ITEM #13: GARY LEE - JUB ENGINEERS: EXTENSION OF CONDITIONAL USE
PERMIT FOR PINE BLUFF PUD:
Tolsma: Is Gary here?
Lee: My name is Gary Lee with JUB Engineers in Boise. This project called Pine Bluff
Apartments was a development that was proposed and approved by the City of Meridian
in the early part of 1991 for a piece of property on Pine Street to develop 120 units
apartment complex. The conditional use was granted for this particular project, it is
currently situated in a L -O zone. Which this particular use is an allowed use with a
conditional use. The sewer and water plans were submitted and approved by both the
City Engineer and the State Health Department Site plans were completed and submitted
and approved. License agreements are in the works with Nampa Meridian Irrigation
District and U.S. Bureau of Reclamation for the Nine Mile Drain which traverses the
property. Ada County Highway District had approved all of the plans and got to a point
in development where it was being bid and ready to go to construction. The only short
come at that particular time was submitting for building and actually starting construction.
The project was put on hold by the owner who is still currently the same owner. At this
point in time they would like to proceed and start the construction of the apartment
complex We have reviewed the conditional use process and the city ordinance with the
City Planner Shari Stiles. And in the specific section on conditional uses it doesn't speak
to any particular time element involved in commencing construction after the conditional
use is approved. There are sections of the subdivision ordinance that address time
elements for subdivision projects, final plats, preliminary plats and alike. We would like to
at this point I guess ask the Council's opinion and request their approval to proceed with
this apartment complex under the current conditional use permit. Will, did you have a
chance to hand out those documents on the plan?
Berg: Yes
Lee: If you have any questions, I would be glad to entertain those at this point.
Tolsma: Is this the same complex that was proposed?
Lee: Same thing, same set of plans.
Tolsma: The storage facilities.
Lee: The storage facilities were part of a separate piece of property. That was under a
planned unit development that was put together by a different person, a different property
owner. This 71/2 acres where this Pine bluff sites stands alone is owned by a separate

entity and it was a separate application process. But it sits next door to it.
Yerrington: I have a question, how much of an extension of time are you asking for?
Lee: They are in the process right now of putting together the plans to resubmit for
building permit. And the last I heard they want to start construction this fall.
Corrie: Mr. President, Mr. Lee, I have 3 questions, 1 to Gary Smith and 2 to you. You say
nothing has changed it is still going to be 2 1/2 story complex, half a story being
underground. ' Open space, you are still requesting 120 units, separate pressurized
irrigation system and how about the well?
Lee: There will be an irrigation well for pressurized irrigation.
Corrie: You are going to continue with the well site. I guess Gary, my question to you is
has anything changed as far as sewer and water, that has been 4 years ago we weren't
as ambitious as we are now with all the subdivisions.
Smith: I haven't looked at the plans again since they were approved at that time, I assume
in talking to Gary Lee that everything is the same as it was. We did have some minimum
grade on sewer there but that had to do with the depth of the sewer in Pine. It was the
only way it could be sewered.
Corrie: You seem satisfied as far as water capability and sewer and all of that to be able
to facilitate that big of complex.
Smith: Well, we would want to make sure that we looked at that again based on the
number of units that we have here and water supply.
Corrie: I guess I have one other question to the Counselor, is there enough changes here
that this needs to go back to a public hearing.
Crookston: No
Lee: Can I make a comment about the water and sewer, Gary and I worked on the sewer
and water easement at the time and that was about the last thing we got accomplished in
our interaction on the project. We did get the last minute things changed and the sewer
and water easements were assigned by the owner. We have those in hand but they
haven't been recorded. So, I guess there is a chance there that we could look at those
one more time too if there is any need to change. We do want to ourselves rereview our
own set of plans and I believe Gary's staff wants to take another look at the water and

sewer as well. State Health Department will require it be reviewed again, they do have
a one year requirement on construction. So we will go through at least those steps. In
addition there are probably some uniform building codes that will have. to be looked at on
the structures themselves.
Morrow: I have a question for Gary, if the project is built now then it does not have a
grandfather right in terms of water and sewer type of construction. It would be built to
today's requirements, is that correct?
Smith: Right
Morrow: And Wayne where does the issue come from with time on conditional use
permits? Do we have anything that covers time?
Crookston: The Council has on various occasions set limitations on how long a
conditional use will be allowed. I don't see that it is in the findings, I don't agree with Gary
Lee that probably the subdivision and development ordinance does have time restrictions
for development. I am not sure that they apply to conditional use permit.
Morrow: The next question would be then is by virtue of the conditional use it does not
give it grandfather rights with respect to building permits because they were never applied
for.
Crookston: That is correct.
Morrow. So they would be current codes both for the sewer and water and building permit
standpoint, Uniform building code standpoint.
Crookston: That is correct.
Morrow: And you are in agreement with those things?
Lee: Yes
Tolsma: I think we need a motion to approve. or disapprove the extension.
Yerrington: I make the motion that we approve the extension for one year from this date.
Morrow: Second

wish to testify for Haven Cove No. 5? No testimony, I will close the public hearing.

