Due to their failure to pay their water bill or present any valid reason why the bill has not been paid, their water shall be turned off on August 12, 1987. In order to have their water turned back on there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idah Code, even though they appeal the water will be shut off. Dennis Clark from Ron Van Auker, basically what we are doing is splitting off two acres from this one parcel, Clark _ showed the Mayor-;&--Council.-on a map which -parcel -this was. The Motion was made by Brewer and seconded by Myers to approve the lot split for Ron Van'Auker as requested. Motion Carried: All Yea: Item #11: Air Quality Ordinance.Amendments:Ordinance #484: The Motion was made by Myers and seconded by Brewer to table this Ordinance until the August 18, 19-87 meeting. As I mentioned at that time we have some interst in adjacent parcels of ground and we now have a buyer who would like to purchase the two (2) acres adjacent to the freeway and East of Coca Cola. This will be the pro- posed site for the new Inland Coca'Cola Bottling plant. The area that is outlined on the maps you have is the site basically.what we are requesting is what was formerly Lot 1 of Timothy Subdivision be enlarged to include that area that extends South to Overland Road along the West side of the property. Clark showed the Mayor &Council on the maps what they were requesting. Mayor Kingsford: Are there any questions of the Council? Under our Ordinance we do have the ability to adjust lot lines and split a lot. Giesler: Mr. Mayor, I,would have noproblemwith this, I_am glad to see further development of there. The Motion was made by Myers and seconded by Tolsma to approve the Lot Line adjustment as requested by Ron Van Auker: Motion Carried: All Yea: Item #4: Fred Fender. Discuss Possible Future Project. Doctor Fender: I -appreciate the opportunity to come at the last moment before the Mayor & Council and present an item of.business, I just have a letter here for the Mayor & Council that explains what,I would. -like some direction on:- It: just.came:_to-my -attention. that the property down ------ the street where. -.the' church- burned down -a- few months ago came up for sale. I have been looking around.the area.in the hopes that in a_couple of years-perhaps-1--might-be able to purchase a piece of property and -build my own office. When this property, came up. for sale -I did some investigat- ing and found it would be feasible for me to do, My purpose for coming before you this -evening, as you know this property is.now zoned resident- ial, and I would appreciate the Mayor & Council's :thinking on whether there ;would be an- objection to the: re -zoning of this property- for- a -- doctors office. There'have beennoplans drawn for a -building, it -prob- ably be two to -.three years -down the road before the building -was built. It would be -in the area of 2500 to 4000 -square. -feet. I would like any of your comments or objections before -I -carry this to far._ Mayor Kingsford: Well certainly I would like to commend you for the job you have done here.for the three years and applaud you for wanting to make an additional committment here in Meridian. Dear Mr. Niemann, As you are aware we have purchased three parcels of land next to the new Western Equipment Building. We will soon begin build- ing a facility for Inland Coca Cola on seven (7) acres, since the lot required by Coke is shaped differently than the original parcels we would request a lot line adjustment for this new lot configuration. I should also mention that we have had several inquiries re- garding this property..::. --.We will probably have a sale of the land East of Coke and South of the freeway soon, so a discussion of future splits may also be appropriate. I would assume since there are three (3) parcels and each parcel is entitled to one split there would be a total of six (6) available splits without sub- dividing the property. If you extend,that assumption that six (6) parcels are available and one would be seven (7) in size, we can calculate the remaining five.(5) parcels would be an average of 1.8 acres in `size. We can not predict, at this time, what people will need in terms of parcel size but I think we can assume that we will not need more.than'six(6) parcels to accommodate our needs, even though they maybe bigger or smaller than 1.80 acres, the aver- age should hold. Please let me know if my assumptions are valid. and the date u and time of any meeting that may be required to approve this action. Motion Carried: Giesler, Yea: Myers, Yea: Tolsma, Yea: Brewer, Yea: Department Reports: Mayor Kingsford, we have received a letter from the Chamber of Commerce and representatives of the Chamber are here with comments to make to the Council. Several times over the last two years we have been approached by APA inviting us back into their organization. After several discussions with residents of the City and comments they had heard, I thought it may be in our best interest if we reevaluated our position on not being a member. I asked the Chamber to send representatives to the meetings and then make a report to us. The representatives sent were Terry Smith and Mary Bodine. They have prepared this letter and will address the issue at this time. Smith, we have been observersat the APA meetings , we started in March and have been attending meeting since that time. I had some reservations