Mayor Kingsford, Mrs. Lytle would you give the Council a synopsis of '
what you are planning to do.
Mrs. Lytle, I live at 1440 West Cherry Lane and am requesting a one to two
station beauty salon at my home, there is no outside restructure necess-
ary. I have met the requirements of the City and also the Licensing
Bureau.
Mayor Kingsford, will you still be able to have your U shaped drive?
Mrs. Lytle, yes they are only taking about five feet for the improvements
on Cherry Lane on the front of property. I will still have parking for
six to eight cars.

Mayor Kingsford, for the Council's information Mrs. Lytle had a Conditional
Use Permit at this location for an accounting business. Any questions of
the Council?
Councilman Giesler, the parking has me concerned, getting in and out
of there as busy as Cherry Lane could be a problem.
There was discussion 'on how much of the u-drive would be lost with Cherry
Lane improvement.
Giesler, you also said it was for a one or two station, is it for one
or two?
Lytle, the application covers one or two at this point there will be only
one, myself and at this time I do not know if it will be full time.
Mayor Kingsford, are you aware of the additional hookup of water and
sewer?
Mrs. Lytle, Yes, I have been informed of this.
Giesler, the only other problem I have is with the Conditional Use Permits
taking away from our business in downtown by allowing business to go in
the home, where the others are operating from commercial property. I think
we are doing a disservice to the ones who are downtown by allowing this
in the home. I have a real problem with this.
Mayor Kingsford, I will open the Public Hearing, is there anyone in the
audience who wishes to comment on this? There was no response, Public
Hearing was closed. Is there any more comments from the Council?
Councilman Brewer, I would like to make further comments along Mr.
Gieslers's point, I do not think it would be fair to come down on this
applicant tonite as it has been a practice for some time.. to allow Cond-
ition Use Permits for this type of business but I believe it is time
for the City Council to express more concern about Conditional. Use Permits,
in that they do conflict with commercial business in town who are in the
commercial property, maybe we need to redesign where we are coming from

as far as Conditional Use Permits are concerned, I would like this enter-
ed into the record.
Councilman Myers, maybe we should put together some kind of Resolution
or Ordinance limiting Conditional Use Permits.
Mayor Kingsford, I have to agree with this, however I have no problem
with Beauty Salons in the home where the neighbors have no objection.
I think this particular trade is different than most of the endeavors
we think about. Maybe it is time we evaluate that portion of the Zoning
Ordinance.

Gerald Vorlicky was present to represent this request.
Vorlicky, we are requesting a Lot Split on the property located on lie
North East of the intersection of Cherry Lane and NW 8th Street. This
property has been rezoned LO (Limited Office) , we are planning on
building a Dental Clinic on this property. The only change from what
was submitted is the line will be moved 30 feet to the East to include
the parking that was shown on the East side of building. It will also
includt the driveway with Parcel #2 and there will be an easment on this
for Parcel #1. We will furnish you with a recordable record of survey
on this split.

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
October 15, 1985, at the hour of 7:30 o'clock p.m., the
Petitioner appearing in person, the Planning and Zoning
Commission of the City of Meridian having duly considered the
evidence and the matter makes the following Findings of Fact and
Conclusions:
FINDINGS OF FACT
1. That a notice of a public hearing on the Conditional
Use Permit was published for two (2) consecutive weeks prior to
the said public hearing scheduled for October 15, 1985, the first
publication of which was fifteen (15) days prior to said hearing;
that the matter was duly considered at the October 15, 1985
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copies of all notices were
made available to newspaper, radio and television stations;

2. That this property is located within the City of
Meridian and is owned by the applicant and is known by the
address of 1440 West Cherry Lane, Meridian, Idaho;
3. That the property is located in a residential
district, that requires a .conditional use permit for the
operation of a home occupation which is what a beauty salon is
and which is the use the application requests;
4. That a proper notice has been given as required by law
and all approvals and procedures before the Planning and Zoning
Commission have been given and followed;
5. That no persons appeared at the hearing objecting to
the use of the property as a two operator beauty salon which is a
commerical use;
6. That the property had a prior conditional use permit
for a bookkeeping business;
7. That at the public hearing there was no public comment
except for the applicants';
8. That the Central District Health Department and City
Engineer submitted recommendations which recommendations are
incorporated herein by this reference as if set forth in full
hereat;
9. That a home occupation is allowed in a residential
district under a Conditinal Ube Permit; that said use is a
commercial use.

