NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the
City of Meridian and the laws of the State of Idaho, that the

Planning and Zoning Commission of the City 'f Meridian will hold
a public hearing at the Meridian City Hallli, 728 Meridian Street,
Meridian, Idaho, at the hour of 7:30 o'clock p.m. on December 8,
1986, for the purpose of reviewing and considering the
Application of Cal Gas Corporation for a conditional use permit
at Lots 1, 21 3, 9, 5, 6, & 7 of Bowenl!,'s Railroad Addition,
corner of Bowen and East 3rd Street for loading, unloading and
storage of propane; a more particular description of the above
property is on file in the City Clerk's office and is available
for inspection during regular business hours.
Public comment will be taken and is welcome.

The Motion was made by Tolsma and seconded by Giesler to approve the
minutes of the previous meeting held December 15, 186 as written:

Mayor Kingsford, is there a representative of Cal -Gs in the audience?
If so, would you come forward and state your name aid give the Council
a brief outline of your request? Mr. Jack Garrett of Cal -Gas was present.
Garrett, what we are proposing and asking for approval by the City of
Meridian is to place a propane storage at the corner of East Third and
Bower by the railroad track. The purpose of this storage will be to
supply the propane for both the Nampa and Boise outlets. This is a
central location. We plan on putting two 30,000 galon storage tanks at
this location with an unloading tower to unload rai cars and we will
load the small trucks for delivery in the Valley. Tie system that will
be installed will be up to all the National Fire ani Safety Codes as
well as Cal -Gas Corporation standards which are mora stringent than the
fire protection codes. The employment will be one fill time man at this
location as well as possibility of some of the drivers moving to this
area. Are there any questions?
Mayor Kingsford, if there are no questions of the Council, I will now
open the Public Hearing. Is there anyone in the audience who wishes to
testify on this request? There was no response, the',Public Hearing was
closed. Council Members.
Giesler, I would like to address the requirements from Ada County
Highway which were not received in time for the Planning & Zoning
Hearing. Is there any problem with meeting with what ACHD has requested
be done?
Dick Deardon, We have talked to ACHD and they are requiring four foot
sidewalks, curbs & gutters and paving and some other items, when we
met with them they advised where there weren't any other improvements
in the area we could ask that the City Council waive these requirements
until such time as the rest of the area was done. The only item that
they were adamant about was that we had to provide our own drainage
within this parcel.

Tolsma, do you have any problems with this request as far as the
Fire Department is concerned; Chief?
Fire Chief, if it is built according to code there should be no problems.
Cal -Gas standards are more strict than the codes.
Brewer, I am in agreement with what has been said here, it is not a
foot traffic area and it would be ridicules for then to have to make
these improvements at this location.
Mayor Kingsford, we have certainly made a precedence of not requiring
the improvements being made. I think there needs toibe recognition on
their part that those would have to go in when the rest of the area
is upgraded. I think that that should also be included in the motion.
Deardon, ACRD advised that there was a bonding that ould be done so
hg
that any
time it was upgraded that the funds would e guaranteed to
complete this.
Giesler, there are adequate ways of draining this p'operty on site?
Deardon, yes.
The Motion was made by Brewer and seconded by Tolsmia to approve the
Findings of Fact and Conclusions of Law as prepared, for the Planning
and Zoning Commission.

for a Conditional Use Permit by Cal -Gas Corporation be approved with
the stipulation that should the surrounding area develop that they
install the curbs, gutters, sidewalks and paving according to ACHD
recommendation and requirements.

Allison, our proposal is to move the Day Care Center from its present
location on Pine Street to a larger facility on Fairview. We have
reviewed all the comments from the City and other agencies involved
and we have no problem with any of them.

Chairman Morrow, is there anyone present to come forward and advise
the Commission about your project?
Mr. Dick Deardon was in the audience and advised he would speak on
behalf of Cal Gas Corporation. Mr. Deardon was sworn by Attorney
Crookston.
Deardon, what we are proposing to do is on the corner of 3rd and
Bower Street is install two 30,000 gallon propane tanks, these will
be used to store propane, load trucks out and unload rail cars.
Everything that will be installed will meet all s andards and all
the different codes that are required for this ty a of operation.
There should be no problem from a safety standpoint and there should
not be any traffic problem there as there will prdbably only be maybe
four trucks a day in and out here. These will be delivery trucks.
Acting Chairman Morrow, are there any questions of the Commission?
Johnson, I do not see the signature of the property owners in my
material, did they get the necessary signatures?
City Clerk, I must have neglected to include these in your package,
they had seven out of the nine adjacent owners.

