Dear Brent:
During the review and approval process for We1127 the Idaho Department of Environmental Quality
(IDEQ) added two new requirements to the project that were not include in our professional services
agreement. These requirements added additional work effort and costs as follows:
1. IDEQ rejected our original plan submittal due to the fact that a Preliminary Engineering Report
had not been submitted and approved. The requirement for the Preliminary Enginesring Report
has been added since the original contract, and IDEQ would not accept your approved Master
Plan as fulfilling the requirement even though Well 27 is specifically addressed in the Master
Plan. This issue caused additional services in the amount of $1,050.00 as shown in our February
2, 2009 bitting.
2. IDEQ added the requirement that we install a pressure relief valve on the distribution side of the
check valve. It is my professional opinion that IDEQ's position on this issue is not supported by
the current version of IDAPA 58.01.08, and was a very broad interpretation of the regulations to
support their requirement. This has not been a requirement on any of the previous well projects
we have completed for Meridian. This issue caused additional services to address IDEQ's
comments and make plan revisions in the amount of $1,754.41, which was included in the April
3, 2009 billing.
I am requesting a supplement in the amount of $2,804.41 for these additional services.
