NOTICE IS HEREBY GIVEN that the City Council of the City of
Meridian will hold a public hearing at 7:30 o'clock p.m, on
January 5, 1987, at the Meridian City Hall, 728 Meridian Street,
Meridian, Idaho, for the purpose of reviewing and considering the
Application of Loren Ross and Greenleaf Friends Academy for a
conditional use permit to allow a private school on the property

Idaho, and is generally described as an irregular tract of land

wishes to testify on the request? There was no response. The Public
Hearing was closed. Commission Members you have preliminary Findings
of Fact & Conclusions, what is your decision?
The Motion was made by Cole and seconded by Shearer that the Meridian
Planning & Zoning Commission hereby adopts and approves the Findings
of Fact and Conclusions as prepared by the City Attorney.

The Motion was made by Shearer and seconded by Cole that the Meridian
Planning & Zoning Commission hereby recommends to the City Council of
the City of Meridian that they approve the Conditional Use Permit
requester by the Applicant for the property described in the application
with the conditions set forth in the Findings of fact & Conclusions of
Lai: and that the property be required to meet the water and sewer requir-
ements and the fire and life safety codes.

Mr. Rich Allison, 1040 East Pine, Mr. Allison was sworn by Attorney
Crookston.
Allison, our proposal is to move the Greenleaf Friends Academy Day Care
Center from their present location on Pine Street to the Ross Furniture
Building located on Fairview Ave. The propsal at the present time is to
use half of the building for a day care center and an elementary school.
We have evaluated the site from the standpoint of the comments received
and would certainly be willing to meet the requirements. One item that
might be of interest as far as safety would be the dropoff and pickup
of the children, this would be in front of the building and then inside
the building they would have a gate which would keep any of the children
from running out into the front of the building at any time. The play-
ground for the children would be directly behind the building and fenced.
Chairman Morrow are there any questions of the Commission Members?
Alidjani, due to a conflict of interest, I would like to abstain from
any comments or action on this application.
Johnson, I understand the Academy is going to lease the East half of
the building, there would be adquate parking for this facility but if
the other half was to be rented to some other type of operation would
there continue to be adquate parking.
Allison, there are currently eighteen parking place in front of the
building, the owner is planning on tearing down the old house between
this building and the building occupied by Calls Service parts as well
as removing the bath house and trailers at the side of the building for

Petitioner appearing in person, the Planning and Zoning
Commission of the City of Meridian having duly considered the._
evidence and the matter makes the following Findings of Fact and
Conclusions:

herein; the other Applicant is Greenleaf Friends Academy who are
the proposed Lessees of the property;
3. That the property is zoned General Retail and Service
Commerical (C -G), which requires a conditional use',permit for the
operation of a private school which is the use the application
requests; that such use requires a conditional use permit in any
zone where allowed.
4. That the C -G district is described in the Zoning
Ordinance, 11-2-408 B. 8 as follows:
(C -G) GENERAL RETAIL AND SERVICE COMMERCIAL: The purpose of-'
the (C -G) District is to provide for commercial uses which
are customarily operated entirely or almost entirely within
a building; to provide for a review of the impact of pro-
prosed commercial uses which are auto and service oriented
and are located in close proximity to major highway or
arterial streets; to fulfill the need of travel -related
services as well as retail sales for the transient and
permanent motoring public. All such districts shall be
connected to the Municipal Water and Seweri,systems of the
City of Meridian, and shall not constitute strip commercial
development and encourage clustering of commercial develop-
ment.
5. That the private school use proposed by Applicants is
an allowed conditional use in the C -G district.
6. That the property to the west is developed
commercially; the property to the east is used residentially and
commercially; the property to the south is used residentially as
a mobile home park; the property to the north is 'Fairview Avenue

That 11-2-418(C) of the Revised and Compiled
Ordinances
of the City of Meridian sets forth the ,standards under
which the
Planning and Zoning Commission and the City Council
shall review
applications for Conditional Use Permits; that upon
a review
of those requirements and a review of the facts
presented
and the conditions of the area, the Planning and Zoning
Commission
specifically concludes as follows:
a.
The use, would in fact, constitute a conditional use
and a conditional use permit would be required by
ordinance.
b.
The use would be harmonious with and in accordance
with the Comprehensive Plan but the Zoning Ordinance
requires a conditional use permit to allow the use.
C.
The use apparently would be designed and constructed,
to be harmonious in appearance with' the intended
character of the general vicinity.
d.
That the use would not be hazardous nor should it be
disturbing to existing or future neighboring uses.
e.
The property has sewer and water service available.
f.
The use would not create excessive additional
requirements at public cost for public facilities and
services and the use would not be detrimental to the
economic welfare of the community.

h. There is sufficient parking for the property and the
proposed use.
i. The development and uses will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.
5. That the location on Fairview Avenue is a very high
traffic area; that access to Fairview from the school use and
property must be controlled; that the fenced play -ground area --
shall have no open access and access must be obtained through the
school; such access restriction appears to be set' forth on the
plans submitted.