We wish to take this opportunity to request that you place the
above -referenced project on the regularly scheduled City Council
meeting for July 19, 1994.
The purpose of this request is to ask that the City of Meridian
allow the developer of this apartment complex to -proceed with plans
to construct this facility, which had been previously approved by
the City.
As you are aware, a Conditional Use Permit was requested and granted
by the City on February 19, 1991. In addition, site plans, sewer

The purpose of this request is to ask that the City of Meridian
allow the developer of this apartment complex to -proceed with plans
to construct this facility, which had been previously approved by

FOR APARTMENT COMPLEX:
Kingsford: At this time I will open the Public Hearing, is there anyone from the public
who would like to offer testimony on this issue.
Gary Lee, 1990 Turnberry Way, Meridian, was sworn by the attorney.
Lee: I am with JUB Engineers, we represent Fiscal Funding Company. They are the owners
of the property for which we are requesting the Conditional Use Permit for. We are
requesting a modification in the density of a portion of this property and also to
seek a Conditional Use for a new owner of the parcel. The density on the parcel
was modified and also the original concept plan was changed to better optimize the
open space. Before we had many more buildings planned for the same seven and a half
acres, two story units. This revised plan is based on two-and a half story complex,
the half story being underground, which provided a much more open space to the
-coject. We are requesting 120 units, the maximum density is 135. We have met all the
_ equirements for the City. On site plan itsself we have 12,18 & 24 unit buildings,
all are two and a half story. There will be a mixture of different sizes, anywhere
from one to three bedroom or one to two bath. The square footage will vary from 700 to
1100 sq. ft. per unit. There will be a separate pressurized irrigation system. The Nine
Mile Drain contains a 100 ft. easement which we won't be able to build on, however
we are working with the U.S. Bureau of Reclamation to modify that drain, to bury a
pipeline to reconstruct the side slopes on the drain to landscape it. ACRD has reviewed
these plans and the only requirement they have is along Pine Street we'll be installing
a five foot sidewalk. (Drawings were shown to the Council)
Kingsford: Have you seem the Engineer's comments?
Lee: Yes we have and we have revised the parking.
Tolsma: They were going to put some kind of sodded road around the back side of this
for access.
Lee: What we've done on that is relocated a couple of our covered stalls to allow
access to that one side of the building. So now we do have the minimum distance required.

understand it the establishment of the flood plains, the City has to adopt that, I
mean the City has to accept that or not. The primary causes of the.flood plains are
culverts under roadways. The culvert that crosses the culvert that carries Nine Mile
Creek causes a back up. Based on what is shown on the southeast side of this development
on Nine Mile Creek, that your going to see some kind of a flood plain through this
project. They do have some restrictions that deal with heigth of floor levels concerning
that flood plain. I don't know how this will affect the project but I wanted you to
be aware of this.
Kingsford: Anyone else to offer testimony? Hearing no response, I will close the

Giesler: Regarding the pressurized irrigation, is that just going to be dry lines or
did you have a solution for when this comes on line it will be charged.
Lee: Right, it will be ready to go. I think we are going to go with a well on this
system. One thing I might say about the floor level, these particular buildings the
way they are designed, the actual floor in most cases is above natural ground, and
then we build a five foot high burin to raise the ground up artificially.

We'd planned to start construction this spring. We have originally planned to
start this month. We've taken bids on the site work. As soon as we get our
Conditional Use Permit straightened out we will probably start construction. The
improvements, as before we've got city water and sewer that'll traverse along the
Main road. We have two hundred forty one spaces for parking, these spaces will be
covered. I met with Ada County Highway District yesterday during their teck review
process, the only comments that they had was to have adequate separation from
our entry to 11th Street, and the addition of a five foot sidewalk on Pine Street.
We are going to provide a pressurized irrigation system for sprinklingthe entire site.
I met with US Bureau of Reclamation and the Nampa -Meridian Irrigation District on
the Nine Mile Drain and we are working on details to finish that particular design.
What we will end up with there is a piped crossing on the spine road and in addition
to that we will have smaller pipe in the open areas that we will cover and we will
develop a landscaped slope.
Johnson: What's the lighting for this project?
Lee: We are working on plans for that right now. I don't know how it's going to be.
Johnson: Was that just a minor alteration you had to make when you were a couple
parking spots short?
Lee: Yes it was.

Rountree: You show alot of common ground recreation areas, is that going to be a
responsibility of a rental association or is that going to be the owners responsibility?
Lee: There will be a Maintenance Manager on site to take care of the entire project.
Rountree: Will this be done in phases or is it going to under construction all at
once?
Lee: The original concept was to build the units north of Nine Mile Drain first.
With it scheduled they may just go ahead and build the whole thing at once, but we will
at least do the front three.
Rountree: Your concept and your illustrations show kind of an upscale kind of facility.
What kind of rental market are you looking at as far as who will be renting these.
Johnson: What's your minimum size unit?
Lee: I don't know.
Rountree: What kind of renter are you looking for?
Lee: From previous submittals they were looking at rental ranges from $350.00 to $550.00
I suppose. I don't know for sure what their market analysis shows. It will be an upscale
market.

Alidjani: Have you read what the City Engineer's comments were? One of those was that
it was two spaces short.
Lee: I talked to Eng. Smith and we have done some modifications on that plan to provide
for this. It was 241.

Alidjani: The second item listed in the comments states that the parking spaces shall be
9' wide and 19' long, for the 90 parking shall be 251,side parking lot do not have a 25'
foot one.
Lee: Right that's one of the items we corrected as well.
Alidjani: Do you have an idea of the height of the building?
Lee: I will let Don answer some of those questions.
Hepper: How about turn arounds for emergency vehicles, is there plenty of room?
Lee: Yes.
Don Gile, 2009 Rock Ridge Rd., Boise, was sworn by the attorney.
Gile: I am the architect on this project. There are three levels of units, it's
really classified as a two and a half story not a three story, with the lower level
classified as a basement although it's like a half basement. From entry level you go
down a half level and up a half level. The overall height of thebuilding is not to
different than a two story building, about 92 feet is the difference. The smallest
;ii.t is 673 square feet and the largest is 1100 square feet. All units have outside
private decks, most of the units have walk in closets, most of them also have master
bath access. The lower units have ramp access, the corridors and the doors are sized
so that they are handicap adaptable.
Johnson: What about exterior lighting?
Gile: It will have some area lighting, like in the common area and the parking area,
it would be down lighting so it wouldn't affect any of the adjacent neighborhoods.
Johnson: How was Gary's estimate on the range of rent?
Gile: Pretty close.
Alidjani: What would be your estimation of the front elevation from the ground
to the roof?
Gile: About 20 to 23 ft..
Alidjani: Voiced concerns about fire fighting at that height. Have you spoke with
the Fire folks?
-tile: It just varily makes the 22 stories. That has already been considered.

