CITY COUNCIL ��- 3 Other Business Cont'd: July 18, 1983 Gary Smith: Water is flowing in the Well again at the Creamery Building and into the ex System, flow at the Plant is up around 2,000,000 gallons per day. Council instr- s tucted Mr. Smith to contact Mr. Amyx or Mr. Raasch whichever is the owner of the lding and try to resolve this problem. Earl Ward: Wheel Inn Mobile Manor has let contract to have some of repair work done on their sewer service lines. FairviWas contacted by Mrs. Clarence Morgan who awn property just South across ew from Settler's Village. They have a problem, the problem being phase III sewer line ends 90 feet from their property on the North side of Fairview, and Central District Health considering the short distance about issuing them a septic tank permit. Property is not in City Limits therefor it would be a Policy decision as to whether City would allow then to hook on even if they could. The only way they would issue a permit if the City wrote then a letter that it was an impractical situation. The fact was brought up that this was not for the present house on the would likey be for a trailer house which the Morgans would like to move n the pmup�y as when the property was taken back by then the person they sold to keep the house. - There more discussion (tape on file) City Polciy to be relayed to them if we are contacted again. Crookston, I talked to him personally and he informed me he was going to do two things, one he was going to get with his tenant to get up and the other thing he was considering was rezoningthe pr it cleaned moving some other type of business in there I e Property and he was talking about some kind of office. got the idea that maybe Brewer, as Fire & QRU Commissioner I and the Mayor would � am sure that the rest of the Council join me in my remarks in regards to the two car accid- ent which occurred Wedriesday May 13, 1987, at the corner of Meridian & McMillian Road. On the scene that morning were three fire trucks that included nine firefighters, 2 EMTs and our Quick paramedics with three or four ambulances, thelifeeflight helicoptertand the Meridian Police Department. I was informed that at the time of -arrival on the scene each victim was considered critical and were treated as such at that time as far as being removed from the accident and to the Hospitals. It is my thinking that it is a miracle that some of those Young people did not actually die at the scene of the accident and I have to believe that it is due to the expendience and professional care given them all that they all survived. All of those emergency personell at the scene are to be commended for the way they handled the situation and we have to be very proud of them all. It is not often they are called upon something of that magnitude and for them to be able to respond as they did it is remarkable. Councilman Tolsma, who was on the scene heartly concurred with Mr. Brewers statement. Mayor Kingsford, I think the one we have discussed a certain amount is in regards to the Conditional Use.Permit that maybe violates Covenants. If you have anything else please submit them to the Planning & Zoning Commission. -City Attorney, just for the Council information we did collect our `judgement from Mr. Amyx. Mayor Kingsford, in regard to that, I did not go over there today but continues to pile back up, what steps have we taken? City Attorney, I was waiting until they served this execution from the Sheriff, I thought this might get his attention, I do not know when that was served, but it was served on March 24, 1987 and he apparently has not done anything since the date of the execution, so maybe I should move henceforth. Mayor Kingsford and the Council concurred with this. City Engineer, the Water & Sewer extension has been completed, Western States Equipment Company has water. Mayor Kingsford, while we are on that subject it is appropriate that I discuss with the Council the preliminary contract proposal that we made with Western States. In meeting with.them last week it was discussed that just them and us will be partners in the extension project. and enter into a late -comers contract. They have at least verbally.at this time agreed to be a one fifth owners in the line and commit to one fifth of the cost-plus their share-:-6f.-,units in the lines. I` might also say that Western States has been a very good firm to work with. Flyers, as you know we had a accident on Franklin where the sewer man- hole cover came off by unknown causes, this girl ran into the hole and damaged her car. She submitted the initial :claim to our Insurance Company. They looked at it and did not think there was any liability on the City's part, however because we have a $1000.00 deductible and the repairs are.only going to be $5.00.00. -they told the girl that they did not think there was any liability. She has now filed a claim against the City as required by the Tort Claims Act. I looked at the car and the repair costs were well within line, the Insurance Company does not feel we have any liability and I am not sure we have any -liability. I have talked to the girl and her mother and they feel the City was at fault and they say that if we -3o not: pay- them they are going to get an attorney and take us to court. We have three alternatives, one is to pay this claim, two is iot:to..-take ".any. action on this claim and three is if we let that happen and they do file suit the Insurance Company will provide defense costs not necessarily pay anything because of our deductible. I do not feel the City is at fault but we have now went to the expense to the City to redo this manhole and another one further to the west, and do not known what effect this would have if suit was filed. The midsection of the ground floor and the three upstairs storage rooms are to be used for storage and sales area for reusable auto parts and supplies. The building across the alley and railroad spur we will use as a body and repair shop, adding an overhead door and building a paint booth to code. The west end of the building has an existing shop area that will be used for dismantling and shop space. The building being used for corn storage we understand is being considered as a continued use by the operators for additional time. The garage and pump building is to be used as additional shop space. It is our intent and plans to rent or lease the entire building and premises and remodel, restore and upgrade in a 5 -year program. We request a waiver of fire and building codes on shop and storage space for a period of 1 -year. Electrical service will be brought to a condition acceptable to the state electrical inspector as buildings are put into use. Water and sewer service at the present time will be for restrooms for less than 10 people and hose