when I first started attending but since that time in my opinion the presence of Meridian at these meeting has considerable value, not only in receiving information but in providing information. It was a joint recommendation between Mr. Bodine and myself that we made to the Chamber Board whether they wanted to recommend that the City return to member- ship in the APA. They have done this in the letter the Mayor & Council has received from the Chamber President. The Council asked the City Attorney to prepare an Ordinance to reflect this Annexation and Zoning to be read at the next City Council meeting which will be held July 7, 1986. After this Ordinance is approved and published in the paper the Annexation and Zoning will be final. That the property is adjacent and abutting to the present City limits. 5. That the petitioner is Ronald W. Van Aucker and the owners are Dorothy E. Rodda, Bruce and Judy Wixson, and Lorraine J. Smith. 6. That the property included in the annexation and zoning application is within the Area of Impact of the City of Meridian. 7. That the entire parcel of ground is included within the Meridian Urban Service Planning Area as the Urban Service Planning Area is defined in the Meridian Comprehensive Plan. 8. That the Application for annexation requests that the parcel be annexed and zoned "I -L" Light Industrial; that the present use of the property is agricultural and is presently zoned by the County as AP -2 and a portion is zoned R-1; that the Terteling Trust Annexation property adjacent to this present property is zoned Light Industrial; that 11-2-408 B. 11 of the Meridian Zoning Ordinance requires that land in this zone be in such proximity to insure connection to City water and sewer. 9. That the land in this annexation is contained in the AMBROSE, FITZGERALD E CROOKSTON Attorneys and Counselors P.O. Box 427 Meridian, Idaho 838/2 Telephone 888-W1 i Mixed Use Area East of the Kuna/Meridian Road and between I-84 and Overland Road, as designated in the Meridian Comprehensive Plan as amended February 19, 1985. 10. That the proposed use of the property would be to develope the property for light, clean industrial businesses. 11. That the Applicant did not state he had immediate plans for development of the parcel. 12. That if the land were annexed at this time the City would be obligated to provide, at a minimum, police and fire protection services. 13. That at the present time there is no available means of connecting the property to City water or sewer; that a portion of the property is presently included in 1986 Idaho Community Development Block Grant proposal which has been submitted to the State of Idaho; that if the Grant is approved it is possible the land could achieve a near access point to the City sewer, and water may have to be developed on sight. 14. That the City has in the recent past conditionally annexed and zoned property conditioned upon final platting and commencement of construction of sewer and water and other reasonable conditions. That the Planning and zoning Commission has judged this annexation and zoning application by the guidelines, standards, criteria, and policies contained in Section 50-222, Title 67, Chapter 65, Idaho Code, the Meridian City Ordinances, Meridian Comprehensive Plan as amended February 19, 1985, and the record submitted to it and things of which it can take judicial notice. 3. That all notice and hearing requirements set forth in Title 67, Chapter 65, Idaho Code, and the Ordinances, of the City of Meridian have been complied with. 4. That the Commission may take judicial notice of government ordinances, and policies, and of actual conditions existing within the City and State. 5. That the land within the proposed annexation is contiguous to the present City limits of the City of Meridian, and the annexation would not be a shoestring annexation. 6. That the annexation application has been initiated by the Petitioner and the owners, and the annexation is not upon the initiations of the City of Meridian and therefore the five (5) acres limitation does not apply. 7. That no objections to the annexation and zoning were made at the public hearings. 8. That since the annexation and zoning of land is a legislative function the City has authority to place conditions upon the annexation of land. That it is concluded that the annexation would be in the best interests of the City of Meridian if the land was going to be immediately developed. 11. Therefore, based on the Application, the testimony and evidence, these Findings and Conclusions, and the Ordinances of the City of Meridian, it is ultimately recommended that Applicant's property should be conditionally annexed and zoned, "I -L", Light Industrial which conditions should be explored at the City Council level; that such annexation would be orderly development and reasonable. Attorney, the way I understood the testimony is that lot 1 & 2 were commercial but lot 3 was part of the residential area. There was discussion on this among the members. Dennis Kelly, 3850 Gemini Circle, Mr. Kelly was sworn by Spencer: Kelly, I am here representing Mr. Van Aucker on his request for annex- ation & zoning of approximately 16 acres of property located between the Interstate and Overland Road bounded on the East by Teare Avenue and on the West by the Western Equipment property. We are requesting that the parcel include the Interstate and