BY:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MERIDIAN,
SETTING FORTH CERTAIN FINDINGS AND PURPOSES; AUTHORIZING
THE PRESIDENT OF THE CITY COUNCIL TO ISSUE, ON BEHALF OF SAID
MUNICIPALITY, A DOCUMENT ENTITLED "CONSENT TO LESSEE
ASSIGNMENT WITH RIGHT OR REASSIGNMENT BY DEED OF TRUST".
BE IT RESOLVED BY THE PRESIDENT OF THE CITY COUNCIL AND
COUNCIL OF THE CITY OF MERIDIAN, IDAHO:
WHEREAS, it is in the best interests of the City of Meridian to issue that
certain document entitled, "CONSENT TO LESSEE ASSIGNMENT WITH RIGHT
OR REASSIGNMENT BY DEED OF TRUST", a copy of which is attached hereto
marked as Exhibit "A" to this Resolution, the reasons and authority for which are as
set forth in said document.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT OF THE
CITY COUNCIL AND CITY COUNCIL, as follows:
1. The President of the City Council and Clerk are hereby authorized to
issue on behalf of the City of Meridian that certain document entitled "CONSENT
TO LESSEE ASSIGNMENT WITH.RIGHT OR REASSIGNMENT BY DEED OF
TRUST", dated the 21S` day of September, 1999, by and between the City of
Meridian and CHERRY LANE RECREATION, INC., an Idaho Corporation, a copy
of which is attached hereto marked as E.~chibit "A" to this Resolution.

RESOLUTION OF THE CITY OF MERIDIAN -PAGE -
AUTHORIZING THE MAYOR TO ENTER
INTO A LESSOR'S STATEMENT CONCERNING AGREEMENT OF LEASE
DATED OCTOBER 30, 1978
"Consent to Lessee assignment with right or Reassignment by Deed of Trust"
Issued by authority of the City Council of the City of Meridian Resolution this
2l s/ day of September, 1999.
To Whom it May Concern: The City of Meridian does hereby consent to Cherry
Lane Recreation, Inc., an Idaho Corporation, entering into that certain Leasehold
Deed of Trust, using as security its Leasehold interest in, and to, that certain
"Agreement of Lease" by and between the City of Meridian and the said Cherry Lane
Recreation, Inc., dated the 3~d day of October, 1978, which Leasehold Deed of Trust
shall be, by and among, the Cherry Lane Recreation, Inc., an Idaho Corporation, as
Borrower/Grantee ,Pioneer Title Company of Ada County, Trustee, and Idaho
Independent Bank, Lender and Beneficiary.
This consent is issued pursuant to a request of Cherry Lane Recreation,
Inc., an Idaho Corporation, which requests the same to enable it to meet condition no.
2.20 of that certain conditional use permit issued to Cherry Lane Recreation, Inc., an
Idaho Corporation, in the City of Meridian Case No. CUP-99-009, for the construction
and use of a golf course club house facility, upon the real property which is the
subject of the said "Agreement of Lease", and pursuant to section 14 of said Lease
Agreement.

instrument, and acknowledged to me that the City of Meridian executed the same.
