THIS WILL BE ON THE CITY COUNCIL AGENDA FOR APRIL 3, 1990: Jack Nie~nann City Clerk SUPPLEMENTAL DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR CREST WOOD ESTATES SUBDIVISION NO. 5 THIS SUPPLEMENTAL DECLARATION is made on the date hereinafter set forth by WASHINGTON FEDERAL SAVINGS & LOAN ASSOCIATION, a federally chartered savings association, hereinafter referred to as "Declarant"; WITNESSETH: WHEREAS, Declarant is the owner of certain real property situate in the City of Meridian, County of Ada, State of Idaho, which is particularly described in Exhibit A attached hereto (and made a part hereof by reference) which real property is hereinafter referred to as the 'Property"; and WHEREAS, the Property is to be subdivided and platted as Crest Wood Estates Subdivision No. 5, in accordance with the preliminary plat attached hereto as Exhibit B; and WHEREAS, a Declaration of Covenants, Conditions and Restrictions for Crest Wood Estates Subdivision No. 3, has heretofore been recorded as Instrument No. 8820074, records of Ada County, Idaho, on Apri128, 1988, and a Supplemental Declaration has been recorded as Instrument No. 8830658, records of Ada County, Idaho, on June 23, 1988, amending the Declaration of Covenants, Conditions and Restrictions for Crest Wood • ~~ Estates Subdivision No. 3 (said instruments being collectively hereinafter referred to as the "Declaration"); and WHEREAS, Crest Wood Estates Subdivision No. 3 is contiguous to the Property, and Declarant desires that the Property be subject to the same covenants, conditions and restrictions set forth in the Declaration, and that owners of Lots or parcels within the boundaries of the Property be members of the Crest Wood Estate Homeowners' Association (as created and authorized pursuant to the Declaration); NOW, THEREFORE, Declarant hereby declares: ARTICLE I The Property shall be held, sold and conveyed subject to the easements, restrictions, covenants and conditions set forth in the Declaration, incorporated herein by this reference, which easements, restrictions, covenants and conditions are for the purpose of protecting the value and desirability of, and which shall run with and bind, the Property and each and every part, parcel and Lot hereof, and be binding on all parties having any right, title and interest in the Property or any part, parcel or Lot thereof, their heirs, successors and assigns, and shall inure to the benefit of each Owner thereof. ARTICLE II Pursuant to Article VIII of the Declaration, the Declaration is hereby amended to include the Property, and the Property is hereby made subject to and the beneficiary of the rights, privileges, restrictions and covenants set forth in the Declaration. SUPPLEMENTAL DECLARATION - 2 ARTICLE III Except for terms expressly defined herein, all capitalized terms shall have the same meaning as defined in the Declaration. ARTICLE IV The Property shall be subject to the following additional or modified covenants, conditions and restrictions: ec ion 1. Article V, Section 7 of the Declaration is amended and modified, as it affects the Property, by deletion of the last clause thereof, so that Section provides: "No residential buildings shall be constructed or maintained on the Property without a minimum of permanently maintained off-street parking spaces in a private garage or carport area of two (2) parking spaces for each dwelling unit " Section 2. Article VI, Section 2 of the Declaration is amended and modified, as it affects the Property, by deletion of the present provision and substitution of the following provision: "No trailer, outhouse, garage, shed, tent or temporary building of any kind shall be erected or maintained on any Lot to building site, except for on a temporary basis during the course of construction of a dwelling structure on a Lot, and in such instance, only as is normal and customary for the residential construction industry in Ada County, Idaho." Section 3. Article VI, Section 5 of the Declaration is amended and modified, as it affects the Property, by deletion of the present provision and substitution of the following provision: 'No single story dwelling shall be erected which shall have a floor area, exclusive of porches and garages, of less than: a. 1,100 square feet on lots 11, 12, 15 and 17, block 5, and lots 28 and 29, block 4; SUPPLEMENTAL DECLARATION - 3 • b. 1,200 square feet on lots 24, 25, 26 and 33, block 4, and lots 8, 9, 13, 14 and 16, block 5; c. 1,300 square feet on lots 27, 30, 31, 32, 34 and 35 of block 4, and lot 10 of block 5. ~; i n .Article VI, Section 10 of the Declaration is amended and modified, as it affects the Property, by deletion of the present provision and substitution of the following provision: 