to put any special conditions on it or the use of it?
Gile: It's just a normally financed conventional financing, not HUD subsidized or

4. That the L -O District is described in the Zoning
Ordinance, 11-2-408 B. 5 as follows:
(L -O LIMITED OFFICE DISTRICT: The purpose of the (L -O)
District is to permit the establishment of groupings of
professional, research, executive, adminstrative, account-
ing, clerical, stenographic, public service and similar
uses. Research uses shall not involve heavy testing
operations of any kind or product manufacturing of such
a nature to create noise, vibration or emissions of a
nature offensive to the•overall purpose of this district.
The L -O District is designed to act as a buffer between
other more intense non-residential uses and high density
residential uses, and is thus a transitional use. connec-
tion to the Municipal Water and Sewer System of the City
of Meridian is a requirement in this district.
5. That the Planned Unit Development, General Planned
Residential use proposed by Applicant is an allowed conditional
use in the L -O district.
6. That sewer and water is already available to the
property, but the use may require additional charges or fees.
7. That the Applicant did not need to submit petitions
signed by a least 75% of the people owning property within 300
feet of the property indicating their approval of the use of the
property as requested by Applicant since the property is not
zoned residential.
8. That there may be testimony submitted in opposition
to the application, and if so the Commission reserves the right
to amend these Findings.

WATER EASEMENT
THIS INDENTURE, made this � day of 19C21

1023.09 feet along the Northerly boundary of said SW 1/4 to a point;

The easement hereby granted is for the purpose of construction and operation
of a water line and allied facilities, together with their maintenance, repair
and replacement at the convenience of the Grantee, with the free right of access
to such facilities at any and all times.
TO HAVE AND TO HOLD, the said easement and right-of-way unto the said
Grantee, its successors and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto,
that the Grantor will complete the work of laying the water line and restoring
the premises used therefor to a condition comparable with that existing prior to
exercising this easement; that, in making future repairs, the Grantee will
expediently replace and restore -the premises to a condition comparable to that
existent prior to undertaking such repairs and replacements.
THE GRANTOR hereby covenants and agrees that he will not place or allow to
be placed any permanent structures on the area described for this easement which
would interfere with the use of said described easement for the purposes stated
herein.
IT IS HEREBY FURTHER AGREED that the Grantor does hereby give and grant to
the Grantee the right of use during initial construction a temporary construction
easement over a strip of land described as follows:

IT IS UNDERSTOOD that the strip of land described in the previous paragraph
is for the purpose of constructing said water line herein described, the same to
expire when the initial construction is completed.

tion of such water line.
THE GRANTOR does hereby covenant with the Grantee that he is lawfully seized
and possessed of the aforementioned and described tract of land, and that he has
a good and lawful right to convey said easement, and that he will warrant and
forever defend the title and quiet possession thereof against the lawful claims
of all persons whomsoever.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public
hearing January 22, 1991, at the hour of 7:30 o'clock p.m., the
Petitioner appearing in person, the Planning and Zoning Commission
of the City of Meridian having duly considered the evidence and
the matter makes the following Findings of Fact and Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional
Use Permit was published for two (2) consecutive weeks prior to
the said public hearing scheduled for January 22, 1991, the
first publication of.which was fifteen (15) days prior to said
hearing; that the matter was duly considered at the January 22,
1991, hearing; that the public was given full opportunity to
express comments and submit evidence; and that copies of all
notices were available to newspaper, radio and television stations;
2. That this property is located within the City of
Meridian and is owned by Petitioner Fiscal Funding, Inc., and is
described in the application which description is incorporated
herein.
3. That the property is zoned Limited Office District
(L -O), which requires a conditional use permit for the construction

of Planned Unit Development, General Planned Residential which
is the use the application requests.
4. That the L -O District is described in the Zoning
Ordinance, 11-2-408 B. 5 as follows:
(L -O LIMITED OFFICE DISTRICT: The purpose of the (L-0)
District is to permit the establishment of groupings of
professional, research, executive, adminstrative, account-
ing, clerical, stenographic, public service and similar
uses. Research uses shall not involve heavy testing
operations of any kind or product manufacturing of such
a nature to create noise, vibration or emissions of a
nature offensive to the overall purpose of this district.
The L -O District is designed to act as a buffer between
other more intense non-residential uses and high density
residential uses, and is thus a transitional use. Connec-
tion to the Municipal Mater and Sewer System of the City
of Meridian is a requirement in this district.
5. That the Planned Unit Development, General Planned
Residential use proposed by Applicant is an allowed conditional
use in the L -O district.
6. That sewer and water is already available to the
property, but the use may require additional charges or fees.
7. That the Applicant did not need to submit petitions
signed by a least 75% of the people owning property within 300
feet of the property indicating their approval of the use of the
property as requested by Applicant since the property is not
zoned residential.
8. That there may be testimony submitted in opposition
to the application, and if so the Commission reserves the right
to amend these Findings.

c. The use apparently would be designed
and constructed, to be harmonious in app-
earance with the intended character of the
general vicinity.
d. That the use would not be hazardous nor
should it be disturbing to existing or future
neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive addi-
tional requirements at public cost for public
facilities and services and the use would not
be detrimental to the economic welfare of the
community.
g. That sufficient parking for the property
and the proposed use will be required.
h. The use would not involve a use, activity,
process, material, equipment or conditions of
operation that would be detrimental to person,
property or the general welfare by reason of
excessive production of traffic or noise.
i. The development and uses will not result
in the destruction, loss or damage of a
natural or scenic feature of major importance.

