All dwellings shall be constructed in accordance with the City of Meridian, Idaho, Zoning and Development --Ordinance- dated 1964. and provided further no other structures shall be permitted except property sanitary housing for pets. Provided, however, the total square feet of space to be occupied by all buildings and structures on any lot cannot exceed 35% of the total area of the lot upon which constructed. 4. No building shall be erected, placed or altered on any lot nearer than twenty (20) feet from the front street lot line, twenty (20) feet to any side street lot line, six (6) feet from the side lot lines, nor six (6) feet from the rear lot line, for the purpose of this covenapt, cornices, canopies, eaves, stairs, steps or open porches shall not be constructed upon nor encroach upon easements. 5. In connection with paragraph 4 above, the following structures or projections are permitted within the set back areas therein described: d A. Cornices, canopies, eaves, or other projections which do not increase the volume of space enclosed by the building; provided, however, that none of these shall project into any required yard more than two (2) feet. B. Exterior stairs of open design; provided that no such stairs shall project into a required front or side yard more than four (4) feet and into any rear yard more than eight (e) feet. 6. Not withstanding the provisions of paragraphs 3, 4, and 5 above, multiple housing by way of apartments, duplexes, condominiums, townhouses, or similar housing may be constructed and operated upon two (2) or more contiguous lots in this subdivision so long as the set -back lines of said structures are observed from the front and rear thereof, and the outside side lines for the lot upon which each side of the structure is located. Provided, however, if multiple dwellings or buildings are constructed on one or more lots in said subdivision, the side lot line requirements shall not apply to the newly created lot line if the multiple dwelling shall be divided and sold as a separate dwelling or dwellings such townhouses, condominiums, duplexes or apartments. 7. No trailer, mobile home, basement, tent, shack, garage, barn or other outbuilding erected in said tract or on any building site thereof shall be used at any time as a residence, temporary or permanent. No structure of a temporary character shall be used at any time as a residence. B. All property will be serviced by public water and public sewer disposal systems. All residences must be connected to these utilities at the time of construction. All platted streets will be paved and provided with concrete curbs and gutters. 9. Each lot owner shall control the drainage and storm run-off from his lot so as to prevent damage or burden to adjoining property. 10. No nuisances or offensive activities shall be carried on any building site or in any structure built thereon, nor shall anything be done thereon or thereof which may be or may become an annoyance or nuisance to the neighborhood. 11. No building site shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be kept in sanitary containers and disposed of as directed and authorized by municipal authority. 12. Each lot owner shal l construct a garage for at least two cars and shall provide for off street parking for any unhoused motor vehicles, trailers, and boats. No inoperative motor vehicle or any of its detached parts may be maintained or stored on any premises longer than seven (7) days except in an enclosed garage. 13. Livestock and Poultry: No animals, livestock or poultry of any kind shall be raised, bred or kept on any lot, except that dogs, cats or other household pets may be kept provided that they are not kept, bred, or maintained for any commercial purpose. 14. Each lot owner shall promptly, after constructing a dwelling and attached garage, and in no event later than five (5) months from occupancy there of, seed the yard to lawn or place sod thereon and provide and maintain landscaping and trees aesthetically acceptable for the neighborhood. 15. These covenants and restrictions shall run with the land and shall be binding upon the undersigned, and all successors in title or interest to said real property or any part thereof, for a period of thirty (30) years from the date these covenants shall be automatically extended for successive periods of ten years, unless an instrument signed by owners of a majority of the building sites within said tracts has been recorded, agreeing to the change or cancellation of these covenants, in whole or in part. If it should be found necessary or advantageous to make changes in or to modify the covenants and restrictions prior to the initial 30 years as stated above, this may be done by an instrument signed by the owners of at least two-thirds of the. building sites. 16. Enforcement of these covenants may be prosecuted by any owner of any building site within said tract by proceedings at law or in equity against any corporation, firm, person or persons violating or attempting to violate any covenant, either to restrain violations or to recover damages. Relocate all obstructions outside of the proposed street improvements. Prior to relocation, obtain written approval from the applicable jurisdication. 