HomeMy WebLinkAboutMurphy, Sandra CUP~;~ ,, F ,~, ~' MERIDIAN CIITY CIL APRIL 15,1985 Regular Meeting of the Meridian City Council called to order at 7:30 p.m. by Mayor Grant Kingsford: Members Present: Bill Brewer; Ron Tolsma; Bert Myers; Bob Giesler; Others Present: Kevin Robertson, Bruce Stuart, Kenny Bowers, Bob Mitich, Lynne Houghton, Laura Hobbs, Lloyd Howe, Earl Ward, Gary Smith, Gary Schaffer, George Wendt, Bill Barkell, Moe Alidjani, LeeRoy Nelson, Bob Spencer, Sandra Murphy, Dennis Murphy, Wayne Crookston. Minutes of the previous meeting held April 1, 1985 were approved as written: Lynne Houghton from the Idaho Thoughbred Breeders Association asked the community support of the horse racing in the State of Idaho, advised that a track was opening in Evanston, Wyoming and they were offering higher purses which could greatly effect racing in the State of Idaho. There would be a Meridian Community Days held May 11, 1985 and would appreciate the Mayor giving away the winning blanket. There would be buses from Meridian that day at no charge to the riders. Mayor Kingsford read a Proclamation declaring the week of April 14-20, 1985 as S.A.D.D, and Safety Week. Miss Laura Hobbs, Meridian FFA was present to accept the signed Froclamation. (Copy on file with these minutes) Mayor Kingsford, read a Proclamation declaring the week of April 21-27, 1985 as Reading is Fun Week. (Copy on file with these minutes) Item #2: From the Table, Request for Conditional Use Permit by Sandra Murphy for 2 Operator Beauty Salon. The Motion was made by Brewer and seconded by Tolsma to bring this request from tree table as the sewer line in question had been repaired and to approve the Findings of Facts and Conclusions as prepared by the City Attorney for the Planning & Zoning Commission: Motion Carried: All Yea: The Motion was made by Giesler and seconded by Brewer to approve the Conditional Use Permit for Dennis and Sandra Murphy for a two operator Beauty Salon at 1418 West Second~wifh the stipulation they pay the additional hookup fees. Motion Carried: All Yea: Item #3: Lawrence Rackham, Mr. Rooter Service, Mr. Rackham called the City Clerk and postponed to a later date. Item #4. The repayment of this Revolving Loan Fund would be approximately $35,000.00 per year and as the fund are repaid would be available for other projects. I would be happy to answer any questions of the Council. Brewer, does this address the Senior Citizens facility? Choates, it does not compete with the Seniors Center, there are sep- arate funds which the different Senior Citizens are eligible for. There wars- no further question or testimony, Public Hearing was closed. The Motion was made by Brewer and seconded by Tolsma that the City apply for a Revolving Loan Fund Grant in the amount of $250,000.00. Motion Carried: All Yea: Mayor, Mr. Choates you will proceed with the application? Choates, will try to have it completed by early next week. ``~ Item #3: Public Hearing: Conditional Use Permit for Sandra Murphy for Beauty Salon. Mrs. Murphy was present to represent this request. Mayor Kingsford opened the Public Hearing. Mrs. Murphy, I am requesting a two operator beauty salon located at__ 1418 west 2nd Street. We have had no objections from the .neighbors within 300 feet. I have been a hairdresser for fifteen years and would now like to have my shop located at residence. There were no comments from the public, Public Hearing closed.- . Mayor Kingsford, any questions of the Council? Myers, I see by the Findings of Fact prepared for the Planning & Zoning the requirements of ACHD are being omitted. Crookston, that is the Planning & Zoning recommendation. Giesler, I have a question on parking. You only have a single width driveway, where are your customers going to park? Mrs. Murphy, there is a space on the other side of driveway and out by the mailbox as well as across the Street. Giesler, how many vehicles would be there at one time? `~,. Murphy, Three. at the most, a lot of the neighbors would be_walking I plan to only schedule one appointment at a time. ~~<; ~ .