by the City Council on April 18, 1989. As part of the approval it
was the consensus of the Planning & Zoning Commission, City Council
and myself that at the present time the curb, gutter and sidewalk
where this property abutts Overland Road and Teare Avenue should not
be required. There are no other curbs, gutters and sidewalks in
this area, as the City of Meridian had previously waived this require-
ment for Western States Equipment which is directly West of this

NOTICE IS HERESY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the
City Council of the City of Meridian will hold a public hearing
at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho,
at the hour of 7:30 0' clock p.m., on April 18, 1989, for the
purpose of reviewing and considering the Application of Ronald

dated March 2, 1989 (copy of Table of Contents attached). ~,
Commission Action - DR-149-88 - State Street Convenience
Store - John Stolley noted that subject item has been deferred
for one week.
Preliminary Plat - Overland West Industrial Park - John
Stolley noted that subject project is adjacent to the Western
Equipment project and that the Highway District requirements
for Western Equipment were waived by Meridian City Council.
CU-25-$9 - 700 Parkcenter - Retirement Center - John Stolley
high{ighted Site Specific Requirement No. 2 and stated that the
developer will probably appeal the requirement on the grounds
that the existing bridge on Parkcenter over Logger's Creek was
erroneously installed to begin with 'and the developer doesn't
believe it is his responsibility to widen.
Preliminary Plat - North Valley - John Stolley presented
subject preliminary plat and recommended approval as submitted.
Larry Sale, Briggs Engineering, representing Mr. Connell, stat-
ed that in the past the District has been diligent in attempt-
. ing to get 36th Street extended and asked the District to as-
sist them in getting the necessary right-of-way. Discussion
held concerning the area in general; the ownership of the prop-
erty; and the alignment of the roadways.
Commissioner Rhodes moved to defer item 1 for one week and to
approve the remainder of the items on the Tech Review Agenda
dated March 2, 1989, subject to the findings of fact and recom-
mendations of staff. Commissioner Winder seconded. Motion
carried.
BID APPROVAL AND CONTRACT AWARD - FURNISHING LI UID ASPHALTIC
MATERIAL - Gene Hall presented the bids for-subject material ___
as outlined on the attached staff report and recomrfiended accep-
tance of the lowest responsive bid of Idaho Asphalt for Sched-
ules A and B; and Koch Asphalt for Schedule C. Commissioner
Rhodes moved to accept of the lowest responsive bid of Idaho
Asphalt for Schedules A and B; and the lowest responsive bid of
Koch Asphalt for Schedule C, as recommended by staff, and to
award a contract to same. Commissioner Winder seconded. Mo-
tion carried.
BID APPROVAL AND CONTRACT AWARD - PURCHASE OF TWO VIBRATORY
ROLLERS - Gene Hall presented the bids for subject equipment
as outlined on the attached staff report and recommended accep-
tance of the lowest responsive bid of Idaho Bit & Steel, Inc.,

4. Relocate all obstructions outside of the proposed street improvements.
Prior to relocation, obtain written permission from the ,applicable
jurisdiction.
5. Relocate all irrigation/drainage structures outside of the public right-
of-way. Prior to relocation, obtain written approval from the applica-
ble jurisdiction.
6. Provide far the continuation of all existing irrigation and drainage
systems across parcel.
7. Submit a site drainage plan showing that site drainage will not flow
onto Ada County Highway District right-of-way, in accordance with Boise
City Code 11-3-54 (A), where applicable, and ACHD policy.
8. Access to parcel to be reviewed and approved by the District.
9. Driveways to be located a minimum of 5-feet from the property line.
10. Approval of this preliminary plat is subject to the condition that if
ACRD standards for subdivisions are revised prior to submittals of
final plats, revised standards will be followed in preparing the final
plats.
11. Any work within ACRD right-of-way requires a permit. For information
regarding the requirements to obtain a permit, please contact Quality
Control at 345-7667. CU, DR, or PDC file number required.
12. Provide for the clear vision sight triangle at the corner of Overland
and Teare, in accordance with Idaho Code 49-593.
13. Provide for the relocation of utilities consistent with sound engineer-
ing practices.
In order that the Final Plat may be considered by the District for accep-
t Lance, the Developer shall cause the following applicable / standard condi-
tions to be satisfied prior to District certification and endorsement:
1. Drainage plans shall be submitted and subject to review and approval by
the District.
2. If public street improvements are required: Prior to any construction
within the existing or proposed public right-ofway, the following shall
be submitted and subject to review and approval by the District:
a. Two complete sets of detailed street construction drawings pre-
pared by an Idaho Registered Professional Engineer, together
with payment of plan review fee.

