At this meeting the Mayor and Council advised they could approve this concept as it was submitted and the Motion was made and duly passed to have the Zoning Administrator of the City of Meridian prepare a letter to reflect their decision. This letter is to advise the Commission Members of Ada County Planning and Zoning that the City of Meridian has no objection and would approve the concept. of the Jasmine Acres Subdivision. Giesler: Number 8 about the businesses, I need that explained to me about the business being conducted on - Page #4 item #B. Crookston: It says that Business shall not be conducted on the above property unless legally permitted under the existing and prevailing zoning restrictions, that just puts it back on the zoning, hnd then if permitted which would I assume would mean if the zoning permits it no business shall be allowed that cannot be owxlucted within the residence of ahe owner, I take it that means it couldn't be conducted outside or in a shop adjacent to the building or something like that, it would have to be in the actual home of the owner. Blazer: What it specifically addresses are things like day cares, or those types of things that people have within there house after they obtain a City License. The Motion was made by Tolsma and seconded by Myers to approve of the Covenants on Chateau Meadows East #1 with the counselors corrections. DI3(U.S,SION ON Pl~DPO68fl PROJECT: Don Hubble, with Hubble Engineering, 3952 Daisy Way, we are coming before you tonight to ask for your approval on a proposed project. The situation for this property is that it's about half within the City's area of impact and about half outside so right now it has a dual zoning designation. What we would like to do is take d:,letter of approval back to the County Planning 6 Zoning, if you approve, and see if they will approve this preliminary plat and act on it. Right now they won't because of this dual zoning. This parcel is about 33~ acres which according to the hew County Zoning Ordinance would make it eligible to be split into 7 lots, 7 building lots, there is an existing home on Lot 7 which would be sold off separatly, then the other lots would be designated as building lots, and then the lots that are left would be designated as non building lots, reserved for agricultural purposes. What ve'd like if you approve of this is a similar letter to the one written for Jasmine Acres. There was discussion about the existing house and lane. Myers: What's the reason for doing it like this, why not 33 one acre lots. Hubble: The new County Zoning Ordinance won't allow that, their density limit is one lot per five acres in their RT Zone. Myers: Okay, but if we amend ours then we could allow one acre per_lot, right? Kingsford: We could allow a denser population than that, but you'd be going through a five acre subdivision to get to the back of this where there could be four dwelling units per acre. Crookston: In our Comprehensive Plan it has a agricultural designation that is five acres, one dwelling unit per five acres. Is this something that divided into these size parcels that could subsequently be re- it would be re-subdivided into let's say two or three dwelling units per acre. Hubble: According to the County Zoning Ordinance the area that she cross-hatched has to be maintained as agricultural land, it cannot be re-subdivided. Kingsford: Is it reasonable to re-subdivide this and have additional building lots down the road. Is it layed out in such a fashion that that is prudent. Hubble: Part of that could be re-subdivided but it's not going to be easy. Each buyer will buy two lots, one for a home site and one that's designated for agricultural preservation. This will have restrictive covenants attached to it at the time it is final platted. There was further discussion about the map. The Motion was made by Myers and seconded by Tolsma to write a letter to the County stating that we do not object to this project. Richard P. Clark, I hereby submit their epplica- tion for a Rezone from A to R-l, a Planned Development Residential and Preliminary Plat for Jasmine Park Subdivision, including a private street within the subdivision. The parcel is currently used for minor agricultural purposes, with a 4200 square foot home and out buildings, centerally located at the end of a gravel private lane. The proposed subdivision has over 1 acre of common landscape encompassing a large area to buffer the homes from State ftighway 55 (Eagle Road) and an entry island within the private roadway. The private roadway (approximately 1/2 mile in length) is requested so as not to impact the local drainage systems by disposing of runoff in drainage awales along each side. The swales will be grassed and protected by platted easements and restrictive covenants filed with the final plat. Anon-profit Home Owners Corporation will be formed to administer the commons and private road. All dwellings within this pcoject will be single family detached and tentatively to have a minimum of 3,000 square feet and other amenities still being planned. There are no common recreational facilities planned as the 1 acre lot size allows plenty of room on each lot to accommodate such needs. The few trees within the site are around the existing residence and the new lot lines have attempted to preserve as many of them as possible. The covenants would require live landscaping and maintenance thereof on every lot. The amount, type and location of such is as yet undetermined. An architectural control committee in conjunction with the covenants and Homeowners Association. will administer such rules. James Shearer: Mr. Shearer was sworn by the City Attorney. Shearer: The reason for rezone on some of these properties is that some of the residents are in the future looking at selling their prop- erty and the value of the property is greater as commercial than residential, some of the residents plan on using their proeerty for commercial use, this would also make it contgivus