Beumeler, Ralph Hakwins, Bill Haylett, Chip Schweers: The Motion was made by Brewer and seconded by Myers to approve the Minutes of the previous meeting held May 3, 1988 as written: Motion Carried: All Yea: Item #1: American Legion & VFW: Memorial Day: Chip Schweers advised the Mayor & Council that he would no longer be involved as Commander of the Memorial Day Services and introduced Ralph Hawkins, Post Commander of the Lloyd Hutchinson Post #113 and Bill Haylett Commander of the Post 4000 VFW: Haylett: We appreciate the City involvement in these Memor Al Day Services and would appreciate your attendance at this Memorial Day Services to be held on May 30th at 11:00 A.M.: Mayor -Kingsford: Thank you very much and I apologize, I will not be able to attend this year, Council President Brewer has said he will be there and I encourage any other members of the Council that can to be there. Thank you very much for all you do for the City and the Memorial Day Services. Item_# -2: Findings of Fact and Conclusions on Variance Request by Jerry Smith for a Church at 1114 Meridian Road. Mayor Kingsford: Councilman you have these included with your agenda, Are there any questions or comments on the Findings? If not I would entertain a motion to approve the Findings. The Motion was made by Tolsma and seconded by Myers that the City Council does hereby adopt and approve the Findings of Fact and Concl- usions on the Variance request by Jerry Smith for a Church at 1114 Meridian Road. That notice of the public hearing on the variance was published for two consecutive weeks prior to the scheduled hearing for May 3, 1988, the first publication of which was fifteen (15) days prior to said hearing; that the matter was duly considered at the May 3, 1988 hearing; that copies of all notices were available to newspaper, radio and television stations. 2. That the Ordinances of the City of Meridian, 11-2-409B, Zoning Schedule of Use Control require in the R-15, Residential District, that no church can be located in that zone unless permitted by a conditional use permit. 4. That the Applicant has requested that he be granted a variance from the Zoning Ordinance requiring a conditional use permit and that the Church be allowed to operate a church in the R-15 Zone; that prior to the adoption of the current Zoning Ordinance on April 2, 1984, a church could have validly operated on the property in question without a conditional use permit; that in fact the structure located on the property was a church and was operated as such. 5. The property in question is Lots 1, 2, & 3 of Block 1, of the Amended Plat of F.A. Nourses Third Addition. 6. That the lot is zoned R-15 Residential which thus can be used for multi -family dwellings and churchs, but only upon issuance of a conditional use permit. 7. That the use to which the Applicant proposes to put the lot is a church. 8. That the Applicant set forth the following pertinent comments as reasons for justification of the variance the following: that the property has been used in the past as a church and the structure thereon is suitable for a church; that the only reason a church could still not be operated is the change in Ordinance. That all the procedural requirements of the Local Planning Act and of the Ordinances of the City of Meridian have been met including the mailing of notice to owners of property within 300 feet -of the external boundaries of the Applicant's property. 2. That the City has authority to grant variances pursuant to Section 11-2-419 of the Zoning Ordinance. 3. That the City Council has judged this application by the guidelines, standards, criteria, and policies contained in the Zoning Ordinance and upon the record submitted to it and the things upon which it may take judicial notice. 4. That the Council may take judicial notice of its own proceedings, those of the Commission, governmental statutes, ordinances, and policies, and of actual conditions existing within the City and the State. 5. That the following provisions of Section 11-2-419, Variances, of the Zoning Ordinance is noted which is pertinent to the Application: 11-2-419 A GENERAL The Council may authorize in specific cases a variance from the terms of this Ordinance as will not be contrary to the public interest where, owing to special AwBROSC nZOERALD CROOKSTON ttmep ow COWMI n '.a Box 427 GWW4 w.tw tax ®sweat 81i6 N01 conditions, a literal enforcement of the provisions of this Ordinance would result in unnecessary hardship. No non -conforming use of neighboring land, structures or buildings in the same district and no permited or non- conforming use of lands, structures or buildings in other districts shall be considered grounds for issuance of a variance. Variances shall not be granted on the grounds of convenience or profit, but only where strict application of the provisions of this Ordinance would result in unnecessary hardship. A variance ap- plication does not go to the Commission unless directed by the Council. 6. That the specific requirements regarding a variance that must be evidenced and found by the City Council are as follows: 11-2-419 C FINDINGS A variance shall not be granted unless (as a result of a public hearing) the Council makes a statement of supportive reasons based directly on the evidence presented to it which supports conclusions that the mentioned standards and conditions of this Ordinance have been met by the applicant and unless all of the following exist: 1. That there are such special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be impracticable or unreasonable; 2. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the owner, subdivider or developer because of unusual topography, other physical conditions or other conditions which are not self-inflicted, or that these conditions will result in inhibiting the achievements or the objectives of this Ordinance. 3. That the granting of the specified variance will not. be detrimental to the public's welfare or injurious to other property in the area in which the property is situated. 4. That such variance will not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan. That regarding Section 11-2-419C it is specifically concluded as follows: a. That there are special circumstances or conditions affecting the property that the strict application of the provisions of this Ordinance would clearly be unreasonable when the property was previously used as a church and is suitable therefore and no objection thereto has been received. b. That strict compliance with the requirements of this Ordinance would result in extraordinary hardship to the owner, subdivider or developer. c. That the granting of the specified variance would not be detrimental to the public's welfare or injurious to other property in the area in which the property is situated. ' d. That such variance would not have the effect of altering the interest and purpose of this Ordinance and the Meridian Comprehensive Plan, or the legislative intent and purpose of Idaho Code 67-6530 through 67- 6532. 9. That it is concluded the Application should be granted provided the Applicant meets the other Ordinances of the City of Meridian, including the Building Codes, Fire Codes, and Life Safety Codes. APPROVAL OF FINDINGS OF FACT AND CONCLUSIONS The City Council of the City of Meridian does hereby adopt and approves these Findings of Fact and Conclusions. Councilman Tolsma: That is one of the comments I had requiring sewer and water connection fees. Mayor Kingsford: Certainly those and other issues in regards to this if is the desire of the Council to pass or recommend that we draft this in Ordinance form, these are items that would be open for discussion at Public Hearings both at the Planning & Zoning and the City Council so there will be time for imput on those items. Councilman Giesler: I visited with Boise City and they advised they had some problems at times with their method of handling these day-care centers. Mayor Kingsford: I might also mention that with checking with Boise Staff they are anticipating fee increases. If there are no other comments I would entertain a motion to either nay, yea or table. The Motion was made by Brewer to table the suggested outline for day-care centers until after the hearings. Mayor Kingsford: A point of order I think what we need to do is if the Council is reasonably satisfied that we need to have an ordinannp change that they want these things entertained then what we have to do is make recommendation to the Planning & Zoning Commission that they entertain these and other suggestions in Public Hearing and suggest a recommended ordinance change to the Council. Councilman Brewer: I withdraw my motion. The Motion was made by Myers and seconded by Brewer to pass the proposed guidelines along to the Planning & Zoning Commission for their review and to start the process for an amendment to the ordinance. Motion Carried: All Yea: Mayor Kingsford: I acknowledge receipt of a petition to the Mayor & Council dated todaythat will be taken into consideration and passed on to the Planning & Zoning Commission as well: The Mayor & Council thanked the Committee for the effort they put forth on this item; 02: Public Hearing: Request for Variance for Church at Mayor Kingsford: Is there a representative to make a presentation Council? Chris Norbyhn, 7426 Lake Hazel Attorney: Norbyhn was sworn by the City Norbyhn: I am a member of the Church of the First Born, basically what we want to do is take the building that is there and turn it into a church, I believe this building was orginally built as a church and we feel this would work as a church for our congregation. MERIDIAN CITY COUNCIL ® • MAY 3, 1988 PAGE # 5 If anyone has any questions I will be happy to try to answer them; Mayor Kingsford: At this time I will open the Public Hearing, is there anyone in the audience who wishes to testify in this matter? There was no response, the Public Hearing was closed: Councilman Brewer: Living in that vicinity and when it was a church before it certainly created no problems and since that time I believe there has been a paved parking lot improvement which would improve the conditions over what it was before. I have no problem this returning to that use. The Motion was made by Myers and seconded by Tolsma to have the City Attorney prepare Findings of Fact and Conclusions on this request. Motion Carried: All Yea: Item #3: Request for Extension on Filing Final Plat on Meridian Manor #5: Mayor Kingsford: Councilman you have an attachment to your agenda regarding this request. Any questions or comments of the Council? The Motion was made by Giesler and seconded by Myers to grant the extension as requested on Meridian Manor #5: Motion Carried: All Yea: Item #4: Pre -Termination Hearing, Water/Sewer/Trash Delinquencies: Mayor Kingsford: You have been informed in writing, if you choose to, you have the right to a pre -termination hearing before the Mayor and Council to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain Counsel: Is there anyone in the audience who wishes a hearing? There was no response; Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on May 11, 1988. In order to get their water turned back on there will be an additional fee of $10.00. They are hereby informed that they may appeal the decision or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal their water will be shut off.
