The Motion was made by Giesler and seconded by Myers to approve .the request for extension on Plat of Golf View Estates #2. Motion Carried: All Yea: ITEM #2: BID ON FENCE AT STOREY PARK: Eng. Smith: The bids were opened for the fencing project at Storey Park on Sept. 6 at 4:00 P.M., Wayne Forrey opened the bids. There were three bidders, Meridian Fence Co., Anvil Fence Co., & Cascade Fence Co.. Cascade Fence Company was the low bidder at $10,728.60. I would recommend that the bid for this amount be awarded to Cascade Fence Co.. The Motion was made by Yerrington and seconded by Myers to approve Cascade Fence Company in the amount of $10,728.60. Motion Carried: All Yea: ITEM #3: TRANSFER BEER & WINE LICENSE FROM MESQUITE MOUNTAIN ALE TO NEW FARMERS CLUB: Kingsford: The Chief advises there are no problems with this transfer. Giesler: I still have a little concern about the intersections of the culdesacs not having enough light. I could mention what the Findings say, basically that we would like to see additional lights at the major intersections. I realize that we didn't ask you to do that in Golf View #1 but I feel that maybe we made a mistake. We are not asking you to do it at the culdesac entrances and I'm not so sure that that is the right decision on my own part. I would like it to be in the minutes that we take a look at that when the project is completed and see how that works. Tolsma: I basically agree with Giesler. Voiced concerns .about emergency personel entering area with not enough lighting. The Motion was made by Giesler and seconded by Yerrington that the Meridian City Council hereby adopt and approved these Findings of Fact and Conclusions of Law for the variance request for New Concept Developers for the street light ordinance. That Cherry Lane Village No. 1 and 2 were not required to install street lights when they were developed in 1977 and 78, but this was prior to adoption of the cur•r'ent Subdivision Ordinance; tha t the. City Council has granted variances from the Street Light O rdinance in the recent past and in one area not in the Cherry Lan e Village Golf Course area. 9. That Section 11-9-606 B. 13. h., providPS that: in the event the street lighting ordinance of 11-9-606 6. 13. b., is waived that the subdividers and the lot owner's shall be responsible for insuring that there is a yard light installed in the front yard of each house, controlled by a photo electric cell, and shall be wired directly to the r'esidence's electrical breaker panel and comply with the National Electrical Code. 11. That even though yard lights, if allowed, must now be required to be directly connected to electrical breaker boxes and come on automatically by means of a photo-.electric cell, replacement of light bulbs and maintenance is difficult to enforce. 12. That in areas where yard lights have been allowed to be substituted for street lights, the areas ar•e often still quite dark, especially at street intersections. 13. Tfrat the purpose of street lights is for' safety and crime prevention. 14. That there were no public comment submitted in opposition to the variance at the public hearing. CONCLUSIONS 1. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet of the external boundaries of the Applicant's i • property. 2. That the City has auttror•i t,y to grant variances pursuant to Section 11-9-612 and 11-2-419 of the Development Ordinances upon meeting the ordinance requirements. 3.- That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Zon-ing Ordinance and Subdivision Ordinances and upon the record submitted to it and the things upon which it may take judicial notice. 4. That the Council may take judicial not-ice of its own proceedings, those of the Commission, yovernmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. 5. That the following provisions of Section 11-9-612, Variances, of the Development Ordinance are noted which are pertinent to the Application: 11-9-612 A. 1. PURPOSE The Council, as a result of unique circumstances (such as topographic - physical limitations or a planned unit development), may grant variances from the provisions of this Ordinance on a finding that undue hardship results from the strict compliance with specific provisions or requir•ernents of the Ordinance or that application of such provision or requirement is impracticable. 6. That there are such special `"~ circumstances or condii.ions • affecting the property that the strict a p p l i c a t i o n o f t h e provisions of this Ordinance would clearly be impracticable or• unreasonable; in such cases, the subdivider shall first state his reasons in writing as to the specific provision or requirement involved; b. That the strict compliance with the requirements of this Ordinance would result in extr•aar•dinary hardship to the subdivider because of unusual topography, other physical conditions or other such conditions which ar•e not self- inflicted, or that these conditions would result in inhibiting the achievement of the objectives of this Ordinance; c. That the granting of the specified variance w-ill not he detrimental to the public welfare or injurious to other praperty in the area in which the property is situated; d. That such variance will not violate the provisions of the Idaho Code; and e. That such variance grill not have the effect of nullifying the interest and purpose of this Or•d i Hance and the Compretrens i ve Development Plan. 7. That it is concluded that street lights are a safety device and measure for pedestrians and vehicles and are a measure which helps prevent crime; that although there are provisions for wavier of street lights in R-4 subdivisions that: the waiver is not automat is and safety factors must be we iyi-led heavily when considering a waiver. 