The Meridian City Council would like go on record as being in
favor of the subdivision request of Rocky Mountain Development
Corporation on the 120 acres southwest of Meridian. We have
met with their representives several times and are well aware
what they propose to do. We understand that at this time the
approval for this project must be through Ada County even though
the impact of this development will be basically on the City
of Meridian.
It is our understanding that there six dwelling units permitted
on the 120 acres based on dividing the parcel into 40 acre tracts
and allowing each track to have two units on a 39 and 1 acre
split. We would be in favor of six 20 acre tracts in lieu of
the 39 and 1 split. This would result in the same density and
in our opinion create a more favorable subdivision. They have
insured us that covenants would be recorded stating that use
of the land subdivided would be agricultural in nature thereby
adhereing fo our rural reserve policies.
The Meridian City Council strongly recommends approval of this
subdivision using alternate #1 with an easement between lot #3
and #4 to Waltman which is designated as collector street in
the Transportation Plan. We feel that a development such as
this is very consistent with the plans designated for this area
and are willing to handle the impact this development will have
on the City of Meridian.

live sewer system for the Rocky Mountain Estates, a 120 acre de-
velopment consisting of twenty one S acre tracts located between
Linder and Tea Mile, south of Franklin. He feels that all of the
affluent coming from this site plus some other sites to the north
would be best served by the construction of the interim lift stn-
- tion located on Ten Mile Road.

On August 15, 1983 Mr. Tarry Hellhake representing Rocky Nbuntain
_ Development Corporation was on the Agenda for the Meridian City
Council Meeting regarding the above subdivision. This subdivision
is outside the Meridian Urban Service Planning Area as the proposed
line follows Ten Mile Creek.
The proposed use Rocky Mountain Development Corporation has presented
for five acre lots with restrictions as to where the housing units
must be placed, malting it feasible in the future to re-subdivide in
smaller lots, is a good concept.
Due to the property not being in the proposed Meridian Urban Service
Planning Area and the problems involved using lift stations for. sewage
the Council will not consider Annexation.
It is the consensus of the Meridian City Council that dry lines should
be installed when property is developed and plans submitted showing
proposed streets, lots and utilities in the event•of future re-subdiv-
ision. These conditions would be a good asset in the event that in
future years the property were to be considered for Annexation.

The following are my thoughts concerning Mr. Hellhake's presentation of
August 15, 1983.
1. The closeness of this 121-acre parcel to the City urban boundaries
does, in my opinion, make the resubdivision concept a valid proposal.
2. I doubt very seriously, because of the nature of the beast -that
is, because people will have bought their five-acre parcel with a
specific use in mind - that all of the parcels would be involved in
a resubdivision process at the same time. Theoretically, any number
may resubdivide over any period of time.
3. I think it is appropriate to have the developer control the location
of the building site on each lot to facilitate possible future
resubdivision.
If this building site control is placed in the covenants, it is then
enforceable by the developer and/or homeowners association or Archi-
tectural Control Committee. As I remember from the Treasure Valley
Baptist Church situation, the City has no jurisdiction in enforcement
of the provisions of covenants.
I think a site plan, showing the building sites, should be made an
attachment to the covenants. ~"` •-
4. The developer should remain responsible to conform to all legal
requirements for subdivision platting in the State and County.

Dear Sirs:
At the Meridian City Council meeting held on August 15, 1983 a discussion
was held with Larry J. Hellhake, a representative of Rocky Mountain Develop-
ment Corporation in reference to 120 acres they want to subdivide-into five
acre tracts.
It is understood by Larry J. Hellhake and Rocky Mountain Development Corpor-
ation that approximately fourteen months ago the Meridian City Council re-
structed the boundary of the Meridian Urban Service Planning Area by elimin-
ating that portion south of the Ten Mile drain and adding these densities
to other areas. The future use of this general area south of Ten Mile drain
east of Ten Mile Road north of Overland Road has been left in limbo due to
this restriction.
As our discussions during the council meeting indicated, we find the proposal
by Rocky Mountain Development Corporation to be consistent with our future
plans for the area as a rural reserve and is also within the Meridian area
of impact.
We, as a council would like to recommend to the Ada County Commissioners
that they approve this 21 lot subdivision as it is consistent with Pieridian's
rural area policies for the area. We feel that the low densities created by
this development will not adversely affect the quality of services found in
Meridian.
The approval of this concept and development will be based on the following
conditions:
1. The developer install dry line sewers sufficient to handle present
and potential future residential growth on the 120 acre site.
2. The developer to receive approval from Central District Health to
construct septic tanks on each of the five acre tracts.
3. Developer to install a private water system acceptable to Central
District Health or a central water system, including a well and an appro-
priate sized mains within the project sufficient to serve the project and
also designed to allow extension to the city systems as needed in the fu-
ture. These water facilities to be designed to city standards and approved
by a city engineer prior to construction.

4. The existing irrigation system will be maintained and expanded to
achieve full irrigation of the parcels while maintaining distribution
beyond the site.
5. All power, gas, cable TV, and telephone utilities will be extended
underground within the site to local utilities standards.
6. All roads to be designed and constructed to ACRD standards.
7. The proposed development will be for a maximum of 21 units of ap-
proximately 5 acres each.