'No fence shall be erected with a height greater than six feet (6') at or behind the front building line of any residence, nor greater than three feet (3') in front of any residence or within twenty feet (20') of any dedicated street." NOW, THEREFORE, Developer hereby declares that the Property shall be held, sold and conveyed subject to the following easements, restrictions, covenants and conditions, which are for the purpose of protecting the value and desirability of, and which shall run with and bind, the Property and each and every part, parcel and lot thereof, and be binding on all parties having any right, title or interest in the Property or any part, parcel or lot thereof, their heirs, successors and assigns, and shall inure to the benefit of each owner thereof. ARTICLE I SUPPLEMENTAL DECLARATION OF CRESTWOOD ESTATES SUBDIVISION N0. 4 AND ANNEXATION WITH CRESTWOOD ESTATES N0. 3 HOMEOWNER'S ASSOCIATION Section 1. For mutual enjoyment and protection, it is desireable t at the owners of lots in Crestwood Estates Subdivision No. 4 record this Supplemental Declaration for Crestwood Estates Subdivision No. 4 and be annexed with and be included in the Crestwood Estates No. 3 Homeowner's Association. Now, therefore, under the provisions of Article VIII of the Declarations of Covenants, ConditionsDevelo er annexesothe followingsproperty t a the Subdivision No. 3 the p property subject to said. Declarations to wit: CRESTWOOD ESTATES SUBDIVISION N0.4 according to the official plat thereof on file in the office of the county recorder of Ada County, State of Idaho, in Book of Plats at page Such-annexation is .for the sole purpose of including the common properties and lot owners in Crestwood Estates Subdivision No. 4 in the Crestwood Estates No. 3 Homeowner's Association. Articles I, II, IIl and IV only of the recorded Declaration of Covenants, Conditions and Restrictions for Crestwood Estates Subdivision No. 3 are, by reference, made a part of this :supplemental declaration, and shall govern the rights and obligations of Developer, Owner, and all common properties within Crestwood Estates Subdivision No. 4. Except as expressly provided above, all other covenants, conditions and restrictions applicable to Developer, Owners, and Property within Crestwood Estates No. 4 are contained within the provisions of this Supplemental Declaration. ARTICLE II USE AND BUILDING RESTRICTIONS Section 1. No Lot or Lots on The Property shall be used for any purpose other than residential purposes unless otherwise shown on the official recorded plat by deed from Grantor or unless otherwise approved by the Association, given by majority-vote at a properly constituted meeting. Nothing in this section shall prevent a builder from using a constructed residence or portion thereof for a model or sales office during any period of time when said builder is actively marketing homes or lots in the subdivision. Section 2. No horses, cattle, cows, goats, sheep, rabbits, hares, reptiles or other animals, pigeons, pheasants, games birds, game or other birds, fowl or poultry shall be raised, kept or permitted upon said property or any part thereof, except that dogs and cats and other household pets may be kept, provided that they are not kept, bred or raised for commercial purposes or in unreasonable quantities, and provided that they do not become a nuisance to the owners of, or occupants of said property. Section 3. No part of said property shall be used for the purpose of dril ing thereon for, or producing therefrom, water, oil, gas or any mineral substance. ..The Developer hereby reserves all crude oil, petroleum, gas, brea, asphaltum and all kindred substances and other minerals and water rights under and in said land. Section 4. No noxious or offensive trade or activity shall be carried on upon said property or any part thereof, nor shall anything be done or maintained thereon which may be or become an annoyance or nuisance to the neighborhood. Section 5. Said real property and the building sites included therein are subject to such easements and right-of-way for erecting, constructing, maintaining and operating public sewers,~and poles, wires and conduits for lighting, heating, power,. telephone, cable television, if any, and any other method of conducting and performing any public or quasi-public utility service or function beneath the surface of the ground, as are more particularly set forth in the recorded plat of the Property, by deed or grant of easement, or are otherwise of record. Section 6. The Developer hereby reserves tj.a right to make any and al cuts and fills on the Property owned by it and on the building sites included therein, and to do such grading as in .its judgment may be