The Meridian Planning and Zoning Commission hereby adopts
and approves these Findings of Fact and Conclusions.

The Special Meeting of the Meridian Planning & Zoning Commission was called to order
by Chairman Jim Johnson at 7:30 P.M.:

BY FISCAL FUNDING, INC.:
Johnson: I will now open the Public Hearing, this is a request for a Conditional
Use Permit for apartment complex by Fiscal Funding, Inc.. Is there a representative
present who would like to come forward and address the Commission?
Gary Lee, 1990 Turnberry Way, Meridian was sworn by the Attorney.
Lee: I represent Fiscal Funding Company, the owner of the property with JUB Engineers.
Gave breif history of project. We requested a rezone to L -O (Limited Office Space)
with a PUD Concept with a Conditional Use Permit for different uses. Those uses included
Multi -family housing, child care facilities, nursing home, retirement center, mini
storage units with a planned unit development overlay. That of course was granted,
the zoning was changed annexation procedures were completed and accepted. Sometime
in September a portion of that was sold and that's what you see before you tonight.
''.ou have the over-all site plan before you you can see where that is. The piece
chat we are looking at tonight is the strip along the easterly border about 7.5 acres.
We were advised by the City Clerk that Conditional Use Permits weren't transferable
without authorization from the previous owner and a petition to the City Council.
Apparently the previous owner Equities International didn't want to grant a transfer,
so that is one of the reasons we are here before you tonight, to apply for a new
Conditional Use Permit under the new owner, Fiscal Funding and we've increased the
density on this site from 108 units to 120. The allowable on this particular use
multi -family in that zone I believe is about 135 on that 7.5 acres so we are shy of
that by quite a few units. In addition the new Concept here, the site plan before you,
was redesigned to make better use of the property. He's used a different concept in
building configuration, style, shape, and by doing so we've been able to maximize the
open space. As you can see we have quite a few more clusters of buildings than what
we show now.
Johnson: Were those original clusters one level or two?
Lee: I believe that these were two level. This particular plan is three level we
have six buildings on the site for apartments and one for recreational facility.
There will be a pool and a basketball court exterior. The building plans include one
twelve unit structure up on the Pine Street side. We have three twenty four unit
structures and two eighteens. These units will consist of one bedroom, one batht
two bedroom, one and a quarter bath, two bedroom two bath and three bedroom two bath.
Johnson: How many three bedroom units are there?
Lee: I don't know for sure.

Alidjani: The second item listed in the comments states that the parking spaces shall be
9' wide and 19' long, for the 90 parking shall be 251,side parking lot do not have a 25'
foot one.
Lee: Right that's one of the items we corrected as well.
Alidjani: Do you have an idea of the height of the building?
Lee: I will let Don answer some of those questions.
Hepper: How about turn arounds for emergency vehicles, is there plenty of room?
Lee: Yes.
Don Gile, 2009 Rock Ridge Rd., Boise, was sworn by the attorney.
Gile: I am the architect on this project. There are three levels of units, it's
really classified as a two and a half story not a three story, with the lower level
classified as a basement although it's like a half basement. From entry level you go
down a half level and up a half level. The overall height of thebuilding is not to
1ifferent than a two story building, about 42 feet is the difference. The smallest
iit is 673 square feet and the largest is 1100 square feet. All units have outside
private decks, most of the units have walk in closets, most of them also have master
bath access. The lower units have ramp access, the corridors and the doors are sized
so that they are handicap adaptable.
Johnson: What about exterior lighting?
Gile: It will have some area lighting, like in the common area and the parking area,
it would be down lighting so it wouldn't affect any of the adjacent neighborhoods.
Johnson: How was Gary's estimate on the range of rent?
Gile: Pretty close.
Alidjani: What would be your estimation of the front elevation from the ground
to the roof?
Gile: About 20 to 23 ft..
Alidjani: Voiced concerns about fire fighting at that height. Have you spoke with
the Fire folks?
-Gile: It just varily makes the 2? stories. That has already been considered.

Atty. Riddlemoser: Is there anything about the financing for this project that's going
to put any special conditions on it or the use of it?
Gile: It's just a normally financed conventional financing, not HUD subsidized or
anything like that.

Kingsford: At this time I will open the Public Hearing, is there anyone from the public
who would like to offer testimony on this issue.
Gary Lee, 1990 Turnberry Way, Meridian, was sworn by the attorney.
Lee: I am with JUB Engineers, we represent Fiscal Funding Company. They are the owners
of the property for which we are requesting the Conditional Use Permit for. We are
requesting a modification in the density of a portion of this property and also to
seek a Conditional Use for a new owner of the parcel. The density on the parcel
was modified and also the original concept plan was changed to better optimize the
open space. Before we had many more buildings planned for the same seven and a half
acres, two story units. This revised plan is based on two. -and a half story complex,
the half story being underground, which provided a much more open space to the
roject. We are requesting 120 units, the maximum density is 135. We have met all the
Aquirements for the City. On site plan itself we have 12,18 & 24 unit buildings,
all are two and a half story. There will be a mixture of different sizes, anywhere
from one to three bedroom or one to two bath. The square footage will vary from 700 to
1100 sq. ft. per unit. There will be a separate pressurized irrigation system. The Nine
Mile Drain contains a 100 ft. easement which we won't be able to build on, however
we are working with the U.S. Bureau of Reclamation to modify that drain, to bury a
pipeline to reconstruct the side slopes on the drain to landscape it. ACRD has reviewed
these plans and the only requirement they have is along Pine Street we'll be installing
a five foot sidewalk. (Drawings were shown to the Council)
Kingsford: Have you seem the Engineer's comments?
Lee: Yes we have and we have revised the parking.
Tolsma: They were going to put some kind of sodded road around the back side of this
for access.
Lee: What we've done on that is relocated a couple of our covered stalls to allow
access to that one sideof the building. So now we do have the minimum distance required.
Giesler: How does the price range for these units compare to what was in the other
proposal?
Lee: About the same market, maybe a little less.

