NOTICE. OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council of the City of
Meridian will hold a public hearing at 7:'30 o'clock p.m. on
October 6, 1986, at''the Meridian City Hall, 728 Meridian Street,
Meridian, Idaho, fbr the purpose of considering the application
of Ron Van Rucker t'o vacate the Plat hereto prepared and filed of
Lot 1, Timothy Subdivision as filed in. Book 31 of Plats at page
1923, records of .Ada County, Idaho amended by Affidavit recorded
January 28, 1977,i';as Instrument No. 7704108, records of Ada

surueyor.or engineer o rtorm land surveying in Idaho to suffi tly checl; the plat and
computations thereon to determine that the requiements herein are met, and said engineer
or surveyor shall certify such compliance on the plat.. For performing such service the
- county shall collect from the subdivider a.fee as provided by local ordinance reasonably
(~` related to the cost of providing such service.

section 67-6526, Idaho,Code, shall be administered in accordance with the provisions set
forth in the adopted city or county zoning and subdivision ordinances having urisdiction.
In the situation Where no area of city impact has been officially adopted, al~ plats
situate Within one tl) mile outside the limits of any incorporated city shall first be
submitted to the said city, and approved by the council of said city before the same shall
be recorded. Items which may be considered by the city include,.but are not limited to,
continuity of Street pattern, street Widths, and drainage provisions. If the city has
adopted a subdivision ordinance and/or a comprehensive plan, then these documents may be
used as guidelines for approving plats.. Such city approval shall be in addition to county
approval. Within one (1) mile of•the city, a city subdivision ordinance shall prevail
over a County subdivision ordinance unless the city and county mutually agree upon any
differences. Where the urisdiction of tWO (2) cities overlaps, then the jurisdiction
shall be assumed by the ~arger city.

association or corpora ion may esire. o vacate a plat.or any part thereof Which is inside
or Within one (1) mile of the boundaries of any city, it shall be lawful for such person,
persons, firm, association or corporation to petition the city council to vacate. Such
petition shall set forth particular circumstances of the requests to vacate; contain a
legal description of the platted area or property to,be vacated; the names of the persons
affected thereby, and said petition shall be filed With the city clerk.
(2) Written notice of public hearing on said petition shall be given, by certified
mail With return receipt, at least ten i10) days prior to the date of public hearing to
all property owners Within three hundred (300) feet of the boundaries of the area
described in the petition. Such notice of public hearing shall also be published once a
Weel; for tWO (2) successive Weeks in the official newspaper of the city, the last of Which
shall be not less than seven (7) days prior to the date of said hearing.
(3) When the procedures set forth herein have been fulfilled, the city council may
grant the request to vacate With such restrictions as they deem necessary in the public
interest.
(4) When the platted area lies more than one (I) mile beyond the city limits, the
procedures set forth herein shall be followed With the county commissioners of the county
~~ Wherein the property lies. The county commissioners shall have authority comparable to
~ the city council{ to grant the vacation, provided, however, When the plated area lies
beyond one (I) mile of the city limits, but adjacent to a platted area Within one (I) mile
of the city, consent of the city council of the affected city shall be necessary in
granting any vacation by the county commissioners.
(5) In the case of easements granted for gas, sealer, Water, telephone, cable
television, polder, drainage, and slope purposes, public notice of intent to vacate is not
required. Vacation of these easements shall occur upon the recording of the new or
amended plat, Provided that all affected easement holders have been notified by certified
mail{ return receipt requested, of the proposed vacation and have agreed to the same in
Writingg.
All pnblication costs shall be at the expense of the petitioner.

city the plat t~ereo~ shall be .submitted accepted and approved by the board of
commissioners of the county in Which the 4ract is located in the same manner and as herein
provided. If the city or county has established a planning commission, then all plats
must be submitted to said commission in accordance With provisions of section 50-1106,
Idaho Code. No plat of a subdivision requiring city approval shall be accepted for record
by the county recorder unless said plat shall have first been submitted to the city and

Gentlemen:
The Board of Commissioners of the Ada County Highway District will hold a public
hearing in accordance with Section 50-1306(A) of the Idaho Code to consider the
vacation and abandonment of above listed public right-of-way on Thursday,
June 18, 1937, at 7:30 p.m. in the office of the Ada County Highway District.
The applicant, Mr. Dennis Clark, representing Ronald W. Van Auker, Inc. desires
that this vacation be approved to better utilize the adjacent properties for
development.
Enclosed is a legal description of the requested vacation (Notice of Public
Hearing), and a drawing, which shows the area of vacation the Ada County Highway
District has been requested to vacate. It is requested you review and advise
this office of your present use and future plans for this area. Your comments
will be used to assist the Board of Commissioners of the Ada County Highway
District in the disposition of this request to vacate.
You are requested to advise this office of your requirements on or before
June 12, 1987. Addressees not responding by this date will be considered
as having no objections and or comments concerning this request to vacate.
Addressees having an interest in this vacation will be advised of disposition
of vacation application upon receipt of written request.

