Recommendation: Approve with conditions (3 ayes, 2 absent)
Summary of Public Hearing:
The property owner, John Schroeder, and the applicant, John Cook, testified in favor
of the applicaton.
Charlene Rockovitz testified in favor of the proposed apartments, but with concerns
over the rezone to Old Town because it may open the neighborhood up to other
potential Old Town uses that are less desirable.
Key issues of discussion and questioning by Commission included:
1. Location and arrangement of the trash enclosure(s).
2. Requirement for a fire hydrant at Pine and 2nd Street.
Key Commission Changes to Staff Recommendation:
Site Specific Condition 4 was modified to allow staff to work out the trash enclosure
location and design between the applicant and SSC.
Site Specific Condition 12 added to restate the fire department requirement for a new
hydrant at Pine and 2nd Street.
Standard Condition #6 was modified to clarify that sidewalks along 2nd Street must be
5 feet wide. A separate condition allows internal walkways to be reduced to 4 feet.
Outstanding Issues for City Council:
The Historic Preservation Commission (HPC) has submitted recommended
conditions of approval that were not discussed at the Planning & Zoning
Commission. Staff recommends that the Council consider the HPC’s
recommendations at the August 5 public hearing.
The applicant has submitted revised plans, stamped July 25, 2003. The revised plan
meets the conditions of the P&Z Commission with the minor exception that the curb
line of the northernmost planter area should extend east to tie into the trash enclosure.
This issue can be rectified upon submittal for a CZC. Also, additional trees must be
added to maximize the trees on site.
