Section 2. That the City Clerk shall cause one (1) copy of
the legal description and map which shall plainly and clearly
designate the boundaries as altered,.to be filed with the Ada
County Recorder, Ada County Assessor, and the State Tax Commission
within 10 days following the effective date of this ordinance.
Section 3. The above property is annexed to the City of
Meridian subject to the following requirements: 1) that before
Preliminary Plat approval, there is positive commitment for water
and sewer across the Interstate I -60N (I-84) to service the property
2) that there is adequate buffering between this property and
surrounding property, 3) design review including detailed land-
scaping and approval of such design, and 4) that the property and
use meet all other City requirements.
Section 4. This Ordinance shall be in full force and effect
from and after its passage, approval and publication as
required by law.

ANNEXATION PETITION
I.
N Legal Description
The undersigned being the purchaser under contract from
the titled owners of those certain parcels of real property presently
located outside the corporate limits of the city of Meridian the
particular descriptions of those parcels herein and hereinafter being
referred to as "The Time For Two" property, Exhibit A, attached and
by this reference incorporated herein as if fully set forth, and the
"Ro-Ho" property, Exhibit B, attached and by this reference incorpor-
ated herein as if fully set forth.
II.
Request for Annexation,
The titled owner of record of the Time For Two property is
Pearle Nyborg whose required request is attached hereto, marked
Exhibit C and by this reference incorporated herein as if fully set
forth.
The titled owners of record of the Ro-Ho property are John
W. Kelly and Ruth E. Kelly whose required request is attached hereto
marked Exhibit D and by this reference incorporated herein as if
fully set forth.
Proposed Subdivision Name And Annexation
The proposed name for the Exhibit A property is "Time For
Two Annexation" and for the Exhibit B property is "Ro-Ho Annexation".
IV.
Annexation Need And Use
A. General.Statement of Purpose and Intent
It is the desire of the petitioners to separate, expand and
completely remodel their present facilities at the intersection of
Overland Road and Meridian/Kuna Highway. In its present posture
petitioners operate a machine, repair, towing and welding shop/stor=-
age area under -the name of Ro-Ho and immediately adjacent thereto

a beer bar under the name of Time For Two.

In its present status
the area and buildings are unsightly, congested and cramped and
the petitioners plans as more accuratly set forth in the accompanying
drawing's caling for the removal of the Ro-Ho business to Parcel B
which is located on the southside of Overland Road, west of the Meri-
dian/Kona Highway and then the razing of the present Time For Two
building and reconstruction of a bar -dining club of 4500 square feet
done in red brick and a 19th century design more -particularly set
forth in the drawings accompanying this petition.
B. Time For Two
At its present location the Time For Two is situated at the
northeast corner of the Overland Road - Meridian/Kuna Highway inter-
section and being so situated is an excellent site for a commercial
zone and the type of dining club proposed. The dining club would
provide a facility for the residents of the proposed and annexed
Meridian Greens as well as the proposed and annexed Mar -Mon develop-
ment.
In addition to providing a dining club service to these
annexed areas the site by its location is easily accessible by I-80
motor traffic_ estimated at 40,000 vehicles per day and the estimated
19,000 vehicles that travel the Meridian/Kuna Highway per day.
The situated property adds the further benefit to the motoring
traffic and more particularly the motoring traffic and the city of
Meridian diverting that motorized traffic from the freeway exit to
the property without adding an additional traffic burden to the
city§ main streets or residential areas. Further more the access
road off the freeway and its return is a dedicated state highway
and would not add an additional burden to the city's street main-
tenance department.
C. Ro-Ho _.Towing
The land proposed for the expanded and improved portion of
the petitioner's business enterprise will provide the residents of
the city of Meridian with a repair, electrical, welding and muffler
shop. This service will also include a fenced impound yard for the
storage of vehicles,that have been wrecked, abandoned or seized by
law enforcement officials. The impound yard is not intended and will
•
not be used as a wrecking or dismantling facility where the vehicles
will be permanently stored but will suffice as a temporary storage
and security area for the vehicles awaiting insurance settlement
or legal disposition.
The facility will be located directly across from the
proposed and annexed Mar -Mon shopping center and will provide
motor services to the center's customers and employees as well as
a facility for interstate and Meridian/Kuna Highway traffic. In
addition, the business enterprise at present specializes in the
repair and restoration of many items of farm or ranch equipment
and the proposed location will provide an excellent location for
such type of service to the Meridian, Nampa, Boise, Kuna farmers
and ranchers and is compatible in its service to the Mountain View
Equipment business also located on Overland Road.
Of major benefit, however, to the city of Meridian and the
residents of Meridian's southern boundary and those persons adjacent
and immediately outside this area is the overall improvement in
present location.of both business entities which are at present,
petitioners recognize., congested and unsightly. Petitioners pro-
pose to not only provide improved services to its customers but at
the same time to remodel and restore the present Time For Two lo-
cation into an area esthetically pleasing and also a business asset
of the city of Meridian.
V.
Connection To City Utilities
Access to the city of Meridian water and sewer facility, given
the Mar -Mon and Meridian Greens utitlity extension plans more parti-
cularily set forth on Exhibit E hereto which by this reference is
incorporated herein as if fully set forth, visually demonstrates the
feasibility of such connection. It is noted however, that Parcel A
and B lie within the city's utitlity impact area.
VI.
Contigious To City Limits
Parcel A, Time For Two Property as well as Parcel B are con-
tigious to the present city limits of Meridian.