b. Execute an Inspection Agreement between the Developer and the
District together with initial payment deposit for inspection
and/or testing services.
c. Complete all street improvements to the satisfaction of the Dis-
trict, or execute Surety Agreement between the Developer and the
District to guarantee the completion of construction of all street
improvements.
3. Furnish copy of Final Plat showing street names as approved by the
Local Government Agency having such authority together with payment
of fee charged for the manufacturing and installation of all street
signs, as required.
4. If Public Road Trust Fund deposit is required, make deposit to the
District in the form of cash or cashier's check for the amount speci°
fied by the District.
5. Furnish easements, agreements, and all other datum or documents as
required by the District.
6. Furnish Final Plat drawings for District acceptance, certifications,
and endorsement. The final plat must contain the signed endorsement of
the Owner's and Land Surveyor's certification.
7. Approval of the plat is valid for one year. An extension of one year
will be° considered by the Commission is requested within 15-days prior
to the expiration date.

First National Bank has wntributed $5,000, Chamber of CaRnerce has allotted $2,500 and
the City of Meridian has been asked to contribute $2,500, some three months ago I wrote
a letter to the Department of Camtierce anticipating being able to use the proceeds we
have received back fran the revolving loan fund that was given tv Power Dyna¢nics, In the
return correspondence they did not feel that would be appropriate use for that it should

is that you approve the Plan, I think it is a good one, and that we allocate $2,500.00
of the revolving loan fund into the Canputrol Project and that we take $2,500.00 that

Downtown Master Plan & Financing Program as submitted by Wayne Forrey of JUB & James
Shearer and the expenditure of $2,500.00 for the City contribution for the Plan and

Ron Van Rucker: I have a letter here for the Mayor & Council, if you would like to

{ facility, in the statements I made in the letter we have been doing ongoing negotiations
`~~ with Freidman Bag Canpany which is out of California, presently located in Boise and
looking for a new site for their manufacturing facility based upon loosing their lease
in Boise. They have been looking at this site for about six months but not got serious
until about three weeks ago. We have submitted a preliminary & final plat on the
subdivision of this property, it is our intent to go ahead and install sewer & water
'_~*~ lines at this time, I had not anticipated that Freidman was going tv move as fast as
_ they have. Ode of the considerations we are asking for is assistance from the Council
in regards to the timing of the building permit and that is based on, if and when they
..~~ elect and based on my inforniation now this oou].d be as early as March 8, 1989 they
would want to start construction, we are asking if a building permit could be obtained
at this time even though the platting is not complete. Secondly we would like to ask

could receive sane reimbursc~nent of our cost on the water & sewer lines that it is
necessary we install.The other thing we would ask of the Mayor & Council is beings

Mayor Kingsford: When Coca Cola came in we had a legal lot split but some time back it
came to our attention that before more land could be sold this needed to be platted,
that process in running in a little arrears basically what they are asking for is
that we will grant a building permit even though the platting is not complete, asking
for us to help eliminate some of the requirements of ACFID that simply do not apply in
an Industrial Zone and also to work with than on a late owner's fee for those areas
that the line extensions could be used by other people.
There was discussion on whether Teare Drive could handle this kind of use.
Mayor Kingsford: I think what they are talking about is the blanket improvanents that
ACID always asks for curbs, gutter & sidewalks:
Giesler: I do not have any problem with that:
Morrow: I do not have any problem with that either:
The Motion was made by Tolsma and seconded. by Myers to work with Ron Van Aucker in
granting a building permit before the platting of the property is canpleteSl ,work
with getting the appropriate requirem~azts of ACfID waived and entering into a Late
Corner's Agreement on Water & Sewer:
Mayor Kingsford: I might point out I asked the City Clerk to do some checking on
the LID procedure after our meeting, we find that sixty percent of the property comers
if they vote to request a LID can force a LID in an area, but a government agency can
without one vote can demand you have an LID. I think particular in this type of area
this is a more logical way to approach those things.

