be commercial. The Comprehensive Plan recognizes that the shape
and character of Old Town will change - with growth and develop-
ment with mixed use.

he advised the Council him and his wife had been out of town and there

AN ORDINANCE AMENDING AND CHMGING THE ZONING OF CERTAIN REAL
PROPERTY IN THE CITY OF MERIDIAN WHICH IS DESCRIBED AS THE SOUTH
HALF OF LOTS 10, 11, 121 13, 14 AND 15 IN BLOCK 1 OF AMENDED PLAT
OF F. A. NOURSE'S THIRD ADDITION TO MERIDIAN, ACCORDING TO THE
OFFICIAL PLAT THEREOF, FILED IN BOOK 7 OF PLATS AT PAGE 299,
OFFICIAL RECORDS, KNOWN AS 1103 EAST FIRST STREET, MERIDIAN,
IDAHO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council and the Mayor of the City of
Meridian, Idaho, have concluded that it is in the best interest
of said City to amend and change the zoning from (R-15)
Residential to (C -C) Community Commercial, for the following

AMENDED PLAT OF F.A. NOURSE'S THIRD ADDITION to Meridian, Ada

Regular Meeting of the Meridian Planning & Zoning Commission called to
order by Chairman Walt. Morrow at 7:30 p.m.:
Chairm Morrow welcomed and introduced the new member of the Commission
Charles Rountree.
Members Present: Moe Alidjani, Jim Johnson, Charles Rountree;

Fact and Conclusion as prepared on this application:

Meridian.
2. It is the policy of the City of Meridian to set
aside areas where commercial and industrial interest
and activities are to dominate.
4. Positive programs should be undertaken to support
existing industrial and commercial areas to insure
their continued vitality, such as:

CONCLUSIONS

amendments and rezones pursuant to Title 67, Chapter 65, Idaho

Ordinances of the City of Meridian.
2. That upon rezone,, the City of Meridian has authority
to place conditions upon the zoning amendment.
3. That 11-2-416(A) of the Revised and Compiled
Ordinances of the City of Meridian sets forth the standards under
which the Planning and Zoning Commission and the City Council
shall review applications for zoning amendments; that upon a
review of those requirements and a review of the facts presented
and the conditions of the area, the Planning and Zoning
Commission specifically concludes as follows:
(a): The new zoning would be .harmonious with and in
accordance with the Comprehensive Plan and no
Comprehensive Plan -Amendment is required.
(b) The area wasinot-previously scheduled for a
rezone but is -designated to be commercial in
in the future.
(c) The area included in the zoning amendment is
intended to be developed in the future in the
fashion that would be allowed under the new zoning of
Community Commercial (C -C).
(d) There has been a change in the area in that other
properties in.the area have been similarly re -zoned.
(e) The Applicant made representations that the area
would be designed and constructed to be harmonious
with the surrounding area.
(f) The uses would not be hazardous or -disturbing to
existing or -future neighborhood uses.
(g) The area would be adequately served by public
facilities and services as those are already
available and in place on the property.
(h) The possible proposed uses would not create

excessive additional requirements of public costs for
public facilities and services and would not be
detrimental to the economic welfare of the
community.
(i) The proposed use will not involve any detrimental
activity to any person's property or the general
welfare.
(j) Development should not cause a significant
increase in vehicular traffic and should not interfere
with surrounding traffic patterns.
(k) That this rezone would not result in the
destruction, loss or damage of any natural or
scenic feature of major importance.
(1) The proposed zoning amendment is in the best
interest of the City of Meridian.
4. That the requirements and comments of the City
Engineer and other governmental agencies are reasonable and
should be a condition of the rezone and met by the Applicant,
provided, however, the requirements of ACHD shall not be required
to be met until the property is re -developed.
5: That the property and Applicant shall be required to
meet all City Ordinances.

The Meridian Planning and Zoning Commission hereby adopts

Johnson: I have had this property since 1980 and planned on using
it for my insurance office, I have not done this yet as it has not
been economically feasible as yet. I paid to much for the property
I bought it when the price of real estate was up, I paid more for it
than it is worth now and if I do make it into my office I want to
do it right, do the proper landscaping and remodeling and parking.
Raymond Grosso, 36 East Carlton, if they want to build something
there do we have any jurisdiction as.to what they can build?
Chairman Morrow; No you would not, other than it would have to be
something that would be allowed under the Ordinances in that zone
and they would have to meet all the requirements of the Ordinances.—
Grosso: Would it increase our taxes?
Chairman Morrow: -No it would ,not effect your property :at- all, -i:t would, -
impact the tax -es for that-property,only=Bering no other comments or
testimony we'will close the'Public Hearing.Are there any=comments= ---

FACTS & FINDINGS:
1. This is a rezone from R-15 to C -C (Community Commercial).
2. East 1st Street has 80 -feet of right-of-way (which is adequate) and is
fully improved.
3. Carlton Avenue has 60 -feet of right-of-way (which is adequate) and is
fully improved.
4. There is a lot of damaged and uneven sidewalk fronting the property.
There is no pedestrian ramp at the co mer of East 1st and Carlton.
5. East 1st Street is currently under the jurisdiction of Idaho Transporta-
tion Department.
If the rezone is approved and development proceeds, the District will have the
following requirements:
SITE SPECIFIC REQUIREMENTS:
1. Replace all unused curb cuts on Carlton with standard curb, gutter, and
sidewalk.
2. Replace all damaged and uneven sidewalk sections on Carlton abutting
parcel.
STANDARD REQUIREMENTS:
1. Submit two sets of street improvement plans for review and approval by
the District.
2. Submit a site drainage plan showing that site drainage will not flow onto
Ada County Highway District right-of-way, in accordance with Boise City
Code 11-3-54 (A) , where applicable, and ACHD policy.
