The Regular Meeting of the Meridian City Council was called to
order by Mayor Kingsford at 7:30 P. M.

OLD INTERMEDIATE SCHOOL FROM ALIDJANI & GLAIR (FAMILY WORSHIP
CENTER) TO ALIDJANI & BARKLEY (APOSTOLIC BIBLE CHURCH):
Kingsford: I will now open the Public Hearing is there a
representative present who wishes to testify first?
Moe Alidjani, 2023 Turnberry, was sworn by the attorney.
Alidjani: I have a gentleman that would like to rent the
cafeteria portion of the old school and also he has indicated to
me that he does have intention of buying that particular piece of
property. At this time all we are looking at is the Conditional
Use Permit which is needed for that particular area for the
church use. Also within that I have a question about the
transfer of some kind of deed in case he's interested to buy.
I'd be happy to answer any questions you may have.
Giesler: Basically the use would be staying the same all around
there would be no real change from what it was before.
Alidjani: No.
Giesler: There would still be plenty of parking and everything.
Alidjani: Yes plenty of parking, there haven't been any changes
at all.
Giesler: The amount of people would be pretty much the same.

Alidjani: I do not know how many people are going to be there.
The one conversation I had with Pastor Barkley, he was talking
about 25-35 people. I have a letter from the School District
stating they are completely moving out of that premises. He
needs me to, in the future, remove the green barracks.
Kingsford: Should that long time be a church and the buildings
removed I think it would be appropriate that the parking lot be
improved, paved and so forth.
A~.ici.j~rris I have no answer at this time, I don't know what Mr.
Barkley has in mind.
Kingsford: Thank you. Anyone else to testify?
Mark Agenbroad, 1671 Jericho Rd., was sworn by the attorney.
Agenbroad: I'm a member of Valley Bible Fellowship and our only
concern is the parking. We meet in the parking across the street
at 211 E. Carlton and we have the parking lot and we use on
street parking. That was our concern is having two churches
meeting there at similar times but it sounds like they intend to
use parking on the premises.
Giesler: Your concerned about parking on the street itself? We
couldn't guarantee that parking on the street would be used.
Agenbroad: We weren't certain about the parking conditions.
Kingsford: Thank you. Anyone else to testify? No response. I

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on December 15, 1992, for the purpose
of considering and taking action on the application of Mohammed
Alidjani and Bill Blair, Jr., for the transfer of the conditional
use permit at East Carlton and 2 1/2 Street at the old Intermediate
School, Meridian, Idaho; the conditional use transfer is for the
operation of a Family Worship and Revival Center to Vernon Barkley
to be known as Apostolic Bible Church.
The transfer of a conditional use is allowed under Section 11-
2-418 J. of the Meridian Zoning Ordinance after public hearing
before the City Council and notice thereof to property owners
within 300 feet of the external boundaries of the subject property.
Public comment is welcome and will be heard and considered.

need to research before we can answer that. Jack will notify you

Max as I got the building report for this month, I would ask that
you maybe take a look and see if we're still on the right track-~

The Motion was made by Rountree and seconded by Hepper that the Meridian Planning &
Zoning Commission hereby recommends to the City Council of the City of Meridian that
they approve the Conditional Use Permit requested by the Applicant for the property
described in the application, subject to the conditions states herein.

Johnson: Before we adjourn we have an item for discussion. Some people have come to
~ the City Clerk to have some water tested on the L~eho property located on the northeast
corner of Meridian Road & Overland. They want to put up a convenience store and then
change that to a truck stop probably beca~zse of the zoning the way that it is.
We don't have anything from them formally or informally as to what they plan on doing
but ,they did mention putting in diesel pumps.
Shearer: Are they going to tear the old building down?
City Clerk: All the old buildings, all the old farm equipment will be gone.
Rountree: I think it's a super idea, but I still think it needs a Conditional Use Permit,
I really think it ought to go by ACRD.
Johnson: Being familiar with the property the only thing that struck me was that
the way the property is shaped and the restrictions because of the ditch and the overpass.

'~~ Johnson: For the record I want to ask you if you had read the recommendations from
T Nampa-Meridian Irrigation District and City Engineer Gary Smith. Do you have any
s ~, problems with any of those? Is there anyone else that would like to testify on this
issue?
Bill Sweet, 1105 Crestwood Drive, Crestwood Estates #1, was sworn by City Attorney.
Sweet: I don't object to this development but I do object to sacraficing the developed
' area there in Crestwood Estates #1 & #2 unnecessarily. That particular area consists
~'~ of a different type of development from the ordinary single family lot development, the
,`~K lots there are half the size of a normal single family lot. So the houses are pretty
well crammed together there and along with that goes some fairly large open common
areas. I feel that this development will turn Crestwood Drive into a Collectors Street
' for a large part of this development that is being proposed and I think unnecessarily.
The main street that comes in to this development here is 12th Ave. and it comes into
the develoc~ment and goes back half way back to the south end of the proposed .development
as a 60' street and I believe that it is narrowed down to a 50' street. It's my
feeling that the main street for this new development should go through to this S.W. 12th
Ave. and be a 60' width and that this portion of street that connects Crestwood #1 and

#4 should be eliminated. _
Rountree: Just from what some of the existing subdivisions are that exist now in
Meridian, I can think of one that has 150 lots with one access and it's not a particular
problem at this time.
There was further discussion about the sewer lines and the width of the roads.

