't -have access -to --this project. We are
reducing the size of Chateau Drive with ACHD's approval from a 60 to a 50 in order to use
it as a residential street rather than a collector. We are proposing City sewer and water
and we are taking our storm drainage off of stro@t draining it into a drop inlet with an
oil trap and piping it into the Jackson Stub drain which will itsself be tiled. We got
a current zoning of R-8 which means a 6,000 sq. ft. minimum and all of out lots exceed
8,000 sq. ft. We would like -to add a note to the face of the. plat. stating that the owner,
of that lot willbe entitled to a one time ,split. -_The -developer , will be constructing some,
duplexes. There will four homes with the minimum of 1000-1099 sq. ft., eight homes
from 1100 to 1199,sixteen from 1200-1299 sq. ft.,_and .13 at.- 1300 sq. _ft. and greater.
Mr. Raleigh Hawe has sent a letter expressing a concern about an easement for his
lateral which is the Stokeberry Lateral and the water distribution box: that serves.for the
irrigation for his property._ This will be addressed and taken care of -.when we get
into the final engineering design stage and do a more extensive survey to €ind_out where
that crosses our property and where. it leaves.
Alidjani: Do you have any problem with the concerns of our City Engineer.
Parker: 11baven't received his comments.
Alidjani: It reads that since Chateau is a main feeder line from the East I
wonder if it should be a more curved alignment to the NE 10th Ave. to provide a more
definite flow.

Rountree: Your description indicates 4 to 6 duplexes, do you have any idea which
Lot and blocks those will be?
Parker: We will have one on Lot 8, Blk 4 and probably will have a cluster of three in
that culdesac area. They wanted some of the larger lots to have the duplexes on them.
They will be marked on the plat.
Rountree: Have you talked to ACRD, we haven't received comments from them.
Parker: Yes we have.
Hepper: On the presurrized irrigation system are you going to implement that.
Parker: Yes.
Crookston: It was my understanding that Chateau was a Collector Street.
There was some discussion.
Scott Swanbeck, 944 Claybourne Drive, was sworn by the Attorney.
Swanbeck: I have a couple of questions. It was indicated to`our 'block "at one time that
there is going to be a school going in somewhere out there, is this true?
Clerk Niemann: The School owns a piece of property to the East of this property.
Swanbeck: How far will the houses go back up to that drain ditch that is there now?
Parker: That ditch will be covered with this development.
Swanbeck: With making the streets smaller like that won't that cause more problems
with people, everyone parks their cars. -on the street as it is;
anyway.
Alidjani: Your street :is 50 ft. now which is what that will be.
Swanbeck: Ok, then that's all I have about that. Voiced some concerns about property
values being less with duplexes being put in also about -water ptotilems witTi pressureL
The last thing I wanted -to 'ment on;'is'that with more houses going back into that area
it will put a burden on the school districts. My children are bused 6 miles away now to
go to primary school. What are the plans for taking care of all these children that
will be in these houses'in that area?

Shearer: I'd like to comment on that. If you get enough houses in an area then
the schools will have to make accomodations. They have already bought that piece
of ground out there.
Swanbeck: I'm not a person that's against building and all this but we need to
think ahead and have some preparations made.

Bolts: I have concerns about the traffic problems, my other concern is about having
duplexes, is this going to end up being a rental area with broken down everything.
I am glad to hear that the ditch will be covered. I've called the City officials about
my water pressure being bad now, what will it be like with all these houses put in.
Marsha Burton, 1011 E. Chateau, was sworn by the Attorney.
Burton: My first concern is also about the water. Not only is it an inconvenience but
it is also a concern if there was a fire will there be sufficient water pressure.
Asked about the square footage of these houses that are going in? Again, as far as
the duplexes are concerned, we don't want them to be run down.
Bob Strasser, 3165 N. Meridian Rd., was sworn by the attorney.
Strasser: A friend of mine mentioned to me that with all the building that is going
on in Meridian that the Schools being so crowded the way they are, one of the things
that we might be able to do is to put a bedroom tax on all development that's going on
because when you get a 4 or 5 bedroom house you probably have four or five kids that
will need school, you put some type of bedroom tax on and the developer tatted the burden.

Hawe: I own the property to the west of this parcel that is being subdivided. At the
NW corner of this subdivision is the point that I pick up the water for my property
which involves about 25 acres. Their subdivision is right at that edge of that
irrigation box. They are talking about easements and that - I notice they have a lot
that is proposed right at that particular junction where this irrigation.lateral
is picked up. It's very key that a width of area -has to be provided for access for
maintenance of that box, not only does it serve my farm but it serves several others
including the proposed developer for this particular place. Expressed concerns about
drainage and water tables.in the area.
Johnson: The drainage specifications will -have to meet approval of Nampa -Meridian
Irrigation District.
Hawe: The fencing is the next question I have. The fencing that was put into the Willows
section all complied with the covenants of the subdivision with the exception of lot 5.
Voiced concerns about a wood fence with fire dangers. My next concern is about the
sewer lines, and that is that I show two streets here, one is the street that runs east
and west it's an extension of Chateau, at that point is the sewer connection going to be
stubbed off so that there could bean extension of that in the street. Just how the main
sewer line go through there to be handling these houses.
Clerk Niemann: That's something that's up to the Engineer.

Boesiger: A short time ago we submitted to you a plat of the Vineyards. This project
is beautiful and will have very large lots. We believe it will take from 7 to 10 years
to market the project. This project must be designed to be compatible with the community,
and designed in such a way to be an asset to the Vineyards Coamunity. I'd like to introduce
to you our Planning & Real Estate Consultant, Chris Korte.
Chris Korte, 499 Main Street, Boise, was sworn by the attorney.
Korte: Presented a conceptual site plan. What the project entails is a small commercial
center approximately 4 acres in size. The types of uses we are contemplating is a convenience
commercial center which is small retail, office, dental, medical and daycare. Landscaping
on project is guaranteed. Explained report that was given out to Commission. (Tape on File)
Hepper: It states in the Comp. Pian that no more than one corner of an intersection
:should be developed as a neighborhood shopping center.
Korte: We believe that one corner is not enough to meet the needs of this area. Explained

NOTICE OF HEARING

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the
Planning and Zoning Commission of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 o'clock p.m., on March 13,
1990, for the purpose of reviewing and considering the
Application of Ray Ewing, Sara Ewing, and John Ewing, for a
preliminary re -plat of Lot 1, Block 6, Meridian Place Subdivision
#2, according to the plat thereof filed in Book 4650 and 4651,
records of Ada County, Idaho, said lot containing approximately
12 acres and is located on Chateau Avenue west of Locust Grove
Road.
A more particular legal description for the parcel is on
file in the office of the City Clerk of the City of Meridian and
is available upon request.
Public comment will be taken and is welcome.