I have been in contact with Mr. Ery Olen, P.EP, Transportation
Planning Director at APA concerning the traffic flow impact to
Fairview Ave. caused by the proposed conditional use.
A copy of Mr. Olen's comments are attached for your review.
Basically he is saying that an "in" and "out" access to Fairview
Ave. in front of the Ross building will handle the traffic flow for
150 students. He is assuming that each student is driven to and from
the school and that this happens each morning and each evening. He
has not considered the use of a bus or buses which I understand are
being used at this time. (The use of a bus or buses should soften
the impact on Fairview Ave. from what he has calculated.)

ttraffic situation.
Chief Portjer, they submitted the concept plan which was distributed
to all the Council Members and the City Engineer was working with
Ada Planning to have a traffic count done on Fairview.
Giesler, the only other thing is I would like to thank our Police
Department and Ada County for their handling of something that could
have been very serious into something that was minor. It was handled
very professionally and I would like to congradulate both of them.

herein; the other Applicant is Greenleaf Friends Academy who are
the proposed Lessees of the property;
3. That the property is zoned General Retail and Service
Commerical (C -G), which requires a conditional use permit for the
operation of a private school which is the use the application
requests; that such use requires a conditional use permit in any
zone where allowed.
4. That the C -G district is described in the Zoning
Ordinance, 11-2-408 B. 8 as follows:
(C -G) GENERAL RETAIL AND SERVICE COMMERCIAL: The purpose of
the (C -G) District is to provide for commercial uses which
are customarily operated entirely or almost entirely within
a building; to provide for a review of the impact of pro-
prosed commercial uses which are auto and service oriented
and are located in close proximity to major highway or
arterial streets; to fulfill the need of travel -related
services as well as retail sales for the transient and
permanent motoring public. All such districts shall be
connected to the Municipal Water and Sewer systems of the
City of Meridian, and shall not constitute strip commercial
development and encourage clustering of commercial develop-
ment.
5. That the private school use proposed by Applicants is
an allowed conditional use in the C -G district.
6. That the property to the west• is developed
commercially; the property to the east is used residentially and
commercially; the property to the south is used residentially as
a mobile home park; the property to the north is Fairview Avenue
and across Fairview the property is used commercially.

7. That a proper notice has been given as required by law
and all procedures before the Planning and Zoning Commission have
been given and followed;
8. That the buuilding on the property is presently vacant
but has been used in the past as a furniture store;
9. That the Applicant has submitted petitions signed by
at least 75% of the people owning property within 300 feet of the
property indicating their approval of"the use of the property as
requested by Applicants.
CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the applicant's
property and having obtained the consent of 75% of the owners of
property within 300 feet of the external boundaries of the
applicant's property;
2. That the City of Meridian has authority to grant

That 11-2-418(C) of the Revised and Compiled
Ordinances
of the City of Meridian sets forth the standards under
which the
Planning and Zoning Commission and the City Council
shall review
applications for Conditional Use Permits; that upon
a review
of those requirements and a review of the facts
presented
and the conditions of the area, the Planning and Zoning
Commission
specifically concludes as follows:

The use, would in fact, constitute a conditional use
and a conditional use permit would be required by
ordinance.

traffic area; that access to Fairview from the school use and
property must be controlled; that the fenced play -ground area
shall have no open access and access must be obtained through the
school; such access restriction appears to be set forth on the
plans submitted.

Tolsma, do you have any problems wit this request as far as the
Fire Department is concerned, Chief?
Fire Chief, if it is built according to code there should be no problems.
Cal -Gas standards are more strict th n the codes.
Brewer, I am in agreement with whatas been said here, it is not a
foot traffic area and it would be ri iculus for them to have to make
these improvements at this location.
Mayor Kingsford, we have certainly made a precedence of not requiring
the improvements being made. I think there needs to be recognition on
their part that those would have to go in when the rest of the area
is upgraded. I think that that should also be included in the motion.
Deardon, ACRD advised that there wasbonding that could be done so
that any time it was upgraded that t e funds would be guaranteed to
complete this.
Giesler, there are adequate ways of (draining this property on site?