4. There was no comment, hearing closed. Mr. Wayne Gibbs, JUB Engineers, who was present representing this request advised the Council that the covenants submitted prior were not correct and presented a corrected copy of the covenants, he also. asked that the Council include two items in their approval for the School District benefit, these items are that the two accesses to the School Site were sufficient and that there would be no further request for additional access at time of construction and that Lot #2 Block 6 be designated as an educational site. Mr. Gibbs explained the property was owned by Earl Harmon and the School District was purchasing the site for a new school and being the school site was fronted by residential lots it was necessary to plat the property. Fairview: I would like to know where the school is going to be built, as I have the property to the West listed for sale. Mrs. Ewing was shown the plat and the proposed location of the school. Raleigh Hawe, 530 Blue Heron Lane: Mr. Hawe expressed concern over the lateral ditch that runs on the North side of the property and is not shown on plat. There was discussion on this lateral and how the ditch would be kept open. It is not known for sure if this ditch borders property or not, but if it does an easement should be shown on plat. Mayor Kingsford: Under our Ordinances we have the provision that allows for a mix of housing sizes, a given percentage can be 1000, a given percentage can be 1100, and a given percentage above that. Garrett: Does anybody know what the average house size is in that area, it is urger than that by a fair amount isn't it? Mayor Kingsford: Do we have a breakdown of what was on the #1? City Clerk: #1 was actually designed with the same thing, most of the homes ended up being larger than the minimium. Mayor Kingsford: The fact that they have that smaller designation does not mean that they have to be that size, they can always be larger, it just allows them to be built down to that size. David Stucker, 1164 Torrington Court, Stucker was sworn by the City Attorney: Stucker: I live about one block from where these house are going in and I am concerned because I would like to see the size of the houses in the area stay about the same, I am concerned that mine is going to depreciate in value if the small ones go in, I an about two to three hundred feet from it, so it effects me, so I would like to go on record that I would like to see them remain pretty close to the same size and there was some discussion as to what size was out there and I think it is fair to say, I am making a estimate and I don't think there are many or any that are in the thousand foot area out there, none of them ,look that small. City Clerk: There would only be one allowed in that area: Stucker: I am glad to hear that: Mayor Kingsford: The percentage breaks down so you would only be allowed to have one of those 1000 to 1100 foot hits. Mayor Kingsford: We are aware of the problem, we thought we had remedied a lot of it, what happens is you are right by one of our wells that basically services that, so when it kicks on it sends 120 PSI pressure towards the water tower and that creates a negative pressure for an interval and then when it shuts off the water reverses direction and you have a lag again. The City Engineer might be able to speak to this better: City Engineer: That is basically what happens, we put in a quick closing check valve in that well house here two years ago when we had quite a few complaints but I hadn't heard of any problems since that was done. Bolts: It is still bad at my house and my next door neighbors and several other people in the area have said are they still going to have to be serviced by the same well and I am also concerned by the small houses being near us. City Engineer: one of the Problems with that subdivision is it is kind of isolated frau the City, so with the well in the subdivision itself, the use as the Mayor mentioned is back towards town, as that area out there develops the problem will lessen as more users are served with that well. Bolts: So in other words we just have to wait until therehamore subdivisions in the area: City Engineer: No, no not at all, there is some other things that can be done, if that valve is not taking care of the problem. Bolts: In the m,mmvar time you can turn your water on and it will be fine and ten minutes later it will be out in the street and then later it will be a three foot circle so if you have a sprinkler system you are defeating your purpose. City Engineer: I wasn't aware that the valve had not solved the problem, I will. Mainly look into it some more. Mayor Kingsford: If you would Mrs. Bolts, please keep us advised. on that because we do want to try and remedy that problem as much as we can. As developuent does take place it will improve, what we need to do is get a looped system, so it does not have. that direct feedback, there are sone things that are costly but we still want to do then. Williaams:I have a couple of questions based on what I have heard, there must have been a change since the covenants and restrictions because basically what you are telling me if we have a 999 square foot house that is in violationof the covenants Of the subdivision because it states no dwelling shall be permitted on any lot in