Smith: The maps presented to us during the Flood Plains Meeting did not include this
particular parcel of land. stare have been some flood plains established and as I

understand it the establishment of the flood plains, the City has to adopt that, I
mean the City has to accept that or not. The primary causes of the flood plains are
culverts under roadways. The culvert that crosses the culvert that carries Nine Mile
Creek causes a back up. Based on what is shown on the southeast side of this development
on Nine Mile Creek, that your going to see some kind of a flood plain through this
project. They do have some restrictions that deal with heigth of floor levels concerning
that flood plain. I don't know how this will affect the project but I wanted you to
be aware of this.
Kingsford: Anyone else to offer testimony? Hearing no response, I will close the

Giesler: Regarding the pressurized irrigation, is that just going to be dry lines or
did you have a solution for when this comes on line it will be charged.
Lee: Right, it will be ready to go. I think we are going to go with a well on this
system. One thing I might say about the floor level, these particular buildings the
way they are designed, the actual floor in most cases is above natural ground, and
then we build a five foot high burm to raise the ground up artificially.

by the City on -February 19, 1991. In addition, site plans, sewer
and water plans, and easements were reviewed and approved by the
City Engineer on December 28, 1990.
After reviewing the City's Zoning and Development Ordinance No. 430,
Title XI, Section 2-418, pg. 79, regarding Conditional Use Permits,
a time limitation is not mentioned, addressing when construction
should begin after a CUP approval is given. We also spoke with
Shari Stiles about the time element; she is still investigating the
ordinance for restrictions on time for CUP's.

Johnson: I will now open the Public Hearing, this is a request for a Conditional
Use Permit for apartment complex by Fiscal Funding, Inc.. Is there a representative
present who would like to coarse forward and address the Commission?
Gary Lee, 1990 Turnberry Way, Meridian was sworn by the Attorney.
Lee: I represent Fiscal Funding Company, the owner of the property with JUB Engineers.
Gave breif history of project. We requested a rezone to L -O (Limited Office Space)
with a PUD Concept with a Conditional Use Permit for different uses. Those uses included
Multi -family housing, child care facilities, nursing home, retirement center, mini
storage units with a planned unit development overlay. That of course was granted,
the zoning was changed annexation procedures were completed and accepted. Sometime
in September a portion of that was sold and that's what you see before you tonight.
fou have the over-all site plan before you you can see where that is. The piece
-That we are looking at tonight is the strip along the easterly border about 7.5 acres.
We were advised by the City Clerk that Conditional Use Permits weren't transferable
without authorization from the previous owner and a petition to the City Council.
Apparently the previous owner Equities International didn't want to grant a transfer,
so that is one of the reasons we are here before you tonight, to apply for a new
Conditional Use Permit under the new owner, Fiscal Funding and we've increased the
density on this site from 108 units to 120. The allowable on this particular use
multi -family in that zone I believe is about 135 on that 7.5 acres so we are shy of
that by quite a few units. In addition the new Concept here, the site plan before you,
was redesigned to make better use of the property. He's used a different concept in
building configuration, style, shape, and by doing so we've been able to maximize the
open space. As you can see we have quite a few more clusters of buildings than what
we show now.
Johnson: Were those original clusters one level or two?
Lee: I believe that these were two level. This particular plan is three level we
have six buildings on the site for apartments and one for recreational facility.
There will be a pool and a basketball court exterior. The building plans include one
twelve unit structure up on the Pine Street side. We have three twenty four unit
structures and two eighteens. These units will consist of one bedroom, one bath,
two bedroom, one and a quarter bath, two bedroom two bath and three bedroom two bath.

We'd planned to start construction this spring. We have originally planned to
start this month. We've taken bids on the site work. As soon as we get our
Conditional Use Permit straightened out we will probably start construction. The
improvements, as before we've got city water and sewer that'll traverse along the
Main road. We have two hundred forty one spaces for parking, these spaces will be
covered. I met with Ada County Highway District yesterday during their teck review
process, the only comments that they had was to have adequate separation from
our entry to 11th Street, and the addition of a five foot sidewalk on Pine Street.
We are going to provide a pressurized irrigation system for sprinklingthe entire site.
I met with US Bureau of Reclamation and the Nampa -Meridian Irrigation District on
the Nine Mile Drain and we are working on details to finish that particular design.
What we will end up with there is a piped crossing on the spine road and in addition
to that we will have smaller pipe in the open areas that we will cover and we will
develop a landscaped slope.
Johnson: What's the lighting for this project?
Lee: We are working on plans for that right now. I don't know how it's going to be.
Johnson: Was that just a minor alteration you had to make when you were a couple
parking spots short?
Lee: Yes it was.
Rountree: You show alot of common ground recreation areas, is that going to be a
responsibility of a rental association or is that going to be the owners responsibility?
Lee: There will be a Maintenance Manager on site to take care of the entire project.
Rountree: Will this be done in phases or is it going to under construction all at
once?
Lee: The original concept was to build the units north of Nine Mile Drain first.
With it scheduled they may just go ahead and build the whole thing at once, but we will
at least do the front three.
Rountree: Your concept and your illustrations show kind of an upscale kind of facility.
What kind of rental market are you looking at as far as who will be renting these.
Johnson: What's your minimum size unit?
Lee: I don't know.
Rountree: What kind of renter are you looking for?
Lee: From previous submittals they were looking at rental ranges from $350.00 to $550.00
I suppose. I don't know for sure what their market analysis shows. It will be an upscale
market.
Alidjani: Have you read what the City Engineer's comments were? One of those was that
it was two spaces short.
Lee: I talked to Eng. Smith and we have done some modifications on that plan to provide
for this. It was 241.