Hubble: I think when this project was originally proposed this development did have
: smaller lots throughout that whole thing we are redoing now. Which would have been
, higher density and probably more traffic than what we are proposing now. I think if
you got out that original proposal it's going to be less impact than what they had
originally proposed.
°'~" Sweet: I'd like to comment on the Engineers last comments. I think that what he said
was correct that in the housing area density was higher however there were large open
:~ common areas where Ithink-that project wise the development density was not greater
`~" °'~ than now proposed.
Johnson: Being no further comment the Public Hearing is closed.

for Crestwood #4 with the condition that they check on lot #2 and rezone that lot
if necessary.

Mohammed Alidjani, 2023 Turnberry, was sworn by the City Attorney:
Alidjani: At the Middle School we have a cafeteria that is about 3500 square feet
and Mr. Blair has indicated he would like to use it as a church. We have done.
some of our work that was necessary to come before the Commission, and he had two
questions regarding that and I will let him later explain and answer any questions
ghat you may have. I'd like to get a Variance for the curbs and gutters especially if
some of it is not pertaining to that particular area of this property. Basically it is
not feasible for us to redo all the sidewalks in that area to have a lease agreement
with Mr. Blair for 3500 square foot of that building considering the total
square footage is about 45,000 square feet. Can I answer any questions?
Shearer: Is the cafeteria attached to the school?
Alidjani: The cafeteria is out by itself. I basically saw two comments, one from the
sewer department and I need to get a Variance through the Ada County Highway District.
Rountree: Is there sufficient paved parking?
Alidjani: There is about one acre of parking.
Rountree.: With having people. on the premises legally, there is slot of broken windows ~
do you propose to take care of that problem?
Alidjani: At the cafeteria, yes we are.
Rountree: How about the rest of the building?
Alidjani: We could clean up the glass that's on the ground but I don't believe at this
time we can replace the glasses. We could cover them.
Hepper: Would there also be a way to make the stairways nonaccessible so that kids
can't play on them.
Alidjani: Right away I don't believe so but we have planned to within the next 90 days
to take some measurements to secure the place so it would be safe for the children
and the insurance and so on. But it won't happen right away.
Hepper: You are leasing this property is that right?
Alidjani: Yes it is a lease.
Johnson: Being there no further questions, we'd like to hear comments-from Mr. Blair.
William Blair, 855 N. Blackcat Road, was sworn by City Attorney.
Shearer: Could you explain a little bit more about the usage?
Blair: We are looking for a building to hold services in on Sunday morning, Sunday
night & Wednesday night. Basically right now we only have 6 people, I can't tell
you how many people there will be in a year.
Shearer: Are you going to have access to the whole cafeteria?
Blair: Not the kitchen part.

Hepper: How do you feel about the broken glass and the stairways?

Blair: There is a lease agreement and it states that we have to take care of the
broken windows in the cafeteria. About the main building, no I have no concern.
We are providing liability insurance so that if anything happened Moe wouldn't
be responsible for it.
Crookston: What about the lavatory facilities, are those adequate?
Blair: There is two bathrooms.
Johnson: Being no further questions I will now close the Public Hearing.
The Motion was made by Rountree and seconded by Shearer to prepare the Findings of Fact
& Conclusions of Law for the City Council. Rountree amended the motion by including
the variance not to make provisions for alterations or improvements to curbs and
gutters. The Motion is favorable.

Item #3: PUBLIC HEARING: REQUEST FOR CONDITIONAL USE PERMIT BY NESMITH & ROSS FOR
VEHICLE STORAGE, BOAT REPAIR & STORAGE AT 34 EAST ADA:
Johnson: The Public Hearing is now open, is there a representative here on behalf of this
application. Please come forward. We are recognizing Moe as being back on the Board.
Steve Nesmith, 1304 W. 1st, was sworn by the City Attorney.
Nesmith: In our business that adjoins this property on Bower Street we've had a little
bit of a parking problem and needed additional parking, also we have moved a little
building in there, my partner wants to do a little boat motor repair. I propose to
put up a 6' high fence around it that is not see through. We plan on siding the
building with the same color as the fence, also planning to put a concrete parking
area in front of the garage on the front. I do have a question about the ACHD
comments about the curbs and gutters what did that mean? There is already sidewalk there.
Johnson: Those are basic requirements from ACRD.
Nesmith: I would like to clean up the front of the building and make more customer

