This application has been referred to ACRD by the City of Meridian for review and comment. The
applicant is requesting preliminary plat approval fora 3-lot commercial subdivision on 5.21-acres. The
5.21-acre site is located on the northwest comer of South Allen Street and Magic View Drive. This
developmenYis estimated to generate 164 additional vehicle trips per day (1,828 existing) based on the
Institute of Transportation Engineers Trip Generation Manual.

B. On September 10, 2001, the District Planning and Development staff inspected this site and
evaluated the transportation system in the vicinity. On September 14, 2001, the staff met as the
District's Technical Review Committee and reviewed the impacts of this proposed development
on the District's transportation system. The results of that analysis constitute the following Facts
and Findings and recommended Site Specific Requirements.
C. For the purposes of estimating daily trip generation and assessing impact fees for this project, the
proposed use of this development has been classified as general office (per the ITE Manual) The
impact fee rate from the fee tables for this use is $2,772.00 per thousand square feet of gross
building area, based on the impact fee ordinance in effect at this time. Note: This rate is
provided for informational purposes only and shall not be construed as an impact fee rate
certification. The impact fee will be assessed at the time of plans acceptance by District
staff, and shall be based on the fee tables and provisions of the District's Impact Fee
Ordinance in effect at that time.
D. The St. Luke's Eagle Road intersection currently operates at a level of service "F". To improve
the level of service, The Idaho Transportation Department will be required to improve their leg to
improve the entire fimction of the intersection.
E. In the consideration of previous developments in the Magic View Subdivision, the District found
that the anticipated fiscal impacts of the projected developments in the area are of such a
magnitude that the District will be unable to accommodate the developments without excessive

and unscheduled public expenditures which exceed the anticipated impact fees from such
developments. Therefore, the Commission, in its review of MCU-43-97, adopted an
extraordinary impact fee of $43.19 per trip based on trip generation rates. Mystery View
Subdivision is estimated to generate 164 additional trips per day, resulting in an extraordinary
impact fee of $7,083.16. Staff recommends that the Commission require the payment of this
amount to reimburse the proportionate cost of the construction of West Magic View Drive from
Eagle Road.
F. Allen Street between West Magic View Drive and St. Luke's was constructed in 2000.
Therefore, utility street cuts will not be allowed without prior written approval from the District
unti12005.
G. If the improvements are damaged during construction, the applicant should replace any damaged
curb, gutter and/or sidewalk on South Allen Street and Magic View Drive with new curb, gutter
and/or concrete sidewalk to match existing improvements. Segments to be replaced shall be
determined by ACHD Construction Services staff. Contact Constmction Services at 387-6280
(with file number) for details.
H. The applicant is proposing to utilize an existing shared driveway on South Allen Street located
approximately 300-feet north of Magic View Drive. This driveway meets District policy and
should be approved with this application.
I. The applicant is proposing to utilize an existing shazed driveway on Magic View Drive located
approximately 400-feet west of South Allen Street. This driveway meets District policy and
should be approved with this application.
J. Graveled driveways abutting public streets create maintenance problems due to gravel being
tracked onto the roadway. In accordance with District policy, the applicant should be required to
pave the driveway its full width 25 to 30 feet and at least 30-feet into the site beyond the edge of
pavement of South Allen Street and Magic View Drive.
K. The applicant should provide a recorded cross access easement for the parcels within the
subdivision to use the shazed driveways for access to the public streets.
L. Any existing irrigation facilities should be relocated outside of the right-of--way.
M. All utility relocation costs associated with improving street frontages abutting the site should be
home by the developer.
N. Based on development patterns in this azea and the resulting traffic generation, staff anticipates
that the transportation system will be adequate to accommodate additional traffic generated by
this proposed development with the requirements outlined within this report.
The following Site Specific Requirements and Standard Requirements must be met or provided
for prior to ACHD approval of the final plat:

Site Specific Requirements:

3. Replace any damaged curb, gutter and/or sidewalk on South Allen Street and Magic View Drive
with new curb, gutter and/or concrete sidewalk to match existing improvements. Segments to be
replaced shall be determined by ACRD Construction Services staff. Contact Construction Services
at 387-6280 (with file number) for details.

borne by the developer.
Standard Requirements:
A request for modification, variance or waiver of any requirement or policy outlined herein
shall be made in writing to the ACRD Planning and Development Supervisor. The request
shall specifically identify each requirement to be reconsidered and include a written explanation
of why such a requirement would result in a substantial hardship or inequity. The written
request shall be submitted to the District no later than 9:00 a.m. on the day scheduled for
ACRD Commission action. Those items shall be rescheduled for discussion with the
Commission on the next available meeting agenda.
Requests submitted to the District after 9:00 a.m. on the day scheduled for Commission action
do not provide sufficient time for District staff to remove the item from the consent agenda and

report to the Conunission regazding the requested modification, variance or waiver. Those
items will be acted on by the Commission unless removed from the agenda by the Commission.
2. After ACHD Commission action, any request for reconsideration of the Commission's action
shall be made in writing to the Planning and Development Supervisor within six days of the
action and shall include a minimum fee of $110.00. The request for reconsideration shall
~ecifically identify each requirement to be reconsidered and include written documentation of
data that was not available to the Commission at the time of its ori¢inal decision. The request
for reconsideration will be heard by the District Commission at the next regular meeting of the
Commission. If the Commission agrees to reconsider the action, the applicant will be notified
of the date and time of the Commission meeting at which the reconsideration will be heard.
3. Payment of applicable road impact fees are required prior to building construction in
accordance with Ordinance #193, also known as Ada County Highway District Road Impact
Fee Ordinance.
4. All design and constmction shall be in accordance with the Ada County Highway District
Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures
and all applicable ACRD Ordinances unless specifically waived herein. An engineer registered
in the State of Idaho shall prepaze and certify all improvement plans.
5. The applicant shall submit revised plans for staff approval, prior to issuance of building permit
(or other required permits), which incorporates any required design changes.
6. Construction, use and property development shall be in conformance with all applicable
requirements of the Ada County Highway District prior to District approval for occupancy.
It is the responsibility of the applicant to verify all existing utilities within the right-of--way.
Existing utilities damaged by the applicant shall be repaired by the applicant at no cost to
ACHD. The applicant shall be required to call DIGLINE (1-800-342-1585) at least two full
business days prior to breaking ground within ACRD right-of--way. The applicant shall contact
ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) aze
compromised during any phase of construction.
8. No change in the terms and conditions of this approval shall be valid unless they are in writing
and signed by the applicant or the applicant's authorized representative and an authorized
representative of the Ada County Highway District. The burden shall be upon the applicant to
obtain written con£mnation of any change from the Ada County Highway District.
9. Any change by the applicant in the planned use of the property which is the subject of this
application, shall require the applicant to comply with all rules, regulations, ordinances, plans,
or other regulatory and legal restrictions in force at the time the applicant or its successors in
interest advises the Highway District of its intent to change the planned use of the subject
propertyunless awaiver/variance of said requirements or other legal relief is granted pursuant
to the law in effect at the time the change in use is sought.

Conclusion of Law:
1. ACRD requirements are intended to assure that the proposed use/development will not place an
undue burden on the existing vehicular and pedestrian transportation system within the vicinity
impacted by the proposed development.