Alidjani: The second item listed in the comments states that the parking spaces shall be
9' wide and 19' long, for the 90 parking shall be 251,side parking lot do not have a 25'
foot one.
Lee: Right that's one of the it we corrected as well.
Alidjani: Do you have an idea of the height of the building?
Lee: I will let Don answer some of those questions.
Hepper: How about turn arounds for emergency vehicles, is there plenty of room?
Lee: Yes.
Don Gile, 2009 Rock Ridge Rd., Boise, was sworn by the attorney.
Gile: I am the architect on this project. There are three levels of units, it's
really classified as a two and a half story not a three story, with the lower level
classified as a basement although it's like a half basement. From entry level you go
down a half level and up a half level. The overall height of thebuilding is not to
different than a two story building, about 42 feet is the difference. The smallest
�11it is 673 square feet and the largest is 1100 square feet. All units have outside
private decks, most of the units have walk in closets, most of them also have master
bath access. The lower units have ramp access, the corridors and the doors are sized
so that they are handicap adaptable.
Johnson: What about exterior lighting?
Gile: It will have some area lighting, like in the common area and the parking area,
it would be down lighting so it wouldn't affect any of the adjacent neighborhoods.
Johnson: How was Gary's estimate on the range of rent?
Gile: Pretty close.
Alidjani: What would be your estimation of the front elevation from the ground
to the roof?
Gile: About 20 to 23 ft..
Alidjani: Voiced concerns about fire fighting at that height. Have you spoke with
the Fire folks?
-Gile: It just varily makes the 22 stories. That has already been considered.

be placed any permanent structures on the area described for this easement which
would interfere with the use of said described easement for the purposes stated

IT IS HEREBY FURTHER AGREED that the Grantor does hereby give and grant to
the Grantee the right of use during initial construction a temporary construction
easement over a strip of land described as follows:

SANITARY SEWER EASEMENT
THIS INDENTURE, made this �L day of_��k_12 199 between Fiscal
Funding Company, Inc., a California corporation, the party of the first part, and
hereinafter called the Grantor, and the City of Meridian, Ada County, Idaho, the
party of the second part, and hereinafter called the Grantee;
WITNESSETH:
WHEREAS, the Grantor desires to provide a sanitary sewer right-of-way across
the premises and property hereinafter particularly bounded and described; and
WHEREAS, the sanitary sewer is to be provided for through an underground
pipeline to be constructed by the Grantor; and
WHEREAS, it will be necessary to maintain and service said pipeline from
time to time by the Grantee;
NOW, THEREFORE, in consideration of the benefits to be received by the
Grantor, and other good and valuable consideration, the Grantor does hereby give,
grant and convey unto the Grantee the right-of-way for an easement for the
construction, operation and maintenance of a sewer line over and across the
following described property:
A parcel of land 15.00 feet in width lying 7.50 feet either side of
and parallel with the following described line, said land being a
portion of Lot 3, Westlawn Subdivision, as filed for record in the
Office of the Ada County Recorder, Boise, Idaho, in Book 2 of Plats at
page 94 and more particularly described as follows: Beginning at a
brass cap marking the Northwest corner of the SW 1/4 of Section 12,
T.3N., R.iW., B.M., Ada County, Idaho; thence North 89030116" West
1052.99 feet along the Northerly boundary of said SW 1/4 to a point;
thence leaving said Northerly boundary of said SW 1/4 South 0032118"
West 30.00 feet to the REAL POINT OF BEGINNING; thence South 0015'41"
East 147.17 feet; thence South 10059113" West 160.61 feet; thence
South 11030141" East 116.84 feet; thence South 34000134" East 112.87
feet; thence South 45°16110" East 89.51 feet; thence South 0000'55"
East 200.51 feet; thence South 44059127" West 44.85 feet; thence South
89013'32" West 160.14 feet to the POINT OF ENDING of the above
described permanent easement; AND ALSOs Beginning at the Northwest
corner of said SW 1/4; thence North 89030'16" West 894.54 feet; thence
South 0032'18" West 805.00 feet to the REAL POINT OF BEGINNING; thence
South 89059'05" West 30.70 feet to the POINT OF ENDING of the above
described permanent easement.
The easement hereby granted is for the purpose of construction and operation
of a sanitary sewer line and allied facilities, together with their maintenance,
repair and replacement at the convenience of the Grantee, with the free right of
access to such facilities at any and all times.
TO HAVE AND TO HOLD, the said easement and right-of-way unto the said
Grantee, its successors and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto,
that the Grantor will complete the work of laying the sanitary sewer line and
restoring the premises used therefor to a condition comparable with that existing
prior to exercising this easement; that, in making future repairs, the Grantee
will expediently replace and restore the premises to a condition comparable to
that existent prior to undertaking such repairs and replacements.
THE GRANTOR hereby covenants and agrees that he will not place or allow to
be placed any permanent structures on the area described for this easement which
would interfere with the use of said described easement for the purposes stated
herein.
IT IS HEREBY FURTHER AGREED that the Grantor does hereby give and grant to
the Grantee the right of use during initial construction a temporary construction
easement over a strip of land described as follows:

IT IS UNDERSTOOD that the strip of land described in the previous paragraph
is for the purpose of constructing said sewer line herein described, the same to
expire when the initial construction is completed.
IT IS UNDERSTOOD AND AGREED that the Grantor will restore said strip to a
condition comparable to that existent prior to the undertaking of the construc-
tion of such sewer line.
THE GRANTOR does hereby covenant with the Grantee that he is lawfully seized
and possessed of the aforementioned and described tract of land, and that he has
a good and lawful right to convey said easement, and that he will warrant and
forever defend the title and quiet possession thereof against the lawful claims
of all persons whomsoever.

attached sheets on the twenty-nine (29) acres on Pine
Street in Meridian as per attached legal.
The following information answers various questions on
the attached forms.
The present land use has been agriculture in years past
but more presently weeds. Our proposed use is a combina-
tion of single family, apartments, and mini storage.
The land is surrounded on three sides by the City of
Meridian. Our use would tie in well with existing pro-
perties in the area and is designated for residential
development under the comprehensive plan.
We do hereby agree to allow the City to lien the property
if for any reason our bilis are not paid.

