CONTENTS OF CONDITIONAL USE APPLICATION
An application for a Conditional Use Permit shall be filed
with the Administrator by at least one (1) owner of lessee
of property for which such conditional use is proposed. At
a minimum, the application shall contain the following information
where applicable. (Application available from Administrator):
-kr.- Name, address and phone number of applicant;
Name, address and phone number of owner of subject property;
3. Legal description of property;
4. Proof of ownership of subject property;
,&'. Description of existing use;
,,6--.' Present use of subject property;
Proposed use of the subject property;
Twenty-five (25) copies of a vicinity map of a scale of
one (1) inch equals three hundred (300) feet;
,9: Characteristics of subject property which make a conditional
use desirable;
10. A listing of the mailing addresses of all property owners
(from authentic tax records of Ada County) who are within
three hundred (300) feet of the external boundaries of
the land being considered, and a list of all owners within
the area being considered for a Conditional Use;
7Lq.1T. In Residential Zoning a petition signed by three-fourths
(3/4) or seventy-five percent (75%) of all those persons
owning property within said three hundred (300) feet approving
of the Conditional Use, and a petition signed by one hundred
percent (100%) of all landowners within the area being
considered showing their approval of the proposed Conditional
Use; Does not apply to Old Town Zoning,Commercial or Industrial
Zoning
12. A fee established by the Council; (See 2-422 A) $160.00
A statement that the owner grants a lien against said property
for payment of all costs incurred by the City including engineer-
ing, publication and attorney fees.
L4-.-eA statement that the proposed use does or does not violate any
subdivision covenants or restrictions or deed restrictions.
15 The property.will be posted 1 week before hearing stating they
have applied for a Conditional Use Permit or Zoning. There must
be a signed affidavit that this has been done as part of the
application.

with the request for a Conditional Use Permit for The Joy School of
Meridian.
One item that came up in regards to the parking area as to whether it
would have to be paved or not. According to the Ordinance all off-
street parking areas shall be paved. (See Attached)

FACTS & FINDINGS:
1. Mary L. Wilson requests a Conditional Use permit to operate preschool
classes for 10 children in an existing building.
2. Meridian Street has 70 -feet of right-of-way (which is adequate), and is
improved with 1/2 plus 12 -feet of a 56 -foot back-to-back roadway
® section without sidewalk along most of the subject parcel frontage.
The curb stops about 20 -feet south of the north property line.
3. The developer is proposing to provide some (3-4 vehicles) off-street
parking on both sides of the building, which would require vehicles to
back into the public right-of-way. With only 65 -feet of street
frontage, District policy allows only one access to Meridian Street.
SITE SPECIFIC REQUIREMENTS:
1. Provide curb, gutter, 5 -foot sidewalk, and match paving on Meridian
abutting parcel.
2. Only one access to Meridian Street is permitted.
STANDARD REOUIREMENTS:
1. Improvements to the dedicated right-of-way to be designed and construc-
ted to ACHD standards and specifications.
2. All specifications, land surveys, reports, plats, drawings, plans,
design information and calculations presented to Ada County Highway
District are to be sealed, signed and dated by a Registered Profes-
sional Engineer or Professional Land Surveyor, in accordance with
Idaho Code 54-1215.
3. Provide for the continuation of all existing irrigation and drainage
systems across parcel.

PRESCHOOL CLASSES (
4. Submit 3 -sets of street improvement plans for review and approval by
the District.
5. Submit a site drainage plan showing that site drainage will not flow
onto Ada County Highway District right-of-way, in accordance with Boise
City Code 11-3-54 (A), where applicable, and ACRD policy.
6. Access to parcel to be reviewed and approved by the District.
7. Driveways to be located a minimum of 5 -feet from the property line.
S. Any work within ACHD right-of-way requires a permit. For information
regarding the requirements to obtain a permit, please contact Quality
Control at 345-7667. CU, DR, or PDC file number required.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the
Planning and Zoning Commission of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 o'clock p.m. on February 14,
1989, for the purpose of reviewing and considering the
Application of Mary Wilson for a conditional use permit for the
operation of a pre-school for children ages 3-5 and an after
school program for elementary aged children, at 1608 Meridian
Street, Meridian, Idaho; a more particular description of the
above property is on file in the City Clerk's office and is
available for inspection during regular business hours.
Public comment will be taken and is welcome.