Also attached hereto and marked Exhibit G is a site develop-
ment plan drawn to a scale of 1" X 300'of the Ro-Ho property and attached
thereto and marked Exhibits G-1, G-2, G-3, G-4, and G-5 which are
by this reference incorporated herein as if fully set forth.

Agenda
1 Mayor Glaisyer announced that the City Council has come to the decision concerning
the Cherry Lane Golf Course. Wallace Lovan has submitted the 1979 budget, proposed
budget, lease agreements, letters of committment from Financial Institutions, and
contracts for employment. Glaisyer stated that the City Council was ready to take
the position of endorsing Wally Lovan to maintain and run the Golf Course for the
upcoming season.
The Motion was made by Orton Jr. and seconded by Williams to accept the material
submitted to the City by Wally Lovan and along with the Mayor and Council's
endorsement, submit to Mr. Leavitt and request his concurrance and if there are
any other side issues that Mr. Leavitt contact Mr. Lovan directly.

ADJACENT AND CONTIGUOUS TO THE CITY OF MERIDIAN, ADA COUNTY, IDAHO.

Mayor Glaisyer stated that with the power invested to him, he vetoed Ordinance #361
with the reason being that Rainey -Kuhl Annexation will be an undue burden upon the
Police Department. He had.no qualms with the actual use of the property, proposed
use of the property, but he felt the Police Department and the City does not need
another bar that causes undue hardship. Until the property has availability for City
wate and sewer facilities on site, the City should not extend its police powers.
Meridian City Hall 2 February 19, 1980
Foley, Attorney for Rainey -Kuhl stated that he was concerned with AIC rules
that any veto must be at the next following meeting after approval, also the
reason for veto in writing. He felt this was not the correct procedure.
Mayor stated that the City's Ordinance will go first and foremost.
Crookston Jr. stated that the Mayor can veto, but if he does not act within a
certain period of time (10 days), the ordinance is vetoed automatically. If the
Council chooses to override the Mayor's Veto, even though the Mayor does not sign
the Ordinance automatically becomes a law.
The Motion was made by Brewer and seconded by Orton Jr. to override the Mayor's
Veto of Ordinance 361.
Motion Carried: Kingsford, yea, Brewer, yea, Orton, yea, Williams, nay.
Mayor Glaisyer abstained from reading Ordinance #362.

3 Kelly Parker Rezone Hearing
David Jensen was present, representing Parker and Valley Dairy Supply rezone of 903
E. 1st from "A" to "C" Commercial. Jensen presented a letter of intention of
improvement to property with a retail dairy equipment store, block or steel, 30X50,
light traffic, only one vehicle. (Letter on file with minutes.)
There was discussion in favor of this improvement by all memebers.
The Motion was made by Williams and seconded by Kingsford that the Kelly Parker
Rezone from "A" Residential to "C" Commercial, located Lots 16 and 17, Block 2,
Bowers First Addition, be approved with the stipulation that Valley Dairy Supply
present a design review,before building,to the City Council.

4 Custom Builders - W. Idaho.
Gene Wright, J -U -B Engineers, Inc., was present to request release of putting in -
curb and gutter on the opposite side of street from Custom Builders Tri-Plexes.
The project involves two tri-plexes by developer, Dick Martens. One of the conditions
of curbs and gutters across the street, which dead ends in a cul-de-sac at this
proposal. Wright stated they did not feel this was a fair requirement.
There was discussion concerning the benefits of building properly and offsite
improvements in the City of Meridian.
Wright felt this improvement was up to ACHD and could see no reason that the
developer should come to this cost.
It was determined that the water service line was put in "in a round -about fashion"
because the owners of the property at that point of time would not grant an easement.
Stuart was not sure at this time if the service would be adequate.

Design Review be approved subject to Ada County Highway District approval, landscaping
design review, City Engineer approval of sewer and water lines, and the reduction
of front building or new building to meet Fire Code.

Agenda Rainey -Kuhl Annexation Hearing "C" Located Overland & Hwy 69
Howard Foley, Attorney, representing Annexation requested,displayed, and explained
graphics stating that this proposal will benefit the City as it lies at the entryway
to the City. The present Time -For -Two building would be razed and a supper club
put in its place. The impound quarters are to be moved across the road from
Mar -Mon development on West Overland (Ro-Ho).
Foley explained the impound yard and general repair facilities, - not dismantling.
The purpose to hold vehicles requested by the City or the State for the period of
time it takes for insurance bids. This lot will not be a permanent storage.
Foley stated the Ro-Ho proposal will serve a need as well as an improvement and
he felt this would be compatible with other buildings that presently exist, in
particular Mtn. View Equipment and their servicing area.
Steve Teed, Architect, described the drawing. Parking has been provided to
comply with Ada County Highway District, State Highway concerning the approach,
landscaping, 4500 sq. ft. restaurant, 25% bar and 75% restaurant area. Supper
Club design, entirely new brick building.
Williams stated that he does not agree with going to the south of the Interstate
for annexing. He questioned the 55 foot center line right-of-way on Hwy 69, known
as the official State requirement. Also, if there would be assurance this would
be built, _
In answer, Foley stated, certainly the Council has means to see that they follow
the policy and general outline of their proposal. He had talked to Mr. Sessions,
Director of the State Highways, regarding the 30 feet on each side in order to
expand to a four lane highway, resulting in 120 feet. They are prepared to
answer to all requirements and give right-of-way.
The Impound Area was displayed, approximately 1/4 of a mile from Kuna-Peridian Rd.
south side of W. Overland. The lot is designed in back of the Rainey home, a
repair complex, a holding area, impound lot, 7 acres, but not all 7 acres included
in annexing.
Orton stated that the general opinion of Planning & Zoning and still in his
opinion, is that this proposal does comply with the Comprehensive Plan, Commercial
on the corner and Industrial in the other area. In the case of the restaurant
and the impound area, the City would achieve an improvement over the existing
situation.
Kingsford asked about the holding period.
Mrs. Kuhl stated 30 to 60 days for insurance companys. With the new State
regulation, they will be holding at least 60 days again.
Brewer stated he agreed to the obvious improvement of the area and that in
communicating with Mar -Mon, found they were definitely encouraging the annexation
and the project. He stated that Mar -Mon was going to do their best to incorporate
the stream into their project and asked that Rainey -Kuhl do this also.
Teed stated there would be no problem of putting some borderline planters on the
easterly side.
Mayor G1aisyer asked for comments from the public.

Dave Reeves questioned "that with the Boy Scout and Deseret Industries
going in on E. Overland, is the Time For Two drinking establishment the
proper blend, he realized it (proposal) would be an improvement over what
we have now, but'is it what we want as an end result?"
Foley responded that the new establishment was committed 75% to dining, the
people and the purpose of their going there would be an improvement. The
Time For Two and Roho situation, as exists, now can continue to do so
indefinitely under Grandfather Rights.
Brewer stated the stipulation is 300 feet from a church and there is quite a
distance from the LDS proposal.
Martin Igo read a letter of support from Winston Moore to the Mayor and City
Council. Letter is on file with these minutes.
Laura Connor, speaking as a citizen of Meridian, commended the proposal as an
improvement and encouraged support.
The Mayor cautioned the Council to be aware of the Impact Area Hearing to be
held the next evening. The Annexation of the Roho property is in conflict
with the Impact Agreement. He suggested tabling the proposal until hearing
the public's feeling of the Impact Agreement.
Foley stated that he appreciated the Council's position on the Impact Area,
but his. research indicates the State of Idaho has granted to any City one
mile radius jurisdiction. This must form any agreement with the County, if
there are other concerns, they would prefer tabling.
The Motion was made by Williams that the Rainey -Kuhl Annexation be tabled until
the first meeting in February.
The Motion died for lack of a second.
The Motion was made by Brewer and seconded by Orton that the Rainey -Kuhl
Annexation "C Commercial, be approved with the condition that before Preliminary
Plat, there is positive committment for water and sewer across the Interstate,
adequate,buffering, detailed landscaping with design review, and meet all City
requirements.