~-CITY COUNCIL ' MARCH 18, 1985 PAGE # 3 Gary Smith, City Engineer, the sewer line which serves this property is a problem line and has to be hydro-cleaned weekly. We are in the process of having an obstruction removed out by Cherry Lane so that a T.V. Camera can be put into the line to discover just what the problem is. This line has an adverse grade. This is the line that has backed up several times and flooded peoples houses. There has been three claims on one house. Mr. Ward and myself are very hesit- ant about allowing additonal useage until this problem is eliminated. We hope to have the obstruction on Cherry Lane repaired in short order and will proceed post haste on solving the balance of the problem. Mrs. Murphy , am I to understand this is the only objection we have? Mayor Kingsford, certainly the only one I have heard voiced. We have not talked about the hookup fees, were you aware of those? M urphy, well you might go over them again. Mayor Kingsford, what he is talking about here, are you talking about' two operators? Murphy, not at the present but in the future I plan to hire somebody, - at the present time it would just be myself. Mayor Kingsford,-based on two operators, they are showing additional hookup fee for sewer and oabe for water,_which would be $750.00-for sewer and $380.00 for water. The Motion was `made by Brewer and -seconded by Tolsma that the request - - ------- for a Conditional Use Permit by Dennis and Sandra Murphy-for _a_two station beauty salon at 1418 West 2nd Street be tabled for sixty (60) days, giving them the-opportunitl that should the. problem with the sewer line be cleared up prior to this time they have the-opportunity:-• to come back and we will-bring-request--~ff--the table. ___ Motion Carried; All Yea: Mayor Kingsford, I would appreciate if you, Mr. Ward and Mr. Smith would proceed post haste at solving the problem. Item #4: Transfer of Beer & Wine License: Whitewater Saloon-from-Lyle - Tuller to Larry Hendrix: Mayor Kingsford, Acting Chief~Robertson do you have any objections to this transfer? Robertson, Police Department has no problems or objections. Johnson, I have a question on the parking requirements, was it decided there would need to be extra parking facilities? I am referring to #4-h of the conclusions. Chairman Spencer, do you wish this statement changed? Morrow, parking needs to be more defined, should not be a hinderance to the neighbors. Alidjani, there is a driveway that serves a multi-family next to this as long as it is kept open. The motion was made by Morrow and seconded by Johnson ghat Item #4-h be stricken from the Findings of Fact and Conclusions. Motion Carried: All Yea: There was no other questions or comments. -t ~_-- The Motion was made by Morrow and seconded by Cole that the Meridian Planning and Zoning Commission hereby adopts and approves of the Findings of Fact and Conclusion as prepared by the City Attorney with the deletion of Item #4-H pertaining to the parking. Chairman Spencer, this hearing is for the the application by Claremont Development forraoComprehensivenPlanif Amendment for the designation of the property located on the North East corner of Eagle Road and I-84 as a Regional Shopping Center warrants further study by the City of Meridian. c:~,,. ~.. _ ,. Mr. Phil Davidson, of Claremont'Development from Bellevue, Washington was present to represent this application. Mr. Davidson, The Eagle Road Site is a good location and has good exposure and is in the center of Treasure Valley, This site has good access and is close enough to Meridian for Zoning. Our Company gained control of this site in July of 1983. I was first introduced to the situation in the Boise Marketplace in 1982 at that time I was with Sutterhill Development Company out of California. We have found a healthly climate in the City of Meridian both for population growth and for welcoming a Regional Shopping Center although Eagle Road is not the preferred location. After obtaining control of this site, I immediately set about to find some major tenants to anchor the shopp- ing site for us. Made trips down to Los Angles and talked to Sears and Pen{Pys who were names we had heard that were interested but found from them they were pretty much committed to the John Price Development Company, not only to Price but to each other. At the time we found they along with Lamonts and DCMI wanted to anchor one large center, as they felt only one center could be supported out here. So they found it -convenient to committo John Price Development, who had developed quite a few sites and a very capable developer and he at the time was