Dear Mayor Glaisyer,
We would like the City Council of Meridian to review our proposed develop-
ment plan for the 120 acres located near the southwest boundary of the
Meridian City Limits. This subdivision is submitted to you subject to the
following considerations.
1. We intend to install dry line sewers to plans and specifications
approved by the Meridian City Engineer. The line will be sized to han-
dle any future development within the project.
2. We will install a central water system, including a well and ap-
propriate sized mains within the project sufficient to serve the project
and also designed to allow extension to the city system as needed in the
future. These water facilitieslwould be designed to city standards and
approved by the city engineer prior to construction.

ing the parcel including all aPriculture lands. The subdivision is immed-
iately adjacent to Primrose and Van Hess-Subdivisions which have lots of
one acre or larger. Fiver acre ',tracts are an agriculture and ranch house
use.
One of the items we considered ', in the planning of this development was
the ability to re-subdivide the property at sometime in the future when
the City of Meridian wants a higher residential density at this :location.

Creamery for their Hobby Shop for 1 year.

It was the consensus of the Council that the letter contained the material that h~l..

Larry Hellanke representing Rocky Mountain Development requested permission to
approach the Council to give findings that he had gathered since the last meeting.
Hellanke explained that in talking to Sheldon Gerber from Ada County Zoningroval
had found that the only way Ada County would approve or would recommend app
would be if the area is in or found to be in the Meridian USPA, or if Meridian
chooses to annex the area.
Hellanke said that he "still believes I am in your USPA."

Appointment of Members to Planning & Zoning Commission
Mayor Glaisyer made the recommendation to appoint Moe Alidjani to a 6 year term
on the Planning & Zoning Commission, and Jim Johnson, to complete the term left
vacant by Gerry Sweet, who resigned.
The Motion was made by K.ingsofrd and seconded by Orton to approve of the Mayor's
recommended appointments Mr. Moe Alidjani and Mr. Jim Johnson to their respective

Discussion Regarding Workshop on Zoning & Development Ordinance Changes
There was discussion amoung the Council on the necessity of holding another
workshop to go through the changes of the Zoning & Development Ordinance.
It was the unanimous concensus of the Council that they would like time to
read over all the changes, but felt a workshop was not necessary. (Tape on
file - City Clerk's Office)
Being there no other business to come before the Council .

Orton: "This is currently a platted lot, as a whole, and by doing what they are
requesting here we aren't really changing our status with them at all but they
~~-; will be able to market these two lots individually. This open piece has the same
status now as it would after we do this thing -frankly, a platted lot in the City
of Meridian zoned A Residential."
The Motion was made by Orton and seconded by Brewer that Milton Subdivision
Preliminary Plat be approved subject to property line agreements and that no
development of any kind, or building of any kind, take place on Lot 2 until -
brought back to the Planning and Zoning Commission and the City Council; and
with the stipulation that the ten (10) foot utility be changed to sixteen (16) feet.

to Linder Road, South to overland Road, Easterly along Overland to City Limits and south
along City Limits, going straight East to the present City Limits of Meridian Greens,

Grove, then straight north to Franklin, then east midsection line between Locust

Agenda Senior Citizens Housing Project Input - John Trowbridge

Trowbridge was present representing Halbeth Management & Concultiag Serysces
and stated that Hal Hogan had been approved as a HUD Coordinator. HUD has approved
a project in Ada County and they felt Meridian has the facilities tp allow~a
Senior Citizens project. Trowbridge stated that they had looked at three properties
John Tromburg (East of 2 1/2 Street); Lembke property (.King & ~'Ieri~dan St) and
Art Moore, (East Pine). This project would need high density zoning. there is
$914,000 allocated for a project in Ada County.
It was the feeling of the Council that Trowbridge should contact the Senior Citizens
President, Elizabeth Ryan and work with that group,

Request for Conditional Use Permit by Janice Love for Day School . -

Fact and Conclusions of Law prepared by the City Attorney as adopted by~.the P&Z °.
Commission concerning the request for a Conditional Use Permit by Janice Love to

Larry Hellhake -Rocky Mountain Development Corporation
Larry Hellhake, a representative of Rocky Mountain Development Corporation was presen
in reference to 120 acres they want to subdivide into five acre tracts.
Several months ago the Meridian City Council restructed the Boundary of the
Meridian Urban Service Planning Area by eliminating that portion South of the
Ten Mile drain and adding these densities to other areas. The future
use of this general area south of Ten Mile drain east of Ten Mile Road North of
Overland Road has been left in limbo due to this restriction.
There was discussion. (Tape on File -City Clerk's Office)
Due to the property not being in the proposed Meridian Urban Service Planning _
Area, and the problems involved using lift stations for sewage the Council will
not consider Annexation.
Hellhake requested a statement to Ada County indicating the approval of the -
concept. Hellhake said that he has been tabled by the County Commissioners pending
a clarification of the Urban Service Planning Area Boundary.
Hellhake said that the covenants that will be placed on the property will stipulate
that all houses are to placed at specific locations on the five acre tracts to
enable future subdivision of these tracts after appropriate application, study,
and approval by the City of Meridian. Hellhake stated that right now they are
only asking for a density of 21 units for the 120 acre tract. Hellhake also
said that the developer will install dry line sewers sufficient to handle present
and potential future residential growth on the 120 acre site.
Councilman Brewer said that he feels this is a "nice size project that makes sense
and has a practical value."
Hellhake told the Council that he felt that there is a "market for a good five
acre development."
Brewer said that annexation of this property may be a long time in comming, and
it would benefit everyone to find away to use the property now, especially
if someone wants to develop it.
The Motion was made by Brewer and seconded by Orton to direct the. City Clerk to
draft a letter to be discussed and approved at the next regular meeting of the
Council, generally in favor of the concept making certain provisions as discussed.
