Glaisyer 'Mayor of , Meridia.n and City Council City of Meridian 728 Meridian Street Meridian, Idaho 83642 Gentlemen; Re: Treasure Valley Business Center - Development As you know, Upland Industrial Development Company intends to develop the first phage of its Treasure Valley Business Center in the near future'. Phase One will occupy the first half mile of land west Of Eagle Road on the south side of Fairview Avenue. As preliminary development plans have taken shape, it appears that conflicts exist between some elements of the plans and certain City ordinances. First, it is Upland's normal procedure to plat industrial subdivisions into large lots or blocks 'ten to twenty acres or larger in area, as apposed to platting with many one or two acre lots, and then to divide off the precise amount required by a purchaser without replatting. The reason for this method of platting is that there is a wide diversity in the area and configuration re- quirements of the industrial and commercial users who buy developed land. However, we ,°'iaLve been advised by Mr. Wayne Crookston, Meridian City Attorney, that this procedure would conflict with the Meridian Subdivision Ordinances. We have been advised by Mr. Crookston that the City might consider amending the City Code to provide that sideyard requirements do not apply to the interior platted lot lines of a single sale parcel. We therefore respectfully request that the City of Meridian amend the City Code to provide'that for interior platted -lot lines in a single sale parcel, side yard requires-' ments shall not apply. The second area of'apparent conflict concerns the length of blocks. The Meridian Subdivision Ordin- ances -provide for a maximum block length of 1000 feet (Section 9-607-3b). Rail-served'industrial parks by nature attract purchasers who occasionally require sites.in excess of 1000 feet long. Because of this fact, a maximum block length of 1000 feet would reduce Upland's ability to satisfy such purchasers. Furthermore, due to the relatively large lots required by typical industrial users, even when such lots are less than 1000 feet in length, limiting the length of blocks will consti- tute uneconomical land use and require unnecessary street construction for some projects, including Treasure Valley Business Center, due to the raw land configuration. It is therefore requested that a variance to Section 9-607-3b of the Meridian Subdivision Ordinances be granted to Upland to allow block lengths up to 1700 feet. Thirdly, Section 9-602(m)S of the Meridian Subdivision Ordinances provides that continuous segments of local streets be limited to 660 feet in length and implies that streets longer than 660 feet would be classified as collector streets. All street roadways in the Treasure Valley Business Center Project will be designed and constructed to at least the minimum curb -to -curb width for collector streets as specified by Ada County Highway District. However, we would .prefer, and so request, that the interior streets other than those specifically required by ACHD as being collector streets, be designated local streets. Fourth, it is requested that Upland be allowed to delete sidewalks in this development. Normally, there is very little requirement for foot traffic between lots of an industrial development. BERT MYERS ROBERT GIESLER BOBSPENCER Chairman Zoning 8 Planning In accordance with your request of November 26, 1984, I have reviewed the proposed realignment of the sewer line at the subject crossing, and the City of Meridian takes no exceptions to your proposal. I am, however, concerned at the amount of cover over the sewer pipe as it crosses Five Mile Creek. According to the flow line elevation that I have for Five Mile Creek and the invert of the 15 -inch sewer pipe at that location, approximately eight and one-half inches of soil cover would exist. Because of that limited amount of cover and the possibility of backhoe ditch -cleaning operations in Five Mile Creek, it is necessary to construct an eight -inch concrete cap over the sewer line between wing walls as it crosses Five Mile Creek. A photocopy of a typical detail, previously used, is attached for you use. I have had a telephone conversation with Steve Sommer at Sommer Construc- tion and find that he has discussed the realignment with Dick Haumann of the Nampa -Meridian Irrigation District. Since the permit for this crossing was issued by the Bureau of Reclamation, they need to be contacted for acknowledge- ment and approval of this revision. Also, since the revised sewer line location will conflict with the existing wing walls of the Five Mile Creek culvert, the Ada County Highway District needs to be contacted for their approval of the relocation, and they also need to accept the proposed construction procedure. I have passed this information on to David Curtis at J -U -B, and if you have any questions concerning these comments, please don't hesitate to contact me. Fairview Meridian, ID 83642 July 4, 1984 Planning and Zoning Commission 728 Meridian Road Meridian, ID 83642 Dear Commission Members, We are submitting this letter for the hearing of the U.P. request for the preliminary and final plats of the development known as Treasure Valley Business Center. The hearing on July 9, 1984 at 7:30 'P.M. is in conflict with our planned vacation and we will be out of town. We own 20 acres and part of it borders U.P. property that is before you for zoning. The following are points of concern that we have reguarding the development of this property. 