Enclosure to John L. Hayward's Application For Conditional use Permit.
The above plan shows Inventory lineup, existing sign that will be used, all traffic
will enter and exit in the existing access. The red cinders will be added for beaut-
ification. Painting and general clean up of the area is in progress. Moet of the
facility I propose to use is existing and will require general beautification only
for now. The existing sign painted on the building will be painted over and replaced
with current use signs. This location should not create traffic problems using existing
property entrances

The above plan shows Inventory lineup, existing sign that will be used, all traffic
will enter and exit in the existing access. The red cinders will be added for beaut-
ifi~ation. Painting and general clean up of the area is in progress. Most of the
facility I propose to use is existing and will require general beautification only
for now. The existing sign painted on the building will be painted over and replaced

Mr. John Hayward, 2192 Meadow, Idaho Falls, Idaho was present to represent
this request.
Mr. Hayward was sworn by Chairman Spencer:
Mr. Hayward, I wish to open a Used Rv Lot and Used Automobile lot at 521
South First Street on the property owned by John Dobaron, I would only
be using the property located in the front of the building and have an
office inside the building. Eventually I hope to only have RV Units
at this location. I would be using the equipment that is already there
like the sign post, refuse disposal, etc: I do plan some painting and
cleanup of the area before opening up.
Chairman Spencer, questions of the Commission?
Johnson, we have had discussion on the size of the property you were going
to use and how it was defined in any kind of lease or legal description.
That is a large lot there.
Hayward, all I am leasing as you will see on application is about 175 foot
frontage along the front of the building, which starts where the driveway
comes into the property and runs down to the existing sign or where the
pavement stops, all I would be interested in using would be the frontage --
along the highway that is paved. ~.
Johnson, the reason I asked the question is in regards with this 300 Foot
notification we have to work with and we wondered if the signatures
you have are the only people that would fall within the 300 feet.
Mr. Hayward that is correct, I took the measurements from that perimeter.
Cole, you do not plan on expanding further than the edge of the pavement.
Hayward, no the property further North has been leased and someone is also
applying for a Conditional Use Permit for that area.
Johnson, is there any plan for any kind of separation between the two
parcels?
Hayward, not at this point, T actually need to leave him access in there
apparently there is another access to his property but I have agreed to
leave him access through there from the driveway.
Johnson, what is the definition of a Recreational Vehicle ?
Hayward, Travel Trailers, Motor Homes, Campers, etc:

3. That the property is located in a commercial district,
which requires a conditional use permit for the operation of a used
recreational vehicle and automobile sales lot and which is the use
the application requests.
4. That a proper notice has been given as required by law and
all approvals and procedures before the Planning and Zoning Com-
mission have been given and followed.
5. That no persons appeared at the hearing objecting to the
use of the property as a mobile home sales lot.
' 6. That the property is presently used for commercial purpose
7. That at the public hearing there was no public comment
except for the applicants'.
8. That any sign meet the City's Sign Ordinance; that any
addit~.onal sewer and water hook-up fees be required to be paid;
additionally, the Nampa and Meridian Irrigation District commented
that there shall be no encroachment on their right-of-way and that
drainage must be retained on site.
9. That a used recreational vehicle and automobile sales lot
is allowed in a commercial district under a Conditional Use Permit.
CONCLUSIONS
1. That all the procedural requirements of the Local Planning
Act and of the Ordinances of the City of ~4eridian have been met
including the mailing of notice to owners of property within 300
feet of the external boundaries of the applicant's property and
having obtained the consent of 75~ of the owners of property withi

uses pursuant to 67-6512, Idaho Code, and, pursuant to 11-2-418 of
the Revised and Compiled Ordinances of the City of teridian, Idaho.
3. That the City of Meridian has authority to place condition
on a conditional use permit and the use of the property pursuant to
67-6512, Idaho Code, and pursuant to 11-2-418(D) of the Revised and
Compiled Ordinances of the City of~iMeridian, Id"aho.
4. That 11-2-418(C) of ,the Revised and Compiled Ordinances
of the City of Meridian sets forth the standards under which the
Planning and Zoning Commission and the City Council shall review
applications for Conditional Use Permits; that upon a review of
those requirements and'a review of the facts presented and the oon-
ditions of the area, the Planning and Zoning Commission specifical]
concludes as follows:
a. The use, in fact, constitutes a conditional use and a
conditional use permit is required by ordinance.
b. The use will be harmonious with and in accordance with
the Comprehensive Plan and the Zoning Ordinance.
c. The use will be designed, constructed, operated, and
maintained to be harmonious in appearance with the in-
tended character of the general vicinity such being des-
iganted for commercial uses.
d. That .the use will not be hazardous or disturbing to ex-
fisting or future neighboring uses.
e. The property if not already connected to sewer and water
lines must be so connected and those services should be
able to be provided adequately.
f. The use will not create excessive additional requirements
at public cost for public facilities and services and wil:
not be detrimental to the economic welfare of the communi~

g. The use will not involve uses, activities, processes,
materials, equipment and conditions of operation that will
be detrimental to any person, property or the general
welfare by reason of excessive production of traffic, noisE
smoke, fumes, glare or odors.
h. The applicant shall be required to have parking for the
property which shall be so designed as not to create an
interference with traffic and parking on surrounding publi
streets and must meet the parking requirements.
i. The development and uses will not result in the destructio
loss or damage of a natural or scenic feature of major
importance.
5. That the Applicant shall be required to pay appropriate
rates for sewer, water, and trash and shall be required to pay for
any and all connection fees for water and sewer necessitated by his
uses. That the comments of the City Engineer and the Nampa and
Meridian Irrigation District are reasonable and must be compiled
with by the Applicant.
6. That the permit once granted shall be personal to the
Applicants and shall not. be transferrable to other individuals "or

The abave plan shows Inventory lineup, existing sign that will be used, all traffic
will enter and exit in the existing access. The red cinders will be added for beaut-
ification. Painting and general clean up of the area is in progress. Most of the
facility I propose to use is existing and will require general beautification only
for now. The existing sign painted on the building will be painted over and replaced
with current use signs. This location should not create traffic problems using existing
property entrances'