9. That it is concluded that the prior variances and waivers. of the Street light Ordinance were a mistake and probably should not have been granted. 10. That it is concluded that due to safety factors, the waiver and variance of the street light ordinance should not be granted at roadway intersections and tflat street 1 fights shall be placed at all roadway intersections of through streets within the subdivision; that due to the City Council having granted a variance from the Street Light Ordinance for Golf View Estates No. 1, and that since the Applicant may have been inappropriately led to believe that another variance would be granted to the remainder of the entire development, it is concluded that the variance shall be granted for areas where street lights would be required under the ordinance other than at roadway intersections of through streets. Variance Request - Street Lights: At a minimum a street light should be required at the major intersections such as: North Jonathan Way/Cherry Lane; North Jonathan Way/West White Ash Dr.; West White Ash Dr./ Blackcat Road. A street light should also be placed at the intersection of N. Summertree Dr./Cherry Lane Raad of the first phase. 2. Preliminary Plat: a. Are back lot line easements being provided in accordance with utility needs? b. Who maintains the sediment-grease, traps and seepage trenches located outside the road right of way? c. Provide confirmation from the Nampa & Meridian Irrigation District concerning easement width for the Safford Lateral. d. We need to have a signed easement from Mr. Fuller for the pressure sewer line crossing his property along with approval to locate and maintain within the easement for the Safford Lateral. e. Is there any way the triangular shaped piece of property, bounded by the Safford Lateral and Lots 7. 8, 9 - Block 6. can be obtained far platting as a part of this No. 2 Subdivision? • • PAGE 2 3. OCTOBER 2, 7,990 PAGE # 2 Lee: I would like to just briefly give you a discription of the project, this is an extension of Golf View Estates #1, we master planned the balance of the property, there is about 37 acres, there will be 97 single family lots, there will be seven common lots, that will be landscaped and main- tained by the Home Owners Association, the common lots along Cherry Lane will be included, density is 2.5 per acre, the project will be served by City water & sewer, the common lots will also be used for storm water, and also serve as park area, the lots as far as storm water are primarily for overflow, during normal times water should not reach those lots, the remainder of Golf View Estates will be designed for pressurized irrigation system, presently the Settlers Irrigation lateral traverses through the property, we will have to relocate that, we do not have a lot of water right}from Settlers so we will need to supplement the irrigation system with `shallow wells, the street lights a varaance has been requested to install individual lighting on the homes with photo electric cells to activate the lights, the reason is that we want to maintain the same as we did in Golf View Estates #l and also in Cherry Lane Village, we did review the .City Engineers comments about some of the lighting requirements at some of the major intersections and we do concur that we would go at lights on Cherry Lane at those two intersections and at Black Cat also. I will be glad to answer any questions the Council might have. Myers: I noticed in the comments that there ought to be a street light at the intersection of N. Johnson Way and West White Ash Drive, that is not on Cherry Lane but that is a major intersection inside the subdivision is that one you are not going to do? Lee: I think I would like to set down and talk lighting scheme, I think when that comment was going through the project, more of a collector to be a major intersection, since then we have pattern up in such a way that it should not be intersection. inside the development. We will d to the Council about that made we did have that street status and that would appear broker: the street traffic different than. any other ~ what is required. Myers: I can appreciate that, it looks nice to have those house lights instead of the street lights, the only thing it get dark at some of those intersections where there is a light a long ways away and I know that going into Cherry Lane Village now there are several of those streets that are dark, maybe hindsite is good for the future. Giesler: This would be my only concern at this point also, the intersections within the subdivision itsself of having a light there, I realize we did not ask it in Golf View Estate #1 and I would maybe like to have you look into putting lights in that section also if it was possible, this is really important, I feel, I live in Cherry Lane Village on Sugar Creek and that is the same type of thing we are doing here and there has been a number of times I have caught myself where it is so dark at those inter- sections, not necessarily with the cars, but there is so many people jogging and walking