6. Relocate all irrigation/drainage structures outside of the public right-

Dear Gary:
After our conversation of 19 December 1994, I reviewed the prior
comments regarding Pine Bluff Estates. The plans that were
submitted on this project look good with the exception of the foot
path which will act as a dam and will back up the water. This has
to be removed or lowered to allow the retention area to work
correctly. Please submit plans that indicate this change.
Nampa & Meridian Irrigation District will require an agreement for
the proposed piping. Contact Danie.? Steenson at 342-4591 and
request that he prepare a License Agreement for this project.
The Bureau of Reclamation should be contacted and plans should be
sent to them for their approval. Please contact John Caywood at
214 Broadway in Boise or telephone 334-1463 to expedite this
project.

situation in this case as his property is bordered by public right -a -way on two sides,
the sewer & water that this developer would use -is in Chateau, since this property also
abutts Locust Grove it is my inter uptation that it would be the developers responsibility
to also extend the sewer and water on Locust Grove even though he would get no use out of
this extension or any benefit, I do not know what the decision should be.
There was discussion on this subject -by the Mayor & Council and the people involved.

Lee: I an the Engineer fran JUB representing the developer on this project, I am in
attendance tonite to answer any questions the Mayor & Council might have on this project.
Mayor Kingsford: Anyone else from the Public who wishes to offer testimony, there was

Giesler:I have visited with Mr. Marshall regaling the apartment part of the project and
I would for the record like him to tell us a few things about that, their plans for it,
the quality and things of that nature.
Marshall: We are working with Architects right now getting basic ideas for the project

our goals is to have a middle -upper range of apartments, we are not interested in Faun
Hone type apartments or govermlent sudsidized apartments by the same token we realize
that the market in Meridian will not bear $700-800 dollar a month apartments, we are
looking at the lowest possible maybe $375.00 and up into the $525.00 and possibibly
$550.00 if we feel the market is there, we are looking at two bedroom units. Another
thing we have looked at is all one level units so that there would be no walkups, but
none of that is definately decided as yet but I assure you it is not lower end units we
are looking at. As I mentioned to you when I spoke to some of you individually about this
project was that we were looking at putting the mini warehouses in because we do not want
a trashy looking project and many times apartment dwellers do not have enough storage.
So part of the object of putting in the mini warehouses in is so the apartment dwellers
can put any of their things that they would have a temptation to set outside and around
having a storage place because we are not going to allow that.
Tolsma: Is this going to be 4 plexes and duplexes?
Marshall: No, I never talked about duplexes, I talked about 4 plexes and possibily 8 plexes,
we looked at one today that would be a sixteen plex, but that might be a little bit much
to put in the area we are just not sure.
Tolsma: How would you handle the parking on something like this?
Marshall: Just around it, front and back, the street we have cn that plan, you know that
is why we are not going for a final, that street might not be where it sits right now.
We might have to move the street over to one side or the other. We are really looking
more at 8 plexes.
Tolsma: Vdat I-waslooking at was avenin+ is really riot enclosed garage type parking?
Marshall: No, it would not be enclosed garage parking but we are looking at covered
Pang.
Morrow: Have all the City Engineer cmrents been taken care of?
City Engineer: I have not heard from anybody since I submitted those comments, we did get
a revised plat back from JUB that shows the road stubout for West Sroadwayto the
East boundxy of the project. The storm drainage , it is my understanding the Engineers
have proposed that to the ACHD and the Highway District has accepted that.
Lee: They have not formally accepted the proposed drainage plan.
City Engineer: There is same question on whether they can sewer the north east portion
of the development without raising the property.
Mayo' ,ford: As per Dr. Hallett letter from the school District in evaluating the streets,
his concern about buses and turnaround, do you feel those are adequate?#
City Engineer: I did not look at it from that standpoint but they have a typical width
of the Highway Districts rern,i runts. a
Mayo Kingsford: One thing that would be a matter if we were to approve the Preliminary ,
Plathat it would be conditioned upon the approving and publication of the Annexation
Ordinance, I think it might be more appropriate to consider: the annexation &zoning
issue for Ordinance before we move into the Preliminary Plat.

Johnson: You all should -have a- revised preliminary plat, the initial -plat was-changed.�
Is there a representative present for this request. — - -
Sumner Johnson, 444 W. Iowa, Nampa, was sworn by the Attorney.
Johnson: I am Sumner Johnson of JUB Engineers, here representing the Developer
for the developer also here is Roger Jeppsen, Dennis Marshall and Elliot Sheffield
and if there is any questions they can answer them although they are not planning to
testify. The plat has some modifications, I have been working with City Engineer Gary
Smith, he wanted in the SE corner Broadway Avenue continued to the easterly boundary
of this project. In addition we have been working with various agencies on how to handle
the Nine Mile Drain. Instead of a 1001 right of way fenced on both sides with a weed
patch in the middle and a big deep gulley, we want to turn that into tiled pipe line that
can be cost effectively constructed. There was further discussion on this. (TAPE ON FILE)
We would fence along the Rutledge Lateral which run along the back of the proeprty, the
property would be served by City Water, the sewer system would be built to meet the City
requirements, the last item, a new -thought in Meridian we have all been -exposed to the
Public cry_ that they cannot get irrigation water but they pay for it, I believe that this
= property could, if all the water_ rights came -out of the Rutledge Lateral -an irrigation
pumping installation with the proper screening could be Mstalledd-and distributed out
through the subdivision, it woulda�,
cost the developer same additim -money, the long term
demand on the municipal system would then be reduced , there -should be an opportune for .
the City Council to give a trade off in the reduction of hookup charges for the water
system in return for reduction of long tern demand on the municipal, systen and that credit
could be used by the developer to construct the independent pressurized irrigation system.
This has worked satisfactory is Nampa, the only problem is the irrigation ompany is going to
give you enough water to irrigate 24 hours a day and there isn't anyone wants to irrigate
that way so you have to devise a way for some makeup water. Nampa does it by shallow wells,
If the City does consider this then I am sure it would expand to a c amunit_y network, then
a well now and then meets the makeup difference for the whole ommunety aril theta has the
advantage of being able to turn it on prior to the irrigation water in the ditch.

