In response to your email below, please note the following:
Per staff recommended condition of approval of the CUP for IDADIV (the hearing is scheduled for April
161'), the project is not allowed to submit a Certificate of Zoning Compliance application or obtain building
permits prior to recordation of the final plat for the first phase. The reason for this is the IDADIV site is not a
legal parcel; it was illegally split. (The preliminary plat condition that prohibited building permits from being
issued for the unplatted portion identified as phase 2 until a subsequent final plat or plats are recorded was
solely for the purpose of ensuring the extension of the remaining portion of Corporate Drive.)
• You are correct, General Requirement #2 does not apply to this project and should be stricken.
If you have any further questions regarding this matter, please don't hesitate to contact me at 8845533. Also,
please let me know if you're in agreement with the staff report as written with the clarification above.
Note: The final plat is not a public hearing so Art does not need to present the project at the meeting tonight. If the
applicant is in agreement with the staff report, it's not necessary for the applicant to attend the hearing at all. If the
applicant is not in agreement, we need to discuss the matter further prior to the hearing and possibly continue the
hearing.

Thank you for sending over the staff report for Trade Plaza Subdivision No. 1. 1 have reviewed the report and it
looks well put together and in good shape with a couple of minor clarifications.
1. In reference to General Requirement 2 on Page 2 of the Staff Report, I just wanted to clarify that it is
my understanding that the City will allow the IDADIV project (in Lot 4, Block 1) to continue processing of
the applications, including building permits prior to recording of the plat. I believe that the Council
clarified this requirement during the preliminary plat approval by specifically restricting any building in
Phase 2 until a plat was recorded there.
2. General Requirement 5 on Page 2 of the Staff Report (re: play equipment) appears to be boiler plate
language from another project and does not apply to this application.
I appreciate your time and effort in pulling this together. Please let me know if you have any questions,
otherwise I will be there on Tuesday night.