necessary to grade streets and building sites designated or delineated upon the recorded plat the Property or any part thereof. Such rights may be developed and assigned by Developer to a buyer, or other party acting as the Developer of some or all of the Property within the Subdivision. Section 7. No residential buildings shall be constructed or maintained on the Property without a minimum of permanently maintained off-street parking spaces in a private garage or carport area of two (2) parking spaces for each dwelling unit, at least one parking space of which shall be a private garage. ~ ~~~ e traile~ livin Section 8. No trailer, boat, hors , g trailer, house car, camper or recreational vehicle shall be parked on any Lot unless it is parked behind the Front line of the dwelling structure and enclosed by fencing. Section 9. The Association shall upon demand at any time furnish to any Owner liable for said assessment a certificate in writing signed by an officer of the Association, setting forth whether said assessment has been paid. Such certificate shall be conclusive evidence of payment of any assessment therein stated to have been paid. Section 10. No part of said property shall be subdivided or split into lots of a lesser size than the size of the original Lots without consent of the' Association, given by majority vote at a properly constituted meeting. ARTICLE III CHARACTER OF BUILDING Section 1. No residential building may be erected or maintained on any of the Property except single family dwellings, with private appurtenant garages, and customary outbuildings. No building shall exceed more than three stories in height or forty (40) feet in height, whichever is less. Section 2. No trailer, outhouses, garage, shed, tent, or temporary bui ings of any kind shall be erected or maintained on any Lot or building site prior to the erection of the principal dwelling building therein. Section 3. The work of constructing any residence or building shall be prosecuted diligently and continuously from the commencement thereof until the same is completed. All structures shall be suitably painted, colored or stained immediately upon completion. Section 4. All yards completed exclusive of fenced areas shall be seec~iec~ -to grass or otherwise landscaped within 60 days of completion of construction or the arrival of suitable seeding weather, whichever occurs later. Section 5. No single story dwelling shall be erected which shall have a oor area exclusive of porches and garages of less than 1100 square feet. Section 6. No multiple level dwelling shall be erected which shalom ave a floor square foot area exclusive of porches and garages of less than 1,,600 square feet. Section 7. Without prior written approval of the Association given y majority vote at a properly constituted meeting, all roofs shall be constructed with vile or cedar shake surface. Section- 8. No building erected or constructed elsewhere shall be moved onto any lot or building site without the prior written approval of the Association .given by majority vote at a properly constituted meeting. Section 9. No motor vehicle not capable of being operated shall be par ed for longer than forty-eight (48) hours outside of a garage on any lot or building site. Section 10. No fence shall be erected with a height greater tha-neat or behind the front building line of any residence nor greater than 4' in front of any residence or within twenty (20) feet of any dedicated street. Section 11. A11 pipes, wire, .cables and conduits for lighting, eating power, telephone, cable television and any other method of conducting and performing any public or quasi-public utility service or function shall be beneath the surface of the ground. Section 12. No signs or other advertising device of any character s a e erected or maintained upon any part of the Property, except that (a) on any one ]:ot or building site one sign, not larger than eighteen (18) inches by twenty-four (24) inches, advertising the property for sale or rent, may be erected and maintained; (b) the Developer or its agents may erect and maintain on said property such signs and other advertising ,devices as it may deem necessary or proper in connection with the conduct of its operations for the development, improvement, subdivision or sale of said property. ARTICLE IV ADDITIONAL GENERAL PROVISIONS Section 1. Construction of Conditions and Restrictions The determination by any court that any of the provisions o t is declaration or any part hereof, are unlawful or invalid shall not affect the validity of the other provisions or remaining portions hereof. Section 2. Duration. The cotenants and restrictions of this declaration s all run w tTi and bind the land, and shall inure