There was no response. The Notion was made by Myers and seconded by Tolsma that the rules and provisions of 50-902 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance # 495 as read be passed and approved: Motion Carried: Roll Call Vote: Giesler-•, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: Item #9: Pre-Tenaination Hearing Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing, if you choose to, you have the right to a pre -termination hearing before the Mayor & Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain Counsel. Is there anyone frau the public who wishes a pre -termination hearing? There was no response. The Motion was made by Tolsma and seconded by Giesler to approve the turn-off list as submitted: Notion Carried: All Yea: Mayor Kingsford: The turn-off list wants to $6,983.35, due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on September, 14, 1988. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code, even though they appeal - the water will be shut off. Box 127 xidlan, Idaho 83842 Mahone 888.481 BEFORE THE MERIDIAN CITY COUNCIL LEON GINGRICH REQUEST FOR REZONE 1300 BLOCK ON NW 8TH STREET MERIDIAN, IDAHO PRELIMINARY FINDINGS OF FACT AND CONCLUSIONS The above entitled matter having come on for public hearing on August 16, 1988, at the hour of 7:30 o'clock p.m., the Petitioner appearing in person and through Dale Ownby, the City Council of the City of Meridian having duly considered the evidence and the matter makes the following Findings of Fact and Conclusions: FINDINGS OF FACT 1. That the property is located within the City of Meridian and is described in the application and which description is incorporated herein as if set forth in full and which property is in the 1300 and 1400 Block of West 8th Street, Meridian, Ada County, Idaho. 2. That the property is located in the Warrior Neighborhood as designated on the Policy Diagram on page 7 of the Meridian Comprehensive Plan. 3. That the Applicant's proposal is to change the zone from R-4 to R-15 so that multi -family dwellings can be located thereon. 5. That the property is an irregular shaped parcel of ground that is somewhat triangular. 6. The requested R-15 zone is described in the Zoning Ordinance as follows: (R-15) MEDIUM HIGH DENSITY RESIDENTIAL DISTRICT: The purpose of the (R-15) District is to permit the establishment of medium-high density single-family attached and multi -family dwellings at a density not exceeding fifteen (15) dwelling units per acre. All such districts must have direct access to a transportation arterial or collector, abut or have direct access to a park or open space corridor, and be con- nected to the Municipal Water and Sewer systems of the City of Meridian. The predominant housing types in this district will be patio homes, zero lot line single-family dwellings, townhouses, apartment buildings and condominiums. 7. The Comprehensive pages 26 and 27; the pertinent stated as follows: Plan contains Housing Policies on policies to this Application are 1. The development of housing for all income groups close to employment and shopping centers should be encouraged. 9. The efficient use of land for public facilities, transportation systems, utilities, and the economic arrangement of buildings should be promoted. 12. Land development regulations should be revised to encourage the infilling of existing vacant parcels within the city limits. 13. Infilling of random vacant lots in substantially developed, single-family areas should be encouraged at densities similar to surrounding development. In- creased densities on random vacant lots should be considered if: a. The cost of such a parcel of land precludes development at surrounding densities; or b. .Development of uses other than single-family structures are compatible with surrounding development. 15. owners of remnant residential parcels or partially developed residential parcels should be encouraged to consolidate these properties where possible to prevent the proliferation of small parcels of vacant land within the city limits. 19. High density development, where possible, should be located near open space corridors or other permanent major open space and park facilities and near major access thoroughfares. That the City Engineer submitted comments which are incorporated herein as if set forth in full and such are reasonable requirements and are included in the Ordinance. 10. That the Nampa and Meridian Irrigation District had comments but no objection to the Application. 11. That the Ada County Highway District submitted requirements. 12. There were objections to the rezone in the form of testimony and a written petition signed by eleven property owners in the area; that the objections were that development in the fashion proposed would be too many buildings in the area and would bring increased traffic to an already heavily trafficed road; there was also concern that the irrigation ditch located on the proposed property not be removed. 13. That the Applicant stated that the irrigation ditch would not be removed and would continue to provide irrigation water for the area. 14. That the property has been a vacant lot for over 10 years and is basically a weed patch at the present time and has been for many years. 15. That the proper notice has been given as required by law and all procedures before the Planning and Zoning Commission have been given and followed. The City of Meridian has the authority to grant Zoning amendments and rezones pursuant to Title 67, Chapter 65, Idaho Code, and pursuant to 11-2-416 of the Revised and Compiled Ordinances of the City of Meridian. 