1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the applicant's
property and having obtained the consent of 75~ of the owners of
property within 300 feet of the external boundaries of the
applicant's property;
2. That the City of Meridian has authority to grant
conditional uses pursuant to 67-6512, Idaho Code, and, pursuant
to 11-2-418 of the Revised and Compiled Ordinances of the City of
Meridian, Idaho;
3. That the City of Meridian has authority to place
conditions on a conditional use permit and the use of the
property pursuant to 67-6512, Idaho Code, and pursuant to
11-2-418(D) of the Revised and Compiled Ordinances of the City of
Meridian, Idaho;
4. That 11-2-418(C) of the Revised and Compiled
Ordinances of the City of Meridian sets forth the standards under
which the Planning and Zoning Commission and the City Council
shall review applications for Conditional Use Permits; that upon
a review of those requirements and a review of the facts
presented and the conditions of the area, the Planning and Zoning
Commission specifically concludes as follows:
a. The uses, in fact, constitute a conditional use and a
conditional use permit is required by ordinance.

b. The uses will be harmonious with and in accordance
with the Comprehensive Plan and the Zoning Ordinance.
c. The use will be designed, constructed, operated, and
maintained to be harmonious in appearance with the
intended character of the general vicinity such being
designated for residential use.
d. That the uses will not be hazardous or disturbing to
existing or future neighboring uses.
e. The use will not create excessive additional
requirements at public cost for public facilities and
services and will not be detrimental to the economic
welfare of the community.
f. The uses will not involve uses, activities, processes,
materials, equipment and conditions of operation that
will be detrimental to any person, property or the
general welfare by reason of excessive production of
traffic, noise, smoke, fumes, glare or odors.
g. That applicant shall be required to have parking for
the property which shall be so designed as not to
create an interference with traffic and parking on
surrounding public streets and which parking meets
the City Ordinances.
h. The development and uses will not result in the
destruction, loss or damage of a natural or scenic
feature of major importance.

5. That the recommendations and requirements submitted by
the Central District Health Department and City Engineer are
reasonable and the Applicant shall be required to comply with
them and they shall be required;
6. That the Applicant shall be required to pay
appropriate rates for sewer, water, and trash and shall be
required to pay for and and all connection fees for water and
sewer necessitated by his uses;
7. That the permit once granted shall be personal to the
Applicants and shall not be transferrable to other individuals or

probldm I can set and it is not.their problem that they are creating it
but sooner or later it is going to develop on that side of the Interstate
and somehow sooner or later you are going to have to get sewer and water
over to that side and I realize this is not a large enough development to
handle entension on their own, but sooner or later when it is extended
over there they are going to ben~.fit from it, I think some policy ought
to be established or something for a fund that development puts into for
cost of the extension. I think the City needs to set some kind of a policy.
Morrow, I believe that the late comers charge or the participation program
that was recently passed by the City Council covers those kinds of things.
Whoever extends it out there, whoever else joins on pays their prorata
share.
There was discussion on what the enforcement on something like this would
be.There was also discussion on the subject of establishing a fund.
Spencer, is there anyone else in the audience who wishes to comment on this
application? There was no response. The Public Hearing was closed.
Alidjani, I have one other question, what is your timetable for construction?
Weber, we would have to start construction in April in order to be out of
our present location by June 30, 1987.

NOTICE IS HEREBY GIVEN that the Planning and Zoning
Commission of the City of Peridian will hold a public hearing at
7:30 o'clock p.m. on October 15, 1985, at the City Hall, 728
