(Letter on file with these minutes) "Would you like to -make a comment on this?" Nesmith: "This has been there for quite some time. I was not aware that it was not zoned correctly for what I am using it for. "What is the objection of me using this property this way?" Mayor Glaisyer refered to the City Attorney's letter stating that the property is zoned "C" Commercial and this zoning cannot allow an automobile wrecking yard nor a storage and impound yard. (Tape on file, City Clerk's Office) "You have the right to apply for a change in zoning or for a Conditional Use or Variance." Nesmith: "It is not going to be used for a wrecking yard." "I repossess cars for banks, and they usually have me store them for a few days while they are taking care of the paper- work." "I have never had more than 10 vehicles at one time, and this has always been a car lot, as far as I know."le,: There was discussion concering the necessary steps to obtain a Conditional Use Permit or a Variance for this property. (Tape on File; City Clerk's Office) City Attorney, Wayne Crookston: "He would have to have a Conditional Use Permit, or a Zone Change." Nesmith: "This letter is the first I have known that I have been using it incorrectly, even though I have been using the property for 5 or 6 years now." IMayor Glaisyer: "We have had some complaints, that is the reason that it came up." Agenda 11 1 5 Nesmith questioned the possibility of the property having Grandfather rights. Mayor Glaisyer suggested that,Nesmith check into the possibi1ity of -:Grandfather rights, and if not pick up a Conditional Use Permit applibation for -the property. The Motion was made by Kingsford and seconded by Tolsma to approve of a stay of action by the City Attorney, in the case of Mr. Nesmith's storage yard for vehicles, for a period of 60 days, in which time Mr. Nesmith is to make application for a Conditional Use Permit. We feel it would be to our advantage and the Citys to be annexed into the City of Meridian only if the properties are rezoned to C2 Commercial at the same time they are annexed. We, as individual property owners, have no immediate plans to commercially improve upon'lour properties as they now exist.
