Recommendation: Approve with conditions (3 ayes, 2 absent)
Summary of Public Hearing:
The applicant’s representative, Daren Fluke, and the applicant, Kevin Howell,
testified in favor of the applicaton.
Tony Moss testified with concerns about access to his property.
Key issues of discussion and questioning by Commission included:
1. Commercial and office layouts are conceptual only. Clear pedestrian access is
needed from the residential areas to the office/commercial areas that do not
dead end into the rear of commercial/office buildings.
2. Access to the commercial and office areas must comply with ACHD offset
requirements.
3. Private street connections are required into the office/commercial areas.
4. The area around Summit Way does not have to be redesigned as staff had
requested.
Key Commission Changes to Staff Recommendation:
Lot 18, Block 10 does not have to be a private street. Instead, lots 18, 19, 20, and 21,
Block 10 will be combined into a single large residential lot.
Lot 26, Block 12 does not have to have frontage on Summit Way. Instead, the lot
must be provided an easement to both Summit Way, and the proposed L-O area.
Outstanding Issues for City Council:
The applicant should verify the number of lots—residential, commercial, office, and
common, as well as the acreage for the proposed project.
The P&Z motion included a statement that the lot layout for the commercial and
office areas is conceptual only and that they are not being platted at this time. This
infers that only the residential areas are approved on the preliminary plat and the
commercial and office areas should be shown as a single large lot for each area, with
the layout to be determined by a future preliminary plat for those areas. This issue
should be clarified during the public hearing.
“At least 10 days prior to the next hearing on this application, the applicant shall
provide a letter from the developer(s) of Lochsa Falls Subdivision stating that they
are in agreement to shift the location of W. Apgar Creek Street as depicted on the
proposed preliminary plat for Kelly Creek Subdivision. If the applicant cannot obtain
such a letter, the preliminary plat must be redesigned to conform to the approved stub
location.” Such a letter has not yet been received.
The Council may (or may not) wish to address the acceptability of the proposed lot
layout around Summit Way, and whether Lot 26 is approved without frontage on
Summit Way.
A final revised preliminary plat has not yet been received by staff for review.
