NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning and Zoning
Commission o£ the City of Meridian will hold a public hearing at
7.:30 O'clock p.m. on June 9, 1987, at the Meridian City Hall, 728
Meridian Street, Meridian, Idaho, for the purpose of considering
the Application of Bonnie Relso, for the rezone of 1430 East
First Street, Meridian, Idaho which is a part of Block 4 of the
Amended Plat of F. A. NOURSE'S THIRD ADDITION TO MERIDIAN, Ada
County, Idaho, from (R-15) Residential to (C-C) Community
Commercial. A more particular legal description is on file at tie
City. Clerk's office and is available for inspection during
regular business hours.

Meridian.
2. East First Street is under the jurisdiction of the Idaho State Transporta-
t i o n Department. It has 80-feet of right-of-way and i s improved with
41-foot back-to-back street section and separated sidewalk.
• RECOMMENDATION:
1. No Requirements.

Kelso: No, definately not. •
Myers: Did you have any problems with the City-Engineers comments,
mainly the parking and such?
Kelso: There would be parking to the North side of the house, there
is thirty three feet there.

Brewer: As I remember this is the same property that was a day school
a few years-back and the parents entered that property and went to the
back and turned around and came back out, is it your intention to put
a circle drive aroung the house?
Kelso: If it is required, yes, if not required., no.
Brewer: Knowing the traffic on that street, I think a circle drive is
a must, to have ingress and egress on one entrance on East First Street
is just about impossible.

Kelso: There is room in the back to turn around and go back out, there
is half an acre there or there is room to make a complete U around the
building.

house size 'of the lots rezoned:
Mayor Kingsford: At this time I will open the Public Hearing, do we
have a repr'esentative~-in the audience, i£ so would yolr~come forward

Don Hubble was present, Hubble was sworn by the City Attorney
Hubble: Our proposal is: to. rezone a protion of Settler's Village
Subdivision-gresently zoned Commercial to R-$ Residential, We are
asking for Lot's 4-7 Block land 4-7 Block 2. We have since then
submitted Covenants for these-lots which are very similar to the
amended covenants on the balance of the Settler's Village Subdivis-
ion. The only Variance we are asking for is in regards to the house
sizes, we would like to vary from the .requirements of-the Ordinance
on the percentages to allowing a minimum_of 1100 square feet on
all the lots. I believe that the balance of the Settler's Village
had a minimum of 1080 square feet. They fully intend to build larger
than that but wanted to use that as a minimum.
Brewer: This is not downgrading the precedence that Settler's. Village
has already.-set then, as far as square footage is Concerned?

FINDINGS OF FACT AND CONCLUSIONS
The above entitled matter having come on for public hearing
June 9, 1987, at the hour- of 7:30 o'clock p.m., the Petitioner
appearing in person,~the Planning and -Zoning Commission of the
Cfty of Meridian having-duly considered the evidence and the
matter makes the following Findings of Fact and Conclusions:
1. That `.the property is located within the City of
Meridian. and ~.is~~ described in the application and which
description~is incorporated herein as if set forth in full and
which property`is known-: by the address .1403 East First Street,
Meridian', Ada County, Idaho.
2. That 'the property is located in OLD TOWN Neighborhood
as designated on the Policy Diagram on page 7 of the Meridian
Comprehensive Plan.
3. That North 33 feet of the property is already zoned
Community Commercial and the balance of the property is presentl~r,_

property surrounding the subject property is similarly zoned and
developed; that the Meridian Building, ari office building is

from R-15 to Community Commercial so all of the Applicant's

(C-C) District is to permit the. establishment of general
business uses that are a larger scale than a neighborhood
business, and to encourage the development of modern
shopping centers with adequate off-street .parking facilities
and' associated site amenities to serve area residents and
employees;~to'prohibit strip commercial development and::
encourage the- •clustering of -eommerciel -enterprises. -All
such districts shall have direct access=to a-transportation
arterial and collector. and be connected to the Muni-cipal --
Water and Sewer systems of_the City of-Meridian.----
6. ! The Comprehensive..Plan••contains Economies Policies on
pages 15 and, 15; the pertinent policies to-this-Applicat-ion--are
stated as follows:

industrial and commercial enterprises to locate in

no objection to those comments or requirements.

CONCLUSIONS
1. ~ The City of Meridian has the authority to grant Zoning
amendments and rezones pursuant to Title 67, Chapter 65, Idaho
Code, and pursuant to 11-2-416 of the Revised and--Coinpile~3

Ordinances of •the City of Meridian.
2. That upon rezone, the City of Meridian has authority
to place conditions upon the zoning amendment.
3. That 11-2-416(A) of the Revised and Compiled
Ordinances of the City of Meridian sets forth the standards under
which the Planning and Zoning Commission and the City Council
shall review applications for zoning amendments; that upon a
review of those requirements and a review of the facts presented
and the conditions of the area, the Planning and Zoning
Commission specifically concludes as follows:

Mrs. Bonnie Kelso was present, Mrs.Kelso was sworn by the City Attorney.
Kelso, the property is located at 1403 East~•~'irst, actually there is
two lots and one is already zoned CC, there is a 33 foot lot on the
North which is already zoned and I am requesting the lot on the South
be zoned CC,my ultimate goal is to establish an antique shop in the
house. We received the comments and we could put the necessary parking
to the north side of the house, currently th~6re is a gravel driveway
on the south side of the house that goes to the back.
Alidjani, did you read the comments from the City Engineer and did you
have any problems with them?
Kelso, I am not sure how the City. Ordinance's read on the sign code,
landscaping I have no problem with that, we have thought that maybe
there could be an entrance driveway and an exit driveway in front of
the house, the house is set back quite aways from the•street, then
there could be the parking area at the side, I was wondering what kind
of screening would be required, I presume this is from the houses on
either side,
Morrow, typically it is a fence of some sort or hedge or something
of this nature, the concept there is to do away with any noise or
disturbance to a residential area.
Kelso, this would not present any problem on the north but on the
south, the house is almost on the line and she use this to go to
the back of her house, I do not know how she would feel about a six
foot high fence or something of that nature.
Alidjani, normally this is put in for the comfort of the next door
neighbor, if they are happy with you there is no problem.

The property at 1403 E. First is on the West side of the street
opposite The Meridian Professional Plaza. The property has 101
feet of street frontage on East First, comprised of two lots,
one 33feet wide on the North and the-other 68 feet wide on the
South. It is my understanding that the 33 foot lot on the North
was re-zoned to commercial at the time the Professional Plaza was
built. It is the 68 foot lot on South for which I am requesting re-
zoning. This would again combine the entire property under the
same zoning classification.
Currently, to the best of my knowledge, Meridian has only one
antique shop. Establishing an antique shop near the shopping
centers at the intersection of Cherry Lane and East First would
expand the variety of merchandise available to Meridian residents.