2. That upon rezone, the City of Meridian has authority to place conditions upon the zoning amendment. 3. That 11-2-416(x) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under which the Planning and Zoning Commission and the City Council shall review applications for zoning* amendments; that upon a review of those requirements and a review of the facts presented and the conditions of the area, the Planning and Zoning Commission specifically concludes as follows: (a) The new zoning would be harmonious with and in accordance with the Comprehensive Plan and no Comprehensive Plan Amendment is required. (b) The area was not previously scheduled for a rezone but such rezone is compatible with other uses in the area. (c) The area included in the zoning amendment is intended to be developed in the future in the fashion that would be allowed under the new zoning of R-15. (d) There has been no change in the area which tends to dictate that the area may lend itself to be rezoned. (e) The Applicant made representations in the application that the area would be designed and constructed to be harmonious with the surrounding area of apartment complexes. Box 427 ieddisn, Who 83842 Mahone 8884481 (f) The proposed use was mentioned of multi -family dwellings and therefore the uses would not be hazardous or disturbing to existing or future neighborhood uses. (g) The area would be adequately served by public facilities and services as those are already available. (h) The possible proposed uses would likely not create excessive additional requirements at public cost for public facilities and services and would not be detrimental to the economic welfare of the community. (i) The proposed use will not involve any detrimental activity to any person's property or the general welfare. (j) Development should not cause a significant increase in vehicular traffic and should not interfere with surrounding traffic patterns. (k) That this rezone would not result in the destruction, loss or damage of any natural or scenic feature of major importance. (1) The proposed zoning amendment is in the best interest of the City of Meridian. 13. That the requirements and comments of the City Engineer are reasonable and should be a condition of the rezone and met by the Applicant. 14. That the requirements of the Ada County Highway District are reasonable and shall be required upon actual development. 15. That the requirements of the Nampa and Meridian Irrigation District are reasonable and shall be required on actual developement. 16. That there is' a confrontation of uses in the area between the single family dwellings owned by the people objecting to the application and the proposed apartments to be constructed and already existing in the area. The policies in the Comprehensive Plan suggest answers to this type of land use confrontation. Those policies are stated in paragraph 7.of the Findings, subparagraphs 1,9,13, and 19. Due to those findings, the irregular shape of the property is question, the fact that there is an open space near the property in the form of the Meridian Middle School play field, and the fact there are a considerable number of apartments already in the area, that the Application should be granted and is in the overall best interests of the City of Meridian. 17. That the Applicant shall be required to meet all of the Ordinances of the City. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The Meridian City Council hereby adopts and approves these Findings of Fact and Conclusions. Box 127 i®rldlan, Idaho 83512 �[>Rr�ns 8'85115t l MERIDIAN CITY COUNCIL AUGUST 16, 1988 PAGE # 7 I have them on a full time basis but same of thein are drop -ins like parents have to go to the doctor during the day or something like that, they call me and provided I am not full I can take then, they have to call and ask if I am full at that point, if I have a child hat is sick or on vacation the way I have been doing it I have the roam for that child for a short time, without that I just want full time children what do people do with their drop -ins. Brewer: I believe in writing all ordinances, all rules and regulations they are written to cover a majority there will always be a minority that this regulation will not address, you seen to be a minority in this instance in that you want to do something a bit irregular the rule will not cover that it will be explicit it will start here arm. end there. Myers: I think the simple solution is that you apply for a child care center. Fischer: I do not want a center though. Myers: If you are going to have thirteen children during the day. Fischer: No, not thirteen children at any one time, during the day. There was discussion on different ways to reduce the costs involved in the permit. Certified letters and etc. Brewer: That completes the list of person who signed up to testify tonite on this issue, therefore I will close the Public Hearing, gentlemen our options tonite are to accept the Planning & Zoning findings and Facts and instruct our Attorney to prepare the appropriate ordinance ; or if you feel there has been enough testimony tonite to warrant the prepar- ation of new findings that would be the step to take however I might say though the representation and the testimony tonite as far as the total numbers we have been dealing with since this arrived are very small. The Motion was made by Giesler and seconded by Tolsma to take the comments that have been given tonite and incorporate then into the Findings of Fact and Conclusions of Law before this City Council takes action on this issue. Motion Carried: All Yea: Item #2: Public Hearing: Rezone Request by Bud Gingrich: Dale Ownby was in the audience and was representing