development, Complete. the following questions and return
with the application.
1. What is intended to be done on or with the property?
future development of parking and landscaping
2. What special conditions and circumstances exist which
are peculiar to the land, structure, or building involved and
which are not applicable to other lands. structures, or buildings
in the same district? An application has been made to the Ada County Highway District
for abandonment of State Avenue from Meridian Street to West First Street, and at
this time we know of no circumstances that would prevent the abandonment. State Avenue
has an 80' right-of-way and is a very minor street with little vehicular traffic as
compared to Meridian Street with a 60' right-of-way.
3. Why will a literal interpretation of the provisions of
this ordinance deprive you of rights commonly enjoyed by other
properties in the same district under the terms of this ordinance?
The Meridian School District is a public entity wholly supported by public tax money
and this varience request therefore is in the public interest for the best use of
school property without any adverse effect on any adjoining property owners or resi-
dents, and will make it possible to more ensure the safety of public school students.
4. What special conditions or circumstances exist that were
not a result of your actions?
The traffic on State Avenue from Pine Street is hazardous and will become more so
with the addition of students from Meridian Intermediate School; therefore our
application for abandonment of State Avenue; therefore our request for a varience
from the City of Meridian for better use of public property.
5. Why will the granting of this Variance not confer on you
any special privilege that is denied by this Ordinance to other
lands, structures, or building in the same district?
We feel this varience is in the best interests of the general public.

Commencing at the Brass Cap Monument representing the position of

to the southeast corner of Block 1 of Niday's Addition; thence North

As you are aware, it is the intention of the Meridian School
District to construct a new School Administration Building which
will be used temporarily as a Five Classroom Elementary School.
The building will be located on the site at Meridian and Pine
Streets.
At this time we are requesting a variance in the setback
requirements, found in Table 5A, page 38, of the Uniform Building
Code, 1985 Edition. It is our desire to locate the building on the
north property line.

Please be advised that we have made application to Ada County
Highway District requesting that State Street be made an abandoned
street. We have been informed that the process to have this
accomplished will take approximately 3 months at which time the
building will be well under construction. At this time we don't
anticipate any complications with our request to ACHD. State
Street is currently an 8010" right-of-way, and we will be able to
add an additional 4010" to the property having this street abandoned.

Brewer, is there someone present to represent this request?
Mr. Nick Hallett, School Superintendent, Hallett was sworn by Attorney
Crookston.
Hallett, we are requesting this Variance to be able to build the permanent
five class room addition on the property line on West State Street, the
purpose of this is two fold, one is to improve saftey for the primary
students as we are applying to vacate this section of State Street and
it would eliminate the traffic taking a shortcut from Pine via State
Street to Meridian Street, the second part is we would like to build
the new building without setback from State Street, this would maxiumize
utilization of the property, we do not need all this property for the
adminstration office and it would be very likely we would market the
South portion of this property in the future if we obtain approval for
the setback requirements, this would be a saving for the taxpayer and the
School District.
Brewer, the 0 -lot line you are asking for that will be on,ithe property -line
which is how. far from the center of the street?
Hallett, this is a eighty foot right-of-wayp--.so-it-_would,be_forty feet from
the center of the street.
Tolsma, you are talking about blocking West First Street at the intersection
of State, that will have to be some kind of diagonal cutoff as there is
an alley way that runs back there.
Hallett, that will be no problem, this might not be a permanent barricade
as I think there will have to be fire truck access and we might at times
wish to have bus access through there.
Giesler, how do you plan on picking these children up there, where will
the buses park?