in that area, they are somtimes hard to see without the lights. I think there is something there that we really need to look at and we do not mean to put a burden on you as far as added expense or anything like that, I think we would need to see if we could not get that done and. from now on any of these subdivisions, I think it would be something I would request. Gary Lee, JUB Engineers, Lee was sworn by the City Attorney: Lee: Golf View Estates #1 is located just to the east of this project, this project is for 37 acres, there will be approximately 98 lots,. these will be single family residential, there will be seven common lots, part of which will be landscaping lots along Cherry Lane, we have allowed for some dual purpose common lots thoughout the project for a combination of uses, primarily storm water retention and disposal that will also second as a tot lot or park facility for the project. The size of the lots will be roughly 100 x 110, there will be quite a few of them that will be much larger, the average lot size will be 11,000 to 13,000 sq. ft. Density on this project will run about 2~ units per acre.This project will be serviced with city water & sewer. As you are aware there is a lift station in Cherry Lane Village, the plan is to abandon that lift station and move it to the west to service this project. Went on to explain where lift station would be located and what it would serve.There was a piece property that was about ~ acre in size in phase 2, just north of phase 2 that belonged to Jim Fuller that was not included in the original concept plan that you received, since that time Mr. Marshal has purchased that parcel and it will be included in the phase 2 development. This will add one additional lot and will eliminate that one small corner that was between the Safford Lateral and what would have been Golf View Estates. E~pl~ined where the water system would be. We met with ACHD yesterday during their tec review of the preliminary plat, one of the major items they pointed out was that they did not want to have White Ash Drive appear to be a col lector street without improving it to that status, the way it was originally presented it was a fairly straight shot from Black Cat all the way to Interlachen, which tends to speed up traffic, so we had our option to either designate that as a collector and in doing so you have to have a wider street and you have to limit access to it, the way this property is shaped on the westerly side there was no way to do that so we opted for the option to break that traffic pattern and offset the intersections and that is what the drawing is that you have before you.Explained the street drainage. SEPTEMBER 11, 1990 PAGE # 2 On the irrigation issue, that particular project is served by Settlers Irrigation, it is somewhat limited on the quantity of water that is available to the parcel, we are going to have to take a close look at using supplemental water on this particular situation, we intend to use both, we will develop a take out structure some where in this project probably in phase 3 or phase 4, to pickup the Settlers Irrigation water, we-will pressurize it through a pumping facility, in addition to that we recommend that there be supplemental wells installed for irrigation purposes, shallow wells, we are hoping to put these down in two or three locations, with the anticipation we would have 200 gallons each, we are in the process of preparing permits for that irrigation right. The system will be operated and maintained by the Home Owners Association. We will place a fence along the Stafford Lateral as we did in Phase I, The Settlers Irrigation ditch will be relocated along the south and westerly boundaries of the property, the other portion of the application was a variance for street lights, we would like to continue system that we now have in Golf View #1, and also in Cherry Lane Village, and that is to use photo electric cell systems for yard lights. and in discussion we would like to put in regular street light at the entrances and major intersections. Cherry lane & Black Cat Road.There are two access on Cherry Lane and one on Black Cat and we will put in lights at these accesses. We have reviewed the City Engineers comments and will comply with them. Rountree: You indicated you would be relocating Settlers Canal to the south and to the west, within the bounds of the property, will it be tiled? Lee: It will follow the bound of the property and will be tiled all the way to Black Cat. Rountree: On those common lots, you indicated they would be used for dual purposes, when you landscape them and prepare them for storm water dentention, do you plan on depressions on thos sites? Lee: Yes, they will propbably be three feet deep, with a shallow slope. Rountree: We do not have but I assume the CC& R have provisions for collecting fees for the maintenance of these? Lee: Yes: Hepper: I have one question on the pressurized irrigation system, is that going to be dry lines for now or are you going to have it set up where it will be pressurized? Lee: It is going to depend a lot on fast we can press that permit through Water Resources for this Phase II in any event. It would make more sense to put the well in Phase II and then the Settlers Irrigation later. We will go ahead and put the dry lines in while we are processing the permit get the permit to drill and then we will develop the well.