through out the street, not having a residential property and then a commercial. There is commercial property in all directions except to the East and to keep that contigious we all got together to do this rezone. There will be two residential properties left on that side of the street if this rezone is approved, It is no ones anticipation at this time to tear down what is there, they anticipate using what there, however we do not want to be restricted from selling it to someone to do something different. Janet Butterfield, Mrs. Butterfield was sworn by the City Attorney. Butterfield: I just want to say that I do not believe very many people ~` would want to purchase that property for residential purposes: Nancy Brigham: Mrs. Brigham was sworn by the City Attorney. Clark, I ea requeating that the Planning and Zoning Commission of the City of Meridian review our application to Ada County for a Rezone from AP-1 to R-1, preliminary plat (Planned Development Residential for 29 lots of 1 acre each and a private road to serve all of the lots within the development. Attached hereto are eight (8) sets of our proposed application and preliminary plat. Your review is requested to facilitate our application to the County as only the western portion of Mr. Clark's property lies within your impact area and this portion of the property has no access to a public right of way without crossing the area not within the impact zone. Therefore we need to rezone to entire parcel and develop it accordingly. The City of Meridian's Urban Service Planning Area is approximately 1/2 miles fr:.m the parcel. We are applging for a private road to eliminate the need to impact the agricultural drainage system in the area by not utilizing curb and gutters which require and point discharge, ie., a drain ditch. Our proposed roadway will be comprised and 32 feet of asphalt paving with 2 foot wide concrete edging which will allow the water to pass into a grassed drainage awale along each side of the road. (See typical roadway section in submitted data) The homes is this subdivision will be required to be of at least 3,000 square feet is size and the lots will be restricted to no animal husbandry uses. The covenants will be written so as to enforce the restrictions and the developers intent of not to create 1 acre mini-farms. The existing home which will be incorporated into the subdivision (Lot 11) has 4,000 square feet and an inground swimming pool. The lots will be self-contained in that individual wells and septic systems will provide for each individuals needs. James Shearer: Mr. Shearer was sworn by the City Attorney. Shearer: The reason for rezone on some of these properties is that some of the residents are in the future looking at selling their prop- erty and the value of the property is greater as commercial than residential, some of the residents plan on using their proeprty for commercial use, this would also make it ccnti-givws through out the street, not having a residential property and then a commercial. There is commercial property in all directions except .to the East and to keep that contigious we all got together to do this rezone. There will be two residential properties left on that side of the street if this rezone is approved, It is no ones anticipation at this time to tear down what is there, they anticipate using what there, however we do not want to be restricted from selling it to someone to do something different. Janet Butterfield, Mrs. Butterfield was sworn by the City Attorney. Butterfield: I just want to say that I do not believe very many people ~, would want to purchase that property for residential purposes: Nancy Brigham: Mrs. Brigham was sworn by the City Attorney. r' Brigham: I just want to say, i would like to see it go one by one, our property backed up to East First Street, I would hate to see it given a blanket zoning although i feel they should be allowed to have it commercial but it should be on an individual basis. Loveless reviewed the project with the Planning & Zoning Commission and the Commission forsaw no problem with the concept of this project. Clark, I am requesting that the Planning and Zoning Commission of [he City of Meridian review our application to Ada County for a Rezone from AP-1 to R-I, preliminary plat (Planned Development Residential for 29 lots of 1 acre each and a private road to serve all of the lots within the development. Attached hereto are eight (8) sets of our proposed application and preliminary plat. Your review is requested to facilitate our application to the County ae only the western portion of Mr. Clark's property lies within your impact area and this portion of the property has no access to a public right of way without crossing the area not within the impact zone. Therefore we need to rezone to entire parcel and develop it accordingly. The City of Meridian's Urban Service Planning Area is approximately 1/2 miles from the parcel. We are applying for a private road to eliminate the need to impact the agricultural drainage system in the area by not utilizing curb and gutters which require and point discharge, ie., a drain ditch. Our proposed roadway will be comprised and 32 feet of asphalt paving with 2 foot wide concrete edging which will allow the water to pass into a grassed drainage awale along each side of the road. (See typical roadway section in submitted data) The homes is this subdivision will be required to be of at least 3,000 square feet ie size and the lots will be restricted to no animal husbandry uses. The covenants will be written eo as to enforce the restrictions and the developers intent of not to create 1 acre mini-farms. The existing home which will be incorporated into the subdivision (Lot I1) has 4,000 square feet and an inground swimming pool. The lots will be self-contained in that individual wells and septic systems will provide for each individuals needs. The street and the landscaped entry lots will be maintained by a homeowners association.
