Wally Lovan has made presentations to the Cherry Lane Village r~omeowners AssociatYOn Board of directors a,nd to the general membership concerning his need for a temporary club house. As homeowners, our organization sees the Cherry Lane Goff Course as an asset to our development and to our community. We are interested in its growth and prosperity. At its general meeting of March 2, 1982., the members of our organization voted that we write to the City Council endorsing a conditional use permit for a mobdle home golf club house on the land north of the present Cherry Lane Golf Club. Councilman Ronald Tolsma: I believe a conditional use permit and a variance of codes is in order in this application. A golf course is not probable without a pro shop and clubhouse, and due to the circumstances involved, I will vote for the conditional use permint and the variance of codes and ordinances. 2. Ada County Highway District: The Ada County Highway District recommends that the applicant'be informed that Interlachen Way is a collector street and it§ perpetuation to the North may be necessary to serve future developments to the North. No permanent structures or obstructions should be placed within the alignment to preclude the future extension of the collector street. 3. Wastewater Supt Earl Ward: Sewer available 139 ft. Temporary Club House 5 ,• .~ Wallace Lovan was present to request a Conditional Use Permit fora temporary club house, dba Cherry Lane Recreaction, Inc. Hinrichs: "Hearing is now opened for Conditional Use." Lovan: "Since October, 1978 we have been in a home in Cherry Lane Village and <, using this home as a club house. The realtor out there is no longer representing Nu-Pacific Corp. and we have been given our notice to move from the Clubhouse. I am here asking fora temporary club house until such time as a road is built back approximately 1000 feet - to the north where the final club house site wi',1 be. i would propose putting this temporary structure on P•ir. (Jim) Fuller's property which would be north, adjacent to the parking lot. It will be serviced by water, __, __ _sewer_and power - even though it is on private ground." -- - - ~; Sharp: "How long would you anticipate before you would put in a permanent type club house?" Lovan`. "I would assume anywhere from two to five years. The future development of the land and the economy -" I Sharp: "I am in favor of approval, but it would seem to me that one of the items we should do is put a reasonable time limit on it - after something happens - for this to be taken care of." Mitchell: "Would you object to a lid of five years?" Lovan: "I would from this standpoint - In five years there may not be a road driven back there where the final club house would be. The only time we could build a permanent club house is when there would be facilities to service one. Right now there is no power, no sewer or water within 1000 feet." • Sharp: "What I'm getting at Wa]ly is that, would it be reasonable to say one year - two years - beyond when the second n ne is built or one year - two years - beyond when the road is built. Would that be reasonable?" Lovan: "When they lay the last piece of asphalt on that road - the house will be there.' The revenue just from the driving range alone would offset any house that I would have. It would set right to the west of the driving range." Hinrichs read a letter presented to the Commission from the Cherry Lane Village Homeowners Association, Inc. stating that they see the Cherry Lane Golf Course as an asset to their development and community. The letter endorsed the conditional use permit fora temporary club house. (Letter on file with these minutes) (Tape on File) Tom Eddy questioned landscaping. Lovan: "Right at this point I have more invested out there than anyone else except .the developers. It is something that is going to have to be done with dignity - I am working up a real fine clientele and I want to hold this clientele. I propose a down-close to the ground, shrubs around it - there could be some type of porch overhang which would blend in. Right now we are using a 2500 sq. ft. home - we are using a little less than 700 sq. ft. - the rest of it is strictly wasted. Hepper stated that the lot is presently zoned for multiple units - the south 40 feet is zoned Commercial. Hepper: "This is not a Nursing Home - it is for the elderly people to stay before they go into a nursing home. They need help - they need somebody to do their cooking, their laundry." This is just one home, one level, six bedroom, not to exceed nine people. "We do nave State Codes but when there is more than nine people it's a different category." Mitchell: "They are putting these in residential areas." They have done considerable research and are very serious with nutting a laundromat with the intent of keeping attractive. Eventually they do plan on completing the approved professional complex. They had talked with the people around this area and they felt it was ideally located, that there is adequate parking. Kim Cherry stated that they would have to get approval of the residents, they felt it can be a positive thing and as far as precedence they have to work through the economy problem one way or another, they would like to stay on tqp and r~gve the business complex when the time comes. They felt they could dq that best by keeping it in a paying proposition and not be forced to sacrifice - they have been carrying the complex for quite awhile - they felt they have an excellent building and too .much value there to let it go. The feeling of the Commission was twq (2) nays and two (2) yeas,. This is coming about because the leaving of the neighborhood of the Real Estate Agency that had been leasing from the agency for three years now - we will have a new agency and the agent wants to sell the clubhouse. The price for the ex fisting clubhouse is just beyond what the golf course can afford - so therefor I am applying fora temporary clubhouse until such time a road and utilities are driven back where the final clubhouse will be built.'' Green: "All City Ordinances have been met with the exception of a one (1) foot setback easement. We would like to get a variance from East State Street." Schenck: "After the initial discussion last time we were here and the engineering was done, there is an irrigation ditch down the alley of the 5th Street side and the property line goes right down the middle. So therefor, we are proposing bringing the ditch inside our line, put in a culvert and bury it - but we have no problem with that. There is also a ditch that is to the west of our property line and to the concern of property owners. Our property line is to the east of that ditch. From our prior meeting we discussed covering it, screening - whatever needed - but since that ditoh ~is to the west of our property we propose putting our back fence along there. That is' the only two changes except requesting a one foot variance on that State Street side. We have a 19 foot setback rather than a 20 foot setback." Councilman Brewer: "Can you answer to Ada County Highvray Districts letter of requirements - dated PJovember 23, 1981?" Schenck: "With what they request, I have no problems at this time." Councilman Orton: "Basically, outside of the one foot variance, there is no hangup now is there?" Schenck: "No sir - we're within one foot and I think what created that is that the property shifted from the irrigation ditch." Councilman Kingsford: "How does the density compare to the other areas. If I have this right it's 14.49. units per acre. What is the density surrounding there?" Schenck: "Across the street - going to the north - is a triplex - on the other side of the street and the other side of the alley, there is a triplex. Outside . of that the rest of the homes are residential - one person has a' rental unit at the back. of the original residence. Once againk to reiterate, why we are doing this is because we have two lots originally. The reason we are building to sell is the ' neighbors have objection to rental units - they don't want rental units and by selling them they will take better care of the property.