Mr. Gingrich: Dale Ownby, 1195 East Overland, Ownby was sworn by the City Attorney: Ownby: What you have before you is an application for a rezone fron an existing residential zone, this property has been laying vacant now since back in the sixties when the school district the property for the school, we are asking for a R-15 Zone wht-h is multi -family dwellings, the property has a length of approximately 350 feet of frontage along 8th street with a depth of approximately 100 feet at the south end and narrows down to about 40 feet at the north end. The property to the south of this is all single family residential and the bulk of the property to the north is multi -family, it would be my recommendation that this rezone be approved so this property can be cleaned up and put to the most eff- icient use. At this time we do not know the exact square footage of this property but is somewhere between 20,000 and 24,000. Mr. Gingrich would have to abide with the existing City Ordinances as to the number of units that he could put on there, have the required number of parking spaces as well as the number of curb cuts that ACD would allow. The type of buildings Mr. Gingrich would build would be attractive buildings such as the ones r MERIDIAN CITY COUNCIL AUGUST 16, 1988 PAGE # 8 he built behind the Hungry onion. Myers: I am familiar with the units at the Hungry onion, is that similar to what he will Put on this property? Ownby: Possibility until the property is surveyed we actually cannot tell, I would have to assume it is going to be somewhere between 4 and 7 units. There are also several easements on this property that will have to be taken ,into consideration. Zblsma: You do not know whether it is going to be one or two story units? may: There might be scene of them that would be two story. The most economical and effic- ient way to do* it and still have a very desireable unit. Brewer: We will now open the Public Hearing, is there anyone testify on this item? in the audience who wishes to Mary Boice, 1319 W. 7th St., Mrs. Boice was sworn by the City Attorney. Boice: Presented a petition signed by eleven property owners in the immediate area that Opposed this rezone, (petition on file with these minutes) we feel it is to many buildings for the area in as much as there is no off street parking for the school, there are many buses stop there and there is no parking whatever provided for them. You are going to have the traffic from this development bucking the traffic already there as well as the children in the school crossing the street. Giesler: That walkway will not be done away with the one between 7th & 8th? Boice: I do not believe so. I would hate to see the irrigation ditch closed as most of the neighbors use it for irrigation. Brewer: What I know about water rights I do not believe ther eis any way it could be closed water will have to continue to be delivered to the present users, whether the ditch be tiled or what. Boice: It would definately have to have some kind of protection if you were going to have families in there because . - you just can not watch every child to see that they do not get in the ditch, it is fenced now. Brewer: I think all of us on the Council, I have been in Meridian about fifteen years and I would have to say that is a odd piece of property, odd shaped, odd location and there are same precedences however set down the street already with amt complexes, we appreciate Mrs. Boice's comments. Being there is no one else signed up to testify on this issue, I will close the Public Hearing. Are there any comments from the Council Members, if not we have the same options as we had with the other issue, we can accept the Findings that were prepared for the Planning & Zoning and instruct that an ordinance be prepared or we can take into consideration the testimony here tonite and have new findings made. Myers: I would make a Notion that we accept the Findings of Fact and Conclusions of Law that have been presented, I can appreciate Mrs. Boice's concern about the property but I have been here sixteen years and lived close to this property and whatever they put on it would be an improvement. Tolsma: I have a question have all the comments made been included in the Findings? Mr. Tolsma was advised they had been. The Motion was made by Giesler and seconded by Tolsma that this item be postponed until the next meeting and that the City Attorney review this testimony to see if additional finding need to be made before a final decision is made. Ownby: Mr. Gingrich may want to say something to, if I could just give you a little history on this Property, this Property was put up for bid almost one year ago, this is our third time of bidding on this property and what I would call problems with the newspaper and other problems related to it, it has been turned down and this is the first time that it has been accepted, if the property is not closed in ninety days then it must go through the same process again, my client has told me he is not willing to bid on it again if this happens because of the money he has spent on it approximately $500.00 to get it to this Point, the School District they are sick of it and I can appreciate your thoughts on it but I do not think anything is going to change two weeks from now. The way I understand there is an easement for the irrigation ditch that -goes along there which does run right adjacent to my property, it is tiled now, I would like to know how far from that easement does he have to stay from my place and the ditch easement. Brewer: That would have to be eluded to, we are kind of doing things through the back door here, that should have