6 Dave Reeves - Gem Estates
Reeves stated he was before the Council concerning the building of four-plexes
in Gem Estates and wanted to point out what has been happening in this subdivision.
Reeves stated "in 1975 Gen Estates was approved as four-plexes, not variances
were granted, and apparently there wasn't a density code at that time. Somewhere
along the line, somebody decided it would be developed as you go process. The
State law requires all property broken up into five or more parcels of land, that
there be a plat filed with Ada County. In 1978 the City of Meridian was notified
by a letter generated by the Assessor's office that Gem Estates Subdivision was
an illegal subdivision, this letter is on file, filed under Gem Estates. Apparently
no action has beentaken on that letter. I don't know why, it appears it is too
late to file it now as the property has already been sold, it's no longer under
the control of the developer. I own one lot, of which a four-plex has gone up
six feet off the property line. In 1978 or approximately, it was adopted to the
Comprehensive Plan which places R-15 on that property. Those lots are 6,900 feet.
It doesn;t meet the criteria for four-plexes. Now, if that is an illegal
subdivision and you throw it out, then it has to meet the density code of the new
Comprehensive Plan which will allow a duplex to go on those lots. I have a map
drawn up by J -U -B that shows how these four-plexes were originally approved.
(Reeves displayed map) All the correspondence in your files indicate there
would be no parking from Pine or Broadway and it refers to this as a subdivision
not under Metes and bounds. This darkened area on here shows access way to the
rear of the building for parking under, if you notice the buildings that went
up on Broadway, this whole development was supposed to be the same. Somewhere
along the way somebody has decided they didn't have to follow this plan and it
was changed. What I am asking you today, is if you are not goino to follow this
plan, then you have to fall under the density code. This property (indicating
property adjacent to 777 W. Pine) was sold to Dunbar since the Comprehensive Plan

The minutes of the previous meeting were approved as read.
Agenda Rainey -Kuhl Annexation - Overland and Meridian-Kuna Road Parcel A

Howard Foley, Attorney, was present to represent request of annexation of the Time -For -Two
Bar and Roho property. The Time -For -Two property is located on the Northeast corner
of Overland and Meridian/Kuna Highway. The Roho property is located just South of the
MarMon Annexation on West Overland. The Roho property, or Parcel.B, will provide an
impound facility for area need. Foley described the travel density of some 14,000 on
the Meridian/Kuna Highway - 40,000 on the Interstate.
Foley stated that since the City has annexed MarMon property which would require extension
of Sewer/water, fire and police protection, that a greater tax base would be required to
support what is now going to be an extended City service. The only way to extend that
tax base is to bring in new commercial type of development, higher tax base.
Foley stated that their most central point is that they are not asking the City to allow
or convert property that is at present something other than commercial. The site is
commercial. This is not a heavy residential area. They are asking agnexation to expand
and improve the services of the area.
Steve Tede, Architect, displayed map sketch describing anticipated Supper Club area
parking and landscaping to be located at the Time -For -Two intersection. Restaurant would
be situated where the building is now and parking where the impound is now. 25% of
the floor area would be bar, the rest restaurant and kitchen.
Foley poihted out location of Parcel B, Roho property, to the West and uphill behind the
present service station on Meridian/Kuna Highway. Extension of water and sewer services
from the MarMon Development were discussed. The Ten Mile route was most feasible.
Orton commented that so far the City has approximately 160 acres annexed and so far no
positive water and sewer plan to bring across the Freeway.
Sharp agreed to the fact that people are led to believe the services will be there and
nothing is happening.
Mitchell questioned if both property requests were contingent upon the other.
Foley answerd yes.
Foley explained that motivation for proposal is that the present location is not
compatable to expansion for either business. One is going to have to move.
The impounding lot would not be a wrecking yard, only storage for towing, insurance
investigation, etc.
Bruce Kuhl described the use of the impounding lot and would be landscaped so i -t would
be compatible with any residential. Boise has only two such lots and the service would
benefit and be convenient to this area.
There was discussion concerning Comprehensive Plan, sewer/water facilities, access -
ability to the Interstate, completion of the zoning ordinances and police service.
The Motion was made by Orton and seconded by Mitchell that the Commission approve the
Rainey -Kuhl Annexation with the condition that before Preliminary Plat there is positive
committment for water and sewer across the Interstate, by a certain date; adequate
buffering; detailed landscaping with design review, and meet all City requirements. i
