This matter coming before the City Council for Final Plat approval pursuant to
Meridian City Code § 12-3-7 on June 24, 2003, and the Council finding that the Administrative
Review is complete which has included certain comments as stated in a letter to the Mayor and
Council from Sonya Allen Planner I for the Planning and Zoning Department, and Bruce
Freckleton, Engineering Technician III, and that Anna Powell Planning Director for the Planning
and Zoning Department, Brad Watson City Engineer, and Becky McKay, commented at the
hearing, and the Council having considered the requirements of the preliminary plat the Council
takes the following action:

Specific Comments/Final Plat, a true and correct copy ofwhich is attached hereto marked
Exhibit "A", and consisting of four pages, and by this reference incorporated herein, and the
response letter from Becky McKay of Engineering Solutions, LLP in her letter dated June 19,
2003, a true and correct copy of which is attached hereto marked Exhibit "B", and consisting of
two pages, and by this reference incorporated herein, and the additional requirements from the
action of the Council taken at their June 24, 2003 meeting as follows, to-wit:
1.1 From the staff comments in their letter dated: Heazing Date: June
24, 2003, under Site Specific Comments/Final Plat number 2, it
shall now read as follows:
SITE SPECIFIC COMMENTS/FINAL PLAT
2. It is the intent of the developer to transfer ownership and
maintenance to Nampa-Meridian Irrigation District.
However, since the properly is split between two districts
(Settler's and NMID), an agreement is required between the
districts. The districts have been unable to come to an
agreement. Therefore, the system is being operated and
maintained by the association. If the districts cannot come
to an agreement, the system will remain under the
association. The City of Meridian requires that pressurized
in•igation systems be supplied by a year-round source of

water. If a creek or well source is not available, asingle-
point connection to the culinary water system shall be
required. If a single-point connection is utilized, the
developer shall be responsible for the payment of
assessments for the common azeas prior to signature on the
final plat by the Meridian City Engineer.
1.2 Comply with the Nampa & Meridian Irrigation District
requirements as follows:
The District has no facilities impacted by this phase of this
project. All laterals and waste ways must be protected. All
municipal surface drainage must be retained on site. If any
surface drainage leaves the site, the District must review
drainage plans.
2. The developer must comply with Idaho Code 31-3805. It is
recommended that irrigation water be made available to all
developments within the District.
1.3 Comply with the Meridian Fire Department requirements as
follows:
1. Commercial occupancies will require afire-flow consistent
with the Uniform Fire Code to service the proposed project.
Fire hydrants shall be placed an average of 400' apart.

2. The fire department requests that any future signalization
installed as the result of the development of this project be
equipped with Opticom Sensors to ensure a safe and
efficient response by fire and emergency medical service
vehicles. This cost of this installation is to be borne by the
developer.
3. Acceptance of the water supply-for fire protection will be
by the Meridian Water Department.
4. Final approval of the fire hydrant locations shall be by the
Meridian Fire Department. The proposed fire hydrant
locations will be submitted to the Public Works for plan
review.

5. All roads and fire lanes shall have a turning radius of 28'
inside and 48' outside.
6. Insure that all yet undeveloped parcels are maintained free
of combustible vegetation per section 1103.2.4 of the
Uniform Fire Code.
7. All access roads within the project shall have a cleaz
driving surface with a minimum width of 20' available at
all times. The typical street widths of 33' will be allowed
to have parking on both sides. The typical street with a
minimum width of 29' will be required to have restricted
parking to only one side. UFC 902.2.2.1
8. Operational fire hydrants and temporary or permanent street
signs are required before combustible construction begins.

9. The phasing plan may require that any roadway greater than
150' in length that is not provided with an outlet shall be
required to have a turn around.
10. That afire-flow of 1,000 gallons per minute shall be
available for duration of 2 hours to service the single-family
dwellings within the project. Fire hydrants shall be placed
an average of 400' apart. 1997 UFC Appendix III-A
1.4 The Central District Health Department requires after written
approval from the appropriate entities aze submitted, they can
approve this proposal for central sewage and central water; that
plans must be submitted to and approved by the Idaho Department
of Health and Welfare, Division of Environmental Quality for
central sewage and central water; that run-off is not to create a
mosquito breeding problem; and it is suggested that stormwater be
pretreated through a grassy swale prior to dischazge to the
subsurface to prevent impact to groundwater and surface water
quality; that engineers and azchitects should obtain current best
management practices for stonnwater disposal and design a
stormwater management system that is preventing groundwater and
surface water degradation. Manuals for guidance:

1.5 Comply with the Parks and Recreation Department requirements as
follows:
Pipe replacement across Meridian Road to the existing
manhole should be reviewed now rather than later.
2. How far to the east of the Sundance pump station is the
developer planning to pipe the ditch? We get a lot of debris
in the ditch along Ustick Road and have to constantly clean
it. This debris could get right into the Sundance pump
station. If a grate is installed it can easily get covered with
trash and the ditch will flood along Ustick Road. The ditch
should be piped up to where it crosses Ustick Road.
2. The final plat upon which there is contained the Certification and signature of the City
Clerk and the City Engineer verifying that the plat meets the City's requirements shall be
signed only at such time as:
The Plat dimensions aze approved by the City Engineer; and
2. The City Engineer has verified that all off-site improvements are
completed and/or the appropriate letter of credit or cash has been issued
guaranteeing the completion of off-site and required on-site
improvements.