all came out during the Public Hearing. Gipe: The reason I am doing this is I would at least like to see it held off to the next meeting. Brewer: Mr. Attorney do you have any thoughts? City Attorney: I only have a proceedual suggestion, If it is the desire of the Council to leave it with the last Notion and leave it tabled until September 6, 1988 then nothing needs to be done, if it is the Council's position to reassess the issue then there needs to be a Notion to rescind the previous Motion to table, that would need to be done by the individual who made the Notion, withdrawal of the second would have to be done by the person who made the second then you are back having the matter still before the Council at that time I would say the best thing to do would be to reopen the Public Hearing, if there is a Motion to do so, then you can do one of two things at that time, you can either ask these people to be sworn and re -testify or since we are recording the meeting anyway, that they be sworn and that they would like to incorporate as testimony before the Public Hearing what they Previously stated. Myers: One question I had is either way we go is there any way, like Mr. Giesler wants to do go take a look at this, is there anyway we could postpone it for a week would that do any good? Would you still be interested in it at that point? Maybe have a special meeting. Gingrich: I need at least two weeks for appraisal and etc. Giesler: I would make the Notion that I would like to rescind the Motion to table that I previously made, the reason being I did not realize we were up against a time frame. I have seen Mr. Gingrich's work before, it is first class, I wish all of our multiple family dwellings were of that caliber, I thought we had more time on this, I would hate to see this opportunity go by the wayside and see that piece of property stay as is has over the years, so I would move to rescind my table. Brewer: Again it seems like every time we get a problem like this before us, we have to appreciate everyones concern but we sitting here on the Council have to consider the entire City and the plight of that property up to this point and if an opportunity like this isn't taken and it does seen like the last one for a while, I guess we would have to look forward to that property remaining like it has been forever. Boic:e: The history of this property was that it was traded to the District by the ACRD and orginally they were going to use it for an administation office, later for parking of the school buses, they have no place to park the buses and the children have to load in the street which is very dangerous, I could see a Doctors Office or something like that there but not five or six additional families to that area for additional traffic. Creating noise so people can not sleep at night is was supposed to be resolved about a month ago, it has not been resolved we have people who if it is not going to be resolved shortly that are going to do their utmost to see it shut down. There is a noise ordinance in the State of Idaho. Brewer: Has anyone or the City taken any decimal meter tests from the area of complaints? There was more discussion on this matter. Brewer: There must be steps that could be taken to reduce the sound sane, I do not think we can ask then to shut their plant down from the standpoint they have made a tremendous investment there and apparently it is a twenty four hour operation to be sucessful, if it does prove to be a qualified legitimate gripe there needs to be something definately done about it, if it takes a legal reading from a certian distance lets get it done so we have something to go to Hoff with and it has to be remedied. Counselor do you have any comments? City Attorney: -I have not looked into the thing, I have not been asked to but I can find out what the provisions are and figure out the best way to approach it. Brewer: Counselor, I do not know exactly what to instuct you to do, but we certainly ask you to to do anything you can to help address this problem. Conduct at least one public hearing at which interested persons will have the opportunity to be heard. At least 15 days prior to hearing notice of the time and place shall be published in newspaper. b. Within 45 days after hearing the Commission, shall transmit its recommendation to the Council with supp- orative reasons, the Commend shall recommend the application be approved, approved with conditions or denied. The Commission shall insure that any approval is in occordance with the Comp Plan, this Ordinance and State Law. 3. The Council: a. The Council shall conduct one public hearing after notice requirements as above. b. After hearing the Council shall approve, approve with conditions or deny, with supporative reasons. Z-73 A MERIDIAN P & Z • JULY ' 12 , 1988 PAGE #2 and past administration and its appointees, in researching that to make sure we are right, the information I have from Nampa is that their Planning & Zoning fees and budgets are approximately $50,000 the fees cover $20,000, the taxpayer subsidize in the City of Nampa approximately $30,000, Caldwell budget is about $1,400.00, their fees cover the $1,400. they have a staff person of approximately $21,800 and the fees do not cover that the taxpayers subsidize that, the City of Boise which everyone was fond of quoting and we had some testimony by a employee of the Planning & Zoning Commission and by the attorney that had worked for the City of Boisebeemed to indicate that the fees over there were relatively inexpensive, in visiting with the City Finance Director of Boise, in 1987 the fees covered approximately 12% of the costs of the Planning & Zoning Department, the rest was subsidized by the taxpayer, their budget was a little less than $400,000 in 1987 meaning the fees covered $48,000 and the taxpayer picked up the balance, they raised their fees in 1988 to cover 25% or approximately $100,000 of the $400,000 budget, the bad news for most everybody is that in 1989 the City of Boise is going to increase their fees to cover $260,000 of the $400,000 budget, it is the City of Boise desire that everybody pay their own way, just like we have here in Meridian, currently the Building Department is fully funded, the Fire Inspection Department is going to be fully funded in 1989 by the fees, Public Works is currently fully funded, most licensing functions are fully funded, those that are not currently fully funded including the Day Care will be fully funded within the next two years, the argument presented by some of the testimony in terms of the costs although they are current- ly correct are going to be changed in the very, very near future, so it seem to -me, here in Meridian we have had a policy that serves the interest best of the taxpayer in general, I recognize that time to time for special interest groups does seem unfair but our job has been to protect the tax- payer interest overall. Chairman Morrow: Are there any comments from the members? There were none. We now need to approve the Findings of Fact & Conclusions of Law. PAGE # 3 Dale Ownby, 1195 East Overland, Meridian, Ownby was sworn by City Attorney: Ownby: Mr. Gingrich has made an offer on this property which has been approved by the School District and is asking for an R-15 Zone and at this point and time without a survey it cannot be determined as to how many units can be put on this property. This would have to be done at 4 a later date after the exact number of square feet is determined. For the last several years since the School District purchased this property, this sliver of grounA. has been nothing but a bunch of weeds, we are asking for the R-15 Zone and I think it would be appropriate for the Planning and Zoning to approve it, as well as the City of Meridian, it would be a good buffer for the residential houses immediately south as well as immediately east, it is directly across the road from the tennis courts, the property adjacent to the north of it is a 4-plex, next to the 4-plex is a single ffi family dwelling and next to that is a duplex and further north is a 5-plex, so in my opinion it does conform to R-15 Zoning. This would be a positive improvement for the City of Meridian.,;�' Alidjani: Would I be in conflict -.of interest if I work as a real estate salesman out of Mr. Ownby's office? x City Attorney: Yes, this would be a conflict of interest. % Mr. Alidjani was asked to step down until this hearing was over.:;>f Johnson: I assume you have seen the recommendations of the City Engineer do you have any problems with any of these recommendations? Ownby: Mr.Gingrich does not: Johnson: How about the comments from Ada County Highway District? Ownby: The verbage on the Ada County Highway District may not completely be { accurate, their office for the last ten or twelve years has inadvertently, written their name in the southerly 30feet of that property, thinxing that they owned it as an extension of Camelia Street and they do not. The School District owns that. The rest of their comments if they apply we have no problems with. Rountree: You indicated you did not know the square footage of the prop- erty can you give us some kind of idea as to what is proposed, concept or what you think you might be able to do with the property. Ownby: There have been three appraisals made over the years and all of -- them have said there is approximately 24,000 square feet, but without Vgvi having it surveyed it is only a guess, at the point in time that the number of square feet is determined and based on the existing City Ordinance's we can determine how many units can be built on the property. I would have to assume it would be somewhere between three and six units. All such districts must have direct access to a transportation arterial or collector, abut or have direct access to a park or open space corridor, and be con- nected to the Municipal Water and Sewer systems of the City of Meridian. The predominant housing types in this district will be patio homes, zero lot line single-family dwellings, townhouses, apartment buildings and condominiums. 7. The Comprehensive Plan contains Housing Policies on pages 26 and 27; the pertinent policies to this Application are stated as follows: 1. The City of Meridian intends to provide for a wide diversity of housing types (single-family, mobile homes and multi -family arrangements) and choices be- tween ownership and rental dwelling units for all e 0 income groups in a variety of locations suitable for residential development. 4. The development of housing for all income groups close to employment and shopping centers should be encouraged. 9. The efficient use of land for public facilities, transportation systems, utilities, and the economic arrangement of buildings should be promoted. 12. Land development regulations should be revised to encourage the infilling of existing vacant parcels within the city limits. 13. Infilling of random vacant lots in substantially developed, single-family areas should be encouraged at densities similar to surrounding development. In- creased densities on random vacant lots should be considered if: a. The cost of such a parcel of land precludes development at surrounding densities; or b. Development of uses other than single-family structures are compatible with surrounding development. 15.
