requirements for your new professional building comply with our
Meridian Zoning Ordinance.
The documentation provided for our review indicates that the
required 19 striped parking spaces will be in place prior to the
occupancy date. We are aware that 2 of these spaces are located
at the southwest corner of the building site and will be accessed
off-site via a portion of State Street that was vacated to the
Meridian School District.
You indicated that the School District will allow access to the two
parking spaces in question, but wishes to reserve the possibility
to revoke ingress/egress if their use of this portion of the
property were to change.
This letter serves as our concurrence with the circumstances and
acceptance of 17 parking spaces as being adequate in the event that
someday the School District no longer permits physical
ingress/egress. We feel that allowing this flexibility is
justified and fair to all concerned considering there is adequate
curb -side street parking in front of your site to retain the
character of our zoning ordinance.

Mayor Kingsford: Doctor'Fender, would you like to make any comments
before we open the Public Hearing?
Dr. Fender: The only comment I have is I think everyone here is familiar
with what I have requested.
Mayor Kingsford: I will now open the Public Hearing, is there anyone
in the audience who wishes to offer testimony on this request? There
was no response, the Public Hearing was closed.
The Motion was made by Myers and seconded by Giesler that the Meridian
City Council approve and adopt the Findings of Fact and Conclusions of
Law as prepared for the Planning & Zoning Commission.

5. Submit a site drainage plan showing that site drainage will not flow onto
Ada County Highway District right-of-way, in accordance with Boise City
Code 11-3-54 (A), where applicable, and ACHD policy.
6. Access to parcel to be reviewed and approved by the District.
7. Driveways to be located a minimum of 5 -feet from the property line.
8. Any work within ACHD right-of-way requires a permit. For information

PRELIMINARY
FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
September 8, 1987 at the hour of 7:30 o'clock p.m., the
Petitioner appearing in person, the Planning and Zoning
Commission of the City of Meridian, having duly considered the
evidence and the matter, makes the following Findings of Fact
and Conclusions:
FINDINGS OF FACT
1. That the property is located within the City of
Meridian and is described in the application and which
description is incorporated herein as if set forth in full and
which property is known by the address 1001 Meridian Street,
Meridian, Ada County, Idaho..
2. That the property is presently zoned R-4. Residential,
and previously had a church located thereon which burned and was
removed; the property is now a vacant lot; that the property
surrounding the subject property is similarly zoned and is
either in OLD TOWN or is developed as R-4 Residential; there is
some intermittent development of
Meridian Street.
Limited Office property along
3. That the Applicant's proposal is to change the zone
from R-4 to L-0, Limited Office so applicant's property will be
so zoned and to eventually use the property in an office fashion
for a doctor's office; no immediate office use is intended for
this property.
4. The requested Limited office zone is described in the
Zoning Ordinance as follows:
(L -O) Limited office District: The purpose of the
L -O District is to permit the establishment of
groupings of professional, research, executive,
administrative, accounting, clerical, stenographic,
public service and similar uses. Research uses shall
not involve heavy testing operations of any kind or
product manufacturing of such a nature to create
noise, vibration or emissions of a nature offensive to
the overall purpose of this district. The L -O
District is designed to act as a buffer between other
more intense non-residential uses and high density
residential uses, and is thus a transitional use.
Connection to the Municipal Water and Sewer System of

The following is a request for rezoning the property listed as 1001 Meridian St.,

The property in question is the previous site of the Church of Christ, which has
relocated and still holds deed to the property. That facility burned to the ground
earlier this year, leaving a lot which .is currently vacant. The property is bounded
on the north by a private residence, on the east by Meridian Street, on the south
by the Meridian School district administration building, and on the west by Meridian
Primary School. The property presently is zoned R-4 for residential use. This
request is for change in the zoning status to a limited office (LO) designation.
The purpose of changing the zoning classification is to allow the future construction
of a medical office to hone at least two primary care physicians. A building
approximating 4000-4500ft would be constructed on the lot, with off street parking
provided on the lot. The size of the building would not be inconsistent with the
size of buildings already in existence in close proximity to the -lot. It is felt
that the close proximity to downtown Meridian and the presence of the school district
administration office and an elementary school would make an office building of this
type a more attractive option than a residence. Tbis type of business and building
should be as asset to the neighborhood.
At this point in time plans for the office building have not been drawn, but construct}c�-1
ion of the building would be consistent with other office structures found around the
Meridian area.
The Church of Christ still holds deed to the aforementioned property. An offer has
been made, accepted, and ernest money placed on the sale of this property. The final
sales transaction is awaiting the decision of this commission as to granting this change
in zoning status.

