Street names must not conflict with City grid system. 9-604 B PRE-APPLICATION MEETING The developer shall meet with the Administrator prior to the submis- sion of the Preliminary Development Plan. The purpose of this meeting is to discuss early and informally the purpose and effect of this Ordinance and the criteria and standards contained herein, and to familiarize the developer with the Comprehensive Plan, Zoning Ordinance, Subdivision Ordinance and such other plans and ordinances as deemed appropriate. The developer may also meet with the Commis- sion or Council prior to submitting an application. 9-604 C. PRELIMINARY PLAT 1. Application - The applicant shall file with the Administrator a complete subdivision application form and preliminary plat data as required in this Ordinance, not less than thirty (30) days prior to the Commission's public hearing. The Commission will not schedule any hearing or workshops or put the application on_ the agenda unless the above conditions have been. met. - - 2. Public Hearing to be He1d.Prior to Subdivision Plat Approval - A public hearing shall be held at the time-of presentation of the preliminary plat by the developer to the Commission for the purpose of allowing public input on the proposed subdivision. 3. Combining Preliminary and Final Plats -The applicant may re- quest that the subdivision application be processed as both a _ preliminary and final plat if all of the following exists: a. The proposed subdivision does not exceed four (4) lots; b. No new street dedication or street widening is involved; c. No major special development considerations are involved, such as development in a floodplain, hillside development or the like; and d. All .required information for both preliminary and final plat is complete and in an acceptable form. A request to combine both preliminary plat and final plat into one application shall be acted upon by the Commission upon recommendation by the Administrator. OF THE CITY OF MERIDIAN, TO INCLUDE SUBSECTION 9-603A ENTITLED "PUBLIC HEARING TO ~ BE HELD PRIOR TO SUBDIVISION PLAT APPROVAL. f ~ WHEREAS, the City Council and the Mayor of the City of Meridian have con- cluded that it is in the best interest of said City to amend Title 9, Chapter 6, to include a subsection 9-603A. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF i MERIDIAN, ADA COUNTY, IDAHO: t Section 1. That Section 9-603 shall be hereby amended to include a sub- section 9-603A which shall read as follows: 9-603A PUBLIC HEARING TO BE HELD PRIOR TO SUBDIVISION PLAT APPROVAL: No final subdivisiofF plat shall be approved or offered for approval until one public hearing has been held for the purpose of allowing public input on the proposed subdivision. This public hearing shall be held at~ the time of. presentation of the tentative plat by the developer to the City Council. Notice of the public hearing shall be given by mailing, by Certified Mail, notice of the hearing to all property owners within 300 feet of the pro- posed boundaries of the subdivision and by publishing notice of said hearing in the City's newsNaper of record at least one time 15 days prior to the date of such hearing. The notice to be mailed to the adjacent property owners shall include a vicinity map of the area which map shall show the proposed subdivision and the property within 300 feet. Any subdivision plats presently pending approval .or pending approval at the time of passage of this Ordinance shall also meet the above public hearing require- ment by having said hearing at some time prior to request for final approval. Section 2. WHEREAS, there is an emergency therefor, which emergency is declared to exist, this ordinance shall take effect and be in force from and after its passage, approval and publication as required by law. FOR A VARIANCE The above entitled variance request having come on for consideration on September 3, 1985, at approximately 7;30 o'clock p.m. on said date, at the Meridian City Hall, 728 Meridian Street, Meridian, Idaho, and the City Council having heard and taken oral and written testimony, the City Council of the City of Meridian makes the following: FINDINGS OF FACT 1. That the Ordinances of the City of Meridian require that a preliminary plat be submitted and approved by both the Planning and Zoning Commission and the City Council prior to the final plat being submitted for approval unless the plat meets the requirements of 11-9-604 C. 3. 4. That Meridian Manor Subdivisions 4 and 5 do not meet the requirements of 11-9-604 C. 3. a,& b; that without a variance to 11-9-604 C. 3. a & b, the Applicant could not submit both the preliminary and final plats at the same time. 5. That the Variance request is being processed under Section 11-9-612; that in regard to the above section the City Council finds that the Applicant previously submitted a preliminary plat for the same property several years ago, but the time for action on that preliminary has lapsed; that the variance requested does not involve a health or safety requirement but only a processing requirement; that the variance would not violate provisions of the Idaho Code; that the granting of the variance would not have the effect o.f nullifying the interest and purpose of this Ordinance or the Comprehensive Plan. 6. That the requirements of 11-9-612 A 2 a & b have not been addressed. 