T~eith Holloway) ,the party of the fast part, and hereinafter called the Grantor, and the City of Meridian, Ada County, Idaho, the parry of the second part, and hereinafter called the Grantee; WITNESSETH: WT-IEREAS, the Grantor desire to provide a sanitary sewer main right-of--way across the premises and property hereinafter particulazly bounded and described; and WHEREAS, the sanitary sewer is to be provided for through underground pipelines to be constructed by others; and WHEREAS, it will be necessary to maintain and service said pipelines from time to time by the Grantee; NOW, THEREFORE, in consideration of the benefits to be received by the Grantor, and other good and valuable consideration, the Grantor do hereby give, grant and convey unto the Grantee the right-of--way for an easement for the operation and maintenance of sanitary sewer rrtains over and across the following described property: An easement located in the NW 1!4 of the SW 1/4 of Section 12, Township 3 North, Range 1 West, Boise Meridian, Ada County, Idaho, more particularly described as follows: Beginning at a brass cap marking the Northwest corner of the NW 1/4 of the SW 114 Section 12, T. 3N., R. 1W., S.M.; thence S 89°30'16" E 661.51 feet along northerly boundary of Said NW 1/4 of the SW 1l4 to a point; Thence S 0'30'23" W 30.00 feet to a point on the southerly right-of--way of West Pine Avenue; Thence S 89°30'16" E along said southerly right-of-way of West Pine Avenue 107.34 feet to a point on the centerline of a sewer line the Beginning Point of the center line of a 20' easement, being 10 feet on each side of the following described line; Thence S 0'29'44" W 81.73 feet to a point; Thence S 28°50'23" W 1?7.47 feet to a point; Thence S 0'30'23" W 143.59 feet to the End Point of said centerline of this sewer line easement. Tie easement hereby granted is for the purpose of construction and operation of sanitary sewer mains ar~d their allied facilities, together with their maintenance, repair and replacement at the convenience of the Grantee, with the free right of access to such facilities at any and all times. Page t ^ J IT iS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto, that the Grantee, in making future repairs, will expediently replace and restore the premises to a condition comparable to that existent prior to undertaking such, repairs and replacement. How'eVez', the Grantee will not be responsible for repairing, replacing or restoring any permanent structures, Iazge trees or brush placed within the area described in this easement. THE GRANTOR hereby covenant and agree that they will not place or allow to be placed arty permanent structures, Iazge trees or brush within the area described for this easement, which would interfere with the use of said easement, for the purposes stated herein. THE GRANTOR do hereby covenant with the Grantee that they are lawfully. seized and possessed of the aforementioned and described tract of land, and that they have a good and la~cvful right to convey said easement, and that they will warrant and forever defend the title and quiet possession thereof against the lawful claims of all persons whomsoever.
