.Brewer: We have had neighbors to the South of me that have had continued
problems with the Phillips 66 Service Station. I am going to just mention
their names, Brent Alger, Dennis Nielsen and then also the people in the
Ambrose Building to the West of the Phillips 66, they have all made for-
mal complaints. I think I will let those people elude to what the compl-
aints are.
Brent Algers, 120 East State, I live across the Street, North of the
Phillips 66 Station, since the present party that is operating the Stat-~
ion has been there we have had problems with vehicles parked in front of
our house either unlicensed or a fictitious•display, I am certain of it,
because any time you find a license plate hung on a pickup with a-nylon
stocking and the licnese plate setting on the bumper the plate in all
probablility does not belong to that vehicle. As of late_ there are three
different semi's that have been parking either in front of our house or
in front of the renters house and across the street, one semi quite
often parks out on-First Street in front of the station and makes it
very difficult and dangerous for traffic leaving State Street onto
East First, it blocks the vision from the South . Not my point of view
but the neighbor across the street says they have parked in the alley
so they can not use the alley, that alley is supposed to be a one-way
alley and they have had cars parked in front of their house as well.
Dennis Nieslen, 1012 East First, _I have h~.d patients complain to me,
about two weeks ago they had a Jeep with a camper parked right at the'
corner of East-State and East First and it was blocking the view of
people coming oizt onto East~First from my business.-ht-was right at
the corner they were parked in a yellow zone plus partially in my
driveway: It stayed there about ten days and I finally went over and
complained to them and it was finally moved. After that one left they
parked another one in the same place and I called the police and it
was towed away. Today I drove by there and. counted nineteen cars parked
around their~business,I imagir~ a couple of them are their employees
but one of them was parked on the sidewalk in front,~~two other vehicles
were parked between the sidewalk and the road, I feel it really looks
like a junk: yard and I think in the middle of town that should be clean-
ed up.
Brewer: We can just add to that the Ambrose people are supportive of
these comments and even though they did not come they wanted their
feelings to be noted. This has been an ongoing problem ever since he
moved in and I know the Police Chief has had to visit them on more
than one occasion.
Mayor Kingsford: City Attorney, do you think anything from your office
might be benificial, do you have any recommendations?
City Attorney: I will look into the violations they have and see about
civil action proceedings, not leaving out criminal violations as well.

Mayor Kingsford: We appreciate your coming forward and making a complaint,
and we will certainly work to get something done to eleviate the problem.
Mayor Kingsford: Two meeting ago the Juvenile Center was before the
Council and to .update the Council on this they asked to use this
building after we vacate it, I have talked to th`e County Commissioners
in that regardland talked to the owner of the building over where they
are at. In visiting with Mike Johnson last Friday he indicated to me
-~A either we have it at City Hall or it goes back to Boise, in talking to
Judy Peavy today she indicated that they were still looking at funding
although I do not give to much hope for that, I would like to get the
Councils feeling in regard to that, if they won't stay in that building
which I would prefer, what is your feeling about the City providing them
space, I think it would be my recommendation that we don't necessarily
put them in here but that we make an office available in the new build-
ing for them short term rather than trying to maintain this building.
We have one extra office in the new building located next to the pre-
council room.
Brewer: I totally -agree as far as locating them over there but you are
not giving up the-additude that hopefully-funding will come.-about?-
Mayor Kingsford: No, I guess I would like to get a-sense of the Councils
feeling if it come to that. It is your desire_to keep them in Meridian
is it not?
It was the consensus of the Council that this should be kept in Meridian,
preferrably.where they are presently located.

Item #2: Approve the Bills:
The Motion was made by Myers and seconded by Giesler to approve the
bills:

Item #3: Ordinance #462:
Mayor Kingsford, to refresh the Council this is the same Ordinance
that was introduced at the February 18, 1986 meeting which had to
be published and according to law not passed until at least thirty
days after the publication. Are there any questions of the Council?
There were none. Mayor Kingsford, an Ordinance of the City of Meridian,
Idaho, granting to Intermountain Gas Company a forty (40) year extension
to its franchise to construct, maintain and operate a gas transmission
and distribution system; providing for the use of streets and alleys,
and rules governing the same; subjecting the grantee to all powers of
the City; setting forth the rules governing repairs and reconstruction
of the streets; providing for the term of the franchise and grant;
providing for the right of inspection by the City of grantee's plans,
accounts, and books; requiring grantee to furnish certain maps; setting
forth the annual payment to the City, and the filing of annual reports
with the City; requiring grantee to indemnify City, and file evidence
of insurance; requiring compliance with safety regulations; setting
forth an agreement not to compete, reserving power of eminent domain;
providing for surrender of franchise; granting right to salvage; requiring
written acceptance; providing for consent of sale, assignment or lease;
setting forth City's right to additional payments; providing for payment
of publication cost; providing for City's consent to gas storage facil-
ities; setting forth penalties and forfeitures, separability and repeal;
setting forth effective date, is there anyone in the audience who wishes
Ordinance #462 read in its entirety? There was no response.