one-half of Overland Road. This property has access from Overland Road and also from Teare Avenue. This property front along the Interstate when the sewer line is expect - to cross the freeway, if and when it is extended. Are there any questions? Mr. Kim Cherry, 1524 Meridian Street, Mr. Cherry was sworn by Spencer: Cherry, we own the property between 3rd & 4th Street off of Cherry Lane, we have a professional office building on this property that was built in 1979, in that building there are three offices, at one end is Dr. Tingy and the other is Dr. Brady, the center office space is approx- imately 1600 square feet and we have had considerable problems keeping the space rented over the past five years. What we propose at this hearing is a Conditional Use Permit to allow a public laundromat in that space. One reason for this is we have concern for the amount of professional office space that is presently vacant and the amount that is being constructed. We feel that this would be a good location for a facility of this type. We did not have any opposition from the resid- ents in the area. We realize the tenants on both sides of this are concerned the effect this will have on their business. Our concern is that this be a positive venture for them as well as for us. The laund- romat would be manned during all operating hours, six days a week Monday through Saturday, hours 7:00 a.m. to 10:00 p.m something in that order. Basically that is all I have to say is there any questions? Johnson, is this a list of people within 300 hundred feet? Cherry, yes this is all the property owners within the 300 foot requirement of the Conditional Use Permit. I might mention I received the comment sheets that were submitted, the requirements by the Ada County Highway District, one of the things they had mentioned was to provide curb gutter & paving on West 4th Street, that is not adjacent to this property, I talked to Jon Thompson and there is a misunderstanding there, he thought that the property on the corner was going to be developed.,as far as that requirement we would request that this be waived. Spencer, at this time I will enter into the record two letters, one from Terrell Tingy and the other from Rodney Brady both in opposition to this request. The owner says that the soil is so poor she has not been able to grow an adequate crop. Parcel II has a small home and horse pasture. Parcel III has a single wide mobile home and horse pasture. 7. Proposed Land Use The applicant shall prepare the property with adequate zoning, utilities and access for light, clean, industrial businesses. The businesses shall be compatible with that of Western Equipment company. 8. Present District The property is presently located in Ada County. Parcels 1 & 2 are zoned AP.2. Parcel 3 is zoned R-1. 9. Proposed District The applicant proposes a Light Industrial (I -L) district as required by the Zoning and Development Ordinance Page 45. 10-11. Property Characteristics and Development Harmony: The property size of 652.50 frontage by 1,086.50' in length or 16.27 acres is fronted by Overland Road to the South, Teare Avenue to the East, Interstate 80 N to the South and western Equipment to the West. The surrounding property consists of 2-20 acre parcels of undeveloped land to the South and Southeast (each contains 1 house presently), one 40 acre parcel to the Southwest, one house sitting on 4.1 acres of multi -housing -zoned land to the Southeast, 3.7 acres of multi -housing zoned land to the Northeast, 96 acres of undeveloped General Commercial to the North, approzimately 100 acres of General Commercial to the Northwest and 26 acres of General Commercial to the West, which will contain Western Equipment's equipment yard, repair shop and sales office. The property has a gentle slope to the Northwest (approximately 4' of drop in 1100 l.f. of length). This will allow for access to the utilities. Part of the property is presently included in the 1986 ICDBG Project for extending sewer and water South of the Interstate. If annexed and zoned, the applicant would include the balance of the property in the project. The property's access to the road system by way of Overland Road to the South and Teare Avenue to the East provides easy access to the Meridian Road interchange (approximately 3300 l.f. or .6 miles) or the Eagle Road interchange (approximately 7,920 l.f. or 1$ miles). Overland Road is designated as a major arterial street by the ACHD Supplemental Standard Specification booklet dated March 1985. Thus there will be more than adequate roads to handle the limited traffic that this development will generate. • • This site will provde Meridian with a location for industrial and business growth that will compete with any site that other communities may have. Its location and physical characteristics will allow for the natural relocation of businesses to the Meridian area. 15. Meridian Comprehensive Plan: The Meridian Comprehensive Plan calls for a mixed use in this general area. This would allow for the Limited Industrial zoning that is being requested. 16- 17. Fees and Expenses: The applicant submits with this application his check for $480.00 for the annexation and zoning fee as set out on Page 45 of the Zoning and Development Ordinance for the City of Meridian, Revised October 1985. The applicant further acknowledges and agrees to pay the costs incurred by the City relating to this request.