City Engineer: Warren Watson lives at the corner of Linder Road and Ustick and he is
presently connected to the city sewer, he was connected in 1979. He recently received
approval from the County to move a temporary living quarters on to his property for
his son. In the process he connected this additional unit onto the existing sewer tap,
so we now have two living units discharging into the sewer. The question is the
connection fee since this is outside the City Limits. Mr. Watson carrtie in after I
contacted him and he informed me he had met w7th the State Tnspector, that Inspector
told him it was not necessary to deal with the City of Meridian because he was out-
side the City Limits. He is requesting a variance from the outside the City Limits
double connection fee because it is a temporary residence.
Mayor Kingsford: Any questions of the Council?
Morrow: It seems to rrue that maybe we waive the double fees and charge the terg~orary
unit a single fee, it just seems to me that we ought to charge a single fee, that if
we don't and I can appreciate the problens with health and other things but this is
the area where you set dangerous precedence.
Mayor Kingsford: One other thing we have it is not on City water so we do riot have a
handle on the amount of water discharged into the sewer. We are charging them the
average which is 65Qd gallons.
Myers: So we should probably charge the hookup fee plus an additional user fee.
Mayor Kingsford: To be consistant with anyone in the City Limits I think you should

Gentlemen:
This letter is written in regards to our potential opportunity to secure Fried-
. man Bag Company as a new industry for Meridian. They would locate on a parcel
of ground east of Inland Coca Cola, back 300 feet from I-84.
Friedman has been located in Boise, Idaho, for the past five years. They are
a leader in their industry and have experienced growth each year. This would
bring about 40 new employees to the Meridian area.
I am presently negotiating with Mr. Harvey Friedman, owner of Friedman Bag Co.
and we have come close to an agreement on the land. In order to induce Fried-
man to locate on our site, I have offered to sell the ground for $32,500. per
acre and have agreed to plat and provide all utilities to the site. Two areas
that I need help from the Council:
1. I need help in being assured that we can have a building permit with-
. out having the final platting process completed. I have caused this prob-
. lem by not following the procedure for platting as I should have and for
this I apologize. When I realized the need to move quickly for Friedman,
I began the procedure, but it may not be completed in time.
2. I will provide for all utilities to the site as required, but need
your help to get A.C.H.D, requirements, i.e. curbs, gutters, sidewalks
and street improvements on both Overland and Terra Drive waived on this
project. As we all know, the engineering and elevations are presently
non-existant.
Additionally, we need to know that they (A.C.H.D.) will not require a de-
posit into the road trust fund. The logical way is the L.I.D. approach
after it is developed.
Additionally, I would request permission to have Van Auker and Meridian enter
into a "late comer's" agreement on the water and sewer lines that would be paid
for by Van Auker.
In summary, I would ask that you consider these items and-give me direction
so I may be able to finalize our negotiations with Friedman. Thank you for

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the
Planning and Zoning Commission of the City of Meridian will hold
a public hearing at the Meridian City Hall, 33 East Idaho Street,
Meridian, Idaho, at the hour of 7:30 o'clock p.m., on March 14,
1989, for the purpose of reviewing and considering the
Application of Ronald Van Rucker and Inland Coke for a
preliminary plat and final plat of the following two parcels of

NOTICE OF HEARING
NOTICE IS HERESY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the
City Council of the City of Meridian will hold a public hearing
at the Meridian City Hall, 33 East Idaho Street, Meridian, Idaho,
at the hour of 7:30 o'clock p.m., on April 18, 1989, for the
purpose of reviewing and considering the Application of Ronald
Van Aucker and Inland Coke for a preliminary plat and final plat
of the following two parcels of property: Lot 1, Block 1, Timothy
Subdivision and the SW1/4 SWl/4 SEl/4 Section 18, Township 3
North, Range 1 East, Boise-Meridian. -
A more particular legal description for the two parcels is
on file in the office of the City Clerk of the City of Meridian
and is available upon request.
Public cornment will be taken and is welcome.
