ORDER GRANTING APPLICATION
FOR TRANSFER OF CONDITIONAL
USE PERMIT
This matter coming on regularly for public hearing before the City Council on
July I, 2003, and Anna Powell Planning Director for the Planning and Zoning
Department, and the applicants, Zejna Garibovic and Kathy Sokoli, appeared and
commented at the hearing, and the Council having considered the record of this matter
and the testimony submitted, and the Planning Director for the Planning and Zoning
Department stating there was no objection to the application, and the applicant having no
objection to the request IT IS HEREBY ORDERED AND THIS DOES ORDER
THAT:
I.
The applicants, Zejna Garibovic and Kathy Sokoli, are requesting a
transfer of Conditional Use Permit for the existing child care center "All About Kids"
located at 1155 E. Chateau Drive, Meridian, Idaho.
2.
Conditional Use Permits, once they are approved, normally run with the
land, and upon sale of the property are transferred to the new owners without further
application, however, home occupations and child care facilities are the exception to this.

original conditional use was approved are required to petition the City Council for
approval (MCC 11-17-10).

The current owners of the property are Muhammad and Sabiha Ali, and
they have submitted notarized consent for this application.

The original conditional use permit was submitted by Jerry Cobler and
approved by City Council on June 11, 1996. The permit was approved for the care of up
to 25 children.
5.
The following uses surround the subject property:
North - Single-family residential, Chief Joseph School, zoned R-4
South - Single-family residential, zoned R-8
East - Single-family residential, zoned R-8
West - Single- family residential, zoned R-8

The application is granted subject to the conditions stated herein.
7.
The conditional use permit held by All About Kids for a child care at 1155
East Chateau, Meridian, Idaho, is hereby transferred to Zejna Garibovic and Kathy
Sokoli.
8.
The conditional use permit is subject to the following additional
conditions:

The transfer ofthe conditional use permit shall require the
applicant to comply with the requirements of the original
conditional use permit, which is on file with the City Clerk's
office, under Jerry Cobler and approved by City Council on June
II, 1996, for the care of up to 25 children.

Adopt the Recommendations of the Meridian Fire Department as
follows:

I.
Provide a fire-flow per the UFC Appendix III-A to service
the project. Fire hydrants shall be placed an average of
400' apart. 1997 UFC Appendix Ill-A
2.
All internal roads shall have a turning radius of28' inside
and 48' outside.
3.
All access roads within the project shall have a clear
driving surface with a minimum width of20' available at
all times. UFC 902.2.2.1
4.
Pass a fire inspection for Daycare utilizing the criteria on
the State Fire Marshal's Daycare Inspection form.
Adopt the Recommendations of the Ada County Highway District
as follows:
I.
All future design plans and construction shall be in
accordance with the ACHD Policy Manual, ISPWC
Standards and approved supplements, Construction
Services procedures and all applicable ACHD Ordinances
unless specifically waived in writing by the District.
Adopt the Recommendations ofthe Central District Health
Department as follows:
I.
The new owner shall contact Susan Simons at the
Department regarding licensure.