Allison, our proposal is to move the Day Care Center from its present
location on Pine Street to a larger facility on Fairview. We have

reviewed all the comments from the City and other agencies involved
and we have no problem with any of them.
Mayor Kingsford, does the Council MImbers have any questions at this
time? There was no response. I will now open the Public Hearing. Is
there anyone in the audience who wishes to testify on this request?

Tolsma, I have some problem with th traffic situation at this location
and I spent some time visiting with the Chief of Police on this and the

preliminary plans do not show a great amount of what is going to
happen there, how traffic is going to ingress and egress except right
in front of the building. There is a lot of traffic in and out of
there and it will be during the peak hours of the traffic on Fairview
Avenue. This is one of the drawbacks at this location unless they had
another way to get off and on Fairview Avenue without just the one
point of ingress and egress.
Allison, at the present time there are two curb cuts in front of the
building that could be designated for ingress and egress, also in front
of the building is a fifth lane on Fairview Ave. which if going to the
West they could enter that fifth lane before entering the traffic to
the West. There should be no problem for the people traveling to the
East. Those who would be dropping off children would probably to a
majority,would be going East on to work. I personally do not feel that
this is as bad as the traffic at the present location.
Police Chief Porter, I agree with the concerns Councilman Tolsma has,
the is no specific plans for ingress or egress for the facility , in
fact today I learned they are going to remove the exiting home and
mobile homes on the West side, my thought is, is there a possibility
to utilize some of that for an access back to third street.
Allison, that could easily be done.
Tolsma, when they are fencing the playground, is that going to be
directly in back of the building?
Allison, Yes, it will.
Tolsma, is there any provision to get emergency vehicles back into
that area? We are looking at if someone got hurt being able to drive
emergency vehicle directly to the area instead of having to walk back.
Allison, provisions in the final plans could be made so there would
be no parking near or around the emergency gate out of the playground.
Striping could be done, something like a fire lane, etc.
Giesler, I also have a problem with the traffic, there probably will
be as much if not more than on Fine Street, you also have two lanes
of traffic instead of just one .to cross. I feel I need to see some
kind of a concept where the traffic would be able to egress and ingress
to another street rather than have everyone exit onto Fairview Avenue.
I think this is a serious problem that needs worked out.
Allison, I am sure that something can be worked out, the owners of the
building own the mobile home park and Cal Is Service Parts building, so
I am sure something could be worked out for additional access and exit.
There was more discussion on the traffic problem.
Mayor Kingsford, if I might make a suggestion, if the Council has no
other problems with this request, that as a condition of approval that
the City Engineer, and one or two members of the Council and the Police
Chief meet with the applicants and figure some additional ways to
route the traffic and some signage showing this routing.

Mr. Phil Davidson, Claremont Development Company was present.
Davidson, our current agreement with the City of Meridian calls for
the unwinding of our conditional annexation and zoning eighteen
months after we were granted the conditional annexation and zoning
which was November 4, 1985. so therefore as of May 5, 1987 our agree-
ment would be terminated. We are still pursuing various alternatives
for the development of this property . What we are asking for tonite
is for the Council to let that agreement rest until the 4th of May
1987 and in between if we come up with an alternative we will be in
to see you.�I-,f leaving the agreement stand is going to cause any
problems in the next couple of months you could get back to us with
either a letter or notice of default.
Tolsma, we met this afternoon and I would have no problems letting
ride until May 4, 1987. Do you see any problem with that Counselor?
Crookston, along the lines you are thinking about, you could either
let it run until May 4, 1987 or set a date certain unless the City
decided to act sooner.
Giesler, where do we stand as far as the default of the funds, do we
really have a problem with that at this time?
Crookston, the agreement itself does not call for a notice of default.

of Credit so we have kind of established a prior procedure. The agree-

FACTS & FINDINGS:
I. To convert an existing 12,000 square foot building into a private school
located at 403 East Fairview Avenue.
2. Fairview has 100 -feet of right-of-way (which is adequate) and is improved
with 65 -feet of paving.
3. This section of Fairview is part of the Idaho Department of Transporta-
tion system, contact District III for right -of --way and access require-
ments.
RECOMMENDATION:
1. No requirements.

1. Requirements are made to Meridian Planning & Zoning Commission as
condition for compliance.