outlets for washing and protection service only. We do not wish to make extensive repairs or remodeling of any part of the building at this time as our desire is to establish an acceptable trend for the entire premises. However, we need to be able to use parts of the buildings to help sustain the cost and overhead while waiting. Council Members Present: Bill Brewer, Bob Giesler, Bert Myers, Ron Tolsma Others Present: Jay Amyx, Wayne Crookston. The purpose of this meeting was to discuss the operations that are being conducted in the old creamery building located at 27 East Broadway. The Mayor and Council informed Mr. Amyx that he had not preformed according to his orginal agreement that was made at the time of occupancy of this building. Mr. Amyx had committed at the time of occupancy and the proposal for a Used Auto Parts Store that there would be no parts or junk automobiles on the outside of building, everything would be stored inside. Mr. Amyx also had agreed to keep the City advised as to the other occupants of the Build- ing. Since the time of Mr. Amyx occupancy there have been junk cars and parts stored in the alley and around the building on the outside and the location has not been kept clean of weeds and other debris. At the present time there is a legal action violation -of the City of Meridian Ordinances. pending against Mr. Amyx for There was more discussion regarding the clean-up of this location and comforming to the City Ordinances. (Tape on File - City Clerk's Office) Item 7 Jay Amyx Regarding the Creamery Building Jay Amyx a Building Contractor, was present, requesting approval to convert a portion of the creamery building into a used auto parts store. Amyx assured the Council that this operation would not be a junkyard for old cars, but an establishment that offered spare parts. Amyx assured the Mayor and Council that the artesian well water problem would be taken care of. (Tape on File - City Clerk's Office) Amyx is asking for a time extension to bring the building up to fire codes. Amyx said that the necessary fire and safety codes can be met gradually as the business begins to make money. Councilman Bill Brewer said he thought the idea showed some promise. "I certainly do encourage it," Brewer said. Amyx said he has experience in leasing retail space and that this idea could develop into many directions. Although no decision on the proposal was handed down, members of the Council seemed in agreement with the plans as submitted. He asked to find out if the Council would approve or have any recommendation in this matter. It was the consensus of the Mayor and Council that if this was to be a plaza in conjuction with development of the building they would probably not have any problems with this request but would want to see some development plans and have design review before any decision was made. Mayor Kingsford, has the patching been completed in the alley? Smith, Ada County has requested this.be patched back with concrete and I believe this is an unfair request as there is not the heavy traffic as in the past. I have been working with them trying to get approval to patch with asphalt. Mayor Kingsford, we need to have this completed as soon as possible. Smith, one other item is a sign at the Park on Franklin Road and the possibility of closing the exit on Meridian Street and making a culdesac. The Park Commissioner, Mr. Tolsma and City Engineer, Mr. Smith were advised to check with other Cities and also the State Parks Department in regards to these items. Tolsma, advised the Council that the Grant for the Park Department was not funded by the State. Mayor Kingsford advised the Department they needed to complete their budgets for the upcoming year. Also if you plan on attending the. AIC Convention you need to get your registration completed. Attorney, I have the pictures that will be submitted to the Court on the problem at the Creamery Building showing it cleaned up and they will be for the record. This will be the basis for any future problems. We had a couple of hearings and the judge gave Mr. Amyz until May 14, 1986 to have the place cleaned up and then he came out to inspect and had Mr. Myers take photos of the premises showing the way it should be. If there is any future problems we probably would have to file an action but the pictures would be on file for the record. Mayor Kingsford, I wish to thank the Attorney, City Clerk and Mr. Myers for their efforts in this matter. Giesler, after the last meeting the Engineer, Sergeant Robertson and I went to where Mr. Pinkley was building the fence and did some meas- uring and Mr. Pinkly agreed to do the 45 angle on the fence and we felt this solved the problem and advised him the Variance was approved. We still feel there should be a stop sign and are in the process of trying to get one installed. Myers, we still have not heard anything on the other quote on the Insurance so we went ahead and renewed with Safeco as the Insurance expired on May 15, 1986. Ly Parther was contacted at the 37 E. Broadway location and he advised that a gas station and a cafe were used. However, that does not take care of the hours when these places are closed. Present sanitary conditions are in violation of Meridian City Ordinance #7-517, copy enclosed. We hope this letter will be sufficient notice to take corrective action. Sincerely. May 21, 19 Item •6 Department Reports Councilman Tolsma brought up the problem of the salvage yard in back of the creamery. Mayor Kingsford commented that he would like to work with the City Attorney, Police Department and Polic Commissioner (Giesler) to "go after that full scale." There was discussion regarding all the problems that are going on at the Creamery building. (Tape on File - City Clerk's Office) Councilman Brewer suggested that Mr. Amyx come to City Hall, and that the Mayor and Council have a very "stern" meeting with Amyx, reminding Amyx of all his promises to the City. Brewer said that he felt this would be a better way of handling this problem that sending a threating letter. Brewer also reminded the Council that the promises that Amyx made are on tape, and maybe "he should hear himself". It was decided that City Clerk, Jack Niemann, would contact Amyx and set up a time for a meeting. Mayor -Kingsford announced that Department Heads should start to prepare budgets. . Mayor Kingsford also commented that in keeping with the wishes of the Don Storey Family, the City had not sent flowers to the funeral. The Motion was made by Brewer and seconded by Myers that the City of Meridian donate $100.00 in the name of Don Storey to the Meridian Senior Citizen's Building Fund. Motion Carried: Brewer, yea; Tolsma, yea; Myers, yea; Giesler, yea; Being there no other business to come before the Council . . . . . .