requested by the Applicant for the property described in the application
with the conditions set forth in the Findings of fact & Conclusions of
Law and that the property be required to meet the Water and sewer requir-
ements and the fire and life safety codes.

and Greenleaf Friends Academy:

Mr. Rich Allison, 1040 East Pine, Mr. Allison was sworn by Attorney
Crookston.
Allison, our proposal is to move the Greenleaf Friends Academy Day Care
Center, -from their present location on Pine Street to the Ross Furniture
Building located on Fairview Ave. The propsal at the present time is to
use half of the building for a day care center and'lan elementary school.
We have evaluated the site from the standpoint of the comments received
and would certainly be willing to meet the requirements. One item that
might be of interest as far as safety would be the'dropoff and pickup
of the children, this would be in front of the bui�'ding and then inside
the building they would have a gate which would keep any of the children
from running out into the front of the building at!iany time. The play-
ground for the children would be directly behind the building and fenced.
Chairman Morrow are there any questions of the Commission Members?
Alidjani, due to a conflict of interest, I would like to abstain from
any comments or action on this application.
Johnson, I understand the Academy is going to lease the East half of
the building, there would be adquate parking for this facility but if
the other half was to be rented to some other type',of operation would
there continue to be adquate parking.
Allison, there are currently eighteen parking place in front of the
building, the owner is planning on tearing down the old house between
this building and the building occupied by Cal's Service parts as well
as removing the bath house and trailers at the side of the building for

1. That a notice of a public hearing on the Conditional

that the matter was duly considered at the December 8, 1986
hearing; that the public was given full opportunity to express
comments and submit evidence; and that copi s of all notices were
made available to newspaper, radio and televislon stations;

3. That the property is zoned Industrial (I -L), which- -
requires a conditional use permit for the opjeration of storage of
flammable liquids or gases which is the use the application
requests;
4. That the I -L district is described in the Zoning
Ordinance, 11-2-408 B. 11 as follows:
(I -L) LIGHT INDUSTRIAL: The purpose) of the (I -L) Light -
Industrial District is to provide for light industrial
development and opportunities for employment of Meridian
citizens and area residents and reduce the need to commute
to neighboring cities; to encourage the development of
manufacturing and wholesale establishments which are clean,
quiet and free of hazardous or objectionable elements, such__
as noise, odor, dust, smoke or glare nd that are operated
entirely or almost entirely within enclosed structures; to
delineate areas best suited for industrial development
because of location, topography, existing facilities and
relationship to other land uses. Thisldistrict must also be
in such proximity to insure connection to the Municipal
Water and Sewer systems of the City of Meridian. Uses
incompatible with light industry are not permitted, and
strip development is prohibited.

CONCLUSIONS
1. That all the procedural requirements of the Local
Planning Act and of the Ordinances of the City of Meridian have
been met including the mailing of notice to owners of property
within 300 feet of the external boundaries of the applicant's
property and having obtained the consent of175% of the owners of

FACTS & FINDINGS:
1. To locate two 30,000 gallon propane tanks on a lot located on the
northeast corner of Bower and East Third Streets.
2. Bower Street has 80 -feet of right-cf-way (whilch is adequate) and is
improved with 18 -feet of paving.
3. Third Street has 80 -feet of right-of-way ( which is adequate) and is
improved with 20 feet of paving.
4. Access as shown on site plan meets ACHD standards.
SITE SPECIFIC REQUIREMENTS:
1. Provide curb, gutter, 4 -foot sidewalk, and matching paving on Bower
abutting parcel. Provide an 18 -foot roadway seci�ion to back -of -curb from
centerline of Bower right-of-way.
2. Provide curb, gutter, 4 -foot sidewalk, and matching paving on Third
abutting parcel. Provide a 24.5 -foot roadway section to back -of -curb
from centerline of Third right-of-way.
STANDARD REQUIREMENTS:
1. Improvements to the dedicated right--cf way to be designed and constructed
to ACHD standards and specifications.
2. Submit two sets of street improvement plans for review and approval by
th a District.
3. Submit a site drainage plan showing that site drainage wM not flow onto
Ada County Highway District right cf-way, in ac rdance with Boise City
Code 11-3-54 (A) , where applicable, and ACHD p 'cy.
4. Any work within ACHD right-of-way requires a permit. For information
regarding the requirements to obtain a permit please contact Quality
Control at 344-6111, extension 430. CU, DR, or DC file number required.