such subdivision with less than 1350 square feet. John Ball, 1057 East Chateau, Bell was sworn by the City Attorney: Ball: I would like to go on record that my wife and I oppose the allowing square foot house basically for the same reason as the rest of the people who have testified it would decrease the value of my place, ours is twenty-two hundred square feet and most of them around there are between sixteen hundred and that, I have another question, on those streets out there on Chateau where they are digging the street up and putting the stubs out for the new lots, are they going to go in there and replace that street or are they going to leave it patched up? City Engineer: 'That is ACM's jurisdiction as to what happens there but that street is older than five years in age so 'therefore they are allowed to dig in the street and they would patch it back to ACM specifications. Ball: So all we will end up with our there is patches? City Engineer: Until such time as they seal coat the road, put oil duan and sore gravel chips, those patches should be installed in such a manner that when you cross then with a vehicle you do not feel a bump and they have to warranty that patch for one year. Scott Swanbeck, 944 Claybourne, Swanbeck was sworn by the City Attorney: Swanbeck: I Would like to go on record confirming Bolts comment about the water, it is very poor, I also called an appraiser and asked his cam --nt on the fact of putting lower square footage houses in there and he did confirm back that it would greatly decrease the value of bores in there also I was concerned with the fact that even though there is only one slated for the 1000 square foot size, there will be more houses in future development that will go to that size and from the appraisers comments when you get into smaller houses like that, they are usually starter mouses they are built a lot poorer and that they devaluate the area even faster, I was also curious on houses they have already starved building in there, I do not know what size MERIDIAN CITY 00[NM • DECEMBER 6, 1988 PAM #5 it is, it looks like a small house, do you know the size? Morrow: I have a couple of comments, This is really a tough issue, in terms of what YOU folks have in your subdivision for your houses and Your square footages, I think one of the things that may be misunderstood here is this Ordinance and what we are doing here tonite in terms of this amended plat proposition in designating house sizes on par't'icular lots is the origin of that Ordinance was to protect subdivisions such as yours from a onslaught of less than ethical builders sbthat would came in and because of cheap lots and cheap money and cheap uild houses that were 750 to 850 square feet and then move on out, the thing of it IS in terms of the building industry and free enterprise system and those kind of things it is really tough for goven ment to mandate Peoples life styles and what they can and can not do, what we have attempted to do in Meridian that by virtue of this Ordinance at least have some protection for your subdivision, we cannot legislate nor should we try to legislate what each house in each subdivision should be, that is not quite how the system works, but also we have an obligation to make sure that your property values do not get decimated by sane unethical enterprise that comes in and build a bunch of real cheap buses, so this is a difficult situation and it is difficult to know how to approach it but I think you need to understand that is basically what is going on here with the amended plat and there are lots of other things that enter into trying to core to a decision here rather than just protecting your hares. We have made an attempt here in Meridian to protect them best we can. but by the same token we can not dictate to everybody what they are going to builgl certainly there are subdivision where a two thousand square foot home or a thirteen square foot hone would be considered less than standard and we can not go into those subdivisions and say you have to all build 2500 square foot homes. Holts: Brought the fact that there are many houses for sale and some look very bad, dead lawns and etc Mayor Kingsford: This is something we have no control over: Morrow: I think one of the comments in addressing those kinds of issues you are working with, in many cases those places are taken back and mortgage c on own those, if you have a very active homeowners association in your s YOU can bring a lot of pressure to bear on those lenders and they will clean those place up and it will help you, in teams of appearance. Im Giesler: We have other subdivisions where we have allowed this and most of are mixed. do not realize they are that small they do not look out of place when they I think you would be surprised with the garage still having to be on there, you really do not notice it like I think you are thinking. Mayor Kingsford: I would say this on that issue to, in Meridian in any of the sub- MERIDIAN CITY CDUir-IL DEER 6, 1988 PAGE # 6 divisions this is the same formula that we use, I would echo Mr. Morrow's comments certainly through covenants and a haneowner's association can bring a lot of pressure to bear there, not only just on the square footage but on the desings and those kinds of things.