work- ing on the Cloverdale Road site. They all submitted letter to Price for that location, since then they have moved those letters down to Westpark Mall. Price has some problem with both of these sites, so we went to him and struck an agreement to jointly develop a regional shopping center at Eagle Road and Interstate 84 should it be approved here in Meridian. I would like to at this time we have put together -~-- -- , a team and I will introduce them now, Mr. Ed Bews, owner of the proper- ty; Mr. Al Lance, Attorney; Mr. Rick Orton, Engineer; Mr. R. D. Bischoff, Real Estate Broker; Mr. Al Norris, John Graham Company, Architect, Mr. Duaine Rasmussen and Mr. Fred Bruning, from the John Price Company. You have this Eagle Road site presented to you before, but let me assure you this is entirely a different proposal and different group of players. When you saw this proposal before it had an annexation route which was very questionable to the City of Meridian as the route was partly on the South side of I-84, as you have seen in our proposal we have a clean route of annexation to this property, also in 1981 when this property came up it was not in the Area of Impact. Today this site is included in Meridians Area of Impact. That the City of Peridian has authority to place conditions on a conditional use permit and the use of the property pursuant to 67-F512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and Compiled Ordinances of the City of Meridian, Idaho; 4. That 11-2-~18(C) of the Revised and Compiled Ordinances of the City of Meridian sets forth the standards under w~iich the Planning and Zoning Commission and the City Council shall review applications for Conditional Use Permits; that upon a review of those requirements and a review of the facts presented and the con- ditions of the area, the Planning and Zoning Commission.specificall concludes as follows: a. The applicant. shall be required to have parking for the property which shall be so designed as not to create an interference with traffic and parking on surrounding public streets. i. The developement and uses will not result in the destructio loss or damage of a natural or scenic feature of major importance. 5. That the recommendations and requirements submitted by the Ada County Highway District are felt to he onnerous and the Applicant shall not be requiredi to comply cvith them and. they shall not be required; 6. That the Applicant shall be required to pa_y appropriate rates for sewer, water, and trash and shall be reRUired to pay for any and all connection fees for water and sewer necessitated by fiis uses; that the other recommendations by the City Engineer shall not be required; 7. That the permit once granted shall be personal to the Applicants and shall not be transferrable to other individuals or property. APPROVAL OF FINDINGS OF FACT ANn CONCLUSIONS The Pieridian planning and Zoning Commission hereby adopts and approves these Findings of Fact and Conclusions. Members Present: Walt Morrow, Jim Johnson, Jim Shearer, Tom Cole: Members Absent: Moe Alidjani: Others Present: Dennis Murphy, Wayne Crookston: The Motion was made by Morrow and seconded by Johnson to approve the minutes of the previous meeting held December 10, 1984. . Motion Carried: All Yea: Item #1: Public Hearing Conditional Use Permit for Sandra Murphy: Mr. Dennis Murphy was present to represent this request: Mr. Murphy advised the Commission that they were applying for a two operator beauty salon although there would only be one operator at the present time. Commissioner Johnson, Mr. Murphy, have any of the neighbors voiced objection to this rer~uest? Mr. Murphy, we have had no negative comments from the neighbors or property owners. We have resided here for ten years and are on good terms with the neighborhood. Commissioner Morrow, what about ACRD recommendations? Mr. Murphy, there is not any sidewalks in this subdivision and it appears this recommendation should not be enforced as my property would be the only one with a sidewalk. Sewer and Water hookups v~ere discussed as well as the problem with the sewer line in this area. Mr. Murphy was advised they would be required to pay additional assessments for sewer and water in con- juction with this permit. This assessment would probably be one additional sewer and water hookup in the amount of $700.00.