The developer has not made a positive decision as to whether or not to consider this,
but I wanted to mention this as I think it is something that should be considered.
Hepper: There isvision here in town that is similiar to that, it is pumping irrigation
water out of the tah and scare of the residents because the irrigation water goes out in the
next week or ten days, the sprinkler season as -not over yet, so they want to connect to the
city water for their q=Mto0mr system and the water works department says no way can you -
hook up a line between the irrigation ditch and the drinking -water, you have a back flow
problem.
Johnson: You can do it but it is not advisable, that is what I said you need -a shallow well
for these times. _
Hepper: So you would not be using any- City Water for irrigation? -
Johnson: We are not proposing any in this situation.
Johnson: There will -be a Hare Owners Association because -these major lots to the east are
apartments, the larger lots are apartment house lots anticipated four units per lot and
so there will be a manager -to manage the apartment house and also the open space greenway -
down the nine mile drain and -the mini storage.
Alid-jani: I have some concern on the flag lots, lot 27 & 28 block 3.-
Johnson:-We
:Johnson:-We would -propose that to be -a common ingress & egress the 30 foot, it would be a
deeded fifteen foot to each lot. This would be specified -on the plat.
Chairman Johnson: This is a Public Hearing, I will now open the Public Hearing, is there

John Navarro, 1200 West Pine, Navarro was sworn by the City Attorney:
Navarro: I live accross from this development on West Pine and I have talked to several of
the neighbors and we have a concern on storage and I have not been able to find out how
much area they have set aside for storage, how many acres?
airman Johnson: It is about four acres set aside for this, and back against the railroad
tracks:
Navarro: The other concern that I have is when you talk about that tile Will there be any
chance that will raise like in July and. August, will that raise the water tablmre than
it left like it is now? -
Chairman Johnson: Mr. Johnson -could you answer this -concern? -
Johnson: That is a legitimate concern, it. is my opinion that tiling- ing_ that ditch will not--_ se
the water table in that area, the tendency is that we will probably lowet the creek in the -
process of tiling and then it will stay lower where now they lower it every five or ten years
when they clean it, my opinion is that in the long range it would be better than the way
it is now.
Navarro: The question come to my mind all of those will be lots and will be sprinkled
and whether that would raise that -water table, the way it is now the water runs awhile and
and then it is of for awhile , this would be a steady input into that ground every day and
every day, would this make the water table higher?

Johnson: There are all kind of studies where sprinkler irrigation for residential use
applies a lot less total volume of water than flood irrigation does once a week or every
10 days as it is done by the fanner mainly because the sprinkler just goes a shallow
depth. Sprinkler irrigation will reduce the amount of water that goes to the water table.
chairman Johnson: Is there anyone else from the Public who wishes to testify on this

Findings of Fact and Conclusions on this, are there any questions of the Cmmi_ssion

Rountree: I would like to conn-ent on the drainage system, I think it is a good idea

this amended Preliminary Plat.

Comments from Public Works Department- Gary Smith
-1. The proposed development is adjacent to the existing City
limits. -
2. Existing City sanitary -sewer and water are located in Pine
Avenue. -
- 3. -The annexation description needs to include the north h or
all of the railroad right of way. Also, can the piece of -
property _that is excepted be included to eliminate the
_enclave? _
4.- A road right of way access needs to be provided from Kaysen
---Drive, east to the east property line. This would eventually
connect to Broadway Avenue to provide access to the land
behind the homes presently_fronting Pine Avenue. -
The sewer and water -lines would also need to be extended -
in this -stub for -future service. The sewer line in Pine -
cannot serve the property between the existing homes and
the railroad fight of way. - - -
-5. The standard water line location is on the north and east
side of street centerline.
6. Locate the water valves and fire hydrants as shown on the
red line plan.
7. The street storm -drainage waters need to be discharged into
Nine Mile Creek within the parameters required by the Nampa
& Meridian Irrigation District in lieu of underground drain
fields. This request is because of the existing high ground
water level.
8. Sewer lines need to be a minimum of 4 feet deep (finish
ground to invert). It appears that the sewer lines in Pine
Bluff Ave. and Pine Bluff Drive will have adequate cover.
Kaysen Drive, north of Nine Mile Creek, does not appear to
have adequate cover using interpolation of existing ground
elevation contours shown on the preliminary plat.
9. Location- of street lights need to be shown on the prelimi-
nary plat.- - _

Dear Jack,
We do hereby request the annexation and zoning as per
attached sheets on the twenty-nine (29) acres on Pine
Street in Meridian as per attached legal.
The following information answers various questions on
the attached forms.
The present land use has been agriculture in years past
but more presently weeds. Our proposed use is a combina-
tion of single family, apartments, and mini storage.
The land is surrounded on three sides by the City of
Meridian. Our use would tie in well with existing pro-
perties in the area and is designated for residential
development under the comprehensive plan.
We do hereby agree to allow the City to lien the property
if for any reason our bills are not paid.