to the benefit of and be enforceable by the Association, or the Owner of any ,land subject to this Declaration, their respective heirs, successors and assigns until the year 2000 A.D., provided, however, that said covenants shall be automatically extended for successive periods of ten (10) years unless an instrument signed by the then Owners of two-thirds (2/3) of the lots has been recorded, agreeing to terminate said covenants and restrictions. Section 3. Notices. Any notice required to be sent to any Member or Owner under the provisions of this Declaration shall be deemed to have been properly sent when mailed, post-paid, to the last known address of the person who appears as Member or Owner on the records of the Association at the time of such mailing. Section 4. Enforcement. Enforcement of these covenants and restrictions s all e y any proceeding at law or in equity against any person or persons violating or attempting to violate any covenant or restriction, either to restrain violation or to recover damages, or both, and against the land to enforce any lien created by these covenants; and failure by the Association or any Owner to enforce any covenant or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. Section 5. Remedies. The .covenants, restrictions and conditions contained in ti~is Declaration or any supplement thereto shall be enforceable by proceeding for prohibitory or mandatory injunction. Damages shall not be deemed an adequate remedy for breach or violation but, in an appropriate case, punitive damages may be awarded. In any action to enforce any such covenant, restriction or condition, the party or parties successful in the .action shall be awarded costs including reasonable attorney's fees. Section 6. Protection of Encumbrancer. No violation or breach of any res riction, covenant or con ition contained in this Declaration or any supplement thereto and no action to enforce the same shall defeat, render invalid or impair the lien of any mortgage or deed of trust taken in good faith or the title acquired by any purchaser upon foreclosure of any mortgage or deed of trust. Any purchaser shall, however, take subject to this declaration and any supplement thereto, except only that violations or breaches which occurred prior to such foreclosure shall not be deemed breaches or violations hereof. Section 7. Owner to Indemnif Owners, and each of them, indemnify and old harm ess t e undersigned Developer, its agents, successors and assigns for any and all damages, actions and/or injuries sustained by Owner, or a member of his family or a licensee or invitee on his Property where such injuries arise on the Property. Section 8. Amendment. The covenants and restrictions of this Declaration may be changed by the recordation of a document signed by the owners of all of the lots subject to this Declaration. ARTICLE V RIGHTS RESERVED BY DEVELOPER Section 1. Notwithstanding anything to the contrary contained in this Declaration, the Developer expressly reserves unto: (a) Itself, its employees, successors and assigns, its agents, representatives, contractors and their employees; easements and rights-of-way on, over and across all or any part of the streets for vehicular and pedestrian. ingress and egress to and from any part of the Property, or any adjacent real property owned by Developer, or its successors or assigns; (b) Itself, its successors and assigns (including any district or other entity providing water, sewer, gas oil, electricity, telephone, cable television,. or other similar services); easements on, over, under and across all or part of the Common Area, and the utility easements as provided on the recorded subdivision plat for installation, use, maintenance and repair of all lines, wires, pipes, and all other things necessary for all such services, provided that any such lines, wires or pipes shall be underground and, further, provided that all work done in connection therewith shall be performed with reasonable care and that the surface of said easement area shall be restored to the level and condition that existed prior to the doing of such work; and (c) Itself, its employees, successors, assigns, agents, representatives, contractors and their employees; the right to use the Common Area, where applicable, to facilitate and complete the development of the Property, and any Annexed Property, including without limitation the use- of the Common Area, where applicable for: (1) Construction, excavation, grading, landscaping, parking and/or storage;. (2) The showing to potential purchasers of any unsold Lot, .unit or improvements within the project; (3) The display of signs to aid in the sale of any unsold lots and units or all or part of the Project.