ITEM 5
The property at 1608 Meridian St. currently consists of
a rental apartment in the front of the building. The re-
maining two-thirds is used for storage.
ITEM 6

ITEM 7
The rental apartment area of the building will be used for
the proposed preschool. This is not a day care facility.
Classes will be held daily, each class lasting two and one-
half hours. AM class from 9-11:30, PM 1-3:30. No meals are
served - only a snack during the classtime.
Parents will arrive with their children and park off the
roadway. This is a drop-off situation generally lasting
less than five minutes before and after class.
When children are outside of the building, they will be in a
fenced area at the back of the building. This fence will be
a major priority of any remodeling.
ITEM 9
1. The property is already commercially zoned, meaning there
are few persons that should object to this type use.
2. Since the area already consists of small businesses, our
use would be consistent with the immediate area.
3. The property is deep, allowing parking totally off the
street to reduce any traffic hazards.
4. The building and land currently need attention to look
better and be abenefit to the community. This would be
accomplished in establishing the preschool.
5. The central location will not move traffic to a residents Z
or low traffic area.
6. The preschool would contribute to the city, filling a
need of an ever growing number of residents. A waiting
list is often maintained with little or no advertizing.

Chairman Johnson: Is there a representative of the Joy School here, if so would you
come forward and be sworn.
Jesse Wilson, 2088 Le.Ann Way, Wilson was sworn by the City Attorney.
Wilson: I do not really have anything to add to the application, I think there was maybe
a little misunderstanding that we were requesting parking on both sides of the building
we were thinking about having parking on the north side of the building but realize that
now that it is not possible, we plan to use the entrance that is there and we would
provide for the clientele to enter there and go in behind the building and turn around
and cane back out which would reduce any safety hazzard. This would also get the traffic
off the street.
Chairman Johnson: Have you reviewed the comments frau the City Engineer and the ACHD?
Wilson: I guess based on what I was sent here, I do not have any problems meeting the
requirements, there is a mention here of a sidewalk and curbing, is it saying here I
have to have the sidewalk in to obtain the permit?
Chairman Johnson: What we have done in the past is waive that recommendation endation until such
time as the entire street or area is developed, at that time when it is developed you
will be expected to do your share.
Wilson: Is there anything that you can tell me tonite that I am not aware of that needs to
be met before it can go onto the City Council?
Chairman Johnson: %hat we will do at this time if that is your presentation, I will open
it up to questions from the Commission if they have any.
Alidjani: You have read the comments that were sent you and you do not have any problem
with then, one camtmpsmt that is in there is if you have more than fifty children, your
assessment on water & sewer would change.
Wilson: I have read then and I do not anticipate anything that I can not commit to

Wilson: Yes, this is the only problem we would have at this time.
Alidjani: How many feet is there approximately between the building and the property

be plenty of roan for people to turn around and come back out without any congestion.

questions.
Wilson: Is there a requirement as to the type of surface for the parking back behind
the building?
Chairman Johnson: There is no requirement that I am aware of that makes it mandatory
to have it paved.

Chairman Johnson: We will have to review the Ordinance on that I have one question

do you have a number that you might have at each session, you have indicated two sessions

Wilson: We would probably go to about twelve children per session if you go above that
you really can rot have a good program, we did anticipate in the future the possibility
and these are projected plans having Perhaps an after school service for parents who
work like to six o'clock and need a good place for the children until they get home.
This would be after the Joy School Classes are over. There would be no night school.
Alidjani: The State has a requirement on haw many square feet is needed per child,
do you know what that is?
Wilson: There is no, requirement for pre-school, that is for day care not for pre-school.
That is the distinction we are makeing, we are using the front part at this time and we
plan in the future to redo the back part which is rrLich larger, the part that is not

Chairman Johnson: You are talking about the fencing being a prerequisite prior to
opening?
Wilson: Yes, the fencing is for the safety of the children, that is something we want
to have protection for keeping the children there, either that or not letting them out.

Towle: We have submitted for the City of Meridian for annexation & zoning and for
a Conditional Use Pemit for a church & school the property owned by the Stonehouse
Church on Ten Mile about 600 feet south of Cherry Lane.Even thing that we have seen
or have received as far as the convents go we have no problems with. We have a church
and school building that is about 7000 square feet we have designed it and have set it
pretty much in the center of the property so we can try to buffer the neighbors around
it.
City Clerk: Did Jim Gipson get ahold of you today?
Towle: Yes, I talked to him today, he is the representative for the LAS Church that
is being built to the north of the property we have and he had scarce questions and
concerns as far as what we were doing'and when we finished our conversation he was
fully supportive as to what we were doing and he said I could state that for the

The above entitled matter having come on for public hearing

CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property

3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the

4. That 11-2-418(C) of the Revised and Compiled
Ordinances of the City of Meridian sets forth the standards under
which the Planning and Zoning Commission and the City Council
shall review applications for Conditional Use Permits; that upon
a review of those requirements and a review of the facts
presented and the conditions of the area, the Planning and Zoning
Commission preliminarily concludes as follows:
