Wilson, was sworn by the City Attorney. Wilson, Mr. Liggett was the only person in the 300 foot radius that objected to my petition and as I understand it his home is for sale. I believe this shoild have some bearing on the permit. My buiiness I do not even like to call it a business, it is ca very limited pre-.-- school program. It will run 22 hours in a session, probably 9:30 in the morning until 11:00 when most people are working. Tf trie response is good enough I may have an afternoon session but I want to limit the program, very definitely, I do not want it expand, I have a 32 year old at home and I want to be a mother more than anything else. If the response should be good enough I would certainly move to a comm- ercial location. We bought in the subdivision because it is a nice place to live and we do not want to inhibit that in any way. I know there is a number of women in the subdivision that are babysitting that actually incurrs much more traffic and extended hours than what I am proposing. By the fact that there is a circular drive in front of the home and has a niced fenced yard, it is a high board fence, the program only allows for the children to be out. of the house for about fifteen minutes. Wilson displayed pictures for viewing. This is a very limited pre-school program. Mayor Kingsford, as I read the request you are renting the home? Wilson, no, we bought the home, we began the process before we closed on the home. Mayor Kingsford, any questions of the Council? Giesler, it was brought up at the P&Z Meeting about the covenants in the subdivision, are we concerned about these in what decision we make? Mayor Kingsford, we can grant something we are allowed to-grant under the City Ordinances, if their covenants restrict this, then that would be a civil action the residents would have to take. Giesler, in the application it states 2Z hours per day, if it did go into the afternoon would that require coming before the Council again? Wilson, the reason I put the 2~ hours in the application, I was not really informed as to how to make the application out. I made-the application to the best of my ability and if there is some problem with that, we discussed this quite at length at the P&Z meeting and they did not feel there was any problem with that. Giesler, the acutal time involved. would be 2~ hours in the morning and 2~ hours in the afternoon, five days a week, that would be the maximium? I do triink Mr. Liggett that there is a need for Conditional Use Permits however in the past in my own thinking that it has been my policy that certainly those people in the subdivision have a right to privacy and if people objected I have a problem approving what is requested. Attorney, I think that there is, I also want to address the 2~ hour situation, technically the application is for a 2~ hour pre-school and I think that is all that can be granted unless you want to make it a situation where to grant the 2~ for which ever one she wants, the a.m. or p.m. because that was not specified and then if she wants to go further she could come back before the Council only with additional notice to obtain approval for the additional session. Mr. Liggett, what is this going to do i:o our covenants that we have in our subdivision? The reason I bought in the subdivision is that it states in there that no business are allowed. Mayor Kingsford, we cannot enforce your covenants, we might be able to approve this type of request, we have a provision in our Ordinance that we can grant a Conditional Use Permit in a R-4 Zone for certain purposes, the fact that we can grant that permit does notpmean that ;: she can operate if it violates yerur covenants, you stillh~~-right to recourse though your covenants. That is a civil action you can take and it can be enforced if the covenants read that way. Wilson, everyone else within that area was very positive about this and were very helpful again that is only one objection out of .the twenty eight resident I had to obtain signatures from. It would be my recommendation that if you do limit it to one session at this time and she does desire to have two session that, technically she should be required to go through the whole process again but if you want to waive that and have her come back before the Council you can do that on whatever terms you deem appropriate and if you did, I would suggest that you serve notice. In the handout she distributed she would like to add `a class from 1;00 to 3:30. My question is would it mean that there are two classes every day of the week if she has a good response? Also I-want to know if this is going to be limited to two classes per day if it•:does extend to a five day a week.~I have no objection to the listed c~'asses she is proposing but I do not want:.it turning to an all day thing. Another thing is the fact that Sunnybrook Farms does have a Homeowers Association and as I understand it now there is an existing covenants against running a business out of your home. and I would like to know how this is going to be approached by Mary Wilson. I believe this has to be passed through the whole Homeowners Association before it can go into effect. If this goes to a two session a day will this be fifteen different children in each session? Johnson, I do not know where the Con~nission stands as far as covenants are concerned , I do not know whether that has anything to do with what we do here tonite or not. . ~, Crookston, in the past it is not the. position of the City to either deny their existance or enforce their provisions it is up to the individual property owners in the subdivision.