Hallett, we have been discussing that, and I will have to tell right now
we are not certain of that. There are a couple of proposals in the works.
Brewer, are there any other questions of the Council? There was no response.
I will now open the Public Hearing, is there anyone present who wishes to
testify in the matter? There was no response, the Public Hearing was closed.
Tolsma, has Ada County Highway given you any problem on this, or indicated
any problem with vacating State Street?
Darrell Leatham, Architect for the School District advised the Council they
had been granted a temporary closure of State Street.
There was discussion on how Ada County would look at this if bus traffic
was allowed through here.
Brewer we have kind of got off the issue here tonite as we are dealing
with the variance for a setback for the building not the vacation of the
street, I am sure we will be able to comment on the street vacation.
We should be dealing with either approving the variance request or dis-
approving it.
City Engineer, I think the one thing that should be thought about, if and
I do not forsee any problem with the vacation of the street, if it doesn't
and a variance is granted to set it out there, the concern I have is the
students going from one school to the other. They will be exiting from the
East of the building and going down West State. The City Engineer had
drawings of the new building and explained and showed the Council on these
drawings what his concerns were, there was more discussion on these items.
The Motion was made by Tolsma and seconded by Myers to grant a Variance
from the Building Code and.the Zoning & Devlopment Ordinance which would
allow the Joint School District to construct a building on the North
property line on West State Street without the required setback.

Item #2: Findings of Fact & Conclusions on Michels request for Annexation
and Zoning:
Brewer, is there any questions of the Council on these Findings? There
were none.
The Motion was made by Tolsma and seconded by Myers the the Meridian City
Council hereby adopts and approves the Findings of Fact & Conclusions on
the Michels request for Annexation & Zoning.

for this use. He should evalute the "future" sprinkler system to

I have also discussed several other items with your
mechanical engineer and to keep you informed these items
are:
1. Move the service line tap from the 6" dia. main to
the 12" dia. main in Meridian St.
2. Use Schedule 80 PVC pipe for the service line from
the street tap to the meter yoke.
3. If the existing meter for the Administration bldg.
is in the new driveway provide a traffic supporting rile.,
ring and cover.
4. Provide as much horizontal separation as possible between
the 8" diameter sewer and the 2" diameter water line lo-
cated along the west side of the new building.
5. Provide two (2) more sets of plans - One each for Water
and Wastewater Superintendents.

FACTS & FINDINGS:
1. Application is made to Meridian City Council to locate a building for
Meridian School District at a temporary school and permanent administra-
tion building on the property line of State Avenue, located on the .corner
of Meridian Road north of Pine Avenue.
2. State Avenue is improved with 30 -feet of AC and 80 -feet of right-of-way
(50 -feet is required) .
3. West 1st Street is improved with 30 -feet of AC and 80 -feet of
right-of-way, (50 -feet is required).
4. Meridian Road is improved with 30 -feet of AC and 60 -feet of right-of-way
(50 -feet is required).
5. Representative has approached staff with proposal to vacate State Avenue,
but formal application has not been made.
6. State Street is used as a bypass when traffic backs up at the Pine
Street/Meridian Road intersection.
RECCMMENDATION:
1. Recommend denial of variance until street vacation has been accomplished.
POLICY IMPLICATIONS:
1. Requirements are made to Merician City Council as condition for
compliance.

NOTICE IS HEREBY GIVEN that the City Council will hold a
public hearing on July 21, 1986 at the hour of 7:30 o'clock p.m.
at the Meridian City Hall, 728 Meridian Street, Meridian, Idaho,
for the purpose of considering the Application of Joint School
District No. 2, Ada and Canyon Counties for a variance from the
building set back requirements of the Uniform Building Code and
the Zoning and Development Ordinances of the City of Meridian
which variance, if granted, would allow construction of a
building on the north property line of the following described
parcel which parcel is located at the southwest quadrant of the
intersection of Meridian Road and State Street, Meridian, Idaho.i
The parcel is described as follows:
A parcel of land located in the Northeast Quarter of Section
12, Township 3 North, range 1 West of the Boise Meridian, being
the south half of State Avenue lying northerly of Block 1 of
Niday's Addition to Meridian as filed for record in Book 2 of
Plats at Page 75, Records of Ada County, Idaho and being more
particularly described as follows:
Commencing at the Brass Cap Monument representing the
position of the Quarter Corner common to Section 12, T3N, R1W,
and Section 7, T3N R1E, B.M., thence North 360 48125" West for a
distance of 50.07 feet to the southeast corner of Block 1 of
Niday's Additions thence North 000 00100" East along a line 30.00
feet distant westerly of and parallel with the line common tc
said sections 12 and 7 for a distance of 256.14 feet to the
northeast corner of Block 1 and the REAL POINT OF BEGINNING;