Lots, Four (4) Office Building Lots, and Five (5) "Other" Lots on 16.17 Acres
in an R-8 (PD) Zone, by Sundance Limited Company, LLC (File No. FP-03-
035).
We have reviewed the above referenced submittals and offer the following comments, as
conditions of approval. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY
The applicant, Sundance Limited Company, LLC, has requested approval of the final plat for
Sundance Subdivision No. 3, consisting of thirty-eight (38) single-family building lots, four (4)
office building lots, and five (5) "other" lots on a 16.17 acre parcel of land located on the
northeast corner of the Meridian and Ustick Road intersection.
The City Council approved the annexation, preliminazy plat, and conditional use permit (PD)
for the subdivision in 2002.
The submitted final plat appears to be in conformance with the approved preliminary plat.
LOCATION
The property is located at the northeast corner of Meridian and Ustick Road.
SURROUNDING PROPERTIES
North: Sundance Place Subdivision zoned R-8.
South: Bedford Place Subdivision (R-8) and rural residential properties zoned R-1 (Ada County).
East: Rural residential, zoned R-1 (Ada County).

FINAL PLAT FINDINGS AND REOUIItEMENTS
Sections 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the acceptance of a proposed
subdivision, the Commission/Council shall consider the objectives of this title and at least the
following:
a. The conformance of the subdivision with the Comprehensive Development Plan;
Staff finds the subdivision to be in conformance with the Comprehensive Plan.
b. The availability of public services to accommodate the proposed development;
Staff finds that public services can be made available to the lots within the proposed
subdivision.
c. The continuity of the proposed development with the capital improvement

3. Graphcally depict 10-foot wide public utilities, drainage and irrigation easements along
all rear lot lines that are not adjacent to the subdivision boundary.
4. Graphically depict 8-foot wide public utilities, drainage and irrigation easements along all
side lot lines where pressurized irrigation mains run.
5. Graphically depict S-foot wide public utilities, drainage and irrigation easements along all
lot lines adjacent to the subdivision boundary that will be side lot lines in future phases.
6. Street signs are to be in place, water system shall be approved and activated, pressurized
irrigation system approved and activated, drainage lots constructed, fencing installed, and
road base approved by the Ada County Highway District prior to applying for building
permits. All development improvements, including perimeter fencing and landscaping
shall be installed and approved prior to obtaining certificates of occupancy. Surety, per
City Ordinance 12-5-3, will be required for all fencing, landscaping, pressurized
irrigation, sanitary sewer, water, etc., prior to signature on the final plat.
7. Sanitary sewer service and municipal water to this site shall be via extensions from
existing mains installed adjacent to the proposed subdivision. Applicant will be
responsible to construct the sewer and water mains to and through this proposed
development, thereby making them available to adjacent properties. Subdivision designer
to coordinate main sizing and routing with the Public Works Department
8. Applicant shall be required to pay Public Works development plan review, and
construction inspection fees, as determined during the plan review process, prior to
signature on the final plat per Resolution 02-374.
9. All drainage areas (detension/retension basins) must be designed to ensure that water is
retained only during 25-year storm events, and for a period of time not to exceed 24
hours. Side slopes within drainage areas shall not exceed 3:1.
10. Revise the landscape plan to include landscaping within the Ustick Road right-of--way per
MCC 12-13-10-9. A license agreement may be required between the property owner and
ACRD.
11. Add the "N" to the chord bearing curve C-2 in the Certificate of Owner's.
12. Correct "ARADIUS" in curve C-1 in the Certificate of Owner's.
13. Add or revise the following plat notes:
• Add a note to the face of the plat (#18) referencing the approved Development
Agreement (Inst. No. 102056126) and Conditional Use Permit (CUP-Ol-030).

14. Staff s failure to cite specific ordinance provisions-or terms of the approved preliminary
plat, does not relieve Applicant of responsibility for compliance.
GENERAL REQUIREMENTS
1. All irrigation ditches, laterals or canals, exclusive of natural waterways, intersecting,
crossing or lying adjacent and contiguous to the area being subdivided shall be tiled per
City Ordinance 12-4-13. Plans will need to be approved by the appropriate
irrigation/drainage district, or lateral users association, with written confirmation of said
approval submitted to the Public Works Department.
2. Any existing domestic wells and/or septic systems within this project will have to be
removed from their domestic service per City Ordinance Section 9-1-4 and 9-4-8. Wells
may be used for non-domestic purposes such as landscape irrigation.
3. Two-hundred-fifty and 100-watt, high-pressure sodium streetlights will be required at
locations designated by the Public Works Department. All streetlights shall be installed at
subdivider's expense. Typical locations are at street intersections and/or fire hydrants.
Final design locations and quantity are determined after power designs are completed by
Idaho Power Company. Street light contractor to obtain design and permit from the
Public Works Department prior to commencing installation.
4. Compaction test results must be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.
5 Applicant's engineer will be required to submit a siated, stamped statement certifying
that all street finish centerline elevations are set a minimum of three feet above the
highest established normal groundwater elevation.
6. Coordinate fire hydrant placement with the City of Meridian's Water -Works
Superintendent.
7. Provide five-foot-wide sidewalks in accordance with City Ordinance Section 12-5-2.K.
8. Any tree over 4" in caliper that is removed from the property shall be replaced by
installing a dditional t rees, b eing t he a quivalent n umber o f c aliper i nches o f t rees that
were removed. Required landscaping trees will not be considered as replacement trees for
those trees that have to be removed.
Despite modifications to the phasing plans of this subdivision, staff supports the approval of this