Johnson: At this point I need to enter into the testimony some written comments we
have and also same photographs that have been provided. That includes specifically
two letters from individuals in the neighborhood that are opposed to this request.
Letters are on File. In addition to that there is a petition that was circulated
in the neighborhood that has 24 signatures opposing this request. The claims that are
made are about the history of the property nearby and the photographs substantiate
basically the claims about it being unsightly to the public.
Alidjani: What type of fence were you planning to put up?
Nesmith: I was planning on a cedar fence 6' high no see through. I've got that
storage box sitting on the property right now and once this was fenced it wouldn't
even be visible from the street. At the growth rate we are at now I figure that by

2. That this property is located within the City of
Meridian and is owned by Mohammed Alidjani, and is described in
the application, which description is incorporated herein as if
set forth in full; the property is generally described as at the
corner of East Carlton Street and 2 1/2 Street; the proposed use
of the property is to operate a church family worship center,
and a revival center.
3. That the property is located in the R-15 Residential
District, which requires a conditional use permit for the
operation of a church which is the use the application requests;
that the previous use was for school purposes.
4. That the R-15 Residential District is described in the'
Zoning Ordinance, 11-2-408 B. 3 as follows:
(R-15) MEDIUM HIGH DENSITY RESIDENTIAL
DISTRICT: The purpose of the (R-15)
District is to permit the establishment of
medium-high density single-family attached
and multi-family dwellings at a density not
exceeding fifteen (15) dwelling units per
acre. All such districts must have direct
access to a transportation arterial or
collector, abut or have direct access to a
park or open space corridor, and be
connected to the Municipal Water and Sewer
systems of the City of Meridian. The
predominant housing types 'in this district
will be patio homes, zero lot line single-
family dwellings, townhouses, apartment
buildings and condominiums.

5. That the use proposed by the Applicant is an
enumerated allowed conditional use in the R-15 Residential
District.
6. That the property to the west is proposed to be
developed as a. post office; the property to the east is
residential; the property to the south is used residentially and
for church purposes; the property to the north is used
residentially.
7. That proper notice has been given as required by law
and all procedures before the Planning and Zoning Commission
have been given and followed.
8. That the entire parcel of property, of which the
subject parcel has been is a part used in the past as a school
and the particular subject building was a cafeteria.
9. That the Applicant has submitted petitions signed by
at least 75~ of the people owing property within 300 feet of the
property indicating their approval of the use of the property as
requested by Applicant.
CONCLUSIONS
1. That all the procedural requirements of the ..Local
Planning Act and of the Ordinances of the City of Meridian have

property pursuant to 67-6512, Idaho Code, and pursuant to 11-2-
418(D) of the Revised and Compiled Ordinances of the City of

4. That 11-2-418(C) of the Revised and Compiled
Ordinances of the City of Meridian sets forth the .standards
under which the Planning and Zoning Commission and the City
Council shall review applications for Conditional~Use Permits;
that upon a review of those requirements and a review of the
facts presented and the conditions of the area, the Planning and
Zoning Commission preliminarily concludes as followso ~~

b. The use would be harmonious with and in
accordance with the Comprehensive Plan but the Zoning
Ordinance requires a conditional use permit to allow
the use.
c. The use apparently would be designed and
constructed, to be harmonious in appearance with the
intended character of the general vicinity, such being
designated as set forth in the definition of R-15
Residential as contained in Section 11-2-408 B 3.
d. That from a zoning standpoint, the use should not
be hazardous nor should it be disturbing to existing
or future neighboring uses.
e. The property has sewer and water service
available.
f. The use would not create excessive additional
requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community.
g. The use would not involve a use, activity,
process, material, equipment or conditions of
operation that would be detrimental to person,
property or the general welfare by reason of excessive
production of traffic or noise.
h. Sufficient parking for the property and the
proposed use must be provided.
i. The development and uses will not result in the
destruction, loss or damage of a natural .or scenic
feature of major importance.

NOTICE OF HEARING
NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City
of Meridian and the laws of the State of Idaho, that the City
Council of the City of Meridian will hold a public hearing at the
Meridian City Hall, 33 East Idaho Street, Meridian, Idaho, at the
hour of 7:30 o'clock p.m., on December 15, 1992, for the purpose
of considering and taking action on the application of Mohammed
Alidjani and Bill Blair, Jr., for the transfer of the conditional
use permit at East Carlton and 2 1/2 Street at the old Intermediate
School, Meridian, Idaho; the conditional use transfer is for the
operation of a Family Worship and Revival Center to Vernon Barkley
to be known as Apostolic Hible Church.
The transfer of a conditional use is allowed under Section 11-
2-418 J. of the Meridian Zoning Ordinance after public hearing
before the City Council and notice thereof to property owners
within 300 feet of the external boundaries of the subject property.
Public comment is welcome and will be heard and considered.
