Crookston Jr.; Jack Niemann; Minutes of the previous meeting held May 14, 1984 were approved as written. Item 1 Findings of Fact and Conclusions of Law - Debbie Kennedy Conditional Use Permit Spencer commented that he had a problem with the wording in Item ~~4 of the Conclusions referring to the time limits of the permit. This particular wording makes it so the Conditional Use is not automatically renewed, as has been the case in the issuance of Permits in the past. Crookston agreed that the wording necessiated a change. The change in the wording was agreed to be: "for a period of 1 year to be automatically renewed at the end of each year unless the applicant is notified that he needs to reapply, or that his Conditional Use 'Permit could be terminated, in which event the applicant will be notified, a Public Hearing Held, and the applicant afforded a hearing to show cause why the Permit should be renewed." The Motion was made by Morrow and seconded by Cole to approve of the Findings of Fact and Conclusions of Law regarding the application for Conditional Use Permit by Debbie Kennedy., with the correction in wording of Item ~~4 of the Conclusions, as noted above. Palmer explained that he realized that he would be needing a Conditional Use Permit and wanted the Commission's imput on the possibility of approval. Palmer told the Commission that he is planning to really clean-up the place. There was discussion concerning the amount of complaints received on the existing radiator shop. Chairman Spencer told Palmer that he needed to see the City Clerk, Jack Niemann, and get an application for a conditional use permit. Spencer also told Palmer that he felt the biggest factor in receiving approval would be the concensus of the surrounding neighbors. Palmer thanked the Commission for their time, and said that he would get in touch with Niemann. Item 4 Dorman Fuller - Imput on Commercial Development at Settler's Village Don Hubble, Civil Engineer representing Fuller told the Commission that they are requesting imput on a Commercial development proposal at Settler's Village. Hubble said that they are requesting a change of boundary lines. Hubble explained that this would be a townhouse style development that would fall between_ retail and office space, and would be sold in "grids" with a common space inbetween. The buyer could then purchase any amount of space needed. The first phase would have 45 parking spaces for 12,000 square feet. There would be no more that 10 owners and no less that 6 or 7. J,7 4eQ4 ; ~~leridian Planning ~ Zoning March 12, 1984 Regular meeting of the Meridian Planning & Zoning was called to order by Chairman Bob Spencer at 7:30 p.m. Commission Members Present: Marvell Chenowith; Jim Johnson; Mo Aldijani; Walt Morrow; Jim Shearer; Others Present: Gary Smith; Beezer Glenn; Doug & Linda Hasslen; Elizabeth Ryan; Grant Kingsford; Steven Hosac; Kent Barney; Wayne Crookston; Minutes-of the previous meeting held February 13,1984 were approved as ~' written. Item 1 Conditional Use Permit; Casa Floral Boutique Chairman Bob Spencer announced that a letter had been received from Sami Peterson, DBA Casa Floral Boutique, withdrawing the request for the Conditional Use Permit. (Letter on File - City Clerk's Office) Item 2 PUBLIC HEARING: Conditional Use Permit, Senior Citizens For Senior Citizens Center Elizabeth Ryan was present representing the Senior Citizens. They are seeking a Conditional Use Permit to allow a Senior Citizens Center at 133 W. Broadway, previously occupied by the Assembly of God Church. Mrs. Ryan reported that there were no objections to the center, and that all neighbors within 300 feet had signed their consent. Chairman Bob Spencer opened the Public Hearing. There was no response. Spencer closed the Public Hearing. Commission Member Shearer reported that he would abstain from voting, as there was a conflict of interest. The Motion was made by Morrow and seconded by Chenowith to instruct the City Attorney to prepare the Findings of Fact and Conclusions of Law regarding the Conditional Use Permit application by the Meridian Area Senior Citizen to allow a Senior Center at 133 W. Planning and Zoning Commission City of Meridian 72 8 Meridian Road Meridian, Idaho 83642 Re: Peterson, Hosford, Johnson-Conditional Use Dear Commission Members: Please find enclosed a copy of a letter which has been sent to me as City Attorney regarding the above conditional ~~ use application and possible conflicts of interest. a. x, Section 67-6506, Idaho Code, governs conflicts of interest. It basically reads as follows: A member or employee of a commission shall not 'participate in any proceeding or action when the member or employee or his employer, business partner, business associate, or any person related to him by affinity or consanguinity within the second degree has an economic interest in the procedure or action. I am not going to give an opinion as to whether any individual on the Planning and Zoning Commission ;has, or may have, a conflict of interest. I believe that we have a professional body which does not need to be advised or informed of a conflict, or possible conflict, of interest, I do have a duty, however, to inform that body of the law and that a knowing violation of it is a misdemeanor. Until the meeting is held, the matter considered, and action taken, I ~~_ have no way of determining if a violation of this law has occurred and I deem it inappropriate to take any action until action by the Commission has been taken. The conflict of interest arises with ~~ ' regard to a certain application filed by my clients, Sami ' 'r Peterson and Carrie Hanford, on or about February 16, 1984. <. ~~ ' It is our information that three members of the Meridian - Planning and Zoning Commission have actual or potential con- f]icts ~f interest in this matter. Mr. Jim Johnson has a business relationship with the applicants in that he owns the building involved in the said application. Mr. Bob Spencer ,,~;. has a close relationship, including a business relationship, .,k,;; with one of the individuals opposing the application (Sue ~' Scott) and has evidenced his pre-disposition to oppose the ~}~~~ application prior to hearing in conversations with a number of people, including Jim Johnson. Sue Scott obviously has an economic interest in the application. Marnell Chitworth has a business relationship with Sue Scott as a part-time employee or agent of Sue's.