NOTICE IS HEREBY GIVEN that the Board of Commissioners of the Ada County Highway
District will hold a public hearing in accordance with Section 50-1306(A) of the Idaho
Cade to consider a petition for the vacation and abandonment of the following described
public right-of-way:
Vacation - Unopened Future Street located in Timothy Subdivision, and situated
in the S''-2 of the SE?; of Section 18, T.3N., R.IE., B.M., Ada County,
Idaho.
That portion of future street as shown in Lot i; Block 1 of Timothy Subdivision,
according to the official plat thereof, filed in Book 31 of Plats at Page 1923,
records of Ada County, Idaho, and situated in the South 2 of the Southeast 4 of
Section 18, Township 3 North, Range 1 East, Boise Meridian, Ada County, Idahog
said parcel containing 0.7587 acre, more or less.
SUBJECT TO THE RETENTION of public utility easements, drainage easements,
irrigation easements and or other easements of record or not of record or in -
use upon or under said described future street public right-of-way.
The Public Hearing will be held in the office of the Ada County Highway District,
318 East 37th Street, Boise, Idaho 83714, on Thursday, -the 18th day of June, 1987,
at 7:30 p.m.

This letter is submitted as a request for the City of
Meridian to vacate a portion of Timothy Subdivision,
specifically: Lot 1 of said Timothy Subdivision,
according to the official plat thereof, in Book 31 of
Plats at Page 1923, amended by Affidavit recorded
January 28, 1977 as Instrument No. 7704108, records of
Ada County, Idaho.
This parcel has been annexed into the City of Meridian
and zoned Light Industrial. I also am enclosing a copy
of City of Meridian Ordinance No. 391 which vacates
Lot 2 of Timothy Subdivision.
Also enclosed is a map showing Timothy Subdivision and
both Lots 1 and 2.

The Motion was made by Myers and seconded by Tolsma to approve the
minutes of the previous meeting held October 6, 1986 as written:
Item #1: Dr. Lee Stokes, Division of Environment Administrator:
Dr. Stokes was present to give an award to the Wastewater Treatment
Plant for their excellence in the operation of the Sewage Treatment
Facility. Dr. Stokes addressed the Mayor and Council and congratulated
the City of Meridian and the Wastewater Treatment Plant Employees
for their great work and attitudes in the operation of the plant.
You will also be receiving the Northwest EPA Award. Dr. Stokes
presented the award to Mr. Earl Ward the Wastewater Superintendent.
Mr. Ward and the Employees of the Wastewater Department were applauded
by the Mayor & Council and the audience for their efforts.
Councilman Myers read a letter from Michael Quigley, Director of the
Office of Municipal Pollution Control that included a Certificate
recognizing the selection of Meridian as a National Finalist for the
EPA'S 1986 Award for Outstanding Operations and Maintenance. Even
though Meridian was not selected for the award, Mr. Quigley recognized
Meridian for their committments for effective wastewater treatment
operations, maintenance and compliance. (Letter on file with these
Minutes).
Item #2: Ordinance #469: Vacation of Lot#1, Timothy Subdivision:
Mayor Kingsford, An Ordinance vacating a portion of Timothy Subdivision
of record in Ada County, Idaho, specifically Lot 1 of said Timothy
Subdivision, according to the official plat thereof, in Book 31
of Plats at page 1923, amended by affidavit recorded January 28,1977,
as Instrument Number 7704108, -records of Ada County, Idaho, is there
anyone present who wishes Ordinance #469 read in its entirety? There
was no response.
The Motion was made by Myers and seconded by Giesler that the rules
and provisions of 50-902 and all rules and provisions requiring that
Ordinances be read on three different days be dispensed with and that
Ordinance Number 469 as read be passed and approved:

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City Council of the City of
Meridian will hold a public hearing at 7:30 o'clock p.m. on
October 6, 1986, at the Meridian City Hall, 728 Meridian Street,
Meridian, Idaho, for the purpose of considering the application
of Ron Van Aucker to vacate the Plat hereto prepared and filed of
Lot 1, Timothy Subdivision as filed in Book 31 of Plats at page
1923, records of Ada County, Idaho amended by Affidavit recorded
January 28, 1977, as Instrument No. 7704108, fecords of Ada
County, Idaho. This property is at the North end of Teare Avenue
previously known as Timothy Street.

acting Chairman Walt Morrow at 7:30 p.m.

The Motion was made by Johnson and seconded by Shearer to approve the
minutes of the previous meeting held August 11, 1986 as written:

Item #1: Findings of Fact ~ Conclusions on proposed Amendments to Zoning
& Development Ordinance:
Chairman Morrow, has the members read the Findings and are there any
comments or questions? There was no response.
The Motion was made by Cole and seconded by Shearer that the Meridian
Planning & Zoning hereby adopts and approves the Findings of Fact and
Conclusions as prepared:
Motion Carried: Roll Call Vote: Johnson, Yea: Cole, Yea: Shearer, Yea:
Morrow, Yea:
The Motion was made by Cole and seconded by Johnson that the Meridian
Planning & Zoning Commission hereby recommends to the City Council that
the Planning & Zoning Commission's proposed Amendments to the Zoning
and Development Ordinances should be approved and adopted:

Item #Z Vacation of Plat on Lot 1 Timothy Subdivision:
Chairman Morrow, this section of Timothy Subdivision has been zoned
Industrial as part of the Van Aucker Annexation and they are asking
that the plat of this lot ~ vacated.
It was explained to the Commission that under the Ordinances the
Commission has to make a recommendation to the City Council to
approve, disapprove or approve with conditions the vacation of a
plat after which time there would be a Public Hearing held before
the Council.
The Motion was made by Shearer and seconded by Johnson that the Meridian
Planning & Zoning Commission hereby recommends to the City Council that
the Vacation of the Plat of Lot 1, Timothy Subdivision be approved:
