NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of
Meridian and the laws of the State of Idaho, that the City Council of
the City of Meridian will hold a public hearing at the Meridian City
Hall, 33 East Idaho Street, Meridian, Idaho, at the hour of 7:30
o'clock p.m. on May 16, 1989, for the purpose of reviewing and consider-
ing the Application of Debi Cavanaugh for a Conditional Use Permit for
the operation of a day care, at the property located at 581 Lynhurst,
Meridian, Idaho; a more particular description of the above property is
on file in the City Clerk's office and is available for inspection during
regular business hours.
Any and all interested persons shall be heard at said public hearing
and the public is welcome and invited to submit testimony.

according to the plat thereof, filed in Book 44 of Plats
at pages 3587-3588, and Affidavit of Plat recorded
November 7, 1978 as instrument no. 7859376, records of
Ada County, Idaho.

5. The subject property is presently being used as the
residence of Craig and Debi Cavanaugh and also as a day
care center which is being operated by Debi Cavanaugh.

9. Exhibit "A" attached hereto shows the layout of the
subject property and a floor plan of the house. The
basement area has been converted for use as a play area
for the children being cared for. There is also a
separate area within the house that can be used for the
children when they are napping. The subject property is
particularly amendable for use as a residential day care
center because of its proximity to the parents who are
utilizing the day care center and its physical layout.
Neither parking nor traffic congestion has been a
problem.

hereby grants a lien against the subject property for

14. The subject property is part of the Franklin Square
Subdivision. Although subdivisions covenants were

imposed by a document recorded April 12, 1978 by the
developer, these covenants are no longer enforced and

have fallen into disuse. Specifically, there is no
longer an active Architectural Control Committee
operating within the subdivision and there are several
home businesses which have developed within the sub-
division. Specifically, the applicant's business has

been in operation for three years without any objection
or lawsuit being filed pursuant to the terms of the
restrictive covenants. There are also two other
babysitting businesses operating within the subdivision.

Dear Nancy,
As of March 22, 1983 the septic system for Franklin Square Subdivision
has been abandoned, the lift station will remain in service, pumping
to the Crestwood Industrial Park Gravity System located on S. W. 10th
Avenue. The septic tanks were pumped, demolished and filled with
pit -run gravel. As to the drain field, this is located on the Sub-
division Lot #17, Block 5 and is no longer under the supervision
of the City of Meridian Wastewater Department. If the Health Depart-
ment has any conditions to be met by the owners of the property where
the abandoned drain field is located, please notify me and we will
help in any way we can to see that are met.

Franklin Square Subdivision Interim Septic System
Dear Nancy,
As of March 22, 1983 the septic system for Franklin Square Subdivision
has been abandoned, the lift station will remain in service, pumping
to the Crestwood Industrial Park Gravity System located on S. W. 10th
Avenue. The septic tanks were pumped, demolished and filled with
pit -run gravel. As to the drain field, this is located on the Sub-
division Lot #17, Block 5 and is no longer under the supervision
of the City of Meridian Wastewater Department. If the Health Depart-
ment has any conditions to be met by the owners of the property where
the abandoned drain field is located, please notify me and we will
help in any way we can to see that are met.

AMENDMENT OF PROTECTIVE COVENANTS TO
FRANKLIN SQUARE SUBDIVISION
DATED APRIL 12, 1978 AND RECORDED ON MAY 1, 1978 AS
DOCUMENT NO. 7822619 IN ADA COUNTY, IDAHO
The undersigned being all of the owners of the lots developed in FRANKLIN SQUARE
SUBDIVISION recorded in Book 44 at Page 3587 of Plats, records of Ada County, Idaho,
hereby mutually agree to Amend Paragraph D-1 of the Restrictive Covenants of said
FRANKLIN SQUARE as follows:

That paragraph D-1 on Page 2 shall be and is hereby amended to read as follows:
D-1 LAND USE AND BUILDING TYPE. NO lots shall be used except for residential
purposes. No building shall be erected, altered, placed or permitted to remain on
any lot other than single family dwellings not to exceed two and one half stories
in height and a private garage for not more than three cars per unit, except on Lots
1-8 in Block 4 & 5 which shall be designated "duplex" lots; and Lots 1-8 in Block 1,
and Lots 9-16 in Block 5, which shall be designated "fourplex" lots; and also
excepted Lot 17 in Block 5, which shall be designated "commercial with storage".
Duplex -townhouses may be built on the following lots designated single family lots:
Lot 4,7,9, &13 of Block 2; Lots 1,2,5,8,9,13,14, & 21 of Block 3; and Lots 47 & 48 of
Block 4; provided the plans and specifications of buildings to be erected must be
submitted to and approved by the Architectural Control Committee as set out under
Paragraph C-1 herein.

CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property

both the preliminary & final plat and have been in contact with him about the
necessary changes. We did forward a revised preliminary plat to the City Engineer,
along with plans for the utilities. As far as ACHD requirements we would appreciate
not having to install the curbs, gutters and sidewalks along Overland Road and
along Teare Avenue.

Winter water use records for this residence are as follows:
1985-86 3740 gal./month
1986-87 9640 gal./month. Avg. Monthly Use
1987-88 15,575 gal./month
Nov.188 - Feb. 271 1989: 10,900 gal./month = 12,040 gal.
In Meridian we have identified a typical single family residence
to have a winter month water use of 6500 gallons.
According to some information available from the Idaho State Health
Dep't. a Day School (W/cafeteria, w/o -gym or shower) can expect to use
20 gal./person/day. This doesn't seem out of line for a Day Care given
that a toilet may use 5 gal./flush. From this information, -for a 12
child day care the use could be expected to be 12x20x23 days/mo. = 5520
gal./mo. (Confirmed from Greenleaf Friends Academy water use records)
The following data is from Water use records for other Meridian City
Operating Day Care businesses:

effect, the applicant is circulating a petition amongst
the residents of the subdivision allowing for a day care

center on the applicant's property. This will be a