Item #3: Ron Van Auker: Lot line Adjustment Property South of.Freeway:

C1ark:.I work ;�or_Ron'Van Auker and what we are requesting is a lot
line adjustment for the property located South of the freeway which
was recently annexed and zoned Light Industrial. This will be the pro-
posed site for the new Inland Coca'Cola Bottling plant. The area that
is outlined on the maps you have is the site basically.what we are
requesting is what was formerly Lot 1 of Timothy Subdivision be
enlarged to include that area that extends South to Overland Road
along the West side of the property. Clark showed the Mayor &Council
on the maps what they were requesting.
Mayor Kingsford: Are there any questions of the Council? Under our
Ordinance we do have the ability to adjust lot lines and split a lot.
Giesler: Mr. Mayor, I would have no problem with this, I am glad to
see further development of there.
The Motion was made by Myers and seconded by Tolsma to approve the
Lot Line adjustment as requested by Ron Van Auker:

Doctor Fender: I appreciate the opportunity to come at the last moment
before the Mayor & Council and present an item of.business, I just have
a letter here for the Mayor & Council that explains what I,would like
some direction on. It just came to my attention --that the -property down'the street where the church burned down a few months ago, came up for sale.
I have been looking around the area in the_ hopes that in a couple of
years perhaps I might be able to purchase a piece of property and build
my own office. When this property came up for sale I did some investigat-
ing and found it would be feasible for me to do. My purpose for coming.
before you this evening, as you know this property -1s now zoned "resident=
ial, and I would appreciate the Mayor & Council's thinking on whether - -
there would be an objection to the re -zoning of this property -fora
doctors office. There have been no plans drawn for a building, it prob---
ably be two to three years down the road before the building was built.
It would be in the area of 2500 to 4000 square feet. I would like any of
your comments or objections before I carry.this to far.
Mayor Kingsford: Well certainly I would like to commend you for the job
you have done here for the three years and applaud you for wanting to
make an additional committment here in Meridian. I would recommend that
you consider a re -zone of this•property.to Limited Office.
There was no objections from the Council on this proposal.

Re: Conditional use permit
This letter is a request for a change in the zoning status of the property listed
as 1001 Meridian Street, Meridian, Idaho. The property is the site of the former
Church of Christ which burned down earlier this year. The property has been
cleared of all debris and currently is a vacant lot, bounded on the west by Meridian
PrimarySchool, on the south by the Meridian School District Administration Building,
on the north by a private residence, and on the east by Meridian Street. It
currently is zoned as R-4, but I am requesting a conditional use permit to use the
property as the future site of a professional medical building.
I am a Family Practice physician and have been practicing in Meridian for three
years. Currently I am leasing space in the Meridian Professional Plaza on Linder
Road. It is my hope to build within three years a professional office building
at the site described above, to house myself and possibly one other physician.
The building would be used solely for the purpose of seeing patients and those
activities related to the practice of medicine. Although the plans for this -build-
ing have not been drawn at the present, the size of the building would be approx-
imately 2.500 to 4000 ft2. These measurements take into consideration the setbacks
currently specified in the Meridian City Code. The building would be one story
and contructed in a visually esthetically fashion to match other newer office
buildings already in existence in the Meridian area. A sign advertising the business
would be placed either on the front of the building or on the lawn facing Meridian
Street.
Parking at this site would be provided for by designating spaces immediately to the
south of the property adjacent to the driveway provided bye the School District

as access to Meridian Primary. The main access to the office would be from
Meridian Street, although alternative access could be had by approaching Meridian
Primary from Pine Street.
A firm offer has been made to the sellers of this property and final financing
is currently being arranged. This offer is obviously dependent on the issuance
of a conditional use permit by this council and Planning and Zoning review.