7. That the testimony at the public hearing was not unfavorable to the granting of the variance. CONCLUSIONS 1. Item #1: Public Hearing Preliminary & Final P Meridian Manor #4 & #5: Chairman Spencer opened the Public Hearing and asked if the representative was present to come forward. Mr. Wayne Gibbs, Engineer with JUB Engineers, Inc was present to represent the developer of Meridian Manor #4 & #5. Gibbs, Meridian Manor #4 & #5 are pretty much in compliance with the Pre- liminary Plat which was approved by the City a few years ago, however that approval has expired and we are submitting these Plats as preliminary & finals. This plat will enable the developer to extend Willowbrook through to Meridian Road. Also on #4 this will enable us to take of NW 8th Street _ and take of the ditch that is there now. There has been basically two phase which have already been developed. There is a major sewer trunk line already in Willowbrook Drive. I have no other comments unless you have questions. Morrow, you have no problems with any of the comments by the City Engineer, Ada County Highway or Nampa Meridian Irrigation? Gibbs, no we don't, in fact we have addressed the City Engineers comments and returned a revised Plat to him. The final plans for the water & sewer are being drawn and will be submitted to the City Engineer prior to the Council review. Smith, I just received the revised Plat today and have not had a chance to review them, Mr. Gibbs, I need to get my red line back so I can check that against the revised Plat. I had a comment about fence along Five Mile Creek I don't know whether that was appropriate comment or not but I did not see any plans or whether it was going to be on an individual lot basis, but I assume there needs to be some kind of fence along Five Mile Creek. Nampa Meridian made a couple of comments I did ~~., ~ ~' ~- --- -~ MERIDIAN PLANNING & ZING AUGUST 12, 1985 PAGE # 2 _ not understand, they said the lots were overlapping into Five Mile Creek, I looked at the Preliminary and did not see that. Did you check with them "- on that Mr. Gibbs. Gibbs, we have to submit an application with them, which will be done in the next week or so, their comments had something to do with the lots going across canal rightway but we have not figured out what that means so we felt we would address that when the application was submitted. Apparently they misread the Plat because obviously we do not have any_ -- lots in the rightway, so far as the fencing plan and lighting plan we -- thought we would submit them with the water & sewer plans. Smith, the setbacks on those culdesac lots on #4, the seventy foot frontage- required by Ordinance, did those lots change? Gibbs, we recalculated the Plat to provide for that. Smith, the only other comment I had was on those setbacks along Willowbrook since it is designated as a collector they need to be thirty feet, I suggested that a note be put on the Plat to that effect., however the note to the effect that the subdivision meets all the requirements, I just did d~i~ want someone to be confused that this was still a twenty foot setback. Gibbs, we actually plan to submit a Variance for the setbacks on Willow- brook we have some problems here with between the canal rightway and we can not do to much with Willowbrook with the sewer trunk line being in there. There were no other questions of Mr. Gibbs at this time. Sally Dubois, 2213 Kenmere, I am representing a group here that live in the subdivision that is existing in Meridian Manor #3, we are wondering about the house size and we have heard that they want to go to plywood foundations, is there any way we can keep our subdivision up, we would - - like to stay with the double car garage and cement foundations. We were also wondering what was happening with the canal along NW 8th. Street. Is that to be covered? What we are asking is that they maintain the double car garage. Morrow, they say a 20 x 24 garage which is a double car garage. They spear to 480 square feet which has to be double car garage. The house size will be according to the City Ordinance where the minimum is 1000 square feet. The wood foundations is up to the builders as this is in the UBC Code and in not a Planning & Zoning matter. Mrs. Dubois, there are some wood foundations across N.W.8th and they are already beginning to deteriorate. There was additional discussion among the Members about wood foundations. Gibbs, we plan on covering the canal along NW 8th. Street. Jack O'Donnell, 2214 Kenmere, I agree with Mrs. Dubois, I have a lot invested in my home and I would hate to see what I would call low income housing in that area. ~:.,, ~, ., ~~~, k as ,y. ~, f. MERIDIAN PLANNING & ~ING AUGUST 12, 1985 PAGE # 3 Morrow, the minimum square footage here is 1000 square feet with two car- garage, with only 10 o at this square footage and the balance graduated in increment as to how~many they can build at each size. This would indicte_ the minimum somewhere around $55,000 to $60,000 at the current building costs. In terms of wood foundations that is an item that is addressed by - the building code and that is strictly up to each individual builder, there is really not anything this body can do about that. Smith, when this came up before our building inspector raised quite a bit of concern over this and it was pointed out by the promoter of wood foundations that these were approved by the UBC. The City of Meridian $as- adopted the UBC and I don't know whether the Council would look at making-~ an exclusion from the UBC Code. Crookston, there has in the past been exclusions. Smith, as the lady testified if there is deterioration already it might be in the best interest of the City to look into something like this. Shearer, there should be some provisions in the Code in regard to water table, wood 'foundations are setup on the basis of drainage and if they are not-done properly they will fail. There was more discussion on the problem of wood foundations and the high water table in the area. There was no other testimony, Chairman Spencer closed the Public Hearing. The Motion was made by Morrow and seconded by Cole that the Meridian Plan- ning and Zoning hereby recommends that the Preliminary and Final Plat of Meridian Manor #4 & #5 be approved by the Meridian City Council contingent upon the Council granting the necessary Variances and the City should review its position on woad foundations relative to high water tables and the Building Inspector should make a survey and in fact if there was deterioration there should be some specific provisions made in the - Code or delete wood foundations from the Code. Motion Carried: All Yea: Item #2: Preliminary & Final Plat The Lake at Cherry Lane #2: Chairman Spencer opened the Public Hearing and asked if a representive of The Lake at Cherry Lane was present. Mr. Kieth Jacobs of Loveless Engineering