RE: Bear Creek No. 7 Variance
Dear Sonya,
As a condition of the Variance application the applicant is required to provide several
statements for justifying any request for a variance of City Ordinance. The following is a list
of the statements required for the variance application:
A statement -what ordinance can you not comply with?
• The applicant cannot comply with the cul-de-sac length ordinance.
2. A statement -what prevents compliance with the ordinance?
• The applicant cannot comply with the cul-de-sac length Ordinance due to
existing conditions approved in previous phases of Bear Creek
Subdivision, and sight distance issues with Victory Road: the sight
distance on Victory Road prohibits the construction of an intersection.
3. A statement -what are the minimum requirements of this ordinance that need to
be reduced to permit the proposed use?
• The 450-foot cul-de-sac length (12-4-2) needs to be relaxed to allow the
proposed street configuration.
4. A statement -what is the difficulty or hardship that would result if requirements of
this ordinance were applied to the subject property?
• The hardship would be creating an unsafe intersection onto Victory Road
to eliminate the cul-de-sac. The intersection would not be approved by
ACHD.
5. A statement -any unusual or peculiar circumstances that indicate regulations of
this ordinance that should not be strictly complied with.
• Existing streets within previously approved phases of Bear Creek, and the
sight distance issues on Victory Road, will not allow this site to comply with
the cul-de-sac length Ordinance. Bear Creek was previously granted a
variance for the cul-de-sac length.
6. A statement -that special conditions and circumstances exist.
Existing streets and sight distance issues on Victory Road prevent
compliance with the ordinance.
7. A statement -that interpretation of the ordinance shall deprive the applicant of
rights commonly enjoyed by other properties.
• The variance has been granted to this applicant for the previously
approved Bear Creek Preliminary Plat and other applicants in the past
have received similar variances. Strict interpretation of the ordinance
would limit the ability to develop this property.
8. A statement -that special conditions or circumstances exist, that were not a result
of the applicant's action.
• I have not created any situation in which resulted in my request for a
variance for this phase of Bear Creek Subdivision.
9. A statement -that granting the variance requested shall not confer on the
applicant any special privilege.
• Granting the variance will not confer on the applicant any special privilege.
The City Council has granted variances for similar subdivisions.
10. A statement -how granting of the variance would convenience the applicant.
• Granting the variance will allow the applicant to develop the property with
the most efficient design without constructing unsafe street intersections.
11. A statement -the relationship of the proposed variance to the Meridian
Comprehensive Plan (cite policy numbers).
By not extending a street out to Victory Road and creating an unsafe
intersection, will limit the number of access point onto an arterial road,
which is supported by the Meridian Comprehensive Plan.
The above-mentioned list is intended to meet the requirements of the Variance
application. If there are any deficiencies or additional requirements of the Variance
applications required prior to its processing please call me at 344-9700.

Boise Meridian, Meridian, Ada County, Idaho, being more particularly described as follows:
Commencing at the southwest corner of the SE'/< (S'/ corner), of Section 24, Township 3
North, Range 1 West, B.M; thence S 89°21'07" E 25.00 feet along the south line of said SE
%< to a point on the east right-of-way of S. Stoddard Road extended;
