What special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands. structures, or buildings in the same district? Property bordered by one neighbor to south only. Other bordering properties are public owned. 3. Why will a literal interpretation of the provisions of this ordinance deprive you of rights commonly enjoyed by other properties in the same district under the terms of this ordinance? Fence regulation would not allow use of side yard (East). West side yard would not be wide enough allow access to rear. 4. What special conditions or circumstances exist that were not a result of dour actions? N. Maxie Place, is a cul-de-sac with Local traffic only. 5. Chateau. The following people were in attendance: Bob Giesler, Bill Gordon, Gary Smith, Pamela Smock, Phyllis Purvis. Bill Gordon positioned his car in the Purvis driveway so that his rear bumper was at the back of the sidewalk. One person was positioned on Smocks rear property line, 10 feet from the back of sidewalk and one person on a line extended from the front of Smocks house, 10 feet from the back of the sidewalk. Bill Gordon was positioned in the car and directed the person on the line extended from the front of Smock's house toward the back of sidewalk. After much discussion it was a consensus of opinion from the city staff that the fence be located no nearer than 10 feet from the back of sidewalk as previously recommended by the City Engineer. I did not follow the bearing of the street , I did not look at that, I did not position the driveway on the property to the south of you. Smock: If with pulling out with a vehicle the line of sight is to the corner, wouldn't the line of sight follow straight down the fence, that would allow us to square it out. Smock: Yes, there would still be a line of sight to the intersection, the fence would not extend out to the sidewalk at any point: It would end closer because of the angle: -- City Engineer: I would have to look at that, our concern was that the people that live in the house to the south of you would have to cross the side~ralk when backing out before they could see to the north. _ - Phyllis Purvis, 2217 Maxie Place: Purvis was sworn by the Ctiy Attorney: Purvis: I am located to the south of the Smock's, I am concerned about them placing a _ six foot fence along my driveway, every time I would back out of my driveway=there would be children playing and I would not be -able to them and also any-cars ocntisig -around the corner, there is just no way I could see and it would be a hazzard and also the safety _ of the children-playing on the sidewalk. The Ordinance calls for a three foot fence. -_ It is for safety reasons that I am concerned. _ Tolsma: I think this is what the City Engineer was eluding-tom on the ten foot setback. Mayor Kingsford: The major reason for that Ordinance, is our concern and the Public Hearing is the same as yours and that is safety. _ -Tolsma: Is your driveway to the North or the South of the pr~xty? _ _ _ Purvis: My garage is on the north side of the house. - - - ~ -- - - - Giesler: I went by there and I am not sure that I would not bike to look at this again after this testimony. I did not particular have a problem the way the City Engineer had it outlined. Mayor Kingsford: I think maybe an appropriate way to handle this would be approve it conditionally maybe upon a committee, I think we need to have Findings, if you Councilman Giesler would be willing to do that could I get you and the Ckiief and the City Engineer along with the Smocks in working out an arrangement that is satisfactory to everyone.