was present to represent this request. Jacobs, what we are asking for tonite, we have had to redesign the pre- liminary plat on this parcel which is North of the existing Cherry Lane Village, we are asking approval for the preliminary plat on the entire parcel with a final plat on a portion, 21 lots. This is primarly because we need access into this area, we only have the Trunberry as our access. We are landlocked to this area. We do not control h land to access off Ten Mile or Black Cat. The owners of said subdivision are under no obligation to deliver water or furnish rights-of-way to any of the lobs in this subdivision. No trash, garbage, ashes, or other refuse may be thrown, dumped or othertaise disposed of upon the real property. No building materials shall be placed upon the building site upon which the structure is to be erected. The undersigned shall have the right to enter upon any vacant building site for the purpose of burning or removing weeds, brush, growth or refuse. (1} FENCE$ - HEDGES: No fence, hedge or boundary wall situated anywhere upon any building site shall have a height greater than that allowed by the local controlli$~g ordinance, but in no event shall it be greater than six (6) feet in height ;'above the finished graded surface of the ground upon which such fence, hedge, dr wall is situated. For the purposes of these Protective Restrictions and Covenants, recreational vehicles shall include, but not be limited to: boats, campers, snowmobiles, motorcycles and race cars. All maintenance work performed on the above vehicles or personal automobiles shall be done inside the garage with the doors closed. No vehicle shall be parked on the street for a period of time exceeding twenty-four hours at a, time . ' r • • the structure have been approved by the Architectural Control Committee, hereinafter designated, as to quality or workmanship and materials, harmony of external design with existing structures, and as to location with respect to topography and finish grade elevation.. No fence or wall shall be erected, placed or altered on any lot nearer to any street than the minimum building setback line unless similarly approved, as provided in Paragraph IV hereof. VI (a) That the owner of said real property, hereinabove described, re- serves unto itself, its successors and assigns, or for public dedication by the owner, its successors and assigns, a six (6) foot right-of-way across and along the street lines of all lots and a ten (10) foot right-of-way along the rear lot lines of each of said lots, for the purpose of constructing water mains, electric distribution lines, irrigation ditches, sewer lines, gas pipelines, and such other public utilities as shall be necessary, convenient and desirable for the Grantees and owners of said lots and parcels henceforth; this reservation being intended to provide an easement twenty (20) feet wide centering on the rear lot line of each lot. The easement area for each lot and all improvements in it shall be maintained continuously by the owner of the lot except for those improvements for which a public authority or utility company is responsible. In accordance with the Ordinance, on a preliminary/final plat sub- mittal, I have been requiring a preliminary plat be submitted that would show t_nose items required by the plat including contour lines and '"proposed or existing utilities, including but not limited to, storm, and sanitary sewers, irrigation laterals, ditches, drainages, bridges, culverts, water mains, fire hydrants." Sack indicates your development drawings are in anear-completed farm and of course these would replace the preliminary plat requirements outlined above if tl'aey are submitted in the near future. 2. Submit proof of current ownership of the real property included in the plat with consent of recorded owners of the plat. 3. Outline what fence improvements are proposed along Five Mile Creek. 4. The final plat can only receive "conditional approval" until such time as the development plans receive final approvals. 5. Apart of the development plans shall include submittal of a street lighting plan. 6. Lots 7 and 9, Block 8, Subd, No. 4.needs to have a 30 foot front yard setback to conform to the Ordinance required 70 foot minimum street frontage. I anticipate Willowbrook to carry a significant amount of traffic from Meridian Manor and Meadow View and I feel the paved transition length should be in the 50-60 feet range . Overall the plans look very good. I think all the comments are pretty much self explanatory however, if you have any questions don't hesitate to call. The area on Cranmer, at the bulb- culdesac, may be a little confusing but what we would like is to remove the 4" diameter line and fitting and simply install a 1~" diameter service line to each of the double set meters. The longest run is about 100 feet however, using polyethylene pipe this length should only result in about 1~ p.s.i. head loss for a 22 g.p.m. flow through a 5/8" diameter meter. We Y•7 also submitted a Varaince to reduce the setbacks on Willowbrook Drive from 30 feet to 25 feet. The sewer truait~_ line is already in place on Willow =' Brook drive and the lots only have 85 feet of depth between the easement '~ of the canal and the street. If we had been aware of 30 foot setback we ~ would not have agreed to provide the City with an easement and then install t~~, the sewer trunk line that close to the easement. Being no other testimony Mayor Kingsford closed the Public Hearing: Mayor Kingsford, we have the Finding of Fact on the Variances requested by Bedelco which are the 25 foot setback and filing the preliminary and final plat together. What is the Council's pleasure? You have to approve the Findings, then the Variances and then the preliminary & final plat. The Motion was made by Brewer and seconded by Tolsma that the Meridian City Council hereby adopts and approves the Findings of Fact & Conclusions as prepared by the City Attorney on the Variances requested. Mr. Giesler was advised they were designated on the Final Plats and were in conformance with the Ordinance.