of the revised and complied Ordinances of the City of Meridian by the
addition thereto of provisions for regulating and licensing pawnbrokers
and providing provisions for definitions; applications; license required;
applications and procedures, license fee; records; minors and intoxicated
persons; sales; forfeitures; hours of operation; reports to Chief of
Police; notice from police department; stolen property; return to true
owner; appeal from denial of license, revocation or suspension of license;
~= violations; and penalties and providing an effective date. Is there any-
one in the audience who wishes Ordinance #463 read in its entirety? There

i Item #6: Request by Todd Devine for Ice Cream & Hot Dog Stand at Phillip 66:
Mr. Devine was presence to present his proposal to the Council:
Devine, I would like approval of the Council to build an 8x12 ice cream
' hot dog type of stand at the station on East First Street, similar to the
one that is set up at Smiths Food King, it would be basically for ice cream
milkshakes and frosted root beer. It will meet all of the building code
requirements and also all of the Department of Health requirements.
''~ Mayor Kingsford, the property now is in our Old Town Zone and the Zoning
Adminstrator had some problem approving this as under the old Ordinances
it was Commercial Zone. Therefore it was thought that the Council should
decide whether to approve this under the old zoning or have a Conditional
Use Permit under the new zoning. It is similar to the Snow Cone at Smiths
with the exception that that is Commercial Zone and this is Old Town.
Crookston, under the old Ordinances this would be allowed when we passed
the new Zoning Ordinances that made that area Old Town Zone any change of
use no matter what required a Conditional Use. We at a later date passed
an amendment that allowed urn the Councils approval if the Zoning Admin-
istrator wants it approved if something was of such a nature that was
allowed under the old Ordinance he could either approve or request that
the Council make a decision on this.
Myers, are you going to have running water in this?
Devine, it would be a self c®ntained system.

Brewer, I have a problem with this, from the standpoint of what he is
= planning to sell it becomes a restaurant where you do have to have on
site toilet facilities.
Devine, it would not be something you would be able to enter, it would be
something you would walk up to, there would be no seating.
Brewer, a drive-in, where are you proposing to set this on the property?
Devine, the building would be set on the North side of the present building
and would be set back from the Street.

Devine, anything that has to be done to meet Building Dept. requirements,
will be done.
Brewer, from what I can see you are looking about 20 to 30 thousand dollars,
are you prepared to do that?
Devine, if that is what it takes to do it, I do not think it will be quite

Brewer, you make reference to the sno-cone shack down at Smith's, they are
selling sno-cones out of a little very professional prepared hutch, they
are not working with food itvns you are proposing to sell, this to me is
going to be a drive-in restaurant, so therefore you are going to have to
meet all the codes, it is not going in on skids as far as I am concerned,
you are going to have to put in foundation and make literly a drive-in
restaurant there.

~~' Devine, I do not think so, according to the Department of Health, the items
I have spoken to which I wish to vend and I have spoken to, I do not need
~: a foundation and can be built on skids, it is very similar to, we are going
to in fact one of the items is the Italian Ice along with the Ice Cream.

``' ice cream, this will be eighty percent basically of the offering.

Myers, you are not sure at this time what you will be vending other than
ice cream?
Devine, i can say at this time, I am definately sure at this
time I will have hershey's ice cream, milkshakes, root beer floats,
mug root beer and cokes, that is basically what we are going to market,
I had compilated the polish sausage type thing and after talking to the
Health they said I must have the self contained water and that which I
would definately have.
Brewer, due~the fact this is located in our Old Town area, I would like
to see a great more detailed drawing pertaining to plumbing, electrical
and the building itsself, I would like to table this for a given period
of time, at least for a month so this information can be presented to the
Council and we have time to look over it.
Giesler, so we do not set a precedence on something like this that might
come before us later on I would like thie_:to come before us with the new
Ordinances rather than the old ones, I think it should be handled that
way, they were passed.
Myers, I do not have a problem with Ice Cream and Ice but do with the
sausages as you have to have something to cook on there.
Devine, the sausage thing we talked about is not cooking it would be a
micro wave type of item. I can guarantee and you might have that for the
record, there will be no cooking facilities persay, there would be a
micro-wave oven.
Gary Smith, City Engineer, I think the parking should also be addressed.

Mayor Kingsford read a Proclamation declaring the Week of ,February 9 thr-
ough February 15, 1986 as Vocational Education Week. Mikki Wofford,
President of the FFA was present to receive this Proclamation.

Crookston, City Attorney, The Mayor has asked me to review the Insurance
Pool that is in the process of being established through the Association
of Idaho Cities and give a report to the Council. Crookston made a
presentation of this program to the Council explaining the procedures
and coverages that would be provided as well as the costs involved in
the City of Meridian becoming a member of this Insurance Pool.
It was the consensus of the Mayor and the Council that Mr. Bert Myers
be appointed to study this proposal further and report back to the Council.

Crookston, I asked the Mayor to approve of the expense I made as the
City Attorney attending a seminar for the Association of Idaho Cities
Attorneys, The fee was $75.00 for a ten hour seminar. I also asked the