1. We protest any railroad track along the border of our property. 2. We protest the diversion or covering of the natural stream that is also used as a canal. Said stream known as Settlers. The stream has many wild birds along it. The stream is a natural creek that flows year around. The stream is a stopover for wild ducks in the winter, and many local ducks nest along the stream. The stream is also home for different species of fish. 3. We would prefer a lake with an improved area that would attract business buildings rather than an industrial area. Park Center in Boise could be a model for such a project. 4. If you do consider approval, we prefer that you approve one small area at a time and not the total property owned by U.P., apd that you sincerely consider the surrounding property. It would not be acceptable for industry. 5. We are concerned that our property will be locked in with no roads available for developing our property. Our property could become one of the hundreds of pieces of property in Ada County that will or can never be developed. This problem was pointed out by the Ada County Planning and Zoning Commission, that "Islands" of property lie within developed areas. The reason being poor planning at the beginning of a large development. 6. We are concerned that our irrigation ditches and irrigation water may be disrupted by this development. We need our water for our cows and horses. 7. A connecting road between Boise and Meridian may never come about is this total area is developed as planned with a rail- road track. Meridian and Boise have an excellent opportunity to have an additional connecting commuter road between the two cities by connecting Pine St. and Emerald. I would really like to attend the hearing on July 99 but we now live here in Dallass Texas. I did attend when the property was rezoned and taken into the city of Meridian and my feelings concerning the changes proposed are the same. Upland Industries does excellent work and all of their developments are a credit to their company and an asset to the valley. They have the financial ability and the expertise to do an excellent job in a short period of time. I have discussed the proposed development with Mr. Lloyd Howe and I approove. By this letter, which con- stitutes a subdivision application form, Upland Industrial Development Company requests that the Planning and Zoning Commission and the City Council of Meridian review and approve the Treasure Valley Business Center Phase I Preliminary/Final Plat and supporting documents. Pursuant to Sections 9-604C and 9-604H of the Meridian City Subdivision and Development Ordinance, adopted on April 2, 1984, the following plats, maps and documents are submitted: 1. Twenty-seven copies of the preliminary/ final plat at a scale of 1 inch equals 100 feet. 2. Twenty-seven copies of a 1 inch equals 300 foot scale vicinity map showing the Phase I plat and ownerships within 300 feet of the boundaries of said plat. 3. Twenty-seven copies of this application letter. 4. Seven sets of final construction plans for the plat which will be transmitted to the City under separate cover on or about July 1, 1984. It is requested that the Council grant a variance to Section 9-604C3 of the Deve- lopment Ordinance to allow the preliminary and final plats for the development to be approved concurrently. 2. It is requested that a variance be granted to Section 9-605E of said Development ordi- nance to permit block lengths in excess of 1,000 feet. Industrial parks by nature attract purchasers who occasionally require sites in excess of 1,000 feet long. Because of this fact, a maximum block length of 1,000 feet would reduce Upland's ability to satisfy such purchasers. Furthermore, due to the relatively large lots required by typical industrial users even when such lots are less than 1,000 feet in length, limiting the length of blocks will constitute uneconomical land use and will require un -- necessary street construction for projects such as Treasure Valley Business Center, Phase I. 3. It is requested that a variance be granted to Section 9-606B11 of said Development Ordinance which would permit Upland to delete sidewalks on interior streets within this development. Normally there is very little requirement for foot traffic between lots of an industrial development. Elimination of sidewalks will permit more latitude in the installation of utilities behind the curb. It is our belief that with the exception of the variances mentioned above, this plat and the development that it represents is in conformance with the current zoning and development ordinances of Meridian City. We are anxious to move ahead with this development project. Please advise